The Group for Legal and Political Studies (GLPS) has raised concerns after the Office of the Prime Minister (OPM) failed to respond to its request for access to public documents concerning the resignations of members of the caretaker government who won seats in the Assembly of Kosovo.

The organization said that on August 6, 2026, it asked the OPM for a list of government members who had left office, the dates on which their resignations were submitted, and the decisions through which they were accepted.

GLPS cited the Law on Government as the basis for its request. The law stipulates that a member of the caretaker government, after being elected as an MP, must leave their ministerial post before the date on which the election results are certified. The organization also emphasized that Article 72 of the Constitution does not allow the positions of minister and MP to be held simultaneously.

In its statement, GLPS also cited Supreme Court ruling P.A. No. 09/2025, dated June 25, 2025. According to the organization, the ruling found that holding both positions simultaneously is contrary to the Constitution.

GLPS claims that the OPM failed to respond within the statutory seven-day deadline set by the Law on Access to Public Documents. The organization believes that, in addition to failing to comply with this deadline, such conduct also undermines institutional transparency and accountability.

Following the lack of a response, GLPS announced that it filed a complaint with the Information and Privacy Agency (AIP) on August 17. Through the complaint, the organization is seeking to compel the OPM to provide the requested data and documents.

At the same time, GLPS has called on the government to inform the public without delay and publish the documents related to the resignations of cabinet members elected as MPs.

Grupi për Studime Juridike dhe Politike (GLPS) ka ngritur shqetësime pasi Zyra e Kryeministrit (ZKM) nuk iu përgjigj kërkesës së saj për qasje në dokumente publike mbi dorëheqjet e pjesëtarëve të Qeverisë në detyrë që kanë fituar mandate në Kuvendin e Kosovës.

Organizata bën të ditur se më 6 gusht 2026 i kërkoi ZKM-së listën e anëtarëve të Qeverisë që janë larguar nga detyra, datat kur janë paraqitur dorëheqjet dhe vendimet përmes të cilave ato janë pranuar.

Si bazë për këtë kërkesë, GLPS ka përmendur Ligjin për Qeverinë. Ky ligj parasheh që anëtari i Qeverisë në detyrë, pasi zgjidhet deputet, duhet të largohet nga posti ministror përpara ditës kur certifikohen rezultatet zgjedhore. Organizata ka theksuar gjithashtu se neni 72 i Kushtetutës nuk lejon që funksionet e ministrit dhe deputetit të ushtrohen në të njëjtën kohë.

Në qëndrimin e saj, GLPS është thirrur edhe në vendimin P.A.nr.09/2025 të Gjykatës Supreme, të datës 25 qershor 2025. Sipas organizatës, në këtë vendim është konstatuar se mbajtja njëkohësisht e të dyja funksioneve bie ndesh me Kushtetutën.

GLPS pretendon se ZKM-ja nuk dha përgjigje brenda afatit ligjor shtatëditor që përcakton Ligji për Qasje në Dokumente Publike. Organizata vlerëson se, përveç mosrespektimit të këtij afati, një veprim i tillë dëmton edhe transparencën dhe përgjegjshmërinë e institucioneve.

Pas mungesës së përgjigjes, GLPS njoftoi se më 17 gusht dorëzoi ankesë në Agjencinë për Informim dhe Privatësi (AIP). Përmes saj, organizata kërkon që ZKM-ja të detyrohet t’i vërë në dispozicion të dhënat dhe dokumentet e kërkuara.

Njëherësh, GLPS i ka kërkuar Qeverisë që, pa vonesa, ta njoftojë opinionin publik dhe t’i publikojë dokumentet që kanë të bëjnë me dorëheqjet e anëtarëve të kabinetit të zgjedhur deputetë.

The Group for Legal and Political Studies has called on political forces in parliament to act without delay to establish the Assembly of Kosovo, respecting the deadline set by the Constitution.

A special appeal was directed at the Vetëvendosje Movement, as the party that came first in the elections and holds the responsibility for proposing the head of the Assembly, to play an active role in finalizing this phase.

According to GLPS’s assessment, failure to form the Assembly within the constitutionally permitted time would mark an institutional crisis and a violation of obligations arising from the country’s fundamental law.

The organization also sharply criticized the explanation given by LVV for suspending the last parliamentary session, where it was claimed more time was needed for consultations regarding the election of the president.

“Citizens have been paying the cost for nearly two years of a politics dominated by partisan calculations rather than institutional responsibility,” the press release emphasized.

GLPS argued that the issue of the head of state cannot serve as a justification for delaying the establishment of the Assembly, as these two steps have entirely separate constitutional timelines and procedures.

The organization underscored that the establishment of the Assembly is a prerequisite for forming the Government and for electing the president, recalling that the procedure for the head of state begins within the deadlines set after the Assembly has been formed.

In closing, GLPS called for the successive delays to stop and for institutions to fulfill their constitutional obligations in honor of the popular will expressed at the ballot box.

“Today there is no more room for justifications, broad political interpretations, or further postponements. There is only one clear obligation: the constitution of the Assembly within the constitutional deadline. Any failure to fulfill this obligation would be a violation of the constitution and an irresponsible political and institutional act,” concluded the GLPS statement.

Grupi për Studime Juridike dhe Politike u ka bërë thirrje forcave politike në parlament që të veprojnë pa vonesë për krijimin e Kuvendit të Kosovës, duke respektuar afatin e caktuar nga Kushtetuta.

Një apel i veçantë i është drejtuar Lëvizjes Vetëvendosje, si partia që doli e para në zgjedhje dhe që mban përgjegjësinë për të propozuar kreun e Kuvendit, që të luajë rol aktiv në finalizimin e kësaj faze.

“Qytetarët tashmë prej gati dy vitesh po paguajnë koston e një politike të dominuar nga kalkulimet partiake dhe jo nga përgjegjësia institucionale”, theksohet në njoftimin për shtyp.

GLPS ka argumentuar se çështja e kreut të shtetit nuk mund të shërbejë si justifikim për të zvarritur themelimin e Kuvendit, duke qenë se këto dy hapa kanë afate dhe rrugëtime kushtetuese krejtësisht të veçanta.

Organizata ka nënvizuar se themelimi i Kuvendit është kushti paraprak për krijimin e Qeverisë dhe për zgjedhjen e presidentit, duke kujtuar se procedura për kreun e shtetit fillon brenda afateve të përcaktuara pasi të jetë formuar Kuvendi.

Në fund, GLPS ka bërë thirrje që të ndërpriten vonesat e radhës dhe që institucionet të përmbushin detyrimet e tyre kushtetuese në nderim të vullnetit popullor të shprehur në kutitë e votimit.

“Sot nuk ka më hapësirë për justifikime, interpretime të gjëra politike apo shtyrje të mëtejshme. Ekziston vetëm një detyrim i qartë, konstituimi i Kuvendit brenda afatit kushtetues. Çdo dështim për ta përmbushur këtë obligim do të ishte shkelje e kushtetutës dhe një akt i papërgjegjshëm politik dhe institucional”, përfundon komunikata e GLPS-së.

“The Group for Legal and Political Studies (GLPS), as an organization that has closely monitored all phases so far of the competition for Chief State Prosecutor and with the aim of assessing the entire process as objectively as possible, on July 2, 2026, one day after the interviews with the candidates, submitted a request to the Kosovo Prosecutorial Council (KPK) seeking access to the score sheets of the Evaluation Panel. In the case of such an important institutional position, where the selection directly affects the functioning of the prosecutorial system and citizens’ trust in justice, the evaluation process must be accompanied by high standards of transparency and reasoning in decision-making.

Based on the seven-day deadline set by Law No. 06/L-081 on Access to Public Documents, the KPK chose silence in relation to this request, failing to respect legal obligations and the practice already established by the Information and Privacy Agency (AIP) regarding the right of NGOs to access the score sheets of candidates for Chief State Prosecutor. Therefore, the KPK’s lack of institutional willingness to allow access to these documents sends a negative signal regarding public expectations over the legal changes and the intended reform in this constitutional body.

The silent refusal to grant access creates unnecessary ambiguity and does not align with expectations for a constitutional institution that aims to strengthen transparency, accountability and public trust.

Access to these score sheets is essential to enable a fair, complete and well-founded assessment of the selection process for the Chief State Prosecutor, as well as to verify whether the institutional decision-making was carried out objectively, impartially and in accordance with the principles of transparency and meritocracy.

Therefore, GLPS today submitted a complaint against the KPK to the Information and Privacy Agency (AIP), requesting that it oblige the Council to allow access to the score sheets of the candidates for Chief State Prosecutor who were interviewed on July 1, 2026,” the reaction by the Group for Legal and Political Studies said.

Sipas GLPS-së, kur bëhet fjalë për një funksion kaq të rëndësishëm institucional, përzgjedhja e të cilit ndikon drejtpërdrejt në funksionimin e sistemit prokurorial dhe në besimin e qytetarëve te drejtësia, i gjithë procesi i vlerësimit duhet të shoqërohet me standarde të larta transparence dhe me arsyetim të qartë të vendimmarrjes.

“Grupi për Studime Juridike dhe Politike (GLPS) si organizatë që i ka monitoruar nga afër të gjitha fazat e deritanishme të konkursit për Kryeprokuror të Shtetit dhe me qëllim të vlerësimit sa më objektiv të të gjithë procesit, më datë 2 korrik 2026, një ditë pas intervistimit të kandidatëve, ka parashtruar kërkesë në Këshillin Prokurorial të Kosovës (KPK) për lejimin e qasjes në fletëpoentimet e Panelit Vlerësues. Bazuar në afatin prej 7 ditësh që përcakton Ligji Nr. 06/L-081 për Qasje në Dokumente Publike, KPK ka zgjedhur heshtjen në raport me këtë kërkesën, duke mos respektuar detyrimet ligjore dhe praktikën që ka vendosur tashmë Agjencia për Informim dhe Privatësi (AIP) në raport me të drejtën e qasjes së OJQ-ve në fletëpoentimet e kandidatëve për Kryeprokuror të Shtetit. Andaj, mungesa e vullnetit institucional të KPK-së që të lejojë qasje në këto dokumente paraqet një sinjal negativ në pritshmëritë e publikut mbi ndryshimet ligjore dhe reformën e synuar në këtë organ kushtetues.

Refuzimi i heshtur për të dhënë qasje krijon paqartësi të panevojshme dhe nuk përputhet me pritshmëritë për një institucion kushtetues që synon forcimin e transparencës, llogaridhënies dhe besimit publik.

Qasja në këto fletëpoentime është e domosdoshme për të mundësuar një vlerësim të drejtë, të plotë dhe të bazuar të procesit të përzgjedhjes së Kryeprokurorit të Shtetit, si dhe për të verifikuar nëse vendimmarrja institucionale është zhvilluar në mënyrë objektive, të paanshme dhe në përputhje me parimet e transparencës dhe meritokracisë.

Prandaj, GLPS sot ka dorëzuar ankesë kundër KPK-së në Agjencinë për Informim dhe Privatësi (AIP), duke kërkuar që e njëjta ta obligojë Këshillin për të lejuar qasje në fletëpoentimet e kandidatëve për Kryeprokuror të Shtetit që janë intervistuar më datë 1 korrik 2026”, thuhet në reagimin e Grupit për Studime Juridike dhe Politike.

At a press conference, GLPS program manager Ema Pula stressed that June 30 marks the end of the final deadline that gave Kosovo the opportunity to avoid financial losses by carrying out the planned reforms.

GLPS researcher Besar Gërgi said that the lack of fully functioning institutions has directly affected the progress of reform implementation.

According to him, only after the publication of official reports by the Government of Kosovo and the European Union will it become clear what level of funding has been obtained, how much money is at risk, and which reforms remain unimplemented.
