The hearing in the case against Gjoko Ristov, a judge at the Court of Appeals, continued today at the Criminal Court in Skopje with the testimony of witnesses. Two people testified before the panel: one called by the Prosecution, the owner of a mobile phone repair shop and store, and the other by the defense, a lawyer who participated in the search of Ristov’s parents’ home in Negotino.

The next hearing has been scheduled for October 6, when the questioning of the defense witnesses is expected to continue, including Fehmi Stafa.

The prosecution witness, who works as a cybersecurity specialist at the Ministry of Internal Affairs and runs a phone sales and repair shop in Skopje, answered a question from prosecutor Iskra Haxhi Vasileva. He was asked whether Gjoko Ristov had gone to repair a mobile phone on December 3, 2025.

“I did not receive a phone from the gentleman, and I provided my full details regarding the phones received through my system,” the witness said.

During questioning by lawyer Zvonko Davidoviq, who is representing Ristov, the witness explained how devices brought in for servicing are registered. “We write down which phone has arrived, the phone number and the name of the person who brought it,” he said.

According to the witness, the Prosecution had asked him to verify whether a specific Samsung phone had been brought to the shop. Through the official record, he informed them that no such device was at the shop. Asked by Gjoko Ristov whether, on December 3 after 7 p.m., he had brought in a black Samsung phone with a cracked screen and asked whether its data could be extracted, the witness said he did not remember such an incident.

After the testimony ended, prosecutor Iskra Haxhi Vasileva asked the Court to examine the case files involving the two defendants, Marian Stoevski and Fehmi Stafa, in which judge Gjoko Ristov is currently a defendant.

With this testimony, the Prosecution concluded the presentation of its evidence and the procedure for presenting the defense evidence began.

Lawyer Aleksandar Varella, called as a defense witness, told the Court about the search conducted at the home of Zdravko and Donka Ristov in Negotino. He provided details about the second search, which was carried out over two days in January.

Varella explained that he had been called by Angel Ristov, Zdravko’s son, and had then gone to the village of Negorci, from where Zdravko was taken.

“The search was intensive, and we thought everything was over. But they told us they had to come again the next day. The second day began with them checking the same rooms and places. They also searched the back part of the house, which has a separate entrance,” he said.

According to the lawyer, during the second search the police focused on the kitchen and began checking the tiles because they suspected that some of them sounded different when struck.

“They removed five tiles, then five more; they fell and broke. I was there, along with the owner, Zdravko, and two police officers who were removing the tiles. Zdravko objected: ‘Don’t break the tiles, or remove them slowly; you will have to put them back.’ But they could not find anything and began breaking them all one after another. They reached the last row, where a hole appeared. Zdravko, as someone who was surprised, simply said: ‘Oh, that happened.’ It had happened. I asked him what it was, and he only said, ‘That.’ Then the police asked him what was there, so they would know whether to call in specialists. Zdravko then said, ‘There’s no need, it’s money.’ The police then began taking it out, in such a way that part of it had to be broken in order to remove it. They took it out, and I think they recovered 13 packages. The police officer directing the operation repeatedly made phone calls and spoke aside; I think he was consulting someone on how to proceed. When they found the money, a forensic technician was called to take photographs,” the witness said.

He said that after the money was discovered, he went downstairs and asked Zdravko why he had not mentioned it. According to the testimony, Zdravko replied that he had not thought the search would go that far, given the way the first search had been conducted.

“He told me: ‘I didn’t know they would go that far; I didn’t want the children to know that I had money.’ I told him, ‘You know they may take it from you now,’ and he told me, ‘Let them do whatever they want; the money is mine,’” the witness said.

When he asked Zdravko about the amount of money, the lawyer said, he answered without hesitation that it was more than 300.350 thousand euros.

“By this, he made it clear to me that he knew about the money, but he did not tell me as his lawyer,” the witness concluded.

Seanca gjyqësore ndaj gjykatësit të Gjykatës së Apelit, Gjoko Ristov, vijoi sot në Gjykatën Penale në Shkup me dëgjimin e dëshmitarëve. Para trupit gjykues dëshmuan dy persona: njëri i thirrur nga Prokuroria, pronar i një servisi dhe dyqani për telefona celularë, ndërsa tjetri nga mbrojtja, avokat dhe pjesëmarrës në bastisjen e shtëpisë së prindërve të Ristovit në Negotinë.

Seanca e radhës është caktuar për 6 tetor, kur pritet të vazhdojë marrja në pyetje e dëshmitarëve të mbrojtjes, mes të cilëve edhe Fehmi Stafa.

Dëshmitari i Prokurorisë, i cili punon si specialist i sigurisë kibernetike në Ministrinë e Punëve të Brendshme dhe administron një dyqan për shitje e riparim telefonash në Shkup, iu përgjigj një pyetjeje të prokurores Iskra Haxhi Vasileva. Ai u pyet nëse Gjoko Ristov kishte shkuar më 3 dhjetor të vitit 2025 për të riparuar një telefon celular.

“Nuk kam marrë telefon nga zotëria dhe kam dhënë të dhënat e mia të plota për marrjen e telefonave nga sistemi im”, deklaroi dëshmitari.

Gjatë pyetjeve të avokatit Zvonko Davidoviq, i cili mbron Ristovin, dëshmitari shpjegoi mënyrën se si regjistrohen pajisjet e dorëzuara për servis. “Shkruajmë se cili telefon ka ardhur dhe numrin e telefonit dhe emrin e personit që e ka sjellë”, tha ai.

Sipas dëshmitarit, Prokuroria kishte kërkuar të verifikonte nëse në servis ishte sjellë një telefon specifik i markës Samsung. Ai u kishte bërë të ditur përmes procesverbalit se një pajisje e tillë nuk ndodhej në servis. I pyetur nga Gjoko Ristov nëse më 3 dhjetor, pas orës 19:00, ai kishte sjellë një telefon Samsung të zi me ekran të thyer dhe kishte kërkuar nëse mund të nxirreshin të dhënat, dëshmitari tha se nuk e kujtonte një rast të tillë.

Pas përfundimit të dëshmisë, prokurorja Iskra Haxhi Vasileva i kërkoi Gjykatës të shqyrtonte dosjet e çështjeve ndaj dy të pandehurve, Marian Stoevski dhe Fehmi Stafa, ku gjykatësi Gjoko Ristov është aktualisht i pandehur.

Me këtë dëshmi përfundoi paraqitja e provave nga Prokuroria dhe nisi procedura e paraqitjes së provave të mbrojtjes.

Avokati Aleksandar Varella, i thirrur si dëshmitar i mbrojtjes, tregoi para Gjykatës për bastisjen e zhvilluar në shtëpinë e Zdravko dhe Donka Ristovit në Negotinë. Ai dha hollësi për kontrollin e dytë, të zhvilluar gjatë dy ditëve në janar.

Varella shpjegoi se ishte telefonuar nga Angel Ristov, djali i Zdravkos, dhe më pas kishte shkuar në banjën Negorcë, prej nga e kishin marrë Zdravkon.

“Bastisja ishte intensive dhe menduam se gjithçka kishte mbaruar. Por na thanë se duhet të vinin edhe të nesërmen. Dita e dytë filloi me kontrollimin e dhomave dhe vendeve të njëjta. Ata kontrolluan edhe pjesën e pasme të shtëpisë, e cila ka hyrje të veçantë”, deklaroi ai.

Sipas avokatit, gjatë kontrollit të dytë policët u përqendruan në kuzhinë dhe nisën të kontrollonin pllakat, pasi dyshonin se disa prej tyre tingëllonin ndryshe kur goditeshin.

“Nxorën pesë pllaka, pastaj pesë të tjera, ranë, u thyen. Edhe unë isha aty dhe pronari Zdravko dhe dy policë që po hiqnin pllakat. Zdravko kundërshtoi: “mos i thyej pllakat ose hiqi ngadalë, do të duhet t’i kthesh përsëri”. Por ata nuk mundën të gjenin asgjë dhe filluan t’i thyejnë të gjitha me radhë dhe arritën në rreshtin e fundit, ku u shfaq një vrimë. Zdravko, si njeri që u befasua, vetëm tha: “aj ndodhi”. Pra, ndodhi. E pyeta se çfarë ishte, ai vetëm tha “aj”. Më pas policia e pyeti se çfarë kishte atje, në mënyrë që të dinte të thërriste specialistë. Pastaj Zdravko tha, nuk ka nevojë, janë para. Më pas policët filluan t’i nxjerrin, në mënyrë të tillë që duhej të thyhej një pjesë për t’i nxjerrë. I nxorën dhe mendoj se nxorën 13 pako. Ai tregoi se, pasi u zbuluan paratë, zbriti dhe e pyeti Zdravkon pse nuk kishte treguar për to. Sipas dëshmisë, Zdravko iu përgjigj se nuk kishte menduar që kontrolli do të shkonte aq larg, duke pasur parasysh mënyrën se si ishte zhvilluar bastisja e parë.

“Më tha: “Nuk e dija se do të shkonin aq larg, nuk doja që fëmijët ta dinin se kisha para”. I thashë, e di që tani mund të t’i marrin, e ai më tha “le të bëjnë ç’të duan, paratë janë të miat”, deklaroi dëshmitari.

Kur e pyeti Zdravkon për shumën e parave, ai, sipas avokatit, u përgjigj pa hezitim se bëhej fjalë për mbi 300.350 mijë euro.

Prosecutor Iskra Haxhiasilevska said that Ristov had communicated with people who had active cases before him, while in other instances he had inquired about proceedings handled by his colleagues.

Among the people with whom Ristov communicated was Ismet Guri, a former deputy director of the Public Revenue Office, who was sentenced for destroying election material and later became involved in the July 2024 investigation into criminal association. The Prosecutor’s Office also announced that he had communicated with Bojan Jovanovski, known as Boki 13, who was convicted in the “Racket” case.

In some of the messages read out in court, Ristov inquired about a case before Judge Enver Bexheti, who was recently placed on the U.S. blacklist for corruption. Ristov told him that he had asked a colleague from the administration, as she had a family connection to him, specifically that she was his sister. In another message, an unidentified person asked Ristov about a case before a female judge named Bukurie. Ristov replied that she was on vacation and that she would review the case after her return.

The Prosecutor’s Office also presented the register of contacts saved on Ristov’s phone, clarifying that there had been no communication with these people, but only that their numbers had been registered. The list includes Vice, the brother of former SDSM leader Zoran Zaev, as well as Ana, the wife of businessman Orce Kamchev. It also includes BDI MP and owner of Pucko Petroll Ismail Jahoski, his son Asmir Jahoski, businessman Zoran Azmanov, and former SDSM MP Frosina Remenski.

Fehmi Stafa and Lupcho Pecov, known as the Devil, also appear on this list. Stafa was sentenced to 15 months in prison after taking 50,000 euros from a family member of the “Devil” in order to bribe Judge Ristov and have the detention order revoked in the “Chain” case.

According to Prosecutor Iskra Haxhivasileva, Ristov should not have had such contacts in his capacity as a judge, especially since active proceedings were underway against some of the people in question.

“According to our assessments, the contacts and communications of the appeals court judge with people against whom, as you saw for yourselves, active cases and proceedings have been and are being conducted are impermissible,” said Iskra Haxhivasileva, Prosecutor.

The defense, meanwhile, argues that keeping telephone contacts does not constitute a violation in the absence of evidence proving that a crime was committed.

“Yes, these people were in his phone. They were. Macedonia is a small country, but if it is claimed that he should not have had them in his phone or that this is suspicious, evidence must be presented of what he did with these people,” said Zvonko Davidoviq, attorney for Gjoko Ristov.

The expert who analyzed the financial income of Ristov and his family members also testified at today’s hearing. The Prosecutor’s Office maintains that the former judge’s income is insufficient to explain the origin of the 350,000 euros found hidden in the wall. The defense disputes this position, saying that Ristov and his wife received 617,000 euros from 2016 to 2024, while his parents had income of 917,000 euros. Gjatë seancës së sotme, Prokuroria paraqiti të dhëna të marra nga telefoni i Gjoko Ristovit, ish-gjyqtarit të Apelit, i cili dyshohet se ka fshehur 350 mijë euro brenda murit të shtëpisë së prindërve të tij në Negotinë. Prokurorja Iskra Haxhiasilevska deklaroi se Ristov kishte komunikuar me persona që kishin çështje aktive para tij, ndërsa në raste të tjera ishte interesuar për procedura që ndiqeshin nga kolegë të tij.

Mes personave me të cilët Ristov ka pasur komunikime është Ismet Guri, ish-zëvendësdrejtor i Drejtorisë së të Ardhurave Publike, i dënuar për shkatërrim të materialit zgjedhor dhe i përfshirë më pas në hetimin e korrikut të vitit 2024 për shoqërim kriminal. Prokuroria bëri të ditur gjithashtu se ai ka komunikuar edhe me Bojan Jovanovskin, i njohur si Boki 13, i dënuar në rastin “Reket”.

Në disa prej mesazheve të lexuara në gjykatë, Ristov interesohet për një çështje që ndodhej te gjyqtari Enver Bexheti, i cili së fundmi u përfshi në listën e zezë amerikane për korrupsion. Ristov i thotë atij se kishte pyetur një kolege nga administrata, pasi ajo kishte lidhje familjare me të, konkretisht i kishte vëlla. Në një tjetër mesazh, një person i paidentifikuar e pyet Ristovin për një lëndë që ndodhej te një gjyqtare me emrin Bukurie. Ristov përgjigjet se ajo ishte me pushime dhe se do ta shqyrtonte çështjen pas kthimit të saj.

Prokuroria paraqiti edhe regjistrin e kontakteve të ruajtura në telefonin e Ristovit, duke sqaruar se me këta persona nuk kishte komunikime, por vetëm numrat e tyre të regjistruar. Në listë figuron Vice, vëllai i ish-kryetarit të LSDM-së, Zoran Zaev, si dhe Ana, bashkëshortja e biznesmenit Orce Kamçev. Aty përfshihen edhe deputeti i BDI-së dhe pronari i Pucko Petroll, Ismail Jahoski, djali i tij Asmir Jahoski, biznesmeni Zoran Azmanov dhe ish-deputetja e LSDM-së, Frosina Remenski.

Po në këtë listë janë edhe Fehmi Stafa dhe Lupço Pecov, i njohur si djalli. Stafa u dënua me 15 muaj burg pasi kishte marrë 50 mijë euro nga një familjar i “djallit”, me qëllim korruptimin e gjyqtarit Ristov dhe shfuqizimin e paraburgimit në lëndën “Zinxhir”.

Sipas prokurores Iskra Haxhivasileva, Ristov nuk duhej të kishte kontakte të tilla në cilësinë e gjyqtarit, veçanërisht pasi ndaj disa prej personave në fjalë kishte procedura aktive.

“Sipas vlerësimeve tona, kontaktet dhe komunikimet e gjyqtarit të Apelit me persona ndaj të cilëve, siç e patë edhe vetë, janë zhvilluar dhe zhvillohen lëndë aktive dhe procedura, janë të palejueshme”, tha Iskra Haxhivasileva, Prokurore.

Mbrojtja, nga ana tjetër, argumenton se ruajtja e kontakteve telefonike nuk përbën shkelje në mungesë të provave që dëshmojnë kryerjen e një krimi.

“Po, këta persona kanë qenë në telefonin e tij. Kanë qenë. Maqedonia është shtet i vogël, por nëse pretendohet se nuk duhej t’i kishte në telefon ose se kjo është e dyshimtë, duhet të paraqiten prova se çfarë ka bërë ai me këta persona”, deklaroi Zvonko Davidoviq, Avokat i Gjoko Ristov.

Në seancën e sotme dëshmoi edhe eksperti që ka analizuar të ardhurat financiare të Ristovit dhe familjarëve të tij. Prokuroria vlerëson se të ardhurat e ish-gjyqtarit nuk mjaftojnë për të shpjeguar origjinën e 350 mijë eurove të gjetura të fshehura në mur.
