Bekim Haxhiu, a parliamentary candidate from the Democratic Party of Kosovo, said that this result is inaccurate and, according to him, should not be accepted.

“Today, together with parliamentary candidate Qëndrim Kryeziu, we submitted a complaint to PZAP regarding the final result published by the CEC, because the published and final result is inaccurate, unverified, and has already been acknowledged and documented in two essential facts confirmed by the recount of 5,201 PDK votes, where 221 votes recorded incorrectly in the initial count were identified. As a candidate, in this recount I was awarded 6 additional votes, and the complaint is well-founded and the result cannot be certified as inaccurate; it must be accurate, the law guarantees that the final and certified result must be accurate.

According to Haxhiu, the complaint is based on two main arguments. The first, he said, is related to the fact that the recount of a small sample of 3.5% of PDK votes brought to light errors in the initial count at the Counting Center, a result which, according to him, is preliminary and cannot be treated as final without going through the verification process.

He added that the second argument concerns CEC meeting number 69, where, according to him, chairman Kreshnik Radoniqi admitted that the final result is inaccurate, calling them “minimal and human errors.” However, Haxhiu said this error amounts to 4.25% of the preferential votes for PDK candidates and that the law does not allow the certification of a result with errors.,” Haxhiu said.

He also stressed that a similar situation had occurred in the December 28 elections last year.

“Therefore, our complaint is based on facts now already known to the CEC, and we are asking PZAP not to allow the certification of an electoral result that is inaccurate. We are not seeking an extraordinary procedure; we are seeking a procedure provided for by law: a recount.

I remind you that in the December 28 elections, in the initial recount verified by the CEC on a 2% sample, during that period I was awarded 12 additional votes, while after the full recount I was awarded 522 additional votes. An almost similar case, though on a smaller scale, is happening now, given that the margin for winning the parliamentary mandate is very narrow, at 102 votes, while the margin of error that has been identified is very high and exceeds this vote difference. Therefore, for the result to be accurate and uncontested, we are asking for a recount procedure, which should be ordered by PZAP, and then to have the accurate final result,” Haxhiu said.

On the other hand, the other parliamentary candidate, Qëndrim Kryeziu, said that the law does not provide for forgiving errors, no matter how small they may be.

“But the law does not say that we should forgive them; the law says it must be applied equally to everyone and that every vote must be counted vote by vote. So we are not asking for anything extraordinary; we are only asking to thank those who voted for us and to have the accurate number of votes because it is known that there are more mistakes there than they say. So we are demanding our right for every vote to be counted and nothing more,” Kryeziu said.

Bekim Haxhiu, kandidat për deputet nga Partia Demokratike e Kosovës, deklaroi se ky rezultat është i pasaktë dhe, sipas tij, nuk duhet të pranohet.

“Sot bashkë me kandidatin për deputet Qëndrim Kryeziu, kemi dorëzuar ankesën në PZAP, në rezultatin përfundimtar të publikuar nga KQZ-ja, për arsye se rezultati i publikuar dhe përfundimtar është i pasaktë, i paverifikuar, tani më i pranuar dhe i evidentuar në dy fakte esenciale të konfirmuar nga rinumërimi i 5,201 votave të PDK-së, ku janë evidentuar 221 vota të regjistruara në regjistrimin fillestar gabimisht. Mua si kandidat në këtë rinumërim mu shtuan 6 vota dhe ankesa është e bazuar dhe rezultati nuk mund të certifikohet si i pasaktë, ai duhet të jetë i saktë, ligji e garanton që rezultati përfundimtar dhe i certifikuar duhet të jetë i saktë.

Sipas Haxhiut, ankesa mbështetet në dy argumente kryesore. I pari, siç tha ai, lidhet me faktin se rinumërimi i një mostre të vogël prej 3.5% të votave të PDK-së ka nxjerrë në pah gabime në numërimin fillestar në Qendrën e Numërimit, rezultat ky që, sipas tij, është preliminar dhe nuk mund të trajtohet si përfundimtar pa kaluar procesin e verifikimit.

Ai shtoi se argumenti i dytë ka të bëjë me mbledhjen numër 69 të KQZ-së, ku, sipas tij, kryesuesi Kreshnik Radoniqi e ka pranuar se rezultati përfundimtar është i pasaktë, duke i quajtur ato “gabime minimale e njerëzore”. Megjithatë, Haxhiu tha se ky gabim përbën 4.25% për votat preferenciale të kandidatëve të PDK-së dhe se ligji nuk lejon certifikimin e një rezultati me gabime.“, tha Haxhiu.

Ai theksoi gjithashtu se një situatë e ngjashme kishte ndodhur edhe në zgjedhjet e 28 dhjetorit të vitit të kaluar.

“Prandaj, ankesa jonë është e bazuar në fakte tani më të njohura nga KQZ-ja dhe po kërkojmë nga PZAP-ja që mos të lejojë certifikimin e një rezultati zgjedhor i cili është i pasaktë. Nuk po kërkojmë procedurë të jashtëzakonshme, po kërkojmë një procedurë të cilën e parasheh ligji: rinumërimin.

Ju rikujtoj se në zgjedhjet e 28 dhjetorit, në rinumërimin fillestar të verifikuar nga KQZ-ja në mostrën prej 2%, në atë periudhë kohore më janë shtuar plus 12 vota, ndërsa pas rinumërimit total më janë shtuar 522 vota. Rast pothuajse i ngjashëm me përmasa më të vogla është edhe tani, duke ditur që diferenca për fitimin e mandatit të deputetit është shumë e ngushtë, është 102 vota, marzhi i gabimit i cili është evidentuar është shumë i lartë që e tejkalon këtë diferencë të votave. Prandaj, që rezultati të jetë i saktë dhe i pakontestueshëm, po kërkojmë që të kemi një procedurë të rinumërimit të cilën duhet ta urdhërojë PZAP-ja dhe pastaj ta kemi rezultatin përfundimtar të saktë”, tha Haxhiu.

Nga ana tjetër, kandidati tjetër për deputet, Qëndrim Kryeziu, u shpreh se ligji nuk parasheh falje të gabimeve, pavarësisht sa të vogla mund të jenë ato.

“Por ligji nuk thotë që duhet t’i falim, ligji thotë që duhet të zbatohet për të gjithë njëjtë dhe votë për votë të numërohet çdo votë. Kështu që ne s’po kërkojmë diçka të jashtëzakonshme, po kërkojmë vetëm ata që na kanë votuar t’i falënderojmë dhe t’i kemi numrin e saktë të votave sepse dihet që ka aty më shumë gabime sesa thonë ata. Kështu që ne kërkojmë të drejtën tonë që të numërohet çdo votë dhe asnjë gjë më shumë”, tha Kryeziu.

“Today we submitted to the Supreme Court the complaint with the now well-known reasoning that the recount process ordered by the CEC has shown that there are inaccuracies in the counting carried out at the municipal counting centers, and this margin of error in the initial count is not small, because in this recount ordered by the CEC only 5,201 votes of the Democratic Party were counted, and in this recount there are 220 votes that were either added or deducted from the candidates’ preferential votes. Therefore, in order to have an accurate result, we ask the Supreme Court to approve our request and order the CEC to count the preferential votes for candidates and MPs of the Democratic Party, because the law also requires that the ballot-counting procedure be guided by accuracy and also provides for the possibility of a recount if inaccuracies are identified in the initial count,” he said.

Haxhiu stressed that their request concerns the recount of the votes of the Democratic Party of Kosovo.

“Beyond our suspicions, we now have a process ordered by the CEC, which is the recount of 185 boxes, or polling stations. This process ordered by the CEC has confirmed inaccuracies in the initial count and this is now a fact proven by the CEC itself, which is why we are asking for a recount of the Democratic Party’s votes, because according to CEC regulations, the votes of political entities are not counted by commissioners of that political entity, but are counted by commissioners or counters from other political entities. Now whether these were intentional or unintentional mistakes, the Constitution of Kosovo, Article 45 on electoral rights, guarantees that in addition to the right to vote, there is also the right that the accuracy of the result must be ensured and that the vote be counted exactly as the voter cast it. No one, under the Constitution and the laws of Kosovo, has the right to distort a citizen’s vote, whether it is 2, 3, 5, 6, or 500 votes — the election result must be accurate, exactly as the voter cast it in the ballot box,” Haxhiu added.

Meanwhile, Qëndrim Kryeziu said they would pursue to the end all the rights that belong to them.

“When we withdrew the documents together, we were told that the minor errors were minimal, so they said there was no need for us to complain, they told us informally, but these are not minor minimal errors, nor technical errors, because the number needed to become an MP is simply very narrow, both for my colleague and for me, with a margin of error of 589 that occurred in the CEC system. Then they said no, we only added two, but we saw it ourselves in person; they told us it was a small technical error, but that the process had to continue.

We have our rights to use to the fullest, and even regarding the final right to a recount we will file a complaint there as well and will seek every possible opportunity that is within our rights and within God’s justice for us to use to the maximum, because every vote matters, has value, and no one needs to become an MP with our votes. So we will use all the opportunities that the law grants us.

We suspect this because I myself was following the CEC’s official website on my phone and 589 were added to me, and I was told it was a technical error, while in the response to the complaint they told me only 2 votes. Whether 2 votes or 589 votes, it is called theft.

So whoever stole them should bear the burden and should learn once and for all to work without theft, without anything of the sort,” Kryeziu said.

On Monday, the Electoral Complaints and Appeals Panel (ECAP) dismissed as unfounded the complaints of Bekim Haxhiu and Qëndrim Kryeziu, parliamentary candidates from the Democratic Party of Kosovo (PDK), who had sought a full recount of the preferential votes of the candidates of this political entity following the recount of 185 regular polling stations.

Ankesa është dorëzuar pasi, sipas Haxhiut, rinumërimi i votave i urdhëruar nga Komisioni Qendror i Zgjedhjeve (KQZ) ka nxjerrë në pah pasaktësi në numërimin e kryer në qendrat komunale.

“Sot kemi dorëzuar në Gjykatën Supreme ankesën me arsyetimin tani më të njohur, që procesi i rinumërimit i urdhëruar nga KQZ, ka treguar që ka pasaktësi në numërimin që është bërë nëpër qendrat komunale të numërimit dhe kjo marzhë e gabimit në numërimin fillestar nuk është e vogël, sepse në këtë rinumërimin e urdhëruar nga KQZ janë numëruar vetëm 5201 vota të Partisë Demokratike dhe në këtë rinumërim janë 220 vota të cilat janë shtuar ose i janë hequr kandidatëve vota preferenciale. Prandaj, për të pasur një rezultat të saktë, kërkojmë që Gjykata Supreme të miratojë kërkesën tonë dhe të urdhërojë KQZ për numërimin e votave preferenciale për kandidatë dhe deputetë të Partisë Demokratike, sepse edhe ligji e obligon që procedura e numërimit të fletëvotimeve të udhëhiqet nga saktësia dhe e jep edhe mundësinë e rinumërimit në rast se evidentohen pasaktësi në numërimin fillestar”, ka thënë ai.

Haxhiu ka theksuar se kërkesa e tyre ka të bëjë me rinumërimin e votave të Partisë Demokratike të Kosovës.

“Përtej dyshimeve tona, tani kemi një proces të urdhëruar nga KQZ, që është procesi i rinumërimit të 185 kutive, apo vendvotimeve. Ky proces i urdhëruar nga KQZ ka vërtetuar pasaktësi në numërimin fillestar dhe kjo tanimë është fakt i provuar nga vetë KQZ, prandaj edhe po kërkojmë që të ketë një rinumërim të votave të Partisë Demokratike, sepse sipas rregullativit të KQZ, votat e subjekteve politike nuk numërohen nga komisionerët e atij subjekti politik, por numërohen nga komisionerë ose numërues të subjekteve tjera politike. Tani a kanë qenë gabime të qëllimshme apo të paqëllimshme, Kushtetuta e Kosovës, neni 45 në të drejtën zgjedhore, garanton që përveç të drejtës për votim, ekziston edhe e drejta që saktësia e rezultatit duhet të jetë dhe vota e njehur, ashtu siç e ka hedhur votuesi, nuk ka të drejtë askush sipas Kushtetutës dhe ligjit të Kosovës të devijojë votën e qytetarit, qoftë edhe 2, 3, 5, 6, 500 vota rezultati zgjedhor duhet të jetë i saktë, ashtu siç e ka hedhur votuesi në kuti të votimit”, ka shtuar Haxhiu.

Nga ana tjetër, Qëndrim Kryeziu është shprehur se do t’i ndjekin deri në fund të gjitha të drejtat që u takojnë.

“Ne kur i kemi tërhjekë dokumentet bashkë, na kanë thënë që gabimet e vogla janë minimale, kështu që tha s’keni nevojë me u anku, po ua themi shoqërisht, por nuk janë këto gabime të vogla minimale, as gabime teknike, sepse është thjeshtë numri shumë i ngushtë që të jesh deputet, si për kolegun, si për mua, me një marzhë gabimi prej 589 që ka ndodhur në sistemin e KQZ, pastaj thanë jo vetëm dy ti kemi shtu, po ne e kemi pa atë vetë prezent, na thanë që është gabim teknik i vogël, po duhet tha me vazhdu.

Ne i kemi të drejtat tona me i shfrytëzu deri në maksimum, edhe të drejtën e fundit në rinumërim kemi me bë ankesë edhe aty dhe do të kërkojmë çdo mundësi të mundshmë që është në të drejtën tonë dhe në të drejtën e Zotit që ne ta shfrytëzojmë maksimalisht, sepse çdo votë ka rëndësi, ka vlerë dhe s’ka nevojë askush të bëhet deputet me votat tona. Kështu që ne do t’i shfrytëzojmë të gjitha mundësitë që na takojnë me ligj.

Dyshojmë sepse unë vetë kam qenë duke përcjellur në telefon faqen zyrtare të KQZ dhe 589 më janë shtuar dhe më është thënë që është gabim teknik, ndërsa në përgjigjen e ankesës më kanë thënë vetëm 2 vota, si 2 vota si 589 vota, quhet vjedhje.

Kështu që ai që i ka vjedhur le ta bajë barrën dhe le të mësohet të punojë një herë e përgjithmonë pa vjedhje, pa asnjë gjë”, ka thënë Kryeziu.
