After four weeks of fieldwork, assessment excavations and the exhumation of human remains have been completed at three locations confirmed as mass graves in Kalludër and Jabukë, in Zubin Potok.

The Government Commission on Missing Persons announced that human remains belonging to six individuals were found at the third site. As a result, the number of people discovered at the three locations has risen to 23. They are suspected to be victims of enforced disappearance.

During the operation, assessment excavations, exhumations, forensic documentation and inspections of other areas of interest were carried out.

The teams from the Institute of Forensic Medicine and the Police Missing Persons Unit, which operates under the Directorate for the Investigation of War Crimes, as well as other police and security institution units, took part in the activity.

The operation was supported by the Government Commission on Missing Persons and the Government of Kosovo. It was carried out pursuant to an order from the competent court, following a request by the prosecutor handling the case at the War Crimes Department of the Special Prosecution of the Republic of Kosovo. EULEX forensic teams from the Institute of Forensic Medicine also took part in the fieldwork.

Following the completion of the excavations, the materials found will undergo forensic examinations and DNA analyses. These procedures are intended to establish the identities of the victims and enable further steps to be taken, including the official notification of their families.

Kushtrim Gara of the Government Commission on Missing Persons confirmed that work at the sites suspected of containing mass graves had been completed, while warning that identification through DNA analysis would take more time.

“This involved around four weeks of work, from the end of the month until now. The area has now been marked and is among the locations confirmed as mass graves. It can be said that the assessment of the sites and the exhumation of all the human remains have been completed, after which they were sent to the Institute of Forensic Medicine for further forensic examinations, including DNA analyses,” Gara said.

According to him, Kosovo’s institutions will address all matters within their jurisdiction as a priority and with professionalism. Gara explained that the genetic identification process could take time and that, once the DNA report is received, the relevant procedures would be followed. One of the first steps will be to notify the families, but this phase will require time.

The Government Commission on Missing Persons thanked the teams and institutions that took part in the process. It also expressed its gratitude to the families of missing persons and the “Voice of Parents” Families’ Association for their cooperation.

Lawyer Gazmend Halilaj stressed that the discovery of the remains does not mark the end of the institutional work, but opens a new phase of humanitarian, legal and criminal importance. According to him, every human remain, personal item, piece of clothing, trace or other material discovered in these areas may help identify the victims and reconstruct the circumstances of their deaths.

In a statement to the newspaper “Bota sot,” Halilaj said that after the excavations, the site must be fully documented, the remains must undergo professional examination, biological samples must be taken and the preservation of every piece of evidence must be guaranteed without compromising its integrity. He considers DNA analysis one of the most important elements of this phase.

According to the lawyer, comparing the genetic material from the human remains with samples from relatives can establish the victim’s identity with a very high degree of certainty. For families who have been waiting for years or decades, such a result is not merely a scientific and legal conclusion, but also a human right and an opportunity to put an end to uncertainty.

However, Halilaj emphasized that identifying the victim is not the same as finding the perpetrator. DNA can establish whose remains they are, while criminal responsibility requires a link between the victim, the crime scene, the manner of death and the people suspected of the crime.

He stressed that each piece of evidence must be accompanied by a clear chain of custody: the time it was found, the person who collected it, where it was stored, the expert who examined it and the methods used must all be known. Failure to comply with legal and professional standards could create serious challenges to the use of the evidence in criminal proceedings, even if it has significant factual weight. According to him, responsibility for guaranteeing this process lies with the institutions.

Halilaj added that the investigation must also establish the place and time of the killings, the circumstances in which they occurred, the people present, the structures operating in the area and any information that could link a specific individual to the crime.

The Prosecution and Police must ensure that evidence is collected and administered in accordance with the law, while forensic experts and other institutions must ensure the professional examination and preservation of the human and biological materials. Every link in the process is important, as this evidence could also be used many years later in a court proceeding.

If the evidence shows that the deaths resulted from a war crime, identifying the victims will be only the starting point for a broader investigation. In that case, not only the identities must be established, but also the place, time and circumstances of the killings, the people present, the structures operating in the area and the possible links between specific individuals and the criminal offense.

According to Halilaj, every excavation requires a twofold approach: families must be given answers about the fate of their relatives, while every piece of evidence must be used to clarify the circumstances of the crime and determine criminal responsibility.

He pointed out that a mass grave should not be viewed only as a place where human remains are found, but also as a potential crime scene. It may provide information about how the crime was committed, the circumstances of the deaths and, potentially, the perpetrators. The passage of many years does not diminish the value of the evidence, especially in cases of war crimes, where every new element may help complete the history of an event that remains unresolved for families.

The lawyer concluded that justice cannot be based on emotions or assumptions, but on evidence collected, administered and preserved professionally and lawfully. If the materials found are linked to specific people and concrete criminal acts, they may carry decisive weight in criminal proceedings and in determining responsibility. For families, identification represents a step toward the truth, while for justice it should serve as the beginning of a full investigation into the crime.

Komisioni Qeveritar për Persona të Zhdukur ka bërë të ditur se në lokacionin e tretë u gjetën mbetje mortore që u përkasin gjashtë individëve. Si rezultat, numri i personave të zbuluar në të tri lokacionet ka shkuar në 23. Ata dyshohen se janë viktima të zhdukjes me forcë.

Gjatë operacionit u kryen gërmime të karakterit vlerësues, zhvarrosje, dokumentim mjekoligjor dhe shqyrtim i hapësirave të tjera me interes.

Në këtë aktivitet morën pjesë ekipet e Institutit për Mjekësi Ligjore, Sektorit të Policisë për Persona të Zhdukur, i cili funksionon në kuadër të Drejtorisë për Hetimin e Krimeve të Luftës, si dhe njësi të tjera të Policisë dhe institucioneve të sigurisë.

Operacioni u mbështet nga Komisioni Qeveritar për Persona të Zhdukur dhe Qeveria e Kosovës. Ai u zhvillua në zbatim të urdhrit të gjykatës kompetente, pas kërkesës së prokurores së çështjes në Departamentin për Krime Lufte të Prokurorisë Speciale të Republikës së Kosovës. Pjesë e punës në terren ishin edhe ekipet mjekoligjore të EULEX-it, në kuadër të Institutit për Mjekësi Ligjore.

Pas përfundimit të gërmimeve, materialet e gjetura do t’i nënshtrohen ekzaminimeve mjekoligjore dhe analizave të ADN-së. Këto procedura synojnë të përcaktojnë identitetin e viktimave dhe të mundësojnë ndërmarrjen e hapave të mëtejshëm, përfshirë informimin zyrtar të familjeve.

Kushtrim Gara nga Komisioni Qeveritar për Persona të Zhdukur ka konfirmuar se puna në lokacionet e dyshuara për varreza masive ka mbaruar, ndërsa ka paralajmëruar se identifikimi përmes analizave të ADN-së do të kërkojë më shumë kohë.

“Bëhet fjalë për rreth katër javë pune, nga fundi i muajit deri më tani. Hapësira tashmë është shënuar dhe bën pjesë në lokacionet e konfirmuara si varreza masive. Mund të thuhet se ka përfunduar vlerësimi i lokacioneve dhe zhvarrosja e të gjitha mbetjeve mortore, të cilat më pas janë dërguar në IML për ekzaminime të mëtejshme ligjore, përfshirë edhe analizat e ADN-së”, ka deklaruar Gara.

Sipas tij, institucionet e Kosovës do t’i trajtojnë me përparësi dhe profesionalizëm të gjitha çështjet që janë në kompetencën e tyre. Gara ka sqaruar se procesi i identifikimit gjenetik mund të zgjasë dhe se, sapo të pranohet raporti i ADN-së, do të ndiqen procedurat përkatëse. Një nga veprimet e para do të jetë njoftimi i familjeve, por kjo fazë do të kërkojë kohë.

Komisioni Qeveritar për Persona të Zhdukur ka falënderuar ekipet dhe institucionet që morën pjesë në këtë proces. Mirënjohje u është shprehur edhe familjeve të personave të zhdukur dhe Shoqatës së Familjeve “Zëri i Prindërve” për bashkëpunimin.

Avokati Gazmend Halilaj thekson se gjetja e mbetjeve nuk shënon përfundimin e punës institucionale, por hap një fazë të re me rëndësi humanitare, juridike dhe penale. Sipas tij, çdo mbetje mortore, send personal, veshje, gjurmë apo material tjetër i zbuluar në këto zona mund të ndihmojë në identifikimin e viktimave dhe në rindërtimin e rrethanave të vdekjes.

Në një prononcim për gazetën “Bota sot”, Halilaj ka deklaruar se pas gërmimeve duhet të dokumentohet në mënyrë të plotë lokacioni, të kryhet ekzaminimi profesional i mbetjeve, të merren mostrat biologjike dhe të garantohet ruajtja e çdo prove pa cenuar integritetin e saj. Ai e konsideron analizën e ADN-së një prej elementeve më të rëndësishme të kësaj faze.

Sipas avokatit, krahasimi i materialit gjenetik të mbetjeve mortore me mostrat e të afërmve mund të përcaktojë identitetin e viktimës me një shkallë shumë të lartë sigurie. Për familjet që kanë pritur për vite ose dekada, një rezultat i tillë nuk përbën vetëm një përfundim shkencor e juridik, por edhe një të drejtë njerëzore dhe një mundësi për t’i dhënë fund pasigurisë.

Megjithatë, Halilaj nënvizon se identifikimi i viktimës nuk është i barabartë me gjetjen e autorit. ADN-ja mund të përcaktojë se kujt i përkasin mbetjet, ndërsa përgjegjësia penale kërkon lidhjen mes viktimës, vendit të ngjarjes, mënyrës së vdekjes dhe personave të dyshuar për krimin.

Ai ka theksuar se secila provë duhet të shoqërohet nga një zinxhir i qartë ruajtjeje: duhet të dihet koha e gjetjes, personi që e ka marrë, vendi ku është ruajtur, eksperti që e ka ekzaminuar dhe metodat e përdorura. Mosrespektimi i standardeve ligjore e profesionale mund të krijojë kontestime serioze për përdorimin e provës në një procedurë penale, edhe nëse ajo ka peshë të madhe faktike. Përgjegjësia për garantimin e këtij procesi, sipas tij, është institucionale.

Halilaj ka shtuar se hetimi duhet të përcaktojë edhe vendin dhe kohën e vrasjes, rrethanat në të cilat ajo ka ndodhur, personat e pranishëm, strukturat që kanë vepruar në atë zonë dhe çdo të dhënë që mund të lidhë një individ konkret me krimin.

Prokuroria dhe Policia duhet të kujdesen që provat të mblidhen dhe të administrohen në përputhje me ligjin, ndërsa ekspertët e mjekësisë ligjore dhe institucionet e tjera duhet të sigurojnë ekzaminimin dhe ruajtjen profesionale të materialeve mortore e biologjike. Çdo hallkë është e rëndësishme, pasi këto prova mund të përdoren edhe shumë vite më vonë në një proces gjyqësor.

Nëse të dhënat tregojnë se vdekjet kanë ardhur si pasojë e një krimi lufte, identifikimi i viktimave do të jetë vetëm pika e nisjes së një hetimi më të gjerë. Në këtë rast duhet të zbardhen jo vetëm identitetet, por edhe vendi, koha dhe rrethanat e vrasjeve, personat e pranishëm, strukturat vepruese në zonë dhe lidhjet e mundshme të individëve konkretë me veprën penale.

Sipas Halilajt, çdo gërmim kërkon një qasje të dyfishtë: familjeve duhet t’u jepet përgjigje për fatin e të afërmve të tyre, ndërsa çdo provë duhet të përdoret për të sqaruar rrethanat e krimit dhe për të përcaktuar përgjegjësinë penale.

Ai ka vënë në dukje se një varrezë masive nuk duhet parë vetëm si vend ku gjenden mbetje njerëzore, por edhe si një skenë e mundshme krimi. Ajo mund të ofrojë të dhëna për mënyrën e kryerjes së veprës, rrethanat e vdekjes dhe, potencialisht, autorët. Edhe kalimi i shumë viteve nuk ia heq vlerën provave, veçanërisht në rastet e krimeve të luftës, ku çdo element i ri mund të ndihmojë në plotësimin e historisë së një ngjarjeje ende të pazbardhur për familjet.

Avokati përfundon se drejtësia nuk mund të mbështetet te emocionet apo supozimet, por te prova të mbledhura, të administruara dhe të ruajtura në mënyrë profesionale e të ligjshme. Nëse materialet e gjetura lidhen me persona dhe veprime konkrete kriminale, ato mund të kenë peshë vendimtare në procedurat penale dhe në përcaktimin e përgjegjësisë. Për familjet, identifikimi përbën një hap drejt së vërtetës, ndërsa për drejtësinë duhet të shërbejë si fillim i zbardhjes së plotë të krimit.

She assessed that this situation makes it more difficult to create new institutions and reach an agreement.

“Up to now, what I have heard, at least, have been general statements from party representatives, but not at the level of decisions by these parties. I exclude people from the Alliance, which has come out concretely. At the moment of certification of the results, official communication with official positions should begin. In our case it is the leader of the largest party in the coalition, Prime Minister Albin Kurti. In other positions are party leaders, who should present the party’s official position, but also that of the group of deputies they have. Because the situation is a bit more complicated than in past elections, when today from one parliamentary grouping or from one political entity there are two or three positions. This is greatly complicating and will complicate the constitution of institutions or an agreement between the election-winning entity and the other parties,” Kusari said.

He underlined that LVV, as the winner of the elections, has the duty to hold talks with all parliamentary entities, while the other parties must also place the interest of the state above party calculations.

In the June 7 elections, the Vetëvendosje Movement, in a pre-election coalition with Guxo and Alternativa, came first with 47.13% and 53 seats. The Democratic Party of Kosovo won 19.44% and 22 seats, the Democratic League of Kosovo 16.69% and 18 seats, while the Alliance won 6.74% and seven seats.

Më 6 korrik, Komisioni Qendror i Zgjedhjeve pritet të certifikojë rezultatet e zgjedhjeve të 7 qershorit, ndërsa deri në atë moment nuk priten bisedime ndërmjet subjekteve politike për zgjedhjen e presidentit të ri të Kosovës dhe ngritjen e institucioneve.

Kryeministri në detyrë dhe lideri i partisë fituese, Albin Kurti, deklaroi sot për media se aktualisht po pritet përfundimi i procesit të certifikimit të rezultateve dhe shqyrtimi i ankesave.

Ai theksoi se vetëm pas këtij hapi do të nisin diskutimet e nevojshme politike.

“Së pari duhet ta presim certifikimin e rezultateve të zgjedhjeve, dhe trajtimin e ankesave dhe pastaj pa humbur kohë do të kemi komunikimet dhe diskutimet e nevojshme”, ka thënë Kurti.

Nga ana tjetër, ministrja në detyrë e Tregtisë, Mimoza Kusari-Lila, vlerëson se partinë fituese dhe partitë e tjera i presin bisedime të vështira.

Në rastin tonë është drejtuesi i partisë më të madhe të koalicionit, kryeministri Albin Kurti. Në pozicione të tjera janë kryetarët e partive, të cilët do të duhej të prezantonin qëndrimin zyrtar të partisë, por edhe të grupit të deputetëve që ata kanë. Për shkak se është situata pak më e komplikuar sesa në zgjedhjet e kaluara, kur sot nga një grupim parlamentar ose nga një subjekt politik ka dy-tri qëndrime. Kjo po se po e vështirëson shumë edhe do ta vështirësojë konstituimin e institucioneve apo një dakordim në mes të subjektit fitues të zgjedhjeve dhe partive tjera”, u shpreh Kusari.

Duke qenë fituese e zgjedhjeve, LVV ka përgjegjësinë të zhvillojë bisedime me të gjitha subjektet parlamentare, ndërsa edhe partitë e tjera kanë përgjegjësi që interesin shtetëror ta vendosin mbi kalkulimet partiake. Sipas tij, problemi kryesor qëndron te mungesa e gatishmërisë së disa partive për të bashkëpunuar me fituesin e zgjedhjeve.

Halilaj paralajmëroi se, nëse në javët e para pas certifikimit nuk arrihet një marrëveshje politike, vendi mund të përballet me zvarritje në konstituimin e institucioneve.

“Pengesa kryesore mbetet mungesa e gatishmërisë së disa partive për të bashkëpunuar me fituesin e zgjedhjeve, si dhe dallimet në programet politike dhe kërkesat për ndarjen e përgjegjësive institucionale. Megjithatë, presioni qytetar për stabilitet dhe funksionalizim të institucioneve pritet të ndikojë që palët të reflektojnë. Nëse një marrëveshje politike nuk arrihet në javët e para pas certifikimit, vendi rrezikon të përballet me vonesa në konstituimin e institucioneve, në miratimin e vendimeve të rëndësishme dhe në avancimin e proceseve zhvillimore e integruese. Një situatë e tillë do të krijonte pasiguri politike dhe institucionale, por njëkohësisht do të shtonte pritjet që subjektet politike të tregojnë pjekuri dhe përgjegjësi. Në këtë kontekst, LVV ka mundësinë të dëshmojë se është e gatshme të ndërtojë ura bashkëpunimi mbi bazën e programit, interesit publik dhe respektimit të vullnetit të qytetarëve, duke synuar krijimin e një qeverie stabile dhe efektive”, shton anëtari.
