Nevenka Tromp, a scholar, professor, author, and former investigator for the International Criminal Tribunal for the former Yugoslavia (ICTY), has criticized the guilty verdict of the Specialist Chambers against Hashim Thaçi, Kadri Veseli, Rexhep Selimi, and Jakup Krasniqi.

In an interview with KosovaPress, given one day after the verdict was announced, she addressed both the human aspect of the sentences and the political consequences the judgment might bring.

In the conversation with journalist Besart Maloku, Tromp also spoke about Thaçi’s role in establishing the Specialist Chambers, his cooperation with the justice system, the possibility that Serbia might exploit the verdict, the appeal procedure, and other issues.

Tromp chose to start the analysis from the personal experience of the four convicts, emphasizing that justice must first be assessed through its impact on individuals.

According to her, the moment of reading the verdict and pronouncing the sentences must have been extremely difficult for the four defendants, who sat and listened to the decision. She said that attention must always return to the human dimension, even though public discussion is now focused on the impact on Kosovo and relations with Serbia. In essence, Tromp added, justice must be seen first and foremost in relation to the individual.

She recalled that three of them were students when they interrupted their ordinary lives and decided to join the war. Tromp stressed that they also came from abroad to fight not only for the country, but also for their sisters, brothers, mothers, and wives, even though they could have returned and chosen another path.

According to her, they fought on the front line and, with the support of NATO countries, won the war. After it ended, they continued to work for Kosovo’s statehood, while now they are paying the price for decisions they made in their twenties. Tromp said that their entire lives were dedicated to a great cause and that they made great sacrifices in relation to their families and children.

She pointed out that the 25-year prison sentence for Hashim Thaçi and Jakup Krasniqi, who is slightly older than the others, constitutes de facto life imprisonment.

Tromp also criticized some statements by the presiding judge, Charles Smith. She considered it ironic that the decision was made “in the name of the people of Kosovo,” while referring at the same time to citizens’ protests against the Specialist Chambers’ verdict.

According to her, it was ironic that the judge repeated that he was acting in the name of Kosovo’s citizens because it was a Kosovo court, while outside massive demonstrations were taking place, which could be followed online. Tromp said that a very large number of citizens were expressing precisely the view that it was not a court in their name.

She also called disturbing the judge’s statement that the verdict was not against the people of Kosovo, the liberation war, or the KLA as an organization.

Tromp raised the question on what basis a judge can determine how the decision will be interpreted, especially by Serbia. She asked whether the judge was in contact with Serbian President Aleksandar Vučić to ask him not to misinterpret or misuse the words of justice to continue what she called a special war against Kosovo.

According to Tromp, Serbia has never accepted that it was militarily defeated and has not given up its territorial claims, at least over a part of Kosovo. She asked whether the court and the judge would ask Belgrade to accept this reality and recognize Kosovo’s independence, emphasizing that this will not happen.

Tromp warned that Serbia will use the verdict to continue what she defines as “lawfare,” that is, the use of law as a weapon of war. According to her, having failed to win the conflict, Serbia will now use legal arguments to come back and revive its territorial aspirations in Kosovo. This time, she added, Belgrade will have the verdict as a means to convince the internationals to leave it alone.

The interview also addressed Thaçi’s involvement in the creation of the Specialist Chambers, which the trial panel mentioned during the sentencing as a mitigating circumstance.

Tromp described as very cynical and cruel the way the judge referred to this circumstance. She said that among the reasons listed for a lighter sentence for Thaçi was the fact that he had played a decisive role in establishing the court. However, according to her, the promised “leniency” resulted in a 25-year sentence, which is practically life imprisonment.

Explaining the political context of the establishment of the Specialist Chambers, Tromp said that Thaçi was placed under extraordinary pressure by Kosovo’s biggest friends at that time: the United States, the United Kingdom, and the European Union.

According to her, he had almost no alternative, as he trusted Kosovo’s international partners. Tromp rejected claims often made in public opinion that Thaçi could have bargained or negotiated some deal to avoid being indicted, saying that the facts already show such an idea is absurd.

She stated that at that time Thaçi made an extremely difficult decision as a statesman. According to Tromp, he accepted the creation of the Specialist Chambers because he was fully convinced there was no other way and believed it would accelerate Kosovo’s statehood process.

Tromp stressed that Thaçi acted this way even though he knew the chances of him being indicted were very high. She said that, as a statesman, he put Kosovo ahead of his personal interest.

In this context, Tromp also spoke about the former Kosovo president’s cooperation with the justice bodies. She recalled that Thaçi had the right not to speak and to leave the entire burden of proof to the Prosecution, but he chose to answer its questions.

According to Tromp, after the victory in the war against Serbia, Kosovo aimed to become part of the democratic family of nations and to develop as a liberal democracy. For this reason, Thaçi could not reject the international criminal justice system, which she described as one of the important pillars of liberal democracy.

She said that Thaçi could not pursue the path toward liberalism and democracy while at the same time excluding international criminal justice. Even after being indicted, he cooperated. In fact, while still in office as president and before the indictment was raised, he gave a number of interviews to the Prosecution.

Tromp also addressed the appeal of the Specialist Chambers’ verdict. She expressed conviction that the appeal is necessary and will be made, but warned that the procedure could last up to five years.

She explained that so far she has seen the content of the verdict only through the summary and that the full decision must be read by everyone. According to her, unlike cases at the ICTY and ICC, Kosovo is not in such a disadvantaged position regarding the treatment of the decision on appeal, as the last word will belong to the Constitutional Court of Kosovo.

However, Tromp stressed that the road remains long. The four former KLA leaders have already spent 6 years in pretrial detention and now face sentences of up to 25 years. According to her, some kind of conclusion may be reached within the next 5 years.

She acknowledged that the prolonged judicial process has already minimized their role in Kosovar society, reducing their functions almost to nothing. Tromp warned that they are placed in a situation where they could turn into martyrs, while Kosovo, according to her, does not need more martyrs.

She said that Kosovo has left many martyrs on the fields where the war against Serbian aggression took place. According to Tromp, the country needs capable and experienced people to continue the difficult work of building state institutions and strengthening the independence of the state of Kosovo.

Në një intervistë për KosovaPress, të dhënë një ditë pas shpalljes së vendimit, ajo trajtoi si aspektin njerëzor të dënimeve, ashtu edhe pasojat politike që mund të sjellë aktgjykimi.

Në bisedën me gazetarin Besart Maloku, Tromp foli gjithashtu për rolin e Thaçit në themelimin e Dhomave të Specializuara, bashkëpunimin e tij me drejtësinë, mundësinë që Serbia ta shfrytëzojë vendimin, procedurën e apelit dhe çështje të tjera.

Tromp zgjodhi që analizën ta niste nga përvoja personale e katër të dënuarve, duke theksuar se drejtësia duhet vlerësuar fillimisht përmes ndikimit që ka te individët.

Sipas saj, momenti i leximit të aktgjykimit dhe shqiptimit të dënimeve duhet të ketë qenë jashtëzakonisht i rëndë për katër të akuzuarit, të cilët qëndronin të ulur dhe dëgjonin vendimin. Ajo tha se vëmendja duhet të rikthehet gjithmonë te dimensioni njerëzor, edhe pse diskutimi publik tashmë është përqendruar te ndikimi mbi Kosovën dhe marrëdhëniet me Serbinë. Në thelb, shtoi Tromp, drejtësia duhet parë para së gjithash në raport me individin.

Ajo rikujtoi se tre prej tyre ishin studentë kur e ndërprenë jetën e zakonshme dhe vendosën t’i bashkoheshin luftës. Tromp theksoi se ata erdhën edhe nga jashtë për të luftuar jo vetëm për vendin, por edhe për motrat, vëllezërit, nënat dhe gratë e tyre, ndonëse kishin mundësi të ktheheshin dhe të zgjidhnin një rrugë tjetër.

Sipas saj, ata luftuan në vijën e parë dhe, me mbështetjen e vendeve të NATO-s, e fituan luftën. Pas përfundimit të saj, vazhduan të punonin për shtetësinë e Kosovës, ndërsa tani po paguajnë çmimin e vendimeve që morën kur ishin në të njëzetat. Tromp tha se e gjithë jeta e tyre iu kushtua një kauze të madhe dhe se ata bënë sakrifica të mëdha në raport me familjet dhe fëmijët e tyre.

Ajo nënvizoi se dënimi me 25 vjet burgim për Hashim Thaçin dhe Jakup Krasniqin, i cili është pak më i moshuar se të tjerët, përbën de facto burgim të përjetshëm.

Tromp kritikoi edhe disa deklarata të kryetarit të trupit gjykues, Charles Smith. Ajo e konsideroi ironike formulimin se vendimi po merrej “në emër të popullit të Kosovës”, duke iu referuar njëkohësisht protestave të qytetarëve kundër aktgjykimit të Dhomave të Specializuara.

Sipas saj, ishte ironike që gjykatësi e përsëriste se po vepronte në emër të qytetarëve të Kosovës për shkak se bëhej fjalë për një gjykatë të Kosovës, ndërkohë që jashtë po zhvilloheshin demonstrata masive, të cilat mund të ndiqeshin online. Tromp tha se një numër shumë i madh qytetarësh po shprehnin pikërisht qëndrimin se ajo nuk ishte një gjykatë në emrin e tyre.

Ajo e quajti shqetësuese edhe deklaratën e gjyqtarit se aktgjykimi nuk ishte kundër popullit të Kosovës, luftës çlirimtare apo UÇK-së si organizatë.

Tromp ngriti pyetjen se mbi çfarë baze një gjyqtar mund të përcaktojë mënyrën se si do të interpretohet vendimi, veçanërisht nga Serbia. Ajo pyeti nëse gjykatësi ishte në kontakt me presidentin serb Aleksandar Vuçiq për t’i kërkuar që të mos i keqinterpretonte apo keqpërdorte fjalët e drejtësisë për vazhdimin e asaj që ajo e quajti luftë speciale kundër Kosovës.

Sipas Tromp, Serbia nuk e ka pranuar asnjëherë se është mposhtur ushtarakisht dhe nuk ka hequr dorë nga pretendimet territoriale, të paktën ndaj një pjese të Kosovës. Ajo pyeti nëse gjykata dhe gjyqtari do t’i kërkonin Beogradit ta pranonte këtë realitet dhe ta njihte pavarësinë e Kosovës, duke theksuar se kjo nuk do të ndodhë.

Tromp paralajmëroi se Serbia do ta përdorë aktgjykimin për të vijuar atë që ajo e përkufizon si “lawfare”, pra përdorimin e ligjit si mjet lufte. Sipas saj, pasi nuk arriti ta fitonte konfliktin, Serbia tani do të përdorë argumente juridike për t’u rikthyer dhe për t’i ringjallur aspiratat territoriale në Kosovë. Këtë herë, shtoi ajo, Beogradi do ta ketë aktgjykimin si mjet për t’i bindur ndërkombëtarët që ta lënë të qetë.

Në intervistë u trajtua edhe angazhimi i Thaçit në krijimin e Dhomave të Specializuara, të cilin trupi gjykues e përmendi gjatë shqiptimit të vendimit si rrethanë lehtësuese.

Tromp e cilësoi shumë cinike dhe mizore mënyrën se si gjyqtari iu referua kësaj rrethane. Ajo tha se mes arsyeve të renditura për një dënim më të ulët ndaj Thaçit ishte fakti se ai kishte luajtur rol vendimtar në themelimin e gjykatës. Megjithatë, sipas saj, “butësia” e paralajmëruar përfundoi në një dënim prej 25 vjetësh, që praktikisht është burgim i përjetshëm.

Duke shpjeguar kontekstin politik të krijimit të Dhomave të Specializuara, Tromp tha se Thaçi ishte vënë nën presion të jashtëzakonshëm nga miqtë më të mëdhenj të Kosovës në atë periudhë: Shtetet e Bashkuara, Mbretëria e Bashkuar dhe Bashkimi Evropian.

Sipas saj, ai pothuajse nuk kishte alternativë, pasi u besonte partnerëve ndërkombëtarë të Kosovës. Tromp kundërshtoi pretendimet e shfaqura shpesh në opinionin publik se Thaçi mund të kishte bërë pazar ose të kishte negociuar ndonjë marrëveshje për të mos u akuzuar, duke thënë se faktet tashmë tregojnë se një ide e tillë është e pakuptimtë.

Ajo deklaroi se Thaçi mori në atë kohë një vendim jashtëzakonisht të vështirë prej burri shteti. Sipas Tromp, ai pranoi krijimin e Dhomave të Specializuara sepse ishte plotësisht i bindur se nuk kishte rrugë tjetër dhe besonte se kjo do ta përshpejtonte procesin e shtetësisë së Kosovës.

Tromp theksoi se Thaçi veproi kështu edhe pse e dinte se mundësitë që ai vetë të akuzohej ishin shumë të larta. Ajo tha se, si burrë shteti, ai e vendosi Kosovën përpara interesit të tij personal.

Në këtë kuadër, Tromp foli edhe për bashkëpunimin e ish-presidentit të Kosovës me organet e drejtësisë. Ajo kujtoi se Thaçi kishte të drejtë të mos fliste dhe t’ia linte Prokurorisë të gjithë barrën e provës, por ai zgjodhi t’u përgjigjej pyetjeve të saj.

Sipas Tromp, pas fitores së luftës ndaj Serbisë, Kosova synonte të bëhej pjesë e familjes demokratike të shteteve të botës dhe të zhvillohej si demokraci liberale. Për këtë arsye, Thaçi nuk mund ta refuzonte sistemin ndërkombëtar të drejtësisë penale, të cilin ajo e përshkroi si një nga shtyllat e rëndësishme të demokracisë liberale.

Ajo tha se Thaçi nuk mund të ndiqte rrugën drejt liberalizmit dhe demokracisë, ndërsa në të njëjtën kohë të përjashtonte drejtësinë penale ndërkombëtare. Edhe pasi u akuzua, ai bashkëpunoi. Madje, ende në detyrën e presidentit dhe para ngritjes së akuzës, dha një numër intervistash për Prokurorinë.

Tromp u ndal gjithashtu te apelimi i verdiktit të Dhomave të Specializuara. Ajo u shpreh e bindur se apeli është i domosdoshëm dhe se do të bëhet, por paralajmëroi se procedura mund të zgjasë deri në pesë vjet.

Ajo sqaroi se deri tani e kishte parë përmbajtjen e aktgjykimit vetëm përmes përmbledhjes dhe se vendimi i plotë duhet të lexohet nga të gjithë. Sipas saj, ndryshe nga rastet e ICTY-së dhe ICC-së, Kosova nuk ndodhet në një pozitë aq të pafavorshme sa i përket trajtimit të vendimit në apel, pasi fjalën e fundit do ta ketë Gjykata Kushtetuese e Kosovës.

Megjithatë, Tromp theksoi se rruga mbetet e gjatë. Katër ish-krerët e UÇK-së kanë kaluar tashmë 6 vjet në paraburgim dhe tani përballen me dënime deri në 25 vjet. Sipas saj, një lloj përfundimi mund të arrihet gjatë 5 viteve të ardhshme.

Ajo pranoi se procesi i zgjatur gjyqësor tashmë e ka minimizuar rolin e tyre në shoqërinë kosovare, duke i reduktuar funksionet e tyre pothuajse në asgjë. Tromp paralajmëroi se ata janë vendosur në një situatë ku mund të shndërrohen në martirë, ndërsa Kosovës, sipas saj, nuk i duhen martirë të tjerë.

Ajo tha se Kosova ka lënë shumë martirë në fushat ku u zhvillua lufta kundër agresionit serb. Sipas Tromp, vendit i nevojiten njerëz të aftë dhe me përvojë për të vazhduar punën e vështirë të ndërtimit të institucioneve shtetërore dhe forcimit të pavarësisë së shtetit të Kosovës.

In an interview with Radio Free Europe, Tromp said the ruling is expected to take the form of a compromise, aimed at meeting the expectations of both the Kosovar and the Serbian sides.

According to her, the outcome will be such that some of the accused will be acquitted, while others will be found guilty and sentenced.

She stressed that it remains to be seen what final combination the court will decide on.

The trial of Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selimi concluded in February. The judgment had been scheduled to be delivered in May, but the judicial panel decided to postpone it until July 20, citing the “complexity of the case” as the reason for the decision.

The Specialist Chambers also clarified that the date of July 20 does not necessarily mean that the judgment will be delivered then, while also warning of the possibility of another postponement.

Në një intervistë për Radion Evropa e Lirë, Tromp u shpreh se vendimi pritet të marrë formën e një kompromisi, me synimin për t’iu përgjigjur pritjeve si të palës kosovare, ashtu edhe të asaj serbe.

Sipas saj, epilogu do të jetë i tillë që disa prej të akuzuarve do të lirohen, ndërsa të tjerë do të shpallen fajtorë dhe do të dënohen.

Ajo theksoi se mbetet vetëm të shihet se cili do të jetë kombinimi përfundimtar që do të vendoset nga gjykata.

Procesi gjyqësor ndaj Hashim Thaçit, Kadri Veselit, Jakup Krasniqit dhe Rexhep Selimit përfundoi në shkurt. Aktgjykimi ishte parashikuar të shpallej në maj, por paneli gjyqësor vendosi ta shtyjë atë deri më 20 korrik, duke arsyetuar vendimin me “kompleksitetin e rastit”.

Gjykata Speciale ka sqaruar gjithashtu se data 20 korrik nuk do të thotë domosdoshmërisht se aktgjykimi do të shpallet atëherë, teksa ka paralajmëruar edhe mundësinë e një shtyrjeje tjetër.
