The Kosovo Democratic Institute (KDI) has reacted to the situation surrounding the constitution of the Assembly, assessing that the process could be completed even after the expiry of the 30-day constitutional deadline. However, according to KDI, the matter requires legal clarification.

According to the institute, the constitution of the Assembly is important for the functioning of the institutions and for overcoming the institutional crisis.

KDI has requested that the Constitutional Court determine the legal consequences of failing to comply with the 30-day deadline, as well as the impact that constituting the Assembly after the expiry of this deadline would have.

“This is an issue that must be addressed through constitutional mechanisms and by the competent institutions,” KDI said in its statement.

The institute has called on deputies and authorized parties to request an interpretation of the legal status of the constitution of the Assembly after the deadline expires, as well as the validity of actions that will be carried out after its constitution.

KDI has emphasized that this issue goes beyond the current crisis, as it is also linked to how Kosovo’s constitutional order will function in the future.

“The citizens of Kosovo need institutions that function, but they equally need these institutions to operate within the constitutional order,” the statement concludes.

Instituti Demokratik i Kosovës (KDI) ka reaguar për situatën e krijuar rreth konstituimit të Kuvendit, duke vlerësuar se ky proces mund të përfundojë edhe pas kalimit të afatit kushtetues prej 30 ditësh. Megjithatë, sipas KDI-së, për këtë çështje nevojitet një sqarim juridik.

Sipas institutit, konstituimi i Kuvendit është i rëndësishëm për funksionimin e institucioneve dhe për kapërcimin e krizës institucionale.

KDI ka kërkuar që Gjykata Kushtetuese të përcaktojë pasojat juridike të mosrespektimit të afatit 30-ditor, si dhe ndikimin që do të kishte konstituimi i Kuvendit pas përfundimit të këtij afati.

“Kjo është çështje që duhet të trajtohet përmes mekanizmave kushtetues dhe nga institucionet kompetente”, thuhet në reagimin e KDI-së.

Instituti u ka bërë thirrje deputetëve dhe palëve të autorizuara që të kërkojnë interpretim për statusin juridik të konstituimit të Kuvendit pas skadimit të afatit, si dhe për vlefshmërinë e veprimeve që do të kryhen pas konstituimit.

KDI ka nënvizuar se kjo çështje shkon përtej krizës së tanishme, pasi lidhet edhe me mënyrën e funksionimit të rendit kushtetues të Kosovës në të ardhmen.

Members of parliament, representatives of public institutions, civil society organizations, experts, and representatives of the international community took part in the discussion.

At the close of the discussion, participants agreed that the upcoming reform must go beyond merely procedural changes and aim to build a modern public procurement system based on performance, integrity, risk management, and the strategic use of public spending.

According to KDI, this reform process should be supported by modernizing the legal framework, strengthening institutional capacities, developing the Procure-to-Pay (P2P) system, managing integrity and risk, orienting the system toward performance, and promoting sustainable procurement.

Opening the roundtable, KDI Program Manager Florent Spahija said that public procurement should not be treated only as an administrative procedure, but as an instrument that directly affects citizens’ lives.

“When public projects fail or do not respond to citizens’ needs, then we have failed to create value from public money. The debate on procurement should focus on the results and impact of public investments,” Spahija said.

KDI researcher Diana Metushi Krasniqi pointed out that although Kosovo has made progress in digitalization and transparency, the upcoming reform must address the system’s structural weaknesses.

“The last comprehensive reform was carried out in 2011, while the changes made in 2015-2016 were mainly technical. Later reform efforts were not finalized, while the exclusion of civil society from the new working group created in January 2026 raises concerns about the inclusiveness of the process,” she said.

According to the analysis presented by KDI, public procurement reform must change the existing approach by shifting the focus from transparency to performance, from tendering to full procurement cycle management, and from the formal observance of procedures to creating value for public money and concrete results for citizens.

During the discussion panel, MP Eliza Hoxha underlined the need to separate purchasing functions from procurement functions, create a State Price Catalogue, and integrate the gender dimension into public procurement processes.

On the other hand, MP Janina Ymeri expressed concern over poor contract management and the lack of accountability in institutions.

“Poor contract management and the lack of accountability remain among the main risks to public finances,” Ymeri said.

Albulena Nrecaj from INPO stressed that Kosovo’s legal framework is largely aligned with European Union directives, but its implementation in practice continues to remain a challenge.

“The Public Procurement Law is largely harmonized with European Union directives, while the main challenge remains implementation in practice and the lack of institutional accountability for violations and omissions,” Nrecaj said.

Sipas KDI-së, ky proces reformues duhet të mbështetet në modernizimin e kuadrit ligjor, forcimin e kapaciteteve institucionale, zhvillimin e sistemit Procure-to-Pay (P2P), menaxhimin e integritetit dhe rrezikut, orientimin drejt performancës dhe nxitjen e prokurimit të qëndrueshëm.

Duke e hapur tryezën, menaxheri i programeve në KDI, Florent Spahija, u shpreh se prokurimi publik nuk duhet trajtuar vetëm si një procedurë administrative, por si një instrument që ndikon drejtpërdrejt në jetën e qytetarëve.

“Kur projektet publike dështojnë ose nuk i përgjigjen nevojave të qytetarëve, atëherë kemi dështuar të krijojmë vlerë nga paratë publike. Debati për prokurimin duhet të fokusohet te rezultatet dhe ndikimi i investimeve publike”, deklaroi Spahija.

Hulumtuesja e KDI-së, Diana Metushi Krasniqi, vuri në dukje se, ndonëse Kosova ka shënuar përparim në digjitalizim dhe transparencë, reforma e ardhshme duhet të merret me dobësitë strukturore të sistemit.

“Reforma e fundit gjithëpërfshirëse është realizuar në vitin 2011, ndërsa ndryshimet e viteve 2015-2016 kanë qenë kryesisht teknike. Përpjekjet e mëvonshme për reformë nuk janë finalizuar, ndërsa përjashtimi i shoqërisë civile nga grupi i ri punues i krijuar në janar 2026 ngre shqetësime për gjithëpërfshirjen e procesit”, tha ajo.

Sipas analizës së paraqitur nga KDI, reforma në prokurimin publik duhet ta ndryshojë qasjen ekzistuese, duke e zhvendosur vëmendjen nga transparenca te performanca, nga tenderimi te menaxhimi i plotë i ciklit të prokurimit, si dhe nga respektimi formal i procedurave te krijimi i vlerës për paranë publike dhe rezultatet konkrete për qytetarët.

Gjatë panelit të diskutimit, deputetja Eliza Hoxha nënvizoi nevojën për të ndarë funksionet e blerjes nga ato të prokurimit, për të krijuar një Katalog Shtetëror të Çmimeve dhe për të integruar dimensionin gjinor në proceset e prokurimit publik.

Nga ana tjetër, deputetja Janina Ymeri shprehu shqetësim për menaxhimin e dobët të kontratave dhe mungesën e llogaridhënies në institucione.

“Menaxhimi i dobët i kontratave dhe mungesa e përgjegjësisë mbeten ndër rreziqet kryesore për financat publike”, tha Ymeri.

Albulena Nrecaj nga INPO theksoi se kuadri ligjor i Kosovës është në masë të madhe i përafruar me direktivat e Bashkimit Evropian, por zbatimi i tij në praktikë vazhdon të mbetet sfidë.

“Ligji i Prokurimit Publik është kryesisht i harmonizuar me direktivat e Bashkimit Evropian, ndërsa sfida kryesore mbetet zbatimi në praktikë dhe mungesa e përgjegjësisë institucionale për shkeljet dhe lëshimet”, deklaroi Nrecaj.
