In a post on his profile on “X,” Misetic said that although the Specialist Chambers Ombudsperson speaks of his “independent mandate to monitor and protect the fundamental rights of the accused,” he has never contacted any of Hashim Thaçi’s defense lawyers in six years.

He also mentioned the Ombudsperson of Kosovo, Naim Qelaj, who he said has shown active interest and maintained continuous contact.

“While the KSC Ombudsperson says that his mandate is to ‘monitor, protect, and independently safeguard’ the fundamental rights of the accused, he has not contacted Hashim Thaçi’s lawyers even once in 6 years. By contrast, the Ombudsperson of the Republic of Kosovo, Naim Qelaj, has been actively in touch as part of his monitoring efforts,” Misetic wrote.

Luka Misetic, avokati mbrojtës i Hashim Thaçit, ka reaguar ndaj Pietro Speras, Avokatit të Popullit të Gjykatës Speciale, pasi ky i fundit njoftoi sot për angazhimin e tij në mbikëqyrjen e ambienteve të paraburgimit. Spera bëri të ditur gjithashtu se, gjatë ushtrimit të detyrës së tij, u ka ofruar të paraburgosurve takime private dhe konfidenciale, por sipas tij, disa kanë pranuar ta takojnë dhe disa të tjerë jo.

Në një postim në profilin e tij në “X”, Misetic tha se, megjithëse Avokati i Popullit i Speciales flet për mandatin e tij “të pavarur për të monitoruar dhe për të mbrojtur të drejtat fundamentale të të akuzuarve”, ai nuk ka kontaktuar asnjëherë, për gjashtë vjet, asnjërin prej avokatëve mbrojtës të Hashim Thaçit.

Ai përmendi edhe Avokatin e Popullit të Kosovës, Naim Qelaj, për të cilin tha se ka treguar interesim aktiv dhe ka mbajtur kontakt të vazhdueshëm.

“Ndërsa Avokati i Popullit i DHSK-së thotë se mandati i tij është të “monitorojë, mbrojë dhe të mbrojë në mënyrë të pavarur” të drejtat themelore të të akuzuarve, ai nuk i ka kontaktuar avokatët e Hashim Thaçit as edhe një herë në 6 vjet. In a post on X, he stated: “The Appeals Panel of the Specialist Chambers in the contempt of court trial against Hashim Thaçi has just granted yet another Prosecution appeal.”

In the same reaction, Misetic also made public the balance of appeals in the two cases.

He wrote: “Prosecution appeals: 3 out of 3 granted (100% success). Defense appeals: 44 out of 44 rejected (100% failure).”

According to Misetic, after the end of the Specialist Chambers’ mandate, this court should undergo an evaluation process.

He also stressed: “When the Kosovo Specialist Chambers are subjected to an inevitable assessment after the end of their mandate, judicial fairness will be one of the main topics of debate.”

Sipas tij, në këtë proces të gjitha apelet e Prokurorisë kanë marrë miratim, ndërkohë që asnjë prej apeleve të mbrojtjes nuk është pranuar nga Paneli i Apelit.

Misetic u shpreh gjithashtu se, pas përmbylljes së mandatit të saj, Gjykata Speciale duhet të kalojë nëpër një proces vlerësimi, teksa ngriti pikëpyetje lidhur me drejtësinë e kësaj gjykate.

“Kur Dhomat e Specializuara të Kosovës t’i nënshtrohen një vlerësimi të pashmangshëm pas përfundimit të mandatit të tyre, drejtësia gjyqësore do të jetë një nga temat kryesore të debatit”, shkroi ai.
