The Albanian Journalists Association, AGSH, has appealed to the Constitutional Court over the new regulation of the Special Court against Corruption and Organized Crime.

During an interview on the “First Minute” program on News24, AGSH Chairman Isa Myzyraj said the new rules impose restrictions that take the process of covering court hearings many years back, to a time when everything was documented with pen and paper.

According to him, the ban on mobile phones and recording devices, together with the numerous procedures required to enter the courtroom, undermine the public interest and citizens’ right to be informed about proceedings involving former prime ministers, former ministers and the use of public funds.

Isa Myzyraj, AGSH chairman: The regulation contains numerous restrictions, as it bans mobile phones and recording devices. This takes us many years back, to a period when proceedings were followed with pen and paper. Entering the courtroom is also accompanied by a series of procedures. It affects the public interest and limits Albanians’ ability to obtain information about court proceedings involving people who have served as prime ministers or ministers and misused public funds.

Journalist Klodiana Lala described the regulation as an outright violation of the law, saying that it creates chaos and isolates GJKKO. She pointed out that she had followed the activities of this court even when it was called the Serious Crimes Court, and that at that time proceedings were monitored by cameras.

Klodiana Lala, journalist: The initiative signed by Judge Erjon Bani closes off and turns GJKKO into a bunker. Journalists are subjected to scanning and physical searches, while the law stipulates that court hearings are public, except in certain cases.

Cases of public interest, involving figures from the business world and organized crime, must be reported. Under the regulation, we have to complete a form for every hearing. I follow up to 10 court proceedings a day at GJKKO, so this makes my work more difficult and directly obstructs it. Another problem is that a journalist must report the truth, but is not a witness in the court proceedings.

GJKKO did not consult journalists about these changes, even though it was the media that placed this court at the center of attention. We understand that caution must be exercised in certain cases, for example when state secrets or minors are involved, and we have never violated these rules.

But when Sali Berisha, Ilir Meta, Erion Veliaj or Belinda Balluku appear in court, the public must have transparency. This regulation was approved precisely now, when political figures are involved in court proceedings. I will follow the trials as a citizen and not as a journalist. Mr. Bani should reconsider and withdraw this unlawful regulation.

Gjatë një interviste në emisionin “Minuta e parë” në News24, kreu i AGSH-së, Isa Myzyraj, deklaroi se rregullat e reja vendosin kufizime që e kthejnë procesin e ndjekjes së seancave gjyqësore shumë vite pas, në kohën kur gjithçka dokumentohej me laps dhe letër.

Sipas tij, ndalimi i celularëve dhe pajisjeve regjistruese, së bashku me procedurat e shumta për të hyrë në sallën e gjyqit, cenojnë interesin publik dhe të drejtën e qytetarëve për t’u informuar mbi procese që lidhen me ish-kryeministra, ish-ministra dhe përdorimin e parave publike.

Isa Myzyraj, kryetar i AGSH-së: Rregullorja përmban kufizime të shumta, pasi ndalon celularët dhe regjistruesit. Kjo na kthen shumë vite prapa, në periudhën kur proceset ndiqeshin me laps e letër. Edhe hyrja në sallë shoqërohet me një seri procedurash. Përmes saj preket interesi publik dhe u kufizohet shqiptarëve mundësia për të marrë informacion mbi procese gjyqësore që përfshijnë persona që kanë qenë kryeministra apo ministra dhe që kanë keqpërdorur fondet publike.

Gazetarja Klodiana Lala, e cilësoi rregulloren një shkelje të hapur të ligjit, duke thënë se ajo krijon kaos dhe e izolon GJKKO-në. Ajo solli në vëmendje se e ka ndjekur veprimtarinë e kësaj gjykate edhe kur ajo quhej Gjykata e Krimeve të Rënda dhe se në atë kohë proceset monitoroheshin me kamera.

Klodiana Lala, gazetare: Nisma e firmosur nga gjyqtari Erjon Bani e mbyll dhe e bunkerizon GJKKO-në. Gazetarët i nënshtrohen skanerit dhe kontrollit fizik, ndërsa ligji përcakton se seancat gjyqësore janë publike, me përjashtim të disa rasteve.

Çështjet me interes publik, ku përfshihen emra nga bota e biznesit dhe e krimit të organizuar, duhet të raportohen. Sipas rregullores, për çdo seancë duhet të plotësojmë një formular. Unë ndjek deri në 10 procese gjyqësore në ditë në GJKKO, ndaj kjo e vështirëson dhe e pengon drejtpërdrejt punën time. Një tjetër problem është se gazetari duhet të raportojë të vërtetën, por nuk është dëshmitar në procesin gjyqësor.

GJKKO nuk është konsultuar me gazetarët për këto ndryshime, ndonëse kanë qenë mediat ato që e kanë vendosur këtë gjykatë në qendër të vëmendjes. Ne e kuptojmë se në raste të caktuara duhet treguar kujdes, për shembull kur bëhet fjalë për sekretin shtetëror ose të miturit, dhe këto rregulla nuk i kemi cenuar asnjëherë.

Por kur në gjykatë paraqiten Sali Berisha, Ilir Meta, Erion Veliaj apo Belinda Balluku, publiku duhet të ketë transparencë. Kjo rregullore u miratua pikërisht tani, kur në procese gjyqësore janë përfshirë figura të politikës. Unë do të ndjek gjyqet si qytetare dhe jo si gazetare. Zoti Bani duhet të reflektojë dhe ta tërheqë këtë rregullore antiligjore.

Isa Myzyraj, në një deklaratë para GJK u shpreh se legjitimimi i një vendimi të tillë, do të sillte një precedent të rrezikshëm që mund t’i hapte më pas rrugën edhe mbylljen e rrjeteve të tjera sociale apo edhe mbyllje përfundimtare të Internetit.

“Nuk mund të shkohet në censurë të plotë dhe mbyllje të rrjeteve sociale. Kjo cënon lirinë e shprehjeve dhe të drejtën ekonomike të qytetarëve shqiptarë.

Jemi besimplotë që anëtarët e GJK nuk do ta legjitimojë sepse kjo do të krijojë precedent që mund të çojë në mbylljen e rrjeteve të tjera sociale, apo mbylljen e internetit nga kjo qeveria apo qeveri të tjera që do të vijnë më pas”, tha kreu i Asocacionit për Gazetarët Shqiptarë.
