At the end of the hearing, the judicial panel led by Judge Izet Gërguri decided not to accept the defense request of Hisni Ibishi for a supplementary psychiatric evaluation. However, the court ordered that the head of the team of experts who prepared the evaluation be summoned to provide additional clarifications. On the other hand, the court approved the request of Bujar Ibishi’s defense that he undergo a psychiatric evaluation by the Kosovo Institute of Forensic Psychiatry.

“The proposal of the defense counsel for defendant Hisni Ibishi, Kada Bunjaku-Përçuku, for the IFPK to be ordered to supplement the psychiatric evaluation for defendant Hisni Ibishi is rejected. Meanwhile, the proposal to summon the head of the team of experts who carried out the evaluation of defendant Hisni Ibishi, so that he may provide the necessary clarifications in line with the parties’ requests, is approved. The proposal of the defense counsel for defendant Bujar Ibishi, lawyer Naim Rudari, for a psychiatric evaluation to be carried out on defendant Bujar Ibishi is approved. By a separate order, the court will instruct the IFPK to carry out this evaluation and determine the tasks,” said presiding judge Gërguri.

Hisni Ibishi’s defense lawyer, Kada Bunjaku-Përçuku, challenged the content of the evaluation by the Kosovo Institute of Forensic Psychiatry, saying it did not address whether her client had acted in a state of severe mental shock.

“Yes, I have remarks regarding the evaluation of the Kosovo Institute of Forensic Psychiatry, because at the previous hearing I proposed that this direct psychiatric examination be conducted on my client, with the aim of establishing the circumstances of whether my client carried out the shooting with a weapon in a state of severe mental shock or not. I do not have the court’s separate ruling by which the experts were assigned their specific duties, but based on the written evaluation and the final conclusion they provided, it is evident that they did not examine or give an opinion on this circumstance, which is precisely why the evaluation was proposed,” said Përçuku.

Meanwhile, Bujar Ibishi’s lawyer, Naim Rudari, requested that his client undergo a psychiatric evaluation, referring to medical reports which, according to him, point to emotional problems and personality disorders.

“As for the health report for detainee Bujar Ibishi, we received it on May 22, 2026, via email and, despite the fact that the report states that the patient’s medical file is attached, we received only the two-page health report. From the content of this report, it is evident that detainee Bujar Ibishi was treated at the detention center and monitored for the diagnoses of ‘personality disorder with schizoid traits’ and ‘borderline personality disorder.’ Among other things, the report describes that the patient manifested increased emotional burden, anxiety, emotional lability, as well as the presence of suicidal ideation,” Rudari said.

These requests were opposed by prosecutor Sahit Tmava, who said that accepting them would only delay the judicial process.

“We have the experts’ decision and findings regarding the mental health condition of defendant Hisni Ibishi, and for this reason I oppose the proposal of Hisni’s defense counsel. As for the proposal of the defense of defendant Bujar Ibishi, in the latest hearings there has been no documentation whatsoever concerning defendant Bujar Ibishi, from the time the criminal offense was committed up to these hearings, showing that he suffers from any psychiatric disorder, either before or after the commission of the criminal offense. Therefore, I also oppose the proposal of Bujar’s defense because, in one respect, it is only delaying the proceedings,” Tmava said.

The representative of the injured party, Fisnik Sogojeva, also opposed the requests for additional evaluations, stressing that the existing evaluation shows that Hisni Ibishi was not in a state of shock at the time of the incident.

“We oppose it because from the evaluation prepared by three experts, dated 06.07.2025, on the last page, the penultimate point, the experts clarified that ‘as regards the critical day, the ability to judge the act, as well as the ability to control one’s actions and the consequences of one’s actions or omissions, was not affected.’ So, it was clarified that at the time of undertaking the act, he was not in a state of shock of any kind and, moreover, in the direct examination in the expert report it is clarified that even now he feels no remorse.” As for Bujar Ibishi, from the minutes of the previous hearing, the proposal of his defense was that his health condition at the detention center be examined, and not any possible examination related to the critical day. Moreover, from the report and evidence submitted on 22.05.2026 by the Prison Health Department, it is sufficiently clarified and understood from that evidence that he did not display any circumstance that could suggest that on the critical day he was affected in such a way as not to be aware of the action he undertook,” said Sogojeva.

According to the prosecution, Hisni and Bujar Ibishi are suspected that on February 12, 2025, in a venue in Adem Jashari Square in Skenderaj, “aware of their actions and intentionally deprived Ismet Ibishi I.I. of life, in that while the victim was drinking coffee in the venue, the defendants, as soon as they entered, pulled out their weapons and fired in his direction, with the shots proving fatal.”

The next hearing has been scheduled for September 3, 2026, starting at 09:00.

Në Gjykatën Themelore në Mitrovicë po zhvillohet procesi gjyqësor ndaj Hisni Ibishit dhe Bujar Ibishit, babë e bir, të akuzuar për vrasjen e kushëririt të tyre, Ismet Ibishit, më 12 shkurt 2025 në një kafiteri në sheshin “Adem Jashari” në Skenderaj.

Në përfundim të seancës, trupi gjykues i udhëhequr nga gjyqtari Izet Gërguri vendosi të mos e pranojë kërkesën e mbrojtjes së Hisni Ibishit për plotësimin e ekspertizës psikiatrike. Megjithatë, gjykata urdhëroi që të thirret drejtuesi i grupit të ekspertëve që e ka hartuar ekspertizën, në mënyrë që të japë sqarime shtesë. Nga ana tjetër, u pranua kërkesa e mbrojtjes së Bujar Ibishit që ai t’i nënshtrohet një ekspertize psikiatrike nga Instituti i Psikiatrisë Forenzike të Kosovës.

“Refuzohet propozimi i mbrojtëses së të pandehurit Hisni Ibishi, Kada Bunjaku-Përçuku, që të urdhërohet IPFK-ja të bëjë plotësimin e ekspertizës psikiatrike për të pandehurin Hisni Ibishi. Ndërsa aprovohet propozimi që të ftohet kryesuesi i grupit të ekspertëve, të cilët e kanë kryer ekspertizën për të pandehurin Hisni Ibishi, që të japë sqarimet e nevojshme sipas kërkesave të palëve. Aprovohet propozimi i mbrojtësit të të pandehurit Bujar Ibishi, avokatit Naim Rudari, që ndaj të pandehurit Bujar Ibishi të kryhet ekspertizë psikiatrike. Gjykata, me urdhër të veçantë, do ta urdhërojë IPFK-në për kryerjen e kësaj ekspertize dhe përcaktimin e detyrave”, tha kryetari i trupit gjykues, Gërguri.

Mbrojtësja e Hisni Ibishit, Kada Bunjaku-Përçuku, kundërshtoi përmbajtjen e ekspertizës së Institutit të Psikiatrisë Forenzike të Kosovës, duke thënë se aty nuk është trajtuar çështja nëse klienti i saj ka vepruar në gjendje të tronditjes së fortë mendore.

“Po, kam vërejtje në ekspertizën e Institutit të Psikiatrisë Forenzike të Kosovës, sepse në seancën e kaluar unë kam propozuar që të kryhet ky ekzaminim i drejtpërdrejtë psikiatrik për të mbrojturin tim, me qëllim që të vërtetohen rrethanat nëse i mbrojturi im të shtënat që i ka bërë me armë i ka kryer në gjendje të tronditjes së fortë mendore apo jo. Nuk e kam aktvendimin e posaçëm të gjykatës me të cilin u janë caktuar detyrat konkrete ekspertëve, mirëpo, bazuar në ekspertizën me shkrim dhe në konstatimin përfundimtar që kanë dhënë, vërtetohet se ata nuk e kanë ekzaminuar apo nuk kanë dhënë mendim lidhur me këtë rrethanë për të cilën edhe është propozuar ekspertiza”, tha Përçuku

Ndërkohë, avokati i Bujar Ibishit, Naim Rudari, kërkoi që ndaj klientit të tij të realizohet ekspertizë psikiatrike, duke iu referuar raporteve mjekësore që, sipas tij, flasin për probleme emocionale dhe çrregullime të personalitetit.

“Ndërsa sa i përket raportit shëndetësor për të paraburgosurin Bujar Ibishin, të njëjtin ne e kemi pranuar më 22 maj 2026 përmes adresës elektronike dhe, përkundër asaj që në këtë raport shkruhet se të bashkangjitur e keni dosjen mjekësore të pacientit në fjalë, ne e kemi pranuar vetëm raportin shëndetësor prej dy fletave, me dy faqe shkrim. Nga përmbajtja e këtij raporti është evidentuar se i paraburgosuri Bujar Ibishi është trajtuar në qendrën e paraburgimit dhe monitoruar për diagnozën “çrregullim i personalitetit me tipare skizoide” dhe “çrregullim i personalitetit borderline”. Ndër të tjera, raporti përshkruan se pacienti ka manifestuar ngarkesë të shtuar emocionale, ankth, labilitet emocional, si dhe prezencë të ideve suicidale”, tha Rudari.

Këto kërkesa u kundërshtuan nga prokurori Sahit Tmava, i cili vlerësoi se pranimi i tyre do të ndikonte vetëm në zvarritjen e procesit gjyqësor.

“Vendimin-konstatimin e ekspertëve lidhur me gjendjen e shëndetit mendor sa i përket të pandehurit Hisni Ibishi e kemi, dhe për këtë arsye kundërshtoj propozimin e mbrojtëses së të pandehurit Hisni. Kurse sa i përket propozimit të mbrojtjes së të pandehurit Bujar Ibishi, në seancat e fundit nuk ka pasur kurrfarë dokumentacioni sa i përket të pandehurit Bujar Ibishi, që nga koha e kryerjes së veprës penale e deri në këto seanca, se i njëjti vuan nga ndonjë çrregullim psikiatrik, në kohën para apo pas kryerjes së veprës penale. Andaj, kundërshtoj edhe propozimin e mbrojtjes së të pandehurit Bujar, sepse në një aspekt vetëm po zvarritet procedura”, tha Tmava.

Edhe përfaqësuesi i palës së dëmtuar, Fisnik Sogojeva, doli kundër kërkesave për ekspertiza shtesë, duke theksuar se nga ekspertiza ekzistuese rezulton që Hisni Ibishi nuk ka qenë në gjendje tronditjeje në kohën e ngjarjes.

“E kundërshtojmë për faktin se nga ekspertiza e përgatitur nga tre ekspertë, ajo e datës 06.07.2025, në faqen e fundit, pika e parafundit, është sqaruar nga ekspertët se ‘sa i përket ditës kritike, aftësia për të gjykuar veprën, si dhe aftësia për kontrollin e veprimit dhe pasojat e veprimeve apo mosveprimeve të veta nuk ka qenë e afektuar’. Pra, është dhënë sqarim se i njëjti, me rastin e ndërmarrjes së veprimit, nuk ka qenë në gjendje të tronditjes të çfarëdo lloji dhe, për më tepër, në ekzaminimin e drejtpërdrejtë në raportin e ekspertizës sqarohet se i njëjti edhe tani nuk ndjen pendim”. Për Bujar Ibishin, nga procesverbali i seancës së kaluar, propozimi i mbrojtjes së tij ka qenë që të ekzaminohet gjendja shëndetësore e të njëjtit në qendrën e paraburgimit dhe jo ekzaminimi eventual lidhur me ditën kritike. Për më tepër, për të njëjtin, nga raporti dhe provat e dorëzuara më datën 22.05.2026 nga Departamenti Shëndetësor i Burgjeve, sqarohet mjaftueshëm dhe kuptohen ato prova se i njëjti nuk ka shfaqur asnjë rrethanë që do të mund të asociohej se në ditën kritike ka qenë i afektuar, për të mos qenë i vetëdijshëm për veprimin që e ka ndërmarrë”, tha Sogojeva

Sipas prokurorisë, Hisni dhe Bujar Ibishi dyshohen se më 12 shkurt 2025, në një lokal në sheshin “Adem Jashari” në Skenderaj, “të vetëdijshëm për veprimet e tyre dhe me dashje e kanë privuar nga jeta Ismet Ibishin I.I., ashtu që derisa viktima ishte duke pirë kafe në lokal, të pandehurit posa hyjnë brenda i nxjerrin armët dhe shtinë në drejtim të tij ku goditjet rezultojnë vdekjeprurëse”
