Serbian President Aleksandar Vučić has sent a letter to NATO Secretary General Mark Rutte, asking KFOR to prevent the opening of the Ibër Bridge in Mitrovica.

The Serbian president’s appeal has reopened discussions about freedom of movement, security in northern Kosovo and the KFOR mission in this part of the country.

Austrian expert Gunther Fehlinger, speaking to “Bota sot,” described Vučić’s request as politically misguided and strategically damaging.

Fehlinger says Kosovo cannot continue indefinitely to have physical obstacles dividing parts of its territory.

“President Vučić’s request that NATO stop the opening of the Ibër Bridge is politically misguided and strategically counterproductive.

A bridge should serve to bring people closer together, not keep them divided. Movement between North Mitrovica and South Mitrovica should be an ordinary European reality. Kosovo cannot keep internal physical barriers forever simply because Belgrade objects to Kosovo’s institutions exercising their responsibilities within its territory.”

According to the Austrian expert, concerns related to the security of the Serbian community must be addressed seriously, but they cannot be used to block the opening of the bridge indefinitely.

“The security of the local Serbian community must absolutely be taken into consideration. The opening process should be carried out in careful coordination with KFOR, the Kosovo Police, the municipalities and representatives of all communities. However, consultations cannot become a permanent Serbian veto over Kosovo’s internal infrastructure.

This latest intervention also places Vučić’s recent pro-Ukrainian appearance alongside President Zelenskyy in a different perspective. In my view, the photographs and diplomatic gestures toward Ukraine increasingly look like political theater when accompanied by policies toward Kosovo that continue the old logic of pressure, obstruction and territorial influence.”

Referring to the Ibër River and infrastructure issues in this area, Fehlinger stressed that they should not be turned into tools for political confrontation.

He underlined that NATO should listen to reasonable security concerns, but should not accept Belgrade’s request to preserve a permanent division.

“The same approach should apply to the dispute surrounding the Ibër water system. Water, bridges and infrastructure should never be used as tools of political confrontation. Instead of turning the Ibër issue into another arena of confrontation over sovereignty, Belgrade should cooperate with Kosovo on water security and regional infrastructure.

Vučić was part of Slobodan Milošević’s political system and during that period served as Serbia’s information minister. Serbia should have abandoned that political culture long ago. But demands to keep Mitrovica physically divided and the repeated confrontations around the Ibër inevitably bring back memories of the doctrine of the Milošević era, which was based on pressure, division and perpetual crisis.

This is not a European Serbia.

NATO should take legitimate security concerns into consideration, but it should not accept Belgrade’s political demand for permanent division. KFOR was created to guarantee security and stability, not to institutionalize division forever.”

Fehlinger says the solution he supports is clear: the Ibër Bridge should be opened, while the security and rights of all communities should be protected.

“My position is clear:

Open the Ibër Bridge. Ensure protection for every Serb and every Albanian. Protect minority rights and religious sites. Guarantee freedom of movement. Secure Kosovo’s water infrastructure. Oppose violence from all sides. Reject the politics of perpetual crisis. And do not accept Belgrade’s claim to have a veto over Kosovo’s sovereign internal affairs.

If President Vučić genuinely wants to demonstrate that Serbia has chosen Europe, Ukraine and peace over the political legacy of the Milošević era, he must show this through policies and not through photo opportunities. Mitrovica’s future must not be another generation of division. It should be an open European city, in a peaceful Kosovo integrated into NATO, the European Union and the Euro-Atlantic community,” Gunther Fehlinger concluded to “Bota sot.”

Presidenti i Serbisë, Aleksandar Vuçiq, i ka dërguar një letër sekretarit të përgjithshëm të NATO-s, Mark Rutte, përmes së cilës kërkon që KFOR-i të pengojë hapjen e Urës së Ibrit në Mitrovicë.

Apeli i presidentit serb ka rihapur diskutimet mbi lëvizjen e lirë, sigurinë në veri të Kosovës dhe misionin e KFOR-it në këtë pjesë të vendit.

Eksperti austriak Gunther Fehlinger, në një prononcim për “Bota sot”, e cilëson kërkesën e Vuçiqit si të gabuar në aspektin politik dhe të dëmshme në planin strategjik.

Fehlinger thotë se Kosova nuk mund të vazhdojë pafundësisht të ketë pengesa fizike që ndajnë pjesë të territorit të saj.

“Kërkesa e Presidentit Vuçiq që NATO të ndalojë hapjen e Urës së Ibrit është politikisht e gabuar dhe strategjikisht kundërproduktive.

Një urë duhet të shërbejë për të afruar njerëzit, jo për t’i mbajtur ata të ndarë. Lëvizja mes Mitrovicës së Veriut dhe asaj të Jugut duhet të jetë një realitet i zakonshëm evropian. Kosova nuk mund të mbajë përgjithmonë barriera të brendshme fizike vetëm sepse Beogradi kundërshton ushtrimin e përgjegjësive nga institucionet e Kosovës brenda territorit të saj”.

Sipas ekspertit austriak, shqetësimet që lidhen me sigurinë e komunitetit serb duhen trajtuar me seriozitet, por nuk mund të përdoren për ta bllokuar për një kohë të pacaktuar hapjen e urës.

“Siguria e komunitetit lokal serb duhet patjetër të merret në konsideratë. Procesi i hapjes duhet të zhvillohet në bashkërendim të kujdesshëm me KFOR-in, Policinë e Kosovës, komunat dhe përfaqësuesit e të gjitha komuniteteve. Megjithatë, konsultimet nuk mund të shndërrohen në një veto të përhershme serbe ndaj infrastrukturës së brendshme të Kosovës.

Kjo ndërhyrje e fundit e vendos gjithashtu në një këndvështrim tjetër paraqitjen e fundit pro-ukrainase të Vuçiqit pranë Presidentit Zelenskyy. Sipas mendimit tim, fotografitë dhe gjestet diplomatike në drejtim të Ukrainës po duken gjithnjë e më shumë si teatër politik, kur shoqërohen me politika ndaj Kosovës që vijojnë logjikën e vjetër të presionit, pengesave dhe ndikimit territorial”.

Duke iu referuar lumit Ibër dhe çështjeve të infrastrukturës në këtë zonë, Fehlinger thekson se ato nuk duhet të kthehen në mjete për përplasjen politike.

Ai nënvizon se NATO duhet të dëgjojë shqetësimet e arsyeshme për sigurinë, por nuk duhet të pranojë kërkesën e Beogradit për ruajtjen e një ndarjeje të përhershme.

“E njëjta qasje duhet të vlejë edhe për mosmarrëveshjen rreth sistemit të ujit të Ibrit. Uji, urat dhe infrastruktura nuk duhet të përdoren asnjëherë si mjete të konfrontimit politik. Në vend që ta shndërrojë çështjen e Ibrit në një tjetër fushë përplasjeje mbi sovranitetin, Beogradi duhet të bashkëpunojë me Kosovën për sigurinë e ujit dhe infrastrukturën rajonale.

Vuçiq ishte pjesë e sistemit politik të Slobodan Millosheviqit dhe gjatë asaj periudhe shërbeu si ministër i informacionit i Serbisë. Serbia duhet ta kishte braktisur shumë kohë më parë atë kulturë politike. Por kërkesat për ta mbajtur Mitrovicën të ndarë fizikisht dhe përplasjet e përsëritura rreth Ibrit rikthejnë në mënyrë të pashmangshme kujtimet e doktrinës së epokës së Millosheviqit, e cila bazohej te presioni, përçarja dhe kriza e vazhdueshme.

Kjo nuk është Serbia Europiane.

NATO duhet të marrë në konsideratë shqetësimet legjitime të sigurisë, por nuk duhet të pranojë kërkesën politike të Beogradit për ndarje të përhershme. KFOR-i është krijuar për të garantuar sigurinë dhe stabilitetin, jo për ta institucionalizuar ndarjen përgjithmonë”.

Fehlinger shprehet se zgjidhja që ai mbështet është e qartë: Ura e Ibrit duhet të hapet, ndërsa siguria dhe të drejtat e të gjitha komuniteteve duhet të mbrohen.

“Qëndrimi im është i qartë:

Hapeni Urën e Ibrit. Siguroni mbrojtje për çdo serb dhe çdo shqiptar. Mbroni të drejtat e pakicave dhe vendet fetare. Garantoni lirinë e lëvizjes. Siguroni infrastrukturën ujore të Kosovës. Kundërshtoni dhunën nga çdo anë. Refuzoni politikën e krizës së përhershme. Dhe mos pranoni pretendimin e Beogradit për të pasur veto mbi çështjet e brendshme sovrane të Kosovës.

Nëse Presidenti Vuçiq dëshiron të dëshmojë realisht se Serbia ka zgjedhur Evropën, Ukrainën dhe paqen në vend të trashëgimisë politike të epokës së Millosheviqit, këtë duhet ta tregojë përmes politikave dhe jo përmes mundësive për fotografi. E ardhmja e Mitrovicës nuk duhet të jetë një tjetër brez ndarjeje. Ajo duhet të jetë një qytet i hapur evropian, në një Kosovë paqësore, të integruar në NATO, Bashkimin Evropian dhe komunitetin euroatlantik”, përfundoi Gunther Fehlinger për “Bota sot”.

Following the initial discoveries, Kosovo’s justice authorities launched forensic examinations and DNA analyses. These procedures are intended to identify the victims and determine the circumstances of their deaths, giving families who have been searching for decades an opportunity to learn what happened to their missing relatives.

The case has renewed attention on mass graves, as well as the need for greater interinstitutional cooperation in locating suspected sites and shedding light on war crimes.

Commenting on these developments, Austrian expert Gunther Fehlinger told “Bota sot” that the discovery of human remains at several locations in Zubin Potok was extremely important for Kosovo, the families of missing persons and the investigation of unresolved war crimes.

According to him, these findings must be handled with dignity, full forensic professionalism and legal care. He stressed that DNA analyses must establish the identity of each victim, while prosecutors must determine the time, circumstances and responsibility for each death.

Fehlinger warned that until these procedures are completed, no claim regarding the victims’ identities or specific perpetrators should be presented as conclusive. According to him, identification and the determination of responsibility must be based solely on accurate evidence and adherence to legal and forensic standards.

The expert also said the findings show that previously unknown grave sites can still be discovered 27 years after the end of the war, thanks to new testimony, forensic investigations and the professional work of institutions.

According to him, each identified site could provide answers to families who have been waiting for decades. At the same time, the locations may preserve evidence of abductions, executions, the concealment of bodies and attempts to obstruct justice.

Fehlinger said the success of the investigations cannot be judged solely by the number of remains discovered. The assessment must also include the preservation of crime scenes, identification through DNA, maintenance of the chain of evidence, witness interviews and the investigation of people who may have ordered, committed or concealed the crimes.

According to the Austrian expert, the discoveries in Zubin Potok add further weight to the Declaration on Missing Persons, adopted during the Kosovo-Serbia dialogue in 2023. The document provides for cooperation in clarifying the fate of missing persons and exchanging relevant information.

He called on the European Union to insist on the agreement’s full implementation. According to Fehlinger, Serbia must provide unrestricted access to military, police, municipal, state and security service archives related to the wartime period.

He also called for the release of operational documents, transport records, information about burials and any material related to primary, secondary or concealed graves. Fehlinger stressed that cooperation on missing persons must not remain merely a symbolic item in the Brussels dialogue.

He said the EU should make Serbia’s progress toward membership, as well as the political and financial benefits associated with that process, conditional on measurable cooperation regarding missing persons and the provision of evidence concerning war crimes.

Addressing the impact the findings could have on war crimes trials, Fehlinger said forensic evidence could strengthen criminal cases. It could help identify victims and establish their number, document patterns of crimes and create links between different locations.

However, he explained that in every court proceeding, the link between the crime and the accused must be proven individually. Delays in DNA identification could slow investigations and trials, while successful identification could strengthen cases, correct the historical record and give families the truth they have sought for so long.

In conclusion, the expert called for the fate of missing persons not to be turned into a tool for political confrontation or interethnic tensions. He stressed that every victim, regardless of their background, has the right to be identified, treated with dignity and given justice.

Fehlinger said the families had waited far too long and that Kosovo’s institutions, Serbia, the European Union, EULEX, the International Committee of the Red Cross and all responsible institutions must continue cooperating until the fate of every missing person is clarified.

In his closing statement to “Bota sot,” Gunther Fehlinger stressed that long-term normalization between Kosovo and Serbia cannot be achieved without the truth about the missing, accountability for war crimes and the full identification of the sites where victims were buried.

Pas zbulimeve fillestare, organet e drejtësisë në Kosovë kanë filluar ekzaminimet mjeko-ligjore dhe analizat e ADN-së. Këto procedura synojnë identifikimin e viktimave dhe përcaktimin e rrethanave të vdekjes së tyre, duke u dhënë mundësinë familjeve që kërkojnë prej dekadash të mësojnë çfarë u ka ndodhur të afërmve të zhdukur.

Rasti ka rikthyer vëmendjen te varrezat masive, si dhe te domosdoshmëria për më shumë bashkëpunim ndërinstitucional në gjetjen e vendeve të dyshuara dhe ndriçimin e krimeve të luftës.

Lidhur me këto zhvillime, eksperti austriak Gunther Fehlinger foli për “Bota sot”, duke e cilësuar zbulimin e mbetjeve njerëzore në disa lokacione të Zubin Potokut si jashtëzakonisht të rëndësishëm për Kosovën, familjarët e të zhdukurve dhe hetimin e krimeve të pazgjidhura të luftës.

Sipas tij, trajtimi i këtyre gjetjeve duhet të bëhet me dinjitet, profesionalizëm të plotë forenzik dhe kujdes juridik. Ai theksoi se analizat e ADN-së duhet të vërtetojnë identitetin e secilës viktimë, ndërsa prokurorëve u takon të përcaktojnë kohën, rrethanat dhe përgjegjësinë për çdo vdekje.

Fehlinger paralajmëroi se, derisa këto procedura të përmbyllen, asnjë pretendim për identitetin e viktimave apo për autorë konkretë nuk duhet të paraqitet si përfundimtar. Sipas tij, identifikimi dhe përcaktimi i përgjegjësive duhet të mbështeten vetëm në prova të sakta dhe në respektimin e standardeve ligjore e forenzike.

Eksperti vlerësoi gjithashtu se gjetjet tregojnë se lokacione varrezash të panjohura mund të zbulohen edhe 27 vjet pas përfundimit të luftës, falë dëshmive të reja, hetimeve forenzike dhe punës profesionale të institucioneve.

Çdo vend i identifikuar, sipas tij, mund t’u sjellë përgjigje familjeve që presin prej dekadash. Në të njëjtën kohë, lokacionet mund të ruajnë dëshmi për rrëmbime, ekzekutime, fshehje trupash dhe tentativa për ta penguar drejtësinë.

Fehlinger tha se suksesi i hetimeve nuk mund të gjykohet vetëm nga numri i mbetjeve të zbuluara. Vlerësimi duhet të përfshijë edhe ruajtjen e vendngjarjeve, identifikimin përmes ADN-së, sigurimin e zinxhirit të provave, intervistimin e dëshmitarëve dhe hetimin e personave që mund t’i kenë urdhëruar, kryer ose fshehur krimet.

Sipas ekspertit austriak, zbulimet në Zubin Potok ia shtojnë peshën Deklaratës për Personat e Zhdukur, të miratuar gjatë dialogut Kosovë-Serbi në vitin 2023. Ky dokument parashikon bashkëpunim për sqarimin e fatit të të zhdukurve dhe shkëmbimin e informatave përkatëse.

Ai kërkoi që Bashkimi Evropian të këmbëngulë për zbatimin e plotë të marrëveshjes. Serbia, sipas Fehlingerit, duhet të mundësojë qasje pa kufizime në arkivat ushtarake, policore, komunale, shtetërore dhe të shërbimeve të sigurisë që lidhen me periudhën e luftës.

Po ashtu, ai kërkoi publikimin e dokumenteve operative, të dhënave të transportit, informatave mbi varrosjet dhe çdo materiali që lidhet me varreza primare, sekondare ose të fshehura. Fehlinger nënvizoi se bashkëpunimi për personat e zhdukur nuk duhet të mbetet thjesht një pikë simbolike në dialogun e Brukselit.

Ai vlerësoi se BE-ja duhet ta kushtëzojë përparimin e Serbisë drejt anëtarësimit, si dhe përfitimet politike e financiare të lidhura me këtë proces, me bashkëpunimin e saj të matshëm për personat e zhdukur dhe sigurimin e provave për krimet e luftës.

Duke trajtuar ndikimin që gjetjet mund të kenë në gjykimet për krime lufte, Fehlinger tha se dëshmitë forenzike mund t’i fuqizojnë çështjet penale. Ato mund të shërbejnë për identifikimin dhe përcaktimin e numrit të viktimave, evidentimin e modeleve të krimeve dhe krijimin e lidhjeve ndërmjet lokacioneve të ndryshme.

Megjithatë, ai sqaroi se në çdo proces gjyqësor duhet të provohet individualisht lidhja ndërmjet krimit dhe personit të akuzuar. Fehlinger tha se familjet kanë pritur tepër gjatë dhe se institucionet e Kosovës, Serbia, Bashkimi Evropian, EULEX-i, Komiteti Ndërkombëtar i Kryqit të Kuq dhe të gjitha institucionet përgjegjëse duhet të vazhdojnë bashkëpunimin derisa të sqarohet fati i secilit person të zhdukur.

Në deklaratën përmbyllëse për “Bota sot”, Gunther Fehlinger theksoi se normalizimi afatgjatë ndërmjet Kosovës dhe Serbisë nuk mund të arrihet pa të vërtetën për të zhdukurit, pa përgjegjësi për krimet e luftës dhe pa identifikimin e plotë të vendeve ku janë varrosur viktimat.

Delays in identification through DNA may prolong investigations and trials, while successful identification can strengthen criminal cases, correct the historical record and give families the truth they have sought for so long,” he said.

In conclusion, the Austrian expert called for the issue of missing persons not to be turned into a tool for political clashes or interethnic tensions. He stressed that every victim, regardless of their background, has the right to identification, dignity and justice.

Fehlinger e ka cilësuar zbulimin e mbetjeve njerëzore në disa lokacione të Zubin Potokut si një ngjarje me rëndësi jashtëzakonisht të madhe për Kosovën, familjet e të zhdukurve dhe hetimin e krimeve të luftës që ende nuk janë zbardhur.

Sipas tij, procedurat duhet të zhvillohen me profesionalizëm maksimal, në përputhje me ligjin dhe standardet forenzike. Vetëm në këtë mënyrë identifikimi i viktimave dhe përcaktimi i përgjegjësive mund të mbështeten në prova të sakta.

“Zbulimi i mbetjeve njerëzore në disa lokacione në Zubin Potok përbën një zhvillim jashtëzakonisht të rëndësishëm për Kosovën, familjet e personave të zhdukur dhe hetimin e krimeve të pazbardhura të kryera gjatë luftës së viteve 1998-1999.

Këto gjetje duhet të trajtohen fillimisht me dinjitet, profesionalizëm forenzik dhe kujdes të plotë ligjor. Përmes ADN-së duhet të përcaktohet identiteti i çdo viktime, ndërsa prokurorët duhet të sqarojnë kohën, rrethanat dhe përgjegjësinë për secilën vdekje. Deri në mbylljen e këtij procesi, asnjë përfundim për viktima apo autorë të caktuar nuk duhet të konsiderohet fakt i përfunduar”.

Fehlinger ka theksuar gjithashtu se, edhe 27 vjet pas përfundimit të luftës, dëshmi të reja, puna profesionale e institucioneve dhe hetimet forenzike mund të çojnë në zbulimin e varrezave të panjohura.

Çdo lokacion i identifikuar, sipas tij, mund t’u sjellë përgjigje familjeve që kanë pritur për dekada, por mund të zbulojë njëkohësisht prova për rrëmbime, ekzekutime, fshehje trupash dhe përpjekje për pengimin e drejtësisë.

“Suksesi i hetimeve nuk duhet të matet vetëm nga numri i mbetjeve të gjetura. Duhet të vlerësohet edhe mënyra e ruajtjes së vendngjarjeve, identifikimi i viktimave përmes ADN-së, garantimi i zinxhirit të provave, marrja në pyetje e dëshmitarëve dhe hetimi i personave që kanë urdhëruar, kryer ose fshehur këto krime”, është shprehur eksperti austriak.

Sipas tij, zbulimet në Zubin Potok e bëjnë edhe më të rëndësishme Deklaratën për Personat e Zhdukur, të miratuar në kuadër të dialogut Kosovë-Serbi në vitin 2023. Ky dokument parashikon bashkëpunim për zbardhjen e fatit të të zhdukurve dhe shkëmbimin e informacioneve përkatëse.

“Bashkimi Evropian duhet të kërkojë zbatimin e plotë të kësaj marrëveshjeje. Serbia duhet të garantojë qasje të pakufizuar në arkivat ushtarake, policore, të shërbimeve të sigurisë, komunale dhe shtetërore të periudhës së luftës. Duhet të bëhen publike dokumentet operative, të dhënat për transportet, informacionet mbi varrosjet dhe çdo material që lidhet me varrezat primare, sekondare ose të fshehura.

Bashkëpunimi për personat e zhdukur nuk mund të mbetet thjesht një element simbolik i dialogut të Brukselit”, ka deklaruar Fehlinger.

Eksperti konsideron se Bashkimi Evropian duhet ta kushtëzojë procesin e anëtarësimit të Serbisë, si dhe përfitimet politike e financiare që lidhen me të, me bashkëpunimin e matshëm të këtij shteti për personat e zhdukur dhe provat e krimeve të luftës.

Duke analizuar ndikimin e zbulimeve në proceset gjyqësore për krimet e luftës, Fehlinger ka thënë se provat forenzike mund të forcojnë rastet penale. Ato mund të ndihmojnë në identifikimin e viktimave, përcaktimin e numrit të tyre, evidentimin e modeleve të krimeve dhe lidhjen mes lokacioneve të ndryshme.

“Në çdo proces gjyqësor duhet të krijohet lidhje individuale e provave ndërmjet krimit dhe të akuzuarit. Vonesat në identifikimin përmes ADN-së mund të zvarrisin hetimet dhe gjykimet, ndërsa identifikimi i suksesshëm mund t’i forcojë çështjet penale, të korrigjojë të dhënat historike dhe t’u japë familjeve të vërtetën që e kanë kërkuar për një kohë kaq të gjatë”, ka thënë ai.

Në përfundim, eksperti austriak ka kërkuar që çështja e të zhdukurve të mos shndërrohet në mjet për përplasje politike apo tensione ndëretnike. Ai ka nënvizuar se çdo viktimë, pavarësisht përkatësisë, gëzon të drejtën për identifikim, dinjitet dhe drejtësi.

“Familjet e personave të zhdukur kanë pritur për një kohë tepër të gjatë. Institucionet e Kosovës, Serbia, Bashkimi Evropian, EULEX-i, Komiteti Ndërkombëtar i Kryqit të Kuq dhe të gjitha strukturat përgjegjëse duhet të bashkëpunojnë deri në zbardhjen e fatit të çdo personi të zhdukur.

Nuk mund të ketë normalizim afatgjatë ndërmjet Kosovës dhe Serbisë pa të vërtetën për personat e zhdukur, pa përgjegjësi për krimet e luftës dhe pa zbardhjen e plotë të lokacioneve ku janë varrosur viktimat”, ka përfunduar Gunther Fehlinger për “Bota sot”.

The discovery of human remains at several sites in Zubin Potok, which are suspected of belonging to victims of the last war in Kosovo, could help clarify the fate of missing persons and aid investigations into unresolved crimes from the 1998-1999 period.

Following the discovery of the remains, Kosovo’s justice institutions have begun forensic examinations and DNA analyses. The aim is to identify the victims and determine the circumstances of their deaths, a process that could provide answers to the families of missing persons, who have waited for decades to learn the truth about their loved ones.

The latest discoveries have brought renewed attention to the issue of mass graves and the need for greater institutional commitment to locating suspected sites and documenting war crimes.

Austrian expert Gunther Fehlinger spoke to “Bota sot” about the significance of this development.

Fehlinger considers the discovery of human remains at several locations in Zubin Potok to be an event of particular importance for Kosovo, the families of the missing, and efforts to investigate war crimes that remain unresolved.

According to him, the work must be carried out to high professional standards, in compliance with the law and the rules of forensic medicine. Only in this way can the victims’ identities and potential responsibility be accurately established on the basis of verifiable evidence.

“The discovery of human remains at various locations in Zubin Potok represents an exceptionally important development for Kosovo, the families of missing persons, and the investigation of unresolved crimes committed during the 1998-1999 war.

The findings must be handled with dignity, forensic professionalism, and full legal care. DNA analysis must be used to establish the identity of each victim, while prosecutors must investigate the timing, circumstances, and responsibility for each death. Before these procedures are completed, the identities of the victims or possible perpetrators should not be presented as confirmed facts,” he said.

The Austrian expert stresses that, even 27 years after the end of the war, new evidence, institutional work, and forensic investigations can lead to the discovery of unknown graves.

According to him, each identified location could bring long-awaited answers to families, but it could also contain evidence related to abductions, executions, the concealment of bodies, and attempts to obstruct justice.

“The success of the investigation should not be measured solely by the number of remains found. Consideration must also be given to how the crime scenes are preserved, the identification of victims through DNA, the safeguarding of the chain of custody, the questioning of witnesses, and the identification of those who ordered, committed, or concealed these crimes,” Fehlinger said.

He emphasizes that the developments in Zubin Potok make the Declaration on Missing Persons, adopted as part of the Kosovo-Serbia dialogue in 2023, even more important. The document provides for cooperation in locating missing persons and exchanging relevant information.

“The European Union must demand the full implementation of this agreement. Serbia must allow unrestricted access to military, police, security service, municipal, and state archives relating to the wartime period. Operational documents, transport records, information on burials, and any material related to primary, secondary, or concealed graves must be made available.

The issue of missing persons cannot be treated merely as a symbolic element of the Brussels dialogue,” Fehlinger said.

According to him, the EU should link Serbia’s concrete cooperation on missing persons and evidence of war crimes to its path toward membership in the European Union, as well as to the political and financial benefits stemming from that process.

Assessing the impact of the discoveries on war crimes proceedings, Fehlinger said forensic evidence could strengthen criminal cases. It could help identify the victims, determine their number, establish patterns of crimes, and create links between different locations.

“In every trial, an individual evidentiary link must be established between the criminal offense and the accused. Delays in DNA identification can prolong investigations and court proceedings, while successful identification can consolidate cases, correct the historical record, and give families the truth they have sought for many years,” the expert said.

In conclusion, he called for the issue of missing persons not to be turned into a tool for political confrontation or interethnic tensions. Fehlinger stressed that every victim, regardless of their background, deserves identification, dignity, and justice.

“The families of the missing have waited far too long. The institutions of Kosovo and Serbia, the European Union, EULEX, the International Committee of the Red Cross, and all responsible bodies must cooperate until the fate of every missing person has been clarified.

There can be no lasting normalization between Kosovo and Serbia without uncovering the truth about missing persons, accountability for war crimes, and the full identification of the locations where the victims were buried,” Gunther Fehlinger concluded for “Bota sot”.

Gjetja e mbetjeve mortore në disa pika të Zubin Potokut, të cilat dyshohet se u përkasin viktimave të luftës së fundit në Kosovë, mund të ndihmojë në zbardhjen e fatit të personave të zhdukur dhe në hetimin e krimeve të mbetura pa përgjigje nga periudha 1998-1999.

Pas evidentimit të mbetjeve, institucionet e drejtësisë në Kosovë kanë nisur ekzaminimet mjeko-ligjore dhe analizat e ADN-së. Synimi është identifikimi i viktimave dhe përcaktimi i rrethanave të vdekjes së tyre, një proces që mund t’u japë përgjigje familjeve të personave të zhdukur, të cilat prej dekadash presin të mësojnë të vërtetën për të afërmit e tyre.

Zbulimet e fundit kanë rikthyer vëmendjen te çështja e varrezave masive dhe te domosdoshmëria e një angazhimi më të madh institucional për gjetjen e lokacioneve të dyshuara dhe dokumentimin e krimeve të luftës.

Fehlinger e konsideron zbulimin e mbetjeve njerëzore në disa lokacione të Zubin Potokut një ngjarje me peshë të veçantë për Kosovën, familjet e të zhdukurve dhe përpjekjet për të hetuar krimet e luftës që ende nuk janë zbardhur.

Sipas tij, puna duhet të kryhet me standarde të larta profesionale, duke respektuar ligjin dhe rregullat e mjekësisë ligjore. Vetëm në këtë mënyrë mund të përcaktohen saktë identitetet e viktimave dhe përgjegjësitë e mundshme mbi bazën e provave të verifikueshme.

“Gjetja e mbetjeve njerëzore në lokacione të ndryshme të Zubin Potokut përbën një zhvillim jashtëzakonisht të rëndësishëm për Kosovën, familjet e personave të zhdukur dhe hetimin e krimeve të pazbardhura të kryera gjatë luftës së viteve 1998-1999.

Gjetjet duhet të trajtohen me dinjitet, profesionalizëm forenzik dhe kujdes të plotë ligjor. Eksperti austriak nënvizon se, edhe 27 vite pas përfundimit të luftës, dëshmi të reja, puna e institucioneve dhe hetimet forenzike mund të çojnë në zbulimin e varrezave të panjohura.

Çdo lokacion i identifikuar, sipas tij, mund t’u sjellë familjeve përgjigje të shumëpritura, por mund të përmbajë gjithashtu prova që lidhen me rrëmbime, ekzekutime, fshehje trupash dhe përpjekje për pengimin e drejtësisë.

“Suksesi i hetimit nuk duhet të matet vetëm nga numri i mbetjeve që gjenden. Duhet parë edhe mënyra e ruajtjes së vendngjarjeve, identifikimi i viktimave përmes ADN-së, garantimi i zinxhirit të provave, marrja në pyetje e dëshmitarëve dhe përcaktimi i personave që kanë urdhëruar, kryer ose fshehur këto krime”, u shpreh Fehlinger.

Ai thekson se zhvillimet në Zubin Potok e bëjnë edhe më të rëndësishme Deklaratën për Personat e Zhdukur, të miratuar në kuadër të dialogut Kosovë-Serbi në vitin 2023. Dokumenti parashikon bashkëpunim për gjetjen e personave të zhdukur dhe shkëmbimin e informacioneve përkatëse.

“Bashkimi Evropian duhet të kërkojë zbatimin e plotë të kësaj marrëveshjeje. Serbia duhet të lejojë qasje të pakufizuar në arkivat ushtarake, policore, të shërbimeve të sigurisë, komunale dhe shtetërore që i përkasin periudhës së luftës. Duhet të bëhen të disponueshme dokumentet operative, të dhënat mbi transportet, informacionet për varrosjet dhe çdo material që lidhet me varrezat primare, sekondare ose të fshehura.

Çështja e personave të zhdukur nuk mund të trajtohet vetëm si një element simbolik i dialogut të Brukselit”, tha Fehlinger.

Sipas tij, BE-ja duhet ta lidhë bashkëpunimin konkret të Serbisë për personat e zhdukur dhe provat e krimeve të luftës me rrugëtimin e saj drejt anëtarësimit në Bashkimin Evropian, si dhe me përfitimet politike e financiare që burojnë nga ky proces.

Duke vlerësuar ndikimin e zbulimeve në proceset gjyqësore për krime lufte, Fehlinger tha se provat forenzike mund të forcojnë çështjet penale. Ato mund të ndihmojnë në identifikimin e viktimave, përcaktimin e numrit të tyre, evidentimin e modeleve të krimeve dhe krijimin e lidhjeve mes lokacioneve të ndryshme.

“Në çdo gjykim duhet të ndërtohet lidhja individuale e provave mes veprës penale dhe të akuzuarit. Vonesat në identifikimin përmes ADN-së mund të zvarrisin hetimet dhe proceset gjyqësore, ndërsa një identifikim i suksesshëm mund të konsolidojë rastet, të korrigjojë të dhënat historike dhe t’u japë familjeve të vërtetën që e kanë kërkuar për shumë vite”, deklaroi eksperti.

Në përfundim, ai kërkoi që çështja e personave të zhdukur të mos shndërrohet në mjet për përplasje politike apo tensione ndëretnike. Fehlinger theksoi se çdo viktimë, pavarësisht përkatësisë, meriton identifikim, dinjitet dhe drejtësi.

“Familjet e të zhdukurve kanë pritur për një kohë tepër të gjatë. Institucionet e Kosovës dhe të Serbisë, Bashkimi Evropian, EULEX-i, Komiteti Ndërkombëtar i Kryqit të Kuq dhe të gjitha strukturat përgjegjëse duhet të bashkëpunojnë deri në zbardhjen e fatit të çdo personi të zhdukur.

For this reason, the question arises as to whether Serbia’s progress in the negotiation process is in line with the criteria and values that guide EU membership, and what signal this step sends to other countries in the region seeking European integration.

It was precisely on this issue that Austrian expert and chairman of the Austrian Committee for NATO Expansion, Gunther Fehlinger, spoke in a statement to “Bota sot”.

He criticized the European Union’s approach and its decision regarding Serbia’s accession process, warning that such a move undermines the credibility of the EU’s enlargement policy.

“The European Union should immediately suspend any further progress in Serbia’s accession negotiations. Opening Cluster 3 at this moment would reward obstruction instead of reforms and would undermine the credibility of the EU enlargement process.”

Fehlinger stressed that the European Commission should tie any further step by Serbia in this process to recognition of Kosovo.

He also listed a series of other conditions that, in his view, Belgrade must fulfill.

“I call on the European Council to make any further progress in Serbia’s accession negotiations conditional on Serbia’s prior recognition of the Republic of Kosovo and then on meeting these conditions:

• Recognize the Republic of Kosovo and establish normal diplomatic relations.

• Fully implement all commitments undertaken within the framework of the Brussels and Ohrid Agreements.

• Fully align its policy 100% with the EU’s Common Foreign and Security Policy, including sanctions against Russia.

• End any political, financial and security support for destabilizing structures in northern Kosovo.

• Fully cooperate in bringing to justice those responsible for the attack in Banjska.

• Stop inflammatory nationalist rhetoric and threats against neighboring countries.

• End strategic military and security cooperation with Russia, which is incompatible with EU foreign policy.

• Reduce excessive dependence on China in strategic infrastructure and security sectors.

• Strengthen judicial independence and the rule of law in line with EU standards.

• Guarantee genuine media freedom and improve protection for independent journalists.

• Ensure free and fair elections in line with international democratic standards.

• Fight corruption and organized crime through measurable reforms that are independently verified.

• Respect the sovereignty and territorial integrity of all neighboring states, including Kosovo.

• End policies that contribute to regional instability and actively support reconciliation throughout the Western Balkans.

• Demonstrate a sustained commitment to European values through concrete actions and not just statements.”

In conclusion, the Austrian expert said that without recognition of Kosovo and without meeting all of these criteria, no new negotiation chapter should be opened for Serbia.

According to Fehlinger, the European Union should value reforms and democracy, not obstruction and nationalism.

“The European Union must restore the principle that enlargement is merit-based and not driven by geopolitical accommodation. Until Serbia recognizes Kosovo and demonstrates sustained compliance with these conditions, no new negotiation cluster should be opened.

Europe must reward reforms, democracy, peace and alignment with European values — not obstruction, nationalism and strategic ambiguity,” Gunther Fehlinger concluded for “Bota sot”.

Komisioni Evropian pritet t’u dërgojë vendeve anëtare të Bashkimit Evropian një rekomandim me shkrim, ku vlerësohet se Serbia i ka përmbushur kushtet për hapjen e klasterit 3 në negociatat për anëtarësim. Sipas burimeve të besueshme në Bruksel, të cituara nga REL-i, do të propozohet që ky grup kapitujsh të hapet gjatë muajit korrik.

Ky zhvillim vjen në një periudhë delikate politike, pasi raportet mes Beogradit dhe Kosovës mbeten të acaruara, ndërsa qasja e politikës së jashtme serbe ndaj Rusisë vazhdon të ngjallë dyshime në Bruksel.

Për këtë arsye, shtrohet dilema nëse ecja përpara e Serbisë në procesin negociues është në përputhje me kriteret dhe vlerat që udhëheqin anëtarësimin në BE, si dhe çfarë sinjali u jep ky hap vendeve të tjera të rajonit që synojnë integrimin evropian.

Pikërisht për këtë temë, në një deklaratë për “Bota sot”, foli eksperti austriak dhe kryetari i Komitetit Austriak për Zgjerimin e NATO-s, Gunther Fehlinger.

Ai kritikoi qasjen e Bashkimit Evropian dhe vendimin e tij në raport me procesin e anëtarësimit të Serbisë, duke paralajmëruar se një veprim i tillë cenon besueshmërinë e politikës së zgjerimit të BE-së.

“Bashkimi Evropian duhet të pezullojë menjëherë çdo përparim të mëtejshëm në negociatat e anëtarësimit të Serbisë. Hapja e Klasterit 3 në këtë moment do të shpërblente obstruksionin në vend të reformave dhe do të minonte besueshmërinë e procesit të zgjerimit të BE-së”.

Fehlinger theksoi se Komisioni Evropian duhet ta lidhë çdo hap të mëtejshëm të Serbisë në këtë proces me njohjen e Kosovës.

Po ashtu, ai renditi edhe një sërë kushtesh të tjera që, sipas tij, Beogradi duhet t’i përmbushë.

“I bëj thirrje Këshillit Evropian që çdo përparim i mëtejshëm në negociatat e anëtarësimit të Serbisë të kushtëzohet me njohjen paraprake të Republikës së Kosovës nga Serbia dhe më pas me përmbushjen e këtyre kushteve:

• Të njohë Republikën e Kosovës dhe të vendosë marrëdhënie normale diplomatike.

• Të zbatojë plotësisht të gjitha zotimet e marra në kuadër të Marrëveshjeve të Brukselit dhe Ohrit.

• Të harmonizojë 100% politikën e saj me Politikën e Përbashkët të Jashtme dhe të Sigurisë të BE-së, përfshirë sanksionet kundër Rusisë.

• T’i japë fund çdo mbështetjeje politike, financiare dhe të sigurisë për strukturat destabilizuese në veri të Kosovës.

• Të bashkëpunojë plotësisht për vënien para drejtësisë të përgjegjësve për sulmin në Banjskë.

• Të ndalojë retorikën nacionaliste nxitëse dhe kërcënimet ndaj vendeve fqinje.

• T’i japë fund bashkëpunimit strategjik ushtarak dhe të sigurisë me Rusinë, i cili është i papajtueshëm me politikën e jashtme të BE-së.

• Të zvogëlojë varësinë e tepruar nga Kina në sektorët strategjikë të infrastrukturës dhe sigurisë.

• Të forcojë pavarësinë e gjyqësorit dhe sundimin e ligjit në përputhje me standardet e BE-së.

• Të garantojë lirinë e vërtetë të mediave dhe të përmirësojë mbrojtjen e gazetarëve të pavarur.

• Të sigurojë zgjedhje të lira dhe të ndershme në përputhje me standardet ndërkombëtare demokratike.

• Të luftojë korrupsionin dhe krimin e organizuar përmes reformave të matshme dhe të verifikuara në mënyrë të pavarur.

• Të respektojë sovranitetin dhe integritetin territorial të të gjitha shteteve fqinje, përfshirë Kosovën.

• T’u japë fund politikave që kontribuojnë në paqëndrueshmërinë rajonale dhe të mbështesë në mënyrë aktive pajtimin në të gjithë Ballkanin Perëndimor.

• Të dëshmojë një angazhim të qëndrueshëm ndaj vlerave evropiane përmes veprimeve konkrete dhe jo vetëm deklaratave”.

Në përfundim, eksperti austriak u shpreh se pa njohjen e Kosovës dhe pa plotësimin e të gjitha këtyre kritereve, Serbisë nuk duhet t’i hapet asnjë kapitull i ri negociues.

Sipas Fehlinger, Bashkimi Evropian duhet të vlerësojë reformat dhe demokracinë, e jo obstruksionin dhe nacionalizmin.

“Bashkimi Evropian duhet të rikthejë parimin se zgjerimi bazohet në meritë dhe jo në akomodim gjeopolitik. Derisa Serbia ta njohë Kosovën dhe të dëshmojë respektimin e qëndrueshëm të këtyre kushteve, nuk duhet të hapet asnjë klaster i ri negociues.

Evropa duhet të shpërblejë reformat, demokracinë, paqen dhe harmonizimin me vlerat evropiane – jo obstruksionin, nacionalizmin dhe paqartësinë strategjike”, përfundoi Gunther Fehlinger për “Bota sot”.
