A new report by the Ombudsperson has highlighted the failures of Kosovo’s education system to provide deaf children with proper education and the use of sign language. According to the findings, students with hearing impairments continue to lag behind even after completing high school.

The investigation was launched after alarming signals from citizens and non-governmental organizations, which showed that many deaf young people, despite high academic success in school, cannot read or write at the expected level. This situation called into question the true quality of education they receive.

During the process, the Ombudsperson’s institution contacted the “Mother Teresa” Resource Center in Prizren and sought explanations from the Ministry of Education and Science. The questions focused on curricula, teacher qualifications, availability of sign language, and concrete strategies to ensure inclusive education for these students.

The report concludes that, although the Constitution and laws in force guarantee the right to education, deaf children face deep barriers in practice. The pronounced lack of teachers trained in sign language, support specialists, interpreters, as well as the absence of adapted textbooks and fair assessment systems, is seriously harming their educational development and exposing them to the risk of discrimination.

To address these problems, the Ombudsperson has directed several key recommendations to the Ministry of Education. Among them are: full implementation of inclusive education policies, engagement of a multidisciplinary team at the “Mother Teresa” Resource Center, increased professional training for teaching staff and interpreters, and the establishment of a regular inspection system to closely monitor the quality of teaching.

Një raport i ri i Avokatit të Popullit ka nxjerrë në pah dështimet e sistemit arsimor në Kosovë për t’iu ofruar fëmijëve të shurdhër arsimimin e duhur dhe përdorimin e gjuhës së shenjave. Sipas gjetjeve, nxënësit me dëmtime në dëgjim vazhdojnë të mbesin mbrapa edhe pas përfundimit të shkollës së mesme.

Hetimi u ndërmorr pas sinjaleve shqetësuese nga qytetarët dhe organizatat joqeveritare, të cilat treguan se shumë të rinj të shurdhër, pavarësisht suksesit të lartë në shkollë, nuk arrijnë të lexojnë apo shkruajnë në nivelin e pritshëm. Kjo situatë e vuri në dyshim cilësinë e vërtetë të arsimimit që ata marrin.

Gjatë procesit, institucioni i Avokatit të Popullit kontaktoi Qendrën Burimore “Nënë Tereza” në Prizren dhe kërkoi shpjegime nga Ministria e Arsimit dhe Shkencës. Pyetjet u fokusuan në programet mësimore, kualifikimet e mësuesve, disponueshmërinë e gjuhës së shenjave dhe strategjitë konkrete për të garantuar një arsim gjithëpërfshirës për këta nxënës.

Raporti konkludon se, megjithëse Kushtetuta dhe ligjet në fuqi parashikojnë të drejtën për arsim, fëmijët e shurdhër hasin barriera të thella në praktikë. Mungesa e theksuar e mësimdhënësve të trajnuar në gjuhën e shenjave, e specialistëve mbështetës, e interpretëve, si dhe mungesa e teksteve të përshtatura dhe sistemeve të drejta të vlerësimit, po dëmton rëndë zhvillimin e tyre edukativ dhe po i ekspozon ndaj rrezikut të diskriminimit.

Për të adresuar këto probleme, Avokati i Popullit i ka drejtuar Ministrisë së Arsimit disa rekomandime kyçe. Ndër to përfshihen: zbatimi i plotë i politikave për arsimin gjithëpërfshirës, angazhimi i një ekipi shumëdisiplinar në Qendrën Burimore “Nënë Tereza”, rritja e trajnimeve profesionale për stafin mësimor dhe interpretët, si dhe vendosja e një sistemi të rregullt inspektimi për të monitoruar nga afër cilësinë e mësimdhënies.

The Chairman of the Kosovo Prosecutorial Council (KPC), Arian Gashi, received the Ombudsperson, Naim Qelaj, in a meeting today, where they discussed cooperation between the institutions and the protection of fundamental human rights and freedoms.

According to the announcement, the meeting was also attended by KPC members Milot Krasniqi and Arlinda Muqa, as well as the General Director of the KPC Secretariat, Sami Istrefi. The Ombudsperson Institution was also represented by Deputy Ombudsperson Basri Kastrati, along with his associates.

Gashi emphasized the KPC’s commitment to deepening cooperation with the Ombudsperson Institution, underlining the importance of regular communication, exchange of experiences, and coordination on issues related to the responsibilities of both institutions.

He said that respect for human rights in criminal proceedings is one of the main pillars of the rule of law and the proper functioning of the justice system.

“The implementation of constitutional and international human rights standards at all stages of criminal proceedings, in accordance with legality, proportionality, impartiality, and due process of law, is the responsibility of justice institutions,” Gashi stated.

Meanwhile, Ombudsperson Naim Qelaj expressed readiness to continue and advance cooperation with the Kosovo Prosecutorial Council, focusing on the respect and protection of human rights.

At the end of the meeting, both sides agreed to continue mutual communication and cooperation, with the aim of strengthening the rule of law, protecting fundamental freedoms, and increasing citizens’ trust in the justice system.

Kryesuesi i Këshillit Prokurorial të Kosovës (KPK), Arian Gashi, ka pritur sot në takim Avokatin e Popullit, Naim Qelaj, ku është diskutuar për bashkëpunimin ndërmjet institucioneve dhe mbrojtjen e të drejtave dhe lirive themelore të njeriut.

Sipas njoftimit, në takim morën pjesë edhe anëtarët e KPK-së, Milot Krasniqi dhe Arlinda Muqa, si dhe Drejtori i Përgjithshëm i Sekretariatit të KPK-së, Sami Istrefi. Nga Institucioni i Avokatit të Popullit ishte i pranishëm edhe zëvendësavokati i Popullit, Basri Kastrati, së bashku me bashkëpunëtorë.

Gashi theksoi përkushtimin e KPK-së për thellimin e bashkëpunimit me Institucionin e Avokatit të Popullit, duke vlerësuar rëndësinë e komunikimit të rregullt, shkëmbimit të përvojave dhe koordinimit në çështjet që lidhen me përgjegjësitë e dy institucioneve.

Ai tha se respektimi i të drejtave të njeriut në procedurat penale është një nga shtyllat kryesore të sundimit të ligjit dhe funksionimit të drejtë të sistemit të drejtësisë.

“Zbatimi i standardeve kushtetuese dhe ndërkombëtare për të drejtat e njeriut në të gjitha fazat e procedurave penale, në përputhje me ligjshmërinë, proporcionalitetin, paanshmërinë dhe procesin e rregullt ligjor, është përgjegjësi e institucioneve të drejtësisë”, ka deklaruar Gashi.

Ndërkaq, Avokati i Popullit, Naim Qelaj, ka shprehur gatishmërinë për vazhdimin dhe avancimin e bashkëpunimit me Këshillin Prokurorial të Kosovës, me fokus respektimin dhe mbrojtjen e të drejtave të njeriut.

Në fund të takimit, të dyja palët u pajtuan për vazhdimin e komunikimit dhe bashkëpunimit të ndërsjellë, me qëllim forcimin e sundimit të ligjit, mbrojtjen e lirive themelore dhe rritjen e besimit të qytetarëve në sistemin e drejtësisë.

Naim Qelaj, the Ombudsperson, told KosovaPress that Kosovo is entering its second year without fully functioning institutions as a result of repeated elections.

He assesses that the failure to form institutions is directly affecting human rights and increasing citizens’ uncertainty about future developments in the country.

“This is the second year that Kosovo has continued to function without fully formed institutions, as a result of the repeated elections taking place in Kosovo. The failure to establish institutions undermines and seriously harms human rights, first and foremost because of the stagnation of legislative initiatives, amendments to laws and the adoption of new laws that directly affect citizens’ lives, their well-being and the raising of living standards. It naturally also greatly affects the work of other institutions themselves, which in the absence of supervisory authorities remain at a very low level of engagement in their daily work, as well as in projects that they are unable to complete and unable to start anew. And this, of course, has led to the citizens of Kosovo today facing a situation of insecurity, or unpredictability, as to what will happen next,” Qelaj said.

According to him, the conclusion of the most recent elections should be followed by the creation of institutions, while he stresses that any further prolongation of political and institutional crises would bring even more serious consequences for the country.

Qelaj underlines that some institutions are continuing their work with extended mandates, including the Ombudsperson institution.

“I consider that the result of the most recent elections will be finalized with the creation of institutions and that there will be no continuation of other political and institutional crises, because we are also in a difficult situation where a large number of institutions are operating under extended mandates, including the Ombudsperson. So, I am in the position of Ombudsperson with an extended mandate, according to the law until the election of the new Ombudsperson; otherwise, my five-year mandate expired back in October of last year. The damage being caused to Kosovo by the failure to create institutions is extraordinary. I think the institutional and political responsibility of the people who are responsible for creating these institutions should be greater and stronger; there should not always be thinking only in terms of political calculations and the division of power,” he added.

The Ombudsperson points out that this crisis has produced budget restrictions, blockages in legislative initiatives, infrastructure projects and the justice reform process. According to him, one of the fundamental pillars of this reform should be respect for the separation of powers.

Everyone who lives in Kosovo and who bears institutional responsibility must know that interference in the branches of power and the influence over or capture of the judicial branch by the legislature or the executive seriously undermines Kosovo’s democracy,” he stressed.

He also expressed concern about what he sees as a tendency toward interference in the justice system, calling for politics and the executive not to influence the judiciary and the prosecution.

“I think there have been actions that show a tendency to interfere in justice. Starting from the reactions of institutional leaders toward specific names. To mention them as undesirable for leadership positions within the prosecutorial and judicial system, and all the way to calls and tendencies to announce vacancies, or to take concrete actions. The justice system, the Judicial Council and the Prosecutorial Council, are independent authorities, whose decision-making should be based on the law and on the needs and plans they themselves make, and not on the basis of political agendas. Therefore, my call in this case is for politics and the executive to stay as far away as possible from interference in the justice system, while always supporting it and coordinating and cooperating in the interest of genuine reform,” Qelaj said.

The latest elections in Kosovo were held on June 7 of this year, and the winner was the Vetëvendosje Movement.

The Central Election Commission has still not certified the results, as some candidates for MPs have filed complaints with Kosovo’s Supreme Court.

LVV leader Albin Kurti told the media that after the certification of the results, he will begin communication with political parties to secure an agreement on the creation of institutions, as well as on the election of Kosovo’s president.

The previous elections were held on December 28 and February 9. In those electoral processes as well, LVV was the winner, but in the December elections no agreement was reached on the election of the president.

“Është viti i dytë që po vazhdon Kosova me funksionu pa institucione të plota, si rezultat i zgjedhjeve që po ndodhin në Kosovë të përsëritura. Mungesa e krijimit të institucioneve cenon dhe ndikon shumë keq tek të drejtat e njeriut, në radhë të parë për shkak të ngecjes së nismave legjislative, të ndryshimit të ligjeve dhe nxjerrjes së ligjeve të reja që ndikojnë drejtpërdrejt në jetën e qytetarëve, në mirëqenien e tyre dhe në rritjen e standardit. Po natyrisht ndikon shumë edhe në vetë punën e institucioneve të tjera, të cilat në mungesë të autoriteteve mbikëqyrëse, mbesin në një dinamikë shumë të ulët të angazhimit në punën e tyre të përditshme, por edhe në projekte të cilat nuk arrijnë me i përfundua dhe nuk arrijnë me i nis të reja. Dhe kjo natyrisht ka bërë që sot qytetarët e Kosovës me u ballafaqu me një situatë të një pasigurie, ose paparashikueshmërie, se çfarë do të ndodhë më tej”, thotë Qelaj.

Sipas tij, përfundimi i zgjedhjeve të fundit duhet të pasohet me krijimin e institucioneve, ndërsa thekson se zgjatja e mëtejshme e krizave politike dhe institucionale do të sillte pasoja edhe më të rënda për vendin.

Qelaj nënvizon se disa institucione po vazhdojnë punën me mandate të zgjatura, mes tyre edhe institucioni i Avokatit të Popullit.

Qelaj: Një numër i madh i institucioneve janë me mandate të vazhduara

“Unë konsideroj që rezultati i zgjedhjeve të fundit do të finalizohet me krijim të institucioneve dhe nuk do të vazhdohet me kriza të tjera politike institucionale, sepse jemi edhe në një situatë të vështirë ku një numër i madh i institucioneve janë me mandate të vazhduara, përfshirë edhe Avokatin e Popullit. Pra, unë jam në pozitën e Avokatit të Popullit me mandat të vazhduar, sipas ligjit deri në zgjedhjen e Avokatit të ri, përndryshe unë mandati pesëvjeçar më ka përfunduar qysh në tetor të vitit që shkoi.. Dëmi që po i shkaktohet Kosovës me moskrijim të institucioneve është i jashtëzakonshëm. Mendoj që përgjegjësia institucionale, politike e njerëzve që kanë përgjegjësi me i kriju këto institucione duhet të jetë më e shtuar dhe më e rritur, nuk duhet me u mendu gjithmonë vetëm kalkulimet politike, të ndarjes së pushtetit”, shton ai.

Avokati i Popullit vë në dukje se kjo krizë ka prodhuar kufizime në buxhet, bllokime në nismat legjislative, në projektet infrastrukturore dhe në procesin e reformës në drejtësi. Sipas tij, një nga shtyllat themelore të kësaj reforme duhet të jetë respektimi i ndarjes së pushteteve.

Qelaj: Kemi ngecje të reformës në drejtësi dhe procese të tjera që janë nisur

“Ne kemi kufizime buxhetore, kufizime të nismave legjislative, të projekteve të reja infrastrukturore. Kemi ngecje të reformës në drejtësi, kemi ngecje në shumë procese të tjera që janë nisur dhe kjo është si rezultat i kësaj krize institucionale e politike që në njëfarë mënyre po e humb edhe kuptimin e vet.. Unë e para që e vlerësoj të rëndësishme, të reformës në drejtësi, është që me u respektu ndarja e pushteteve. Duhet me e ditë, gjithkush që jeton në Kosovë dhe që bart përgjegjësi institucionale, që ndërhyrja në pushtete dhe ndikimi ose kapja e pushteteve gjyqësore nga legjislativi, nga ekzekutivi cenon rëndë demokracinë e Kosovës”, thekson ai.

Ai ka shprehur shqetësim edhe për atë që e sheh si prirje për ndërhyrje në sistemin e drejtësisë, duke kërkuar që politika dhe ekzekutivi të mos ndikojnë në gjyqësor dhe në prokurori.

Qelaj: Mendoj që ka pasur veprime që tregojnë tendencë me ndërhy në drejtësi

“Mendoj që ka pasur veprime që tregojnë tendencë me ndërhy në drejtësi. Të nis prej reagimeve të liderëve institucionalë tek emrat e veçantë. T’i përmend si të padëshirueshëm për pozita udhëheqëse brenda sistemit prokurorial dhe gjyqësor, e deri tek thirrjet dhe tendencat që me e shpall konkurse, ose me marrë veprime konkrete. Sistemi i drejtësisë, Këshilli Gjyqësor dhe Këshilli Prokurorial, janë autoritete të pavarura, të cilat vendimmarrjen e tyre duhet ta bëjnë mbi bazë të ligjit dhe mbi bazën e nevojave e planifikimeve që ata i bëjnë, e jo mbi bazën e agjendave politike. Prandaj thirrja ime në këtë rast është që, politika dhe ekzekutivi me qëndru sa më larg ndërhyrjeve në sistemin e drejtësisë, por gjithmonë duke e mbështetur dhe duke u koordinuar e bashkëpunuar në interes të një reforme të mirëfilltë”, thotë Qelaj.

Zgjedhjet e fundit në Kosovë janë zhvilluar më 7 qershor të këtij viti dhe fituese ka dalë Lëvizja Vetëvendosje.

Komisioni Qendror i Zgjedhjeve ende nuk i ka certifikuar rezultatet, pasi disa kandidatë për deputetë kanë paraqitur ankesa në Gjykatën Supreme të Kosovës.

Kryetari i LVV-së, Albin Kurti, ka thënë për media se pas certifikimit të rezultateve do të nisë komunikimin me partitë politike për të siguruar një marrëveshje për krijimin e institucioneve, si dhe për zgjedhjen e presidentit të Kosovës.

Zgjedhjet paraprake janë mbajtur më 28 dhjetor dhe 9 shkurt. Edhe në ato procese zgjedhore fituese ishte LVV-ja, por në zgjedhjet e dhjetorit nuk u arrit marrëveshje për zgjedhjen e presidentit.
