Following Bekim Sejdiu’s withdrawal from the race for head of state, the Vetëvendosje Movement and the Democratic League of Kosovo have decided to suspend discussions on the presidency. Neither party expects any meetings in the coming days.

The Democratic League, which holds 18 seats in Kosovo’s Parliament, sees no reason to sit down with the governing party on this issue before the Constitutional Court delivers its ruling on the legality of the formation of the 11th legislature.

Lutfi Haziri, LDK deputy leader, said unequivocally in comments to Radio Free Europe on September 15 that no meeting would take place without a decision from the Constitutional Court.

Sources within the Vetëvendosje Movement also confirmed the suspension of the negotiations, saying that no meeting with LDK representatives had been scheduled during this week.

One day earlier, on September 14, the Democratic Party of Kosovo, the largest opposition force, referred the procedure for constituting the Assembly to the Constitutional Court, also requesting the imposition of an interim measure.

According to the PDK’s complaint, submitted on Monday, the authorities violated constitutional provisions concerning the manner in which the Assembly’s presiding officers are elected. They claim that the deadlines set for establishing the legislative institution were not respected.

Specifically, they argue that LVV failed to meet the constitutionally mandated 30-day deadline for establishing the Assembly, as well as the rule requiring a session to be convened every two days until that goal was achieved.

On Tuesday, the Constitutional Court gave no response to Radio Free Europe’s questions about whether it had accepted the PDK’s request for review and whether an interim measure was expected.

The agreement reached on August 31 between LVV and LDK to nominate Bekim Sejdiu as a presidential candidate failed on September 14. Sejdiu himself announced his withdrawal from the process because he was unable to secure the necessary votes.

Six LDK lawmakers opposed supporting Sejdiu, who, as Prime Minister Albin Kurti announced, had the backing of only 74 deputies. Parliamentary rules require the presence of at least 80 deputies at a session for the voting process to be valid.

In a statement on Facebook, Sejdiu explained that the new circumstances, defined by a lack of parliamentary support and the process’s diversion into internal political conflicts, had led him to decide to withdraw from the race for head of state.

With Sejdiu’s withdrawal, the political parties must negotiate a new agreement on another candidate. If Parliament fails to elect a president, the country will face new elections, the fourth in the span of two years.

Nevertheless, analyst Dritëro Arifi believes that continuing the talks between LVV and LDK is not appropriate at the moment, precisely because the legitimacy of the Assembly that is supposed to elect the president is being contested.

He warned Radio Free Europe that if the process returns to the starting point, all negotiations held so far would have been in vain.

However, if the Constitutional Court confirms that the Assembly’s formation was in accordance with the law, Arifi believes that an agreement on the president could be reached quickly if the parties show willingness. According to him, everything could be concluded within an hour if the ruling is favorable.

LVV and LDK, the only party that agreed to engage in dialogue with the election winner on this issue, have not disclosed the names of other candidates discussed during the negotiations before they agreed on Sejdiu.

According to Arifi, in the current situation, whenever the talks resume, the most appropriate alternative would be to propose an LDK lawmaker who enjoys broad support, both within the party and from LVV, in order to complete the establishment of Kosovo’s new institutions.

Pas tërheqjes së Bekim Sejdiut nga gara për kreun e shtetit, Lëvizja Vetëvendosje dhe Lidhja Demokratike e Kosovës kanë vendosur të ndërpresin diskutimet për postin e presidentit. Të dyja partitë nuk parashikojnë takime në ditët në vijim.

Lidhja Demokratike, e cila zotëron 18 mandate në Parlamentin e Kosovës, nuk sheh arsye për t’u ulur në tryezë me partinë qeverisëse për këtë temë, përpara se Gjykata Kushtetuese të japë verdiktin e saj mbi ligjshmërinë e formimit të legjislaturës së 11-të.

Lutfi Haziri, nënkryetar i LDK-së, deklaroi prerazi për Radion Evropa e Lirë më 15 shtator se asnjë takim nuk do të zhvillohet pa vendimin e Gjykatës Kushtetuese.

Edhe burime brenda Lëvizjes Vetëvendosje konfirmuan pezullimin e negociatave, duke bërë të ditur se gjatë kësaj jave nuk është programuar asnjë takim me përfaqësues të LDK-së.

Një ditë më parë, më 14 shtator, Partia Demokratike e Kosovës, si forca më e madhe opozitare, e dërgoi në Gjykatën Kushtetuese procedurën e krijimit të Kuvendit, duke kërkuar gjithashtu edhe vendosjen e një mase të përkohshme.

Sipas ankesës së PDK-së, e dorëzuar të hënën, pushteti ka shkelur dispozitat kushtetuese që lidhen me mënyrën e zgjedhjes së drejtuesve të Kuvendit. Ata pretendojnë se nuk u respektuan afatet kohore të përcaktuara për themelimin e institucionit ligjvënës.

Konkretisht, sipas tyre, LVV dështoi të përmbushte afatin 30-ditor kushtetues për themelimin e Kuvendit, si dhe rregullin që kërkonte thirrjen e seancës çdo dy ditë deri në arritjen e këtij qëllimi.

Të martën, Gjykata Kushtetuese nuk dha asnjë përgjigje për Radion Evropa e Lirë lidhur me pyetjet nëse e ka pranuar për shqyrtim kërkesën e PDK-së dhe nëse pritet ndonjë masë e përkohshme.

Marrëveshja e arritur më 31 gusht midis LVV-së dhe LDK-së për ta nominuar Bekim Sejdiun si kandidat për president dështoi më 14 shtator. Vetë Sejdiu njoftoi tërheqjen nga procesi për shkak të pamundësisë për të siguruar votat e nevojshme.

Gjashtë ligjvënës të LDK-së kundërshtuan mbështetjen për Sejdiun, i cili, siç bëri të ditur kryeministri Albin Kurti, gëzonte përkrahjen e vetëm 74 deputetëve. Rregullorja parlamentare kërkon praninë e minimumi 80 deputetëve në seancë për ta bërë të vlefshëm procesin e votimit.

Në njoftimin e tij në Facebook, Sejdiu shpjegoi se rrethanat e reja, të përcaktuara nga mungesa e mbështetjes parlamentare dhe devijimi i procesit në konflikte të brendshme politike, e shtynë të merrte vendimin për t’u larguar nga gara për kreun e shtetit.

Me daljen e Sejdiut, partitë politike duhet të negociojnë një marrëveshje të re për një kandidat tjetër. Nëse Parlamenti nuk arrin të zgjedhë presidentin, vendi do të përballet me zgjedhje të reja – të katërtat në harkun e dy viteve.

Sidoqoftë, analisti Dritëro Arifi është i mendimit se vazhdimi i bisedimeve midis LVV-së dhe LDK-së nuk është i përshtatshëm për momentin, pikërisht për shkak të kontestimit të legjitimitetit të Kuvendit që duhet ta zgjedhë presidentin.

Ai paralajmëroi për Radion Evropa e Lirë se në rast se procesi kthehet në pikën fillestare, të gjitha negociatat e deritanishme do të ishin të kota.

Megjithatë, nëse Gjykata Kushtetuese vërteton se themelimi i Kuvendit ishte në pajtim me ligjin, Arifi beson se arritja e një marrëveshjeje për president do të ishte e shpejtë, nëse palët tregojnë gatishmëri. Sipas tij, gjithçka mund të përmbyllet brenda një ore nëse vendimi është favorizues.

LVV dhe LDK, e cila ishte e vetmja parti që pranoi të dialogonte me fituesen e zgjedhjeve për këtë çështje, nuk kanë bërë të ditur emrat e tjerë që kanë qarkulluar gjatë negociatave përpara se të binin dakord për Sejdiun.

Sipas Arifit, në situatën e tanishme, kurdo që bisedimet të rifillojnë, alternativa më e përshtatshme do të ishte propozimi i një deputeti të LDK-së që gëzon mbështetje të gjerë, si brenda partisë ashtu edhe nga LVV, për të përfunduar së ndërtuari institucionet e reja të Kosovës.

Arbër Rexhaj, a deputy of the Vetëvendosje Movement, said that his political entity had made the final compromise to overcome the deadlock over the constitution of the Assembly. He called on the other parties to present their candidates for deputy speakers so that the process of establishing the institutions could continue.

Speaking before the resumption of the constitutive session, Rexhaj said that constituting the Assembly without a political agreement would lead the country toward new elections.

According to him, a meeting of the Assembly presidency had been held the previous day, while LVV had already made its final compromise. Rexhaj stressed that the other parties should come forward with their proposed names so that the process could move ahead.

The LVV deputy was also asked about the possibility of a meeting between Albin Kurti, Bedri Hamza and Lumir Abdixhiku, but he provided no concrete details on whether such a meeting would take place.

Rexhaj denied that LVV was working to send the country to new elections. He said that acting Prime Minister Albin Kurti had made efforts to establish communication with the opposition parties in order to overcome the situation.

He said that Kurti was constantly sending messages to party representatives and that there had been attempts to communicate with the Democratic Party of Kosovo and the Democratic League of Kosovo. As for the Alliance, Rexhaj said he was not sure, but believed that such efforts had been made.

According to Rexhaj, the other parties had had the opportunity to unblock the process by changing the names proposed for deputy speakers. He said that the Assembly could easily have been constituted two days earlier, since the decision had been in their hands.

Vetëvendosje Movement MP Arbëreshë Kryeziu-Hyseni has called on the Democratic Party of Kosovo and the Democratic League of Kosovo to participate in today’s Assembly session, where the constitution of the eleventh legislature is expected to take place.

As she was entering the Kosovo Assembly building, Kryeziu-Hyseni explained why LVV has changed its position regarding the voting of Vlora Çitaku and Kujtim Shala for deputy speaker posts.

Arbër Rexhaj, deputet i Lëvizjes Vetëvendosje, ka deklaruar se subjekti i tij politik e ka bërë kompromisin përfundimtar për tejkalimin e bllokadës rreth konstituimit të Kuvendit. Ai u ka kërkuar partive të tjera të paraqesin kandidatët e tyre për nënkryetarë, në mënyrë që të vazhdohet me krijimin e institucioneve.

Duke folur para nisjes së vazhdimit të seancës konstituive, Rexhaj tha se një konstituim i Kuvendit pa marrëveshje politike do ta çonte vendin drejt zgjedhjeve të reja.

Sipas tij, një ditë më parë ishte zhvilluar mbledhja e kryesisë, ndërsa LVV-ja tashmë kishte bërë kompromisin e fundit. Rexhaj theksoi se palët e tjera duhet të vijnë me propozimet për emrat dhe procesi të ecë përpara.

Deputeti i LVV-së u pyet gjithashtu për mundësinë e zhvillimit të një takimi ndërmjet Albin Kurtit, Bedri Hamzës dhe Lumir Abdixhikut, por nuk dha hollësi konkrete nëse një takim i tillë do të mbahej.

Rexhaj mohoi se LVV-ja po punon për ta dërguar vendin në zgjedhje të reja. Ai deklaroi se kryeministri në detyrë, Albin Kurti, ka bërë përpjekje për të vendosur komunikim me partitë opozitare, me qëllim që situata të tejkalohet.

Rexhaj shtoi se, nëse bëhet fjalë për një strategji politike që lidhet me konstituimin dhe datën e përfundimit të këtij procesi, palët e tjera e kishin pasur mundësinë ta konstituonin Kuvendin para dy ditësh. Sipas tij, ndryshimi i emrave të propozuar do ta kishte mundësuar konstituimin e Kuvendit para 48 orëve.

Ai e cilësoi si valide marrëveshjen politike me LDK-në, pavarësisht deklarimeve të gjashtë deputetëve të kësaj partie se nuk do të merrnin pjesë në votim.

Rexhaj përsëriti se konstituimi i Kuvendit pa një marrëveshje politike do ta orientonte vendin drejt zgjedhjeve. Megjithatë, sipas tij, tashmë ekziston një marrëveshje politike valide me LDK-në, ndërsa qëndrimi i 6 deputetëve të saj për të mos marrë pjesë dhe për të mos votuar mbetet çështje e tyre.

Në këto rrethana, ai tha se ka bazë për thirrjen e një seance, vazhdimin e konstituimit të Kuvendit dhe themelimin e institucioneve.

“Shpresoj që partitë opozitare ta ndryshojnë qëndrimin dhe të ecim përpara me konstituimin e Kuvendit. Lëvizja Vetëvendosje ka vepruar njësoj si gjatë këtyre dy viteve të fundit, duke ndërmarrë hapa për të ndihmuar në zhbllokimin e situatës së krijuar nga bllokada e vazhdueshme e këtyre partive opozitare. Shpresoj që deputetët të jenë sot të pranishëm në seancë. Në fund të fundit, aktgjykimi e përcakton si obligim pjesëmarrjen e tyre në votim, në mënyrë që ta konstituojmë Kuvendin dhe të vazhdojmë me proceset e tjera”, deklaroi ajo.

Sipas saj, në grupin parlamentar të LVV-së janë zhvilluar diskutime për emrat e propozuar nga dy partitë politike. Pas këtyre diskutimeve, kryesia e LVV-së ka vendosur t’i mbështesë të dy kandidatët, me synimin që bllokada të mos vijojë.

“As you know, last year Vlora Çitaku called for the removal of Albulena Haxhiu, while this year she called for the removal of Feride Rushiti. The day before yesterday, she did not take part in the vote to elect Haxhiu as speaker of Parliament, and she has also announced a boycott in the case of the president. We will certainly vote for a PDK lawmaker for deputy speaker, just as we will vote for an LDK lawmaker, but you must take the judgments into consideration, and it is not essential that it be the same name. I hope they will be constructive, just as we were last year. At the meeting with Hamza, we can determine which lawmaker can be voted for,” Kurti said.

According to Kurti, the meeting is primarily in the PDK’s interest, as the party needs LVV’s votes to elect its candidate for deputy speaker of Parliament. On the other hand, for the election of the president, LVV may be able to manage even with the PDK voting against.

“I think the PDK should not have abandoned the process of constituting Parliament. I hope it returns on Sunday so that we can also elect the other four deputy speakers and continue with the formation of the government and the election of the president. I repeat that we must avoid new elections, which are unnecessary, repeated and costly. For this, we need a political agreement. I regret that the chairman of the PDK did not respond to the request for a meeting, which he made public, but I believe that a meeting is essential. The PDK needs VV’s votes to elect the deputy speaker, while VV, for the election of the president, only needs the PDK not to boycott or even to vote against. In other words, they need our vote in favor, while we can make do with their vote against,” Kurti said.

Kurti was among the last to leave the Parliament building, but he did not say whether he would take part in Saturday’s march, which is being held ahead of the final decision in The Hague. He had also evaded the same question in the morning, saying that he would answer later in the day.

Ne do ta votojmë patjetër një deputet të PDK-së për nënkryetar, ashtu si edhe një deputet të LDK-së, por aktgjykimet duhet t’i keni parasysh dhe nuk është e domosdoshme të jetë i njëjti emër. Shpresoj që të tregohen konstruktivë, ashtu siç kemi qenë ne vitin e kaluar. Në takimin me Hamzën mund të përcaktojmë se cili deputet mund të votohet”, deklaroi Kurti.

Sipas Kurtit, takimi është më së shumti në interes të PDK-së, pasi kjo parti ka nevojë për votat e LVV-së për të zgjedhur kandidatin e saj për nënkryetar të Kuvendit. Në anën tjetër, për zgjedhjen e presidentit, LVV-së mund t’i mjaftojë edhe vota kundër e PDK-së.

“Mendoj se PDK-ja nuk duhej ta kishte braktisur procesin e konstituimit të Kuvendit. Shpresoj të rikthehet të dielën, në mënyrë që të zgjedhim edhe katër nënkryetarët e tjerë dhe të vazhdojmë me formimin e qeverisë e zgjedhjen e presidentit. Po e përsëris se duhet t’i shmangemi zgjedhjeve të reja, të cilat janë të panevojshme, të përsëritura dhe të kushtueshme. Për këtë na duhet një marrëveshje politike. Më vjen keq që kryetari i PDK-së nuk i është përgjigjur kërkesës për takim, gjë që e ka bërë publike, por besoj se një takim është i domosdoshëm. PDK-së i duhen votat e VV-së për zgjedhjen e nënkryetarit, ndërsa VV-së, për zgjedhjen e presidentit, i mjafton që PDK-ja të mos bojkotojë ose edhe të votojë kundër. Pra, atyre u duhet vota jonë pro, ndërsa neve na mjafton edhe vota e tyre kundër”, u shpreh Kurti.

Kurti doli ndër të fundit nga ndërtesa e Kuvendit, por nuk tregoi nëse do të marrë pjesë në marshin e së shtunës, i cili mbahet para vendimit përfundimtar në Hagë. Të njëjtës pyetje ai i ishte shmangur edhe gjatë mëngjesit, duke thënë se do të përgjigjej më vonë gjatë ditës.
