This was stated on Thursday during the court hearing held at the Basic Court of Prishtina.

According to prosecutor Bekim Kodraliu, U.S. federal laboratories analyzed mud and soil samples taken from the boots of the accused Jovan Vićentijević, comparing them with soil collected at the crime scene, as well as with samples taken from three other locations, with the aim of confirming the match of the mud.

“Among the evidence that will be presented before you, which we consider to be of particular reliability and importance, is the expert report on soil samples produced by the federal laboratories of the United States of America. FBI experts analyzed the mud and soil samples taken from the boots of the defendant Jovan Vićentijević and compared those samples with soil samples secured at the crime scene, as well as at three other different locations, in order to verify the accuracy of the mud found on the defendant’s boots. The conclusion of the FBI experts established that the samples from the defendant’s boots, unlike those from the three other locations, show no differences in color, structure, mineral composition and other physical characteristics when compared with the soil taken from the crime scene and the soil and mud found on the defendant’s boots. And it will be proven before you that the defendants were direct participants in the terrorist attack,” he said, KosovaPress reports.

He stressed that the FBI experts’ conclusion shows that, unlike the three other locations used for comparison, the samples taken from the defendant’s boots have no differences in color, structure, mineral composition and other physical features compared with the soil taken from the crime scene.

Kodraliu also said this would be supported by reports from examinations of electronic devices, communications between the accused and various individuals, photographs and recordings of KFOR facilities from the inside, as well as materials related to Kosovo’s Special Unit and footage of Vićentijević in Serbian military uniforms.

“This situation will also be proven by the reports from the examination of electronic devices, communications between various persons and the defendants, the photographing and filming of KFOR facilities from inside, the photographing of the base of the Kosovo Police Special Unit in Jasenovik, the photographing and video recording of members of the American KFOR, as well as video recordings and photographs of the defendant Vićentijević in Serbian military uniforms and combat equipment and his participation in their exercises at the training ground we mentioned earlier. All of this documents that the defendants undertook incriminating actions. During the examination of the defendant’s electronic devices, confidential KFOR documents of around 66 pages with the classification level ‘Confidential’ were found. His identification card was also found, confirming that he was a member of the Serbian military intelligence service,” he said, KosovaPress reports.

According to the prosecutor, Vićentijević is specifically responsible for the terrorist attack on the Ibër-Lepenc canal, based on the report of the scientific police service in Rome, which, he said, established that traces of the Serb’s DNA were identified on the detonating fuse of the explosive device found at the crime scene.

“The report of the scientific police service in Rome, specifically the biological examination of DNA samples, will prove without any doubt that the defendant Jovan Vićentijević carried out the terrorist attack, because on the detonating fuse of the explosive found and collected at the crime scene, it has been scientifically confirmed that traces of the DNA of the defendant Jovan Vićentijević were found on that fuse.”

At the hearing held on Thursday at the Basic Court in Prishtina, the two Viqentijeviq brothers and Igor Dimoviq rejected responsibility for damaging the canal, an act which, according to the indictment, was aimed at seriously endangering water and electricity supplies for part of Kosovo and which, it says, was planned in Serbia.

Before Judge Vesel Ismajli, they stated that they understood the contents of the indictment, but pleaded not guilty.

Following these statements, the case prosecutor, Bekim Kodraliu, said he has sufficient evidence which, according to him, proves the opposite of what the Viqentijeviq brothers and Dimoviq claimed.

In his opening statement, he presented material evidence, including footage, which he said supports the indictment and shows beyond dispute the guilt of the three accused.

“This indictment is not just about an ordinary criminal offense. It concerns an organized and well-planned attack against the critical infrastructure of the Republic of Kosovo, infrastructure vital to supplying citizens with drinking water and to the functioning of the country’s energy system. Based on the evidence that will be presented before you, it will be established that on November 29, 2024, the defendants Jovan and Dragisha Viçentijeviq, together with other persons not yet identified, following a prior agreement, placed a considerable quantity of military explosives, around 20 kilograms of TNT, in the Ibër-Lepenc canal, causing serious material damage, interrupting the water supply and seriously endangering electricity supply in part of the country. Therefore, for these actions as well, the prosecution charges the defendants with the criminal offense of endangering the constitutional order, destruction or damage of public installations and equipment, in connection with the criminal offense of committing a terrorist act, in co-perpetration. Likewise, during searches carried out on the defendants’ properties, a large quantity of weapons, ammunition, grenades, military communication devices, military uniforms and other equipment were found and seized, the possession of which was contrary to the law in force. As a result, they are also charged with the criminal offense of unauthorized ownership, control or possession of weapons,” Kodraliu said, KosovaPress reports.

Further, Kodraliu said that the Prosecution will also present investigative findings carried out in cooperation with the FBI of the United States of America, as well as scientific evidence secured by the Italian police.

“Honorable trial panel, the evidence that will be presented during this judicial review consists of: Kosovo Police reports, forensic technician reports, expert analyses of the Kosovo Forensic Agency, DNA analyses, expert assessments by the Federal Bureau of Investigation of the United States of America – FBI, expert assessments by the Scientific Police of the Republic of Italy, with offices in Rome, reports of the competent authorities, explosive analyses including that of American KFOR, analyses of electronic devices, material evidence, documentation secured during the searches, as well as other evidence which, taken together, create an uninterrupted logical chain linked to the facts presented in the indictment,” Kodraliu said, KosovaPress reports.

According to him, the attack on the Ibër-Lepenc canal was not a random or isolated act, but part of an organized, planned and coordinated activity, with the sole aim of striking Kosovo’s critical infrastructure and national security. He added that preparations for this attack were carried out in Serbia, in a place called “Pasuljanske Livade.”

“The prosecution will present evidence before you which, in our assessment, shows that the attack on the Ibër-Lepenc canal represents a continuation of a series of serious attacks that over the past three years have aimed to undermine the legal order and national security. According to the evidence we have secured and will present before you, this attack represents the fourth attack of this nature, following earlier events that directly undermined the country’s institutions and security. The prosecution will also present concrete evidence before you regarding the training and preparations which, according to the evidence, were carried out at the Serbian military training ground called ‘Pasuljanske Livade’ in the Republic of Serbia, where it is now suspected that there was a mass grave. All of this was part of preparations for unlawful activities against the state of the Republic of Kosovo. And from the evidence we have secured, which will be presented before you, and from evidence from earlier cases, it is established that the Serbian government had a key role in these preparations,” he said, KosovaPress writes.

The Ibër-Lepenc canal was damaged by an explosive blast on November 29, 2024, near the village of Varagë in Zubin Potok. The explosion caused major damage to the canal’s structure, putting water supply and the functioning of the energy sector at risk.

After the incident, Kosovo institutions took emergency measures to repair the damage and managed to stabilize the water flow within a short time, avoiding long supply interruptions.

Kosovo authorities described the case as a terrorist attack on critical infrastructure, while the Kosovo Police, in cooperation with the Special Prosecution and international partners, immediately launched investigations to identify the perpetrators and the motives behind the attack. The case was also condemned by Kosovo’s international partners, who called for the incident to be fully clarified and for those responsible to be brought to justice.

Just one day after the attack, Kosovo Police arrested eight people during raids carried out at 10 locations in the north of the country, where weapons, ammunition, explosives, military uniforms and other equipment were seized, while on December 1, 2024, the now-accused Jovan Viçentijeviq was also arrested.

Ekspertizat e Byros Federale të Hetimeve të SHBA-së dhe të Policisë Shkencore të Romës po paraqiten si dëshmi që, sipas akuzës, lidhin tre të pandehurit me sulmin terrorist në kanalin e Ibër-Lepencit.

Kjo u tha të enjten në seancën gjyqësore që u mbajt në Gjykatën Themelore të Prishtinës.

Sipas prokurorit Bekim Kodraliu, laboratorët federalë të Shteteve të Bashkuara kanë analizuar mostrat e baltës dhe dheut të marra nga çizmet e të akuzuarit Jovan Vićentijević, duke i krahasuar ato me dheun e mbledhur në vendin e ngjarjes, si edhe me mostra të marra në tri lokacione të tjera, me synimin për të vërtetuar përputhshmërinë e baltës.

Ekspertët e FBI-së kanë analizuar mostrat e baltës dhe të dheut të marra nga çizmet e të pandehurit Jovan Vićentijević dhe ato mostra i kanë krahasuar me mostrat e dheut të siguruara në vendin e ngjarjes, po ashtu edhe në tre vende të tjera të ndryshme me qëllim që të vërtetohet saktësia e baltës së gjetur në çizmet e të pandehurit. Konkluzioni i ekspertëve të FBI-së ka konstatuar se mostrat e çizmeve të të pandehurit për dallim nga tre vendet e tjera, nuk paraqesin dallime për nga ngjyra, struktura, përbërja minerale dhe karakteristika të tjera fizike të dheut të marrë në vendin e ngjarjes me dheun dhe baltën që është gjetur në çizmet e të pandehurit. E që do të vërtetohet para jush se pandehurit kanë qenë pjesëmarrës të drejtpërdrejtë në sulmin terrorist”, tha ai, raporton KosovaPress.

Ai theksoi se përfundimi i ekspertëve të FBI-së tregon se, ndryshe nga tri vendet e tjera të krahasuara, mostrat e marra nga çizmet e të pandehurit nuk kanë dallime në ngjyrë, strukturë, përbërje minerale dhe veçori të tjera fizike në raport me dheun e marrë në vendin e ngjarjes.

Po ashtu, Kodraliu deklaroi se kjo do të mbështetet edhe nga raportet e ekzaminimit të pajisjeve elektronike, komunikimet mes të akuzuarve dhe personave të ndryshëm, fotografitë dhe incizimet e objekteve të KFOR-it nga brenda, si dhe materialet që lidhen me Njësinë Speciale të Kosovës dhe pamjet e Viçentijeviqit me uniforma ushtarake serbe.

“Kjo gjendje do të vërtetohet edhe nga raportet e ekzaminimit të pajisjeve elektronike, komunikimet në mes personave të ndryshëm dhe të pandehurve, fotografimi dhe incizimi i objekteve të KFOR-it në brendësi të tij, fotografimi i bazës së njësisë speciale të Policisë së Kosovës në Jasenovik, fotografimi dhe video incizimi i pjesëtarëve të KFOR-it amerikan, si dhe video incizime e fotografi të të pandehurit Viçentijeviq me uniforma ushtarake serbe dhe pajisje luftarake e pjesëmarrja në ushtrimet e tyre në poligonin që e potencuam më herët. Sipas prokurorit, përgjegjës për sulmin terrorist në kanalin e Ibër-Lepencit është pikërisht Viçentijeviqi, duke u mbështetur në raportin e shërbimit të policisë shkencore në Romë, i cili, sipas tij, ka konstatuar se në fitilin ndezës të eksplozivit të gjetur në vendin e ngjarjes janë identifikuar gjurmët e ADN-së së serbit.

Jovan Viqentijeviq, Dragisha Viqentijeviq dhe Igor Dimoviq, të arrestuar në lidhje me sulmin ndaj kanalit të Ibër-Lepencit në Varagë të Zubin Potokut më 29 nëntor 2024, kanë deklaruar se nuk kanë faj për veprat penale që u vihen në barrë.

Në seancën e mbajtur të enjten në Gjykatën Themelore në Prishtinë, dy vëllezërit Viqentijeviq dhe Igor Dimoviq hodhën poshtë përgjegjësinë për dëmtimin e kanalit, akt që sipas aktakuzës synonte të rrezikonte rëndë furnizimin me ujë dhe energji elektrike për një pjesë të Kosovës dhe që, sipas saj, ishte planifikuar në Serbi.

Përpara gjykatësit Vesel Ismajli, ata pohuan se e kanë kuptuar përmbajtjen e aktakuzës, por u deklaruan të pafajshëm.

Pas këtyre deklarimeve, prokurori i çështjes, Bekim Kodraliu, tha se disponon prova të mjaftueshme që, sipas tij, dëshmojnë të kundërtën e asaj që pretenduan vëllezërit Viçentijeviq dhe Dimoviq.

Në fjalën hyrëse, ai paraqiti prova materiale, përfshirë edhe pamje, për të cilat u shpreh se mbështesin aktakuzën dhe se tregojnë në mënyrë të pakontestueshme fajësinë e tre të akuzuarve.

“Kjo aktakuzë nuk ka të bëjë vetëm me një vepër të zakonshme penale. Ajo ka të bëjë me një sulm të organizuar dhe të planifikuar mirë kundër infrastrukturës kritike të Republikës së Kosovës, një infrastrukturë jetike për furnizimin e qytetarëve me ujë të pijshëm dhe për funksionimin e sistemit energjetik të vendit. Në bazë të provave që do të administrohen para jush, do të vërtetohet se më datë 29 nëntor 2024, të pandehurit Jovan dhe Dragisha Viçentijeviq, së bashku me persona të tjerë të paidentifikuar ende, pas një marrëveshjeje paraprake, kanë vendosur një sasi të konsiderueshme të eksplozivit ushtarak, rreth 20 kilogramë TNT, në kanalin e Ibër-Lepencit, duke shkaktuar dëmtime të rënda materiale, ndërprerje të furnizimit me ujë dhe duke rrezikuar seriozisht furnizimin me energji elektrike në një pjesë të vendit. Andaj, edhe për këto veprime, prokuroria i ngarkon të pandehurit për veprën penale: rrezikim i rendit kushtetues, shkatërrimi apo dëmtimi i instalimeve dhe pajisjeve publike, lidhur me veprën penale: kryerja e veprës terroriste, në bashkëkryerje. Po ashtu, gjatë kontrolleve të realizuara në pronat e të pandehurve, janë gjetur dhe sekuestruar sasi e madhe e armëve, municione, granata, mjete ushtarake të komunikimit, uniforma ushtarake dhe pajisje të tjera, posedimi i të cilave pra ka qenë në kundërshtim me ligjin në fuqi. E që si pasojë edhe akuzohen për veprën penale mbajtje në pronësi, kontroll apo posedim të paautorizuar të armëve”, tha Kodraliu, raporton KosovaPress.

Më tej, Kodraliu deklaroi se Prokuroria do të sjellë edhe rezultate hetimore të kryera në bashkëpunim me FBI-në e Shteteve të Bashkuara të Amerikës, si dhe prova shkencore të siguruara nga policia italiane.

“I nderuar trup gjykues, provat që do të paraqiten gjatë këtij shqyrtimi gjyqësor përbëhen nga: raportet e Policisë së Kosovës, raportet e teknikës kriminalistike, ekspertizat e Agjencisë së Kosovës për Forenzikë, analizat e ADN-së, ekspertiza e Byrosë Federale të Hetimeve të Shteteve të Bashkuara të Amerikës – FBI, ekspertizat e Policisë Shkencore të Republikës së Italisë, me zyrën në Romë, raportet e organeve kompetente, analizat e eksplozivëve duke përfshirë edhe atë të KFOR-it amerikan, analizat e pajisjeve elektronike, dëshmitë materiale, dokumentacioni i siguruar gjatë kontrolleve, si dhe prova të tjera që në tërësinë e tyre krijojnë një zinxhir logjik të pandërprerë dhe të ndërlidhur me faktet e paraqitura në aktakuzë”, tha Kodraliu, raporton KosovaPress.

Sipas tij, sulmi ndaj kanalit të Ibër-Lepencit nuk ka qenë një akt i rastësishëm apo i izoluar, por pjesë e një veprimtarie të organizuar, të planifikuar dhe të koordinuar, me synim të vetëm goditjen e infrastrukturës kritike dhe sigurisë kombëtare të Kosovës. Ai shtoi se përgatitjet për këtë sulm janë zhvilluar në Serbi, në vendin e quajtur “Livadhet e Fasuleve”.

“Prokuroria para jush do të paraqesë prova që sipas vlerësimit tonë, tregojnë se sulmi në kanalin e Ibër-Lepencit përbën vazhdimësi të një serie sulmesh të rënda që në tre vitet e fundit kanë pasur për objektiv cenimin e rendit juridik dhe sigurinë kombëtare. Sipas provave që kemi siguruar dhe që do të paraqiten para jush, ky sulm paraqet sulmin e katërt të natyrës së tillë. Pas ngjarjeve të mëhershme që kanë cenuar drejtpërsëdrejti institucionet dhe sigurinë e vendit. Gjithashtu, prokuroria para jush do të paraqesë prova konkrete lidhur me trajnimet dhe përgatitjet që sipas provave janë zhvilluar në poligonin ushtarak serb të quajtur ‘Pasuljanske Livade’ në Republikën e Serbisë, ku tashmë po dyshohet se aty ka pasur një varrezë masive. E krejt kjo si pjesë e përgatitjeve të aktiviteteve të kundërligjshme ndaj shtetit të Republikës së Kosovës. E që nga provat që kemi siguruar që do të prezantohen para jush dhe nga provat e rasteve të mëhershme vërtetohet se qeveria serbe ka pasur një rol kyç në këto përgatitje”, tha ai, shkruan KosovaPress.

Kanali i Ibër-Lepencit u dëmtua nga shpërthimi me eksploziv më 29 nëntor 2024, pranë fshatit Varagë të Zubin Potokut. Nga shpërthimi u shkaktuan dëme të mëdha në strukturën e kanalit, duke vënë në rrezik furnizimin me ujë dhe funksionimin e sektorit energjetik.

Pas ngjarjes, institucionet e Kosovës morën masa emergjente për riparimin e dëmeve dhe arritën të stabilizonin rrjedhën e ujit brenda një kohe të shkurtër, duke shmangur ndërprerje të gjata të furnizimit.

Autoritetet kosovare e cilësuan rastin si sulm terrorist ndaj infrastrukturës kritike, ndërsa Policia e Kosovës, në bashkëpunim me Prokurorinë Speciale dhe partnerët ndërkombëtarë, nisën menjëherë hetimet për identifikimin e autorëve dhe motiveve të sulmit. Rasti u dënua edhe nga partnerët ndërkombëtarë të Kosovës, të cilët kërkuan zbardhjen e plotë të ngjarjes dhe nxjerrjen e përgjegjësve para drejtësisë.

Vetëm një ditë pas sulmit, Policia e Kosovës arrestoi tetë persona gjatë bastisjeve të zhvilluara në 10 lokacione në veri të vendit, ku u sekuestruan armë, municione, eksplozivë, uniforma ushtarake dhe pajisje të tjera, ndërsa më 1 dhjetor 2024 u arrestua edhe tani i akuzuari Jovan Viçentijeviq.
