Deborah Beqaj, the daughter of former Health Minister Ilir Beqaj, has renounced her Albanian citizenship. The decision approving her renunciation of citizenship was decreed by President of the Republic Bajram Begaj and made public on July 30, one day before her father, Ilir Beqaj, was released from prison.

The news comes at a time when the Beqaj family name is in the public spotlight because of the legal cases involving the former health minister.

Ilir Beqaj is currently under house arrest, while legal proceedings against him continue as part of the ongoing investigations.

Former Health Minister Ilir Beqaj has issued his first reaction after the Special Court against Corruption and Organized Crime (GJKKO) ordered his release from pre-trial detention and replaced the security measure with “house arrest.” Beqaj’s statement was made public through his lawyer, Ermal Yzeiraj.

Beqaj describes the end of his pre-trial detention as the termination of an unjustified measure. Referring to reports published a day earlier about his release from prison, he clarifies that he was not imprisoned for a single day in the legal sense, since that designation applies to a person convicted by a final court ruling.

According to the former minister, he spent 25 months in pre-trial detention as part of an investigation by the Special Prosecution Office (SPAK), and has held the status of defendant for 16 months.

Nevertheless, no sentence has been handed down against him so far, not even by the court of first instance.

He explains that the court determined yesterday that the continuation of his pre-trial detention was no longer supported by the provisions of criminal procedure. The deadlines stipulated by law had expired and, for this reason, the pre-trial detention order dated 03.07.2024 was no longer valid.

Beqaj adds that this conclusion was also accepted during the proceedings by the representative of the prosecution.

According to him, yesterday’s decision was preceded by another ruling issued by the preliminary hearing judge a few days earlier. The relevant reasoning found that the evidence and arguments presented by the prosecution were insufficient to continue the trial.

Beqaj claims that, specifically, the last 15 months of his pre-trial detention were unjust. He says he is being charged in his capacity as a senior official in violation of the Constitution, the Code of Criminal Procedure, the case law of the GJKKO and three court decisions issued specifically in his case.

In his statement, the former minister recalls that he served as health minister for three and a half years, while for two years he headed SASPAC as director general.

At present, three criminal proceedings are being conducted against him simultaneously by SPAK. According to Beqaj, the duration of the investigations, calculated together, amounts to 16 years, specifically 6.5 + 6.5 + 3. Despite this, he emphasizes that he has not yet received any sentence, including at the first-instance level.

He also states that throughout the investigations, not a single penny or cent has been discovered to prove an unlawful increase in his wealth resulting from actions or omissions connected to the state functions he has held.

After being placed under “house arrest,” Beqaj says he is happy to be close to his family. He says that, starting in September, he will be able to participate in the criminal proceedings without remaining in the security cage and will have the opportunity to use the electronic version of the investigation files.

According to him, these are rights arising from the European Convention, the Constitution and criminal procedural legislation, but which were unlawfully denied to him by the courts, the prosecution and the prison administration.

Beqaj calls on everyone who is able to continue the fight for these causes, as, in his words, they help guarantee due process and equality of arms.

In his statement, the former minister also mentions Dr. Berisha, saying that he had learned that the doctor had sent him his regards the previous day.

Beqaj says he will not respond to him now, as in the autumn he will give him the opportunity to speak even more when he appears as a witness in the proceedings concerning the concession for surgical instruments.

At the end of his message, Beqaj wishes everyone a pleasant holiday and announces that they will see each other again in September. Meanwhile, he remains under investigation by SPAK, while the new security measure requires him to remain at home until another decision by the judicial authorities.

Beqaj e cilëson përfundimin e paraburgimit si mbylljen e një mase të pajustifikuar. Duke iu referuar lajmeve të një dite më parë për lirimin e tij nga burgu, ai sqaron se nuk ka qenë asnjë ditë i burgosur në kuptimin juridik, pasi ky përcaktim vlen për një person të dënuar me vendim gjykate të formës së prerë.

Sipas ish-ministrit, ai ka kaluar 25 muaj në paraburgim për llogari të një hetimi të SPAK-ut dhe prej 16 muajsh ka statusin e të pandehurit.

Megjithatë, deri tani ndaj tij nuk është dhënë asnjë dënim, madje as nga gjykata e shkallës së parë.

Ai shpjegon se gjykata konstatoi dje se vazhdimi i paraburgimit nuk kishte më bazë në dispozitat e procedurës penale. Afatet e parashikuara nga ligji kishin përfunduar dhe, për këtë arsye, vendimi i paraburgimit i datës 03.07.2024 nuk kishte më vlefshmëri.

Beqaj shton se një përfundim i tillë u pranua gjatë procesit edhe nga përfaqësuesi i organit të akuzës.

Vendimit të djeshëm, sipas tij, i parapriu një tjetër vendimmarrje e gjyqtarit të seancës paraprake, e marrë pak ditë më herët. Në arsyetimin përkatës ishte vlerësuar se provat dhe argumentet e paraqitura nga organi i akuzës nuk mjaftonin për vazhdimin e gjykimit.

Beqaj pretendon se, konkretisht, 15 muajt e fundit të paraburgimit kanë qenë të padrejtë. Ai thotë se akuzohet në cilësinë e funksionarit të lartë në kundërshtim me Kushtetutën, Kodin e Procedurës Penale, jurisprudencën e GJKKO-së dhe tri vendime gjyqësore të dhëna posaçërisht për çështjen e tij.

Në reagim, ish-ministri kujton se ka ushtruar detyrën e ministrit të Shëndetësisë për tre vjet e gjysmë, ndërsa për dy vjet ka drejtuar SASPAC-un si drejtor i Përgjithshëm.

Aktualisht, ndaj tij po zhvillohen njëkohësisht tri procedime penale në SPAK. Sipas Beqajt, kohëzgjatja e hetimeve, e përllogaritur së bashku, arrin në 16 vjet, përkatësisht 6,5 + 6,5 + 3. Pavarësisht kësaj, ai thekson se nuk ka marrë ende asnjë dënim, përfshirë edhe në shkallën e parë.

Ai pohon gjithashtu se gjatë gjithë hetimeve nuk është zbuluar asnjë qindarkë apo cent që të dëshmojë një shtim të paligjshëm të pasurisë së tij, të ardhur si rezultat i veprimeve ose mosveprimeve të lidhura me funksionet shtetërore që ka mbajtur.

Pas kalimit në “arrest shtëpie”, Beqaj shprehet i lumtur që është pranë familjes. Ai thotë se, duke nisur nga shtatori, do të mund të marrë pjesë në proceset penale pa qëndruar në kafazin e sigurisë dhe do të ketë mundësi të përdorë versionin elektronik të fashikujve hetimorë.

Sipas tij, këto janë të drejta që burojnë nga Konventa Evropiane, Kushtetuta dhe legjislacioni procedural penal, por që i janë mohuar në mënyrë të paligjshme nga gjykatat, organi i akuzës dhe administrata e burgjeve.

Beqaj u bën thirrje të gjithë atyre që kanë mundësi të vijojnë betejën për këto kauza, pasi, siç shprehet ai, ato ndihmojnë garantimin e procesit të rregullt ligjor dhe barazisë së armëve.

Ish-ministri përmend në reagim edhe doktor Berishën, duke thënë se kishte mësuar se një ditë më parë ai i kishte dërguar selam.

Beqaj deklaron se nuk do t’i përgjigjet tani, pasi në vjeshtë do t’i japë mundësinë të flasë edhe më shumë, kur të paraqitet si dëshmitar në procesin për koncesionin e instrumenteve kirurgjikale.

Në mbyllje të mesazhit, Beqaj uron pushime të mbara dhe njofton se do të rishihen në shtator. Ndërkohë, ai vazhdon të jetë nën hetim nga SPAK-u, ndërsa masa e re e sigurisë e detyron të qëndrojë në banesë deri në një vendim tjetër të autoriteteve gjyqësore.

The request of former Health Minister Ilir Beqaj to ease the security measure of “prison detention” was rejected this Thursday by the Special Court of Appeal for Corruption and Organized Crime. The judging panel decided to uphold the previous decision of the First Instance Court.

The former minister had filed an appeal seeking to replace the “prison detention” measure with “house arrest.” As an alternative, he proposed a property guarantee of 2 million lekë or any other amount the court deemed appropriate.

The single judge of the case, Miliana Muça, after reviewing the appeal, announced “The upholding of decision no. 362, dated 25.05.2026, of the Special Court of First Instance for Corruption and Organized Crime.”

Consequently, Ilir Beqaj will remain under the security measure of “prison detention,” as previously determined.

Ilir Beqaj made another attempt today to get out of jail. The former minister has filed an appeal with the Supreme Court, asking for the “pretrial detention” security measure to be replaced with a more lenient one in exchange for a financial guarantee.

The request was reportedly filed this Tuesday and follows an attempt by Beqaj on May 13, when he made the same request and offered a financial guarantee of 20,000 euros.

Ilir Beqaj has been held in pretrial detention in Durrës since July 4, 2024, in connection with the sterilization case. On May 28, the Special Court ruled that he would be tried separately on charges of theft through abuse of office and participation in a structured criminal group.

Ilir Beqaj was formally charged by SPAK over the 100-million-euro sterilization concession. He was initially placed under the security measure of “obligation to report” before an investigator or Judicial Police officer once a week, every Friday at 15:30. Beqaj was also notified of a second measure, a “ban on leaving the country.”

In August 2023, the Special Prosecution Office arrested former Deputy Health Minister Klodian Rrjepaj on charges of abuse of office and falsification of documents in collusion, in connection with the nearly 100-million-euro sterilization concession awarded eight years earlier.
