“The Group for Legal and Political Studies (GLPS), as an organization that has closely monitored all phases so far of the competition for Chief State Prosecutor and with the aim of assessing the entire process as objectively as possible, on July 2, 2026, one day after the interviews with the candidates, submitted a request to the Kosovo Prosecutorial Council (KPK) seeking access to the score sheets of the Evaluation Panel. In the case of such an important institutional position, where the selection directly affects the functioning of the prosecutorial system and citizens’ trust in justice, the evaluation process must be accompanied by high standards of transparency and reasoning in decision-making.

Based on the seven-day deadline set by Law No. 06/L-081 on Access to Public Documents, the KPK chose silence in relation to this request, failing to respect legal obligations and the practice already established by the Information and Privacy Agency (AIP) regarding the right of NGOs to access the score sheets of candidates for Chief State Prosecutor. Therefore, the KPK’s lack of institutional willingness to allow access to these documents sends a negative signal regarding public expectations over the legal changes and the intended reform in this constitutional body.

The silent refusal to grant access creates unnecessary ambiguity and does not align with expectations for a constitutional institution that aims to strengthen transparency, accountability and public trust.

Access to these score sheets is essential to enable a fair, complete and well-founded assessment of the selection process for the Chief State Prosecutor, as well as to verify whether the institutional decision-making was carried out objectively, impartially and in accordance with the principles of transparency and meritocracy.

Therefore, GLPS today submitted a complaint against the KPK to the Information and Privacy Agency (AIP), requesting that it oblige the Council to allow access to the score sheets of the candidates for Chief State Prosecutor who were interviewed on July 1, 2026,” the reaction by the Group for Legal and Political Studies said.

Grupi për Studime Juridike dhe Politike (GLPS) ka reaguar pasi kësaj organizate nuk i është lejuar qasja në fletëpoentimet e kandidatëve për Kryeprokuror të Shtetit.

Sipas GLPS-së, kur bëhet fjalë për një funksion kaq të rëndësishëm institucional, përzgjedhja e të cilit ndikon drejtpërdrejt në funksionimin e sistemit prokurorial dhe në besimin e qytetarëve te drejtësia, i gjithë procesi i vlerësimit duhet të shoqërohet me standarde të larta transparence dhe me arsyetim të qartë të vendimmarrjes.

“Grupi për Studime Juridike dhe Politike (GLPS) si organizatë që i ka monitoruar nga afër të gjitha fazat e deritanishme të konkursit për Kryeprokuror të Shtetit dhe me qëllim të vlerësimit sa më objektiv të të gjithë procesit, më datë 2 korrik 2026, një ditë pas intervistimit të kandidatëve, ka parashtruar kërkesë në Këshillin Prokurorial të Kosovës (KPK) për lejimin e qasjes në fletëpoentimet e Panelit Vlerësues. Në rastin e një pozite kaq të rëndësishme institucionale, ku përzgjedhja ndikon drejtpërdrejt në funksionimin e sistemit prokurorial dhe besimin e qytetarëve në drejtësi, procesi i vlerësimit duhet të jetë i shoqëruar me standarde të larta të transparencës dhe arsyetimit të vendimmarrjes.

Bazuar në afatin prej 7 ditësh që përcakton Ligji Nr. 06/L-081 për Qasje në Dokumente Publike, KPK ka zgjedhur heshtjen në raport me këtë kërkesën, duke mos respektuar detyrimet ligjore dhe praktikën që ka vendosur tashmë Agjencia për Informim dhe Privatësi (AIP) në raport me të drejtën e qasjes së OJQ-ve në fletëpoentimet e kandidatëve për Kryeprokuror të Shtetit. Andaj, mungesa e vullnetit institucional të KPK-së që të lejojë qasje në këto dokumente paraqet një sinjal negativ në pritshmëritë e publikut mbi ndryshimet ligjore dhe reformën e synuar në këtë organ kushtetues.

Refuzimi i heshtur për të dhënë qasje krijon paqartësi të panevojshme dhe nuk përputhet me pritshmëritë për një institucion kushtetues që synon forcimin e transparencës, llogaridhënies dhe besimit publik.

Qasja në këto fletëpoentime është e domosdoshme për të mundësuar një vlerësim të drejtë, të plotë dhe të bazuar të procesit të përzgjedhjes së Kryeprokurorit të Shtetit, si dhe për të verifikuar nëse vendimmarrja institucionale është zhvilluar në mënyrë objektive, të paanshme dhe në përputhje me parimet e transparencës dhe meritokracisë.

Prandaj, GLPS sot ka dorëzuar ankesë kundër KPK-së në Agjencinë për Informim dhe Privatësi (AIP), duke kërkuar që e njëjta ta obligojë Këshillin për të lejuar qasje në fletëpoentimet e kandidatëve për Kryeprokuror të Shtetit që janë intervistuar më datë 1 korrik 2026”, thuhet në reagimin e Grupit për Studime Juridike dhe Politike.

At a press conference, GLPS program manager Ema Pula stressed that June 30 marks the end of the final deadline that gave Kosovo the opportunity to avoid financial losses by carrying out the planned reforms.

GLPS researcher Besar Gërgi said that the lack of fully functioning institutions has directly affected the progress of reform implementation.

According to him, only after the publication of official reports by the Government of Kosovo and the European Union will it become clear what level of funding has been obtained, how much money is at risk, and which reforms remain unimplemented.

Gërgi also added that, given the current situation in Kosovo, GLPS has prepared several recommendations to improve and speed up the implementation of the reform agenda.

Në një konferencë për media, menaxherja e programit në GLPS, Ema Pula, theksoi se 30 qershori përbën përfundimin e afatit të fundit që i jepte Kosovës mundësinë të shmangte humbjet financiare përmes realizimit të reformave të parapara.

Hulumtuesi i GLPS-së, Besar Gërgi, deklaroi se mungesa e institucioneve që funksionojnë plotësisht ka ndikuar drejtpërdrejt në ecurinë e zbatimit të reformave.

Sipas tij, vetëm pas publikimit të raporteve zyrtare nga Qeveria e Kosovës dhe Bashkimi Evropian do të qartësohet niveli i fondeve të përfituara, shuma e mjeteve të rrezikuara dhe reformat që kanë mbetur të parealizuara.

Gërgi shtoi gjithashtu se, duke pasur parasysh situatën aktuale në Kosovë, GLPS ka përgatitur disa rekomandime për të përmirësuar dhe përshpejtuar zbatimin e agjendës së reformave.
