The constituent session of the Assembly, at which the deputy speakers were expected to be voted on, was suspended by Speaker Albulena Haxhiu.

The decision came after the Democratic Party of Kosovo failed to present a new candidate for the post.

In the first vote, LVV lawmakers did not support Vlora Çitaku. Following the result, PDK lawmakers left the chamber, while Mërgim Lushtaku was the only lawmaker from the party who remained inside.

Earlier, PDK lawmakers had voted in favor of LVV candidate Ardian Gola for the position of deputy speaker.

“Under these circumstances, I deem it necessary to suspend the constituent session. We will inform you in due time of the date of the next session,” Haxhiu declared.

Vendimi erdhi pasi Partia Demokratike e Kosovës nuk paraqiti një kandidaturë të re për këtë post.

Në votimin e parë, deputetët e LVV-së nuk e mbështetën Vlora Çitakun. Pas këtij rezultati, deputetët e PDK-së u larguan nga salla, ndërsa Mërgim Lushtaku ishte i vetmi deputet i kësaj partie që qëndroi brenda.

Më herët, deputetët e PDK-së kishin votuar pro kandidatit të LVV-së, Ardian Gola, për detyrën e nënkryetarit.

Kosovo could enter an unclear constitutional situation in less than a month if a new president is not elected by October 4. According to some legal experts, Albulena Haxhiu cannot exercise this function beyond the six-month period.

Haxhiu, who currently serves as acting president, was re-elected as Speaker of the Assembly of Kosovo on September 9. Earlier, the ruling Vetëvendosje Movement had floated the idea that she could continue in this role for a second six-month term, if necessary.

The Presidency has also stated that the new Speaker of the Assembly could continue exercising the duties of the president until a new head of state is elected. Haxhiu has held this responsibility since April 4, when the then-president Vjosa Osmani’s term ended.

However, legal experts consulted by Radio Free Europe say that Haxhiu cannot continue the duty after October 4.

Kosovo’s Constitution stipulates that the post of acting president can be held for a period no longer than six months.

Vullnet Bugaqku, from the Democratic Institute of Kosovo, says that Haxhiu’s mandate as acting president ends on October 4, despite her being re-elected as head of the Assembly.

“After this date, the six-month deadline expires, and legally, the same person does not have the right to also function as acting president, because it is contrary to Article 90, paragraph 3, of the Constitution of Kosovo,” Bugaqku told RFE on Wednesday, after Haxhiu’s re-election as speaker.

According to him, any decree or decision issued by Haxhiu after this deadline would be contestable from a constitutional standpoint and could be overturned by the courts.

Bugaqku called on lawmakers to consider the deadline until October 4 as alarming, within which the country’s president must be elected.

On Wednesday, Haxhiu suspended the constitutive session and announced that it would continue on Friday, aiming to complete the constitution of the Assembly.

She explained that there was no agreement on how to vote for the deputy speakers. Haxhiu also mentioned the fact that the Serbian List MP, Igor Simiq, did not withdraw the phrase “on behalf of the Serbian people” when proposing the candidate for deputy speaker from the Serb community.

Ehat Miftaraj, executive director of the Kosovo Institute for Justice, has another emphasis on this issue. He told RFE that the six-month limitation provided by the Constitution relates to the exercise of the president’s function, not to the individual who holds it.

For this reason, according to Miftaraj, neither the change of the person serving as acting president nor the re-election of the Assembly speaker can create a new six-month deadline.

“Such an interpretation would make it possible, through a change of person, for the state of exercising the president’s duties to continue beyond the six-month limit expressly set by the Constitution,” he stressed.

Bugaqku warned that passing October 4 without electing a new president would constitute “a very bad stain and a dangerous precedent that also harms national security.” According to him, such a development would damage the state and Kosovo’s parliamentary constitutional system.

On October 4, the six-month period during which the Constitution allows the duty of Kosovo’s president to be exercised by a substitute comes to an end.

LVV MP Adnan Rrustemi had earlier told RFE that the position of acting president “is dependent on the position of the Assembly speaker.”

Rrustemi had argued that the new Assembly speaker, once elected, also begins exercising the duties of the president until a new president is elected. According to him, with the election of the new speaker, the six-month deadline set by the Constitution starts anew.

“It is in the spirit and content, but also the function of the Constitution, to guarantee institutional continuity. Never, for any reason, can the country be left without a president or without an acting president. An institutional vacuum cannot exist under any circumstances,” Rrustemi had told RFE.

Eugen Cakolli, a researcher at the Democratic Institute of Kosovo, had earlier taken the stance that the six-month deadline for exercising the president’s duties is absolute and cannot be repeated under any circumstances.

Cakolli has described the failure to elect a new president by October 4 as the most dangerous constitutional scenario Kosovo could face.

“In such a situation, the country would enter constitutional terrain which, besides being serious and dangerous, would inevitably need to be addressed to the Constitutional Court,” he emphasized.

Meanwhile, Melos Kolshi, a legal researcher at the Kosovo Institute for Justice, told RFE that any continuation of the exercise of the president’s duties after October 4 would lack constitutional support and would seriously undermine the constitutional order.

The Albanian opposition parties have not made public statements on this issue. PDK, LDK, and Alliance did not respond to RFE’s questions on this topic.

The election of the president has been at the center of the political crisis in Kosovo and led to the holding of new parliamentary elections in June.

The fragile agreement between LVV and LDK on the candidacy of Kosovar diplomat and jurist Bekim Sejdiu does not seem to have the necessary support. Public objections to it have also been expressed by LDK’s own MPs.

For the vote for Kosovo’s president to be valid, 80 MPs must be present in the 120-seat Assembly.

Kosova mund të hyjë në një situatë të paqartë kushtetuese brenda më pak se një muaji, nëse deri më 4 tetor nuk zgjidhet presidenti i ri. Sipas disa ekspertëve ligjorë, Albulena Haxhiu nuk mund ta ushtrojë këtë funksion përtej afatit gjashtëmujor.

Haxhiu, e cila aktualisht ushtron detyrën e presidentit, u rizgjodh kryetare e Kuvendit të Kosovës më 9 shtator. Më herët, nga Lëvizja Vetëvendosje në pushtet, ishte hedhur ideja se ajo mund të vazhdonte në këtë rol edhe për një mandat të dytë gjashtëmujor, nëse do të lindte nevoja.

Edhe Presidenca ka deklaruar se kryetarja e re e Kuvendit do të mund ta vazhdonte ushtrimin e detyrës së presidentit deri në zgjedhjen e kreut të ri të shtetit. Haxhiu e mban këtë përgjegjësi që nga 4 prilli, kur presidentes së atëhershme, Vjosa Osmani, i përfundoi mandati.

Megjithatë, ekspertët ligjorë të konsultuar nga Radio Evropa e Lirë shprehen se Haxhiu nuk mund ta vazhdojë detyrën pas 4 tetorit.

Kushtetuta e Kosovës përcakton se posti i ushtruesit të detyrës së presidentit mund të mbahet për një periudhë jo më të gjatë se gjashtë muaj.

Vullnet Bugaqku, nga Instituti Demokratik i Kosovës, thotë se mandati i Haxhiut si ushtruese e detyrës së presidentit përfundon më 4 tetor, pavarësisht se ajo u rizgjodh në krye të Kuvendit.

“Pas kësaj date skadon afati i gjashtëmujor dhe ligjërisht i njëjti ose e njëjta nuk ka të drejtë që të funksionojë edhe si ushtrues i detyrës së presidentit, për shkak se është në kundërshtim me nenin 90, paragrafin 3, të Kushtetutës së Kosovës”, deklaroi Bugaqku për REL-in të mërkurën, pas rizgjedhjes së Haxhiut si kryeparlamentare.

Sipas tij, çdo dekret ose vendim i nxjerrë nga Haxhiu pas këtij afati do të ishte i kontestueshëm në aspektin kushtetues dhe mund të rrëzohej nga gjykatat.

Bugaqku u ka bërë thirrje deputetëve ta konsiderojnë si alarmues afatin deri më 4 tetor, brenda të cilit duhet të zgjidhet presidenti i vendit.

Të mërkurën, Haxhiu e pezulloi seancën konstituive dhe njoftoi se ajo do të vazhdonte të premten, me synim përfundimin e konstituimit të Kuvendit.

Ajo shpjegoi se mungonte pajtueshmëria për mënyrën e votimit të nënkryetarëve. Haxhiu përmendi gjithashtu faktin se deputeti i Listës Serbe, Igor Simiq, nuk e tërhoqi shprehjen “në emër të popullit serb” gjatë propozimit të kandidatit për nënkryetar nga komuniteti serb.

Ehat Miftaraj, drejtor ekzekutiv i Institutit të Kosovës për Drejtësi, ka një tjetër theksim lidhur me këtë çështje. Ai tha për REL-in se kufizimi gjashtëmujor i parashikuar nga Kushtetuta lidhet me ushtrimin e funksionit të presidentit dhe jo me individin që e mban atë.

Për këtë arsye, sipas Miftarajt, as ndërrimi i personit që ushtron detyrën e presidentit dhe as rizgjedhja e kryetarit të Kuvendit nuk mund të krijojnë një afat të ri gjashtëmujor.

“Një interpretim i tillë do të mundësonte që, përmes ndryshimit të personit, gjendja e ushtrimit të detyrës së Presidentit të vazhdonte përtej kufirit prej gjashtë muajsh të përcaktuar shprehimisht me Kushtetutë”, theksoi ai.

Bugaqku paralajmëroi se kalimi i 4 tetorit pa zgjedhjen e një presidenti të ri do të përbënte “një njollë shumë të keqe dhe një precedent të rrezikshëm që cenon edhe sigurinë kombëtare”. Sipas tij, një zhvillim i tillë do të dëmtonte shtetin dhe sistemin kushtetues parlamentar të Kosovës.

Më 4 tetor mbyllet periudha gjashtëmujore gjatë së cilës Kushtetuta lejon që detyra e presidentit të Kosovës të ushtrohet nga një zëvendësues.

Deputeti i LVV-së, Adnan Rrustemi, kishte deklaruar më herët për REL-in se pozita e ushtruesit të detyrës së presidentit “është e varur nga pozita e kryetarit të Kuvendit”.

Rrustemi kishte argumentuar se kryetari i ri i Kuvendit, sapo të zgjidhet, nis edhe ushtrimin e detyrës së presidentit deri në zgjedhjen e presidentit të ri. Sipas tij, me zgjedhjen e kryeparlamentarit të ri fillon nga e para edhe afati gjashtëmujor i përcaktuar në Kushtetutë.

“Është në frymën dhe përmbajtjen, por edhe në funksionin e Kushtetutës, që të garantojë vazhdimësi institucionale. Asnjëherë, e për asnjë arsye, vendi nuk mund të mbetet pa president apo pa ushtrues detyre të presidentit. Vakum institucional nuk mund të ketë në asnjë rrethanë”, kishte deklaruar Rrustemi për REL-in.

Eugen Cakolli, hulumtues në Institutin Demokratik të Kosovës, ka mbajtur më herët qëndrimin se afati gjashtëmujor për ushtrimin e detyrës së presidentit është absolut dhe nuk mund të përsëritet në asnjë rrethanë.

Cakolli e ka cilësuar moszgjedhjen e presidentit të ri deri më 4 tetor si skenarin më të rrezikshëm kushtetues me të cilin mund të përballet Kosova.

“Në një situatë të tillë, vendi do të hynte në një terren kushtetues, i cili, përveçse do të ishte serioz dhe i rrezikshëm, do të duhej medoemos të kishte parashtresë në Gjykatën Kushtetuese”, ka theksuar ai.

Ndërkaq, Melos Kolshi, hulumtues ligjor në Institutin e Kosovës për Drejtësi, deklaroi për REL-in se çdo vazhdim i ushtrimit të detyrës së presidentit pas 4 tetorit do të ishte pa mbështetje kushtetuese dhe do ta cenonte rëndë rendin kushtetues.

Partitë opozitare shqiptare nuk kanë bërë deklarata publike për këtë çështje. PDK-ja, LDK-ja dhe Aleanca nuk iu përgjigjën pyetjeve të REL-it lidhur me këtë temë.

Zgjedhja e presidentit ka qenë në qendër të krizës politike në Kosovë dhe ka çuar në mbajtjen e zgjedhjeve të reja parlamentare në qershor.

Marrëveshja e brishtë mes LVV-së dhe LDK-së për kandidaturën e diplomatit dhe juristit kosovar, Bekim Sejdiu, nuk duket se ka mbështetjen e nevojshme. Kundërshtime publike ndaj saj kanë shprehur edhe deputetë të vetë LDK-së.

Që votimi për presidentin e Kosovës të jetë i vlefshëm, në Kuvendin me 120 vende duhet të jenë të pranishëm 80 deputetë.

A debate took place in the Kosovo Assembly between Speaker Albulena Haxhiu and Serb List MP Igor Simiq during the continuation of the constitutive session on Wednesday.

The clash began after Simiq, while proposing Slavko Simiq for the post of deputy speaker from the Serb community, stated that the candidacy was being presented “in the name of the Serbian people.”

Haxhiu objected to the wording, describing it as unacceptable and contrary to the Constitution of the Republic of Kosovo. After the break ended, she requested that the proposal be reformulated in accordance with the Constitution and the Assembly’s Rules of Procedure.

Haxhiu calls for the statement to be withdrawn

“I want to address the statement made by MP Igor Simiq after he was given the floor to present the proposals for deputy speaker from the non-majority Serb community. MP Simiq made an unacceptable statement. Allow me to read it: ‘In the name of the Serbian people, with the signatures of the majority of MPs occupying the reserved seats for the Serb community, nine of the ten MPs, we propose Slavko Simiq as a candidate for deputy speaker,’” Haxhiu said.

She added that the wording was contrary to the Constitution, stressing: “There is a Serbian people in Serbia, whereas the Republic of Kosovo has the people of Kosovo, of whom 92 percent are Albanians, 4 percent are Serbs and 4 percent belong to other non-majority communities.”

Haxhiu asked Simiq to withdraw the statement and present the proposal in accordance with the Constitution of the Republic of Kosovo and the Assembly’s Rules of Procedure.

Simiq: The proposal was made according to the Assembly’s Rules of Procedure

The Serb List MP did not accept the speaker’s request. He argued that the candidacy for deputy speaker from the Serb community had been submitted in the manner prescribed by the Assembly’s rules.

“I understand the game you are playing. In accordance with Article 67 of the Constitution and Article 12, paragraph 6 of the Assembly’s Rules of Procedure, proposals for the deputy speaker concerning the Serb community, as you call it, are made in writing, and you accepted this on the 6th of the 8th month. So the proposal we submitted…” Simiq said.

His speech was interrupted by Haxhiu, who once again asked him to withdraw the statement and continue with a proposal based on the Constitution and the Assembly’s Rules of Procedure.

Haxhiu: Submit the request based on the Constitution

“Honourable MP, please, control room, cut off his microphone. Withdraw your statement first. I ask you to withdraw your statement first and continue with the proposal in accordance with the Assembly’s Rules of Procedure and the Constitution of the Republic of Kosovo. Not the other words; do it according to the request that is based on the Constitution,” Haxhiu said.

Simiq refused to withdraw the statement and continued to insist on his position.

Përplasja nisi pasi Simiq, duke propozuar Sllavko Simiqin për postin e nënkryetarit të Kuvendit nga komuniteti serb, deklaroi se kandidatura po paraqitej “në emër të popullit serb”.

Haxhiu e kundërshtoi këtë formulim, duke e cilësuar të papranueshëm dhe në kundërshtim me Kushtetutën e Republikës së Kosovës. Pas përfundimit të pauzës, ajo kërkoi që propozimi të riformulohej në përputhje me Kushtetutën dhe Rregulloren e Kuvendit.

Haxhiu kërkon tërheqjen e deklaratës

“Dua të ndalem tek deklarimi i deputetit Igor Simiq, pas dhënies së fjalës për propozimet për nënkryetarin e kuvendit nga radhët e komunitetit jo shumicë serb. Deputeti Simiq bëri një deklarim të papranueshëm. Më lejoni t’ju lexoj: ‘Në emër të popullit serb, me nënshkrimet e shumicës së deputetëve që zënë vendet e rezervuara për komunitetin serb, nëntë nga dhjetë deputetët, propozojmë Slavko Simiq si kandidat për nënkryetar kuvendi’”, tha Haxhiu.

Ajo shtoi se ky formulim bie ndesh me Kushtetutën, duke theksuar: “Popull serb ka në Serbi, ndërsa Republika e Kosovës e ka popullin e Kosovës, ku 92 për qind janë shqiptarë, 4 për qind serbë dhe 4 për qind nga komunitetet tjera jo shumicë.”

Haxhiu i kërkoi Simiqit ta tërhiqte deklaratën dhe ta paraqiste propozimin në përputhje me Kushtetutën e Republikës së Kosovës dhe Rregulloren e Kuvendit.

Simiq: Propozimi është bërë sipas Rregullores së Kuvendit

Deputeti i Listës Serbe nuk e pranoi kërkesën e kryetares së Kuvendit. Ai argumentoi se kandidatura për nënkryetarin nga komuniteti serb ishte dorëzuar në mënyrën e parashikuar nga rregullat e Kuvendit.

“E kuptoj lojën të cilën po e luani. Në pajtim me nenin 67 të Kushtetutës dhe nenit 12, pika 6 të Rregullores së Punës së Kuvendit, propozimet për nënkryetarin sa i përket komunitetit serb, siç thoni ju, bëhen në mënyrë të shkruar dhe ju e keni pranuar këtë më datën 6 të muajit 8. Kështu që propozimi që dhamë…”, tha Simiq.

Fjalimi i tij u ndërpre nga Haxhiu, e cila i kërkoi edhe një herë të hiqte dorë nga deklarata dhe të vazhdonte me një propozim të mbështetur në Kushtetutë dhe në Rregulloren e Kuvendit.

Haxhiu: Paraqiteni kërkesën në bazë të Kushtetutës

“I nderuari deputet, ju lutem regjia, ja ndaleni fjalën. Tërhiqeni fjalën paraprakisht. Ju kërkoj të tërhiqni fjalën paraprakisht dhe të vazhdoni me propozimin në përputhje me Rregulloren e Kuvendit dhe në përputhje me Kushtetutën e Republikës së Kosovës. Jo fjalët e tjera, bëjeni sipas kërkesës që është e bazuar në Kushtetutë”, u shpreh Haxhiu.

Simiq refuzoi ta tërhiqte deklaratën dhe vijoi të këmbëngulte në qëndrimin e tij.

Simiq: Jam përfaqësues i popullit serb

“Jam përfaqësues i popullit serb dhe këtë të drejtë ju nuk do të ma merrni. Pra, propozimi me letër që e kemi bërë më…”, deklaroi ai.

Edhe kjo ndërhyrje u ndërpre nga Haxhiu. Pak çaste më vonë, kryetarja ndërpreu tërësisht punimet e seancës, duke thënë se nuk kishte pajtim për zgjedhjen e nënkryetarëve të Kuvendit.

Acting President of Kosovo Albulena Haxhiu met with members of the “Siparantum” choir, who won two gold medals and a special prize in Kuala Lumpur.

In a Facebook post, Haxhiu said the choir competed against more than 200 choral ensembles from different countries, presenting works that convey Albanian music, culture and history.

She also highlighted the role of music by Albanian composers in the repertoire of “Siparantum”, which is being presented to international audiences.

Haxhiu congratulated all the choir members, while expressing particular appreciation for conductor and composer Memli Kelmendi for the work and dedication that have made “Siparantum” known on the international stage.

The acting president wished the choir continued success in honoring Kosovo through its work and achievements.
