A vote cast more than a decade ago is bringing visible consequences today. According to lawyer Tomë Gashi, the proposal of the Democratic Party of Kosovo to amend the Law on the Specialist Chambers has no practical value, even if it gets the green light in the Assembly, because the judicial process in The Hague has already entered an advanced stage. He assesses that this move weighs more on the political plane than on the legal one.

Gashi argues that beyond political calculations, the initiative cannot bring concrete consequences to the justice system. His reasoning is that any change to the law on the Specialist Court would first require an intervention in the text of the Constitution, which makes its realization impossible at this moment.

Another point the lawyer highlights relates to the contradictory stance of PDK itself. He draws attention to the fact that the same party that today asks the Assembly to pass a new law, has previously contested the legitimacy of this institution, calling it unconstituted and sending the matter for review to the Constitutional Court.

Regarding the content of the proposal itself, Gashi says that it is legally unenforceable at this stage. He recalls that the initial law on the Specialist Chambers was passed on 3 August 2015, only after several constitutional amendments were made. Consequently, according to him, it is futile to think that one could touch even a comma of that law without first amending the Constitution.

Regarding the claim that the Specialist Court has overstepped its mandate, the lawyer calls this a wrong approach. He recalls that PDK’s proposal aims to focus the court’s work precisely on the accusations of human organ trafficking, mentioned in the report of Swiss senator Dick Marty at the Council of Europe. However, Gashi emphasizes, a special investigative team composed of American prosecutors investigated for four years without finding a single piece of evidence for these allegations. He adds with conviction that no member of the Kosovo Liberation Army will ever face such an accusation, not simply for lack of evidence, but because such a thing never happened.

The lawyer also rejects the possibility that through the amendment of the law, investigations could be opened into matters that have already been closed by a court ruling. He refers to the fact that the Specialist Court, after a six-year investigation and a trial lasting about three and a half years, has issued an acquittal for charges of crimes against humanity. For Gashi, it is a paradox to seek the investigation of a matter for which such a ruling already exists, and he sees these simply as political hypotheses that will bring no real effect.

Linking the initiative to the current political climate in Kosovo, Gashi estimates that it could further polarize an already fragile situation. He recalls that most of those who are in PDK today voted precisely for the law on the Specialist Court in 2015 and should have reflected then on the consequences of that action, not try to change it more than 11 years later, when things are irreversible.

As for the possible closure of the Specialist Chambers, Gashi explains that the termination of the court’s work does not depend on Pristina’s will, but on a special body within the Council of Europe or the European Union, which will decide whether it has fulfilled the purpose for which it was created. Afterwards, funding would be cut and a timeline would be given for winding down the activity.

Another important element, according to him, is the international agreement with the Netherlands as the host state. Gashi underscores that the Specialist Court has the character of an international court and the contract with the Netherlands cannot be broken unilaterally. If the Netherlands were to aim to end the agreement, a special arbitration would have to be formed to assess the consequences of this action.

In conclusion, Gashi sees this entire initiative as an episode of internal political struggle, which, despite the engagement, will yield an almost zero result. He considers any attempt to change the law as overdue and impossible, no matter how painful and unjust the court may seem. According to him, the deputies who voted that law in 2015 should have been more careful and not react now, driven by public dissatisfaction with the recent ruling against the former KLA leaders, which he says is based on evidence from Serbia.

The lawyer also raises the question of why PDK has not reacted to previous rulings of the Specialist Chambers, such as those for Pjetër Shala, Hysni Gucati, and Nasim Haradinaj. According to him, the current reaction is purely political, while the demand is addressed to a parliament that the party itself disputes as unconstituted, calling this a pure contradiction.

The Democratic Party of Kosovo deposited today in the Assembly the Draft Law on amending and supplementing the normative act that regulates the Specialist Chambers and the Specialist Prosecutor’s Office. Chairman Bedri Hamza announced that the initiative does not aim to close the court, but that the charges against the four former KLA leaders – Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selimi – be closely linked to the reasons for which that court was established and not to expanded interpretations. This initiative comes as a consequence of PDK’s public opposition to the sentence that the Specialist Chambers handed down to these figures, a ruling that the party has called unjust and unacceptable.

Sipas avokatit Tomë Gashi, propozimi i Partisë Demokratike të Kosovës për të ndryshuar Ligjin për Dhomat e Specializuara nuk ka asnjë vlerë praktike, edhe sikur të marrë dritën jeshile në Kuvend, për shkak se procesi gjyqësor në Hagë tashmë ka hyrë në një fazë të avancuar. Ai vlerëson se kjo lëvizje peshon më shumë në rrafshin politik sesa në atë ligjor.

Gashi argumenton se përtej llogaritjeve politike, nisma nuk mund të sjellë pasoja konkrete në sistemin e drejtësisë. Arsyetimi i tij është se çdo ndryshim në ligjin për Gjykatën Speciale do të kërkonte më parë një ndërhyrje në tekstin e Kushtetutës, çka e bën të pamundur realizimin e saj në këto momente.

Një tjetër pikë që avokati vë në dukje lidhet me qëndrimin kontradiktor të vetë PDK-së. Ai tërheq vëmendjen se e njëjta parti që sot i kërkon Kuvendit të miratojë një ligj të ri, e ka kontestuar më herët legjitimitetin e këtij institucioni, duke e cilësuar si të pakonstituuar dhe duke e dërguar çështjen për shqyrtim në Gjykatën Kushtetuese.

Në lidhje me përmbajtjen e vetë propozimit, Gashi shprehet se ai është juridikisht i pazbatueshëm në këtë stad. Ai kujton se ligji fillestar për Dhomat e Specializuara u miratua më 3 gusht 2015, vetëm pasi u kryen disa ndryshime kushtetuese. Për pasojë, sipas tij, është e kotë të mendohet se mund të luhet qoftë edhe një presje e atij ligji pa prekur më parë Kushtetutën.

Lidhur me pretendimin se Gjykata Speciale ka tejkaluar mandatin e saj, avokati e quan këtë një qasje të gabuar. Ai rikujton se propozimi i PDK-së synon ta përqendrojë punën e gjykatës pikërisht tek akuzat për trafikim të organeve njerëzore, të përmendura në raportin e senatorit zviceran Dick Marty në Këshillin e Evropës. Mirëpo, thekson Gashi, një trup hetues i posaçëm i përbërë nga prokurorë amerikanë hetoi për katër vjet pa gjetur as edhe një provë të vetme për këto pretendime. Ai shton me bindje se asnjë pjesëtar i Ushtrisë Çlirimtare të Kosovës nuk do të përballet kurrë me një akuzë të tillë, jo thjesht për mungesë provash, por sepse një gjë e tillë nuk ka ndodhur kurrë.

Avokati hedh poshtë edhe mundësinë që përmes ndryshimit të ligjit të hapen hetime për çështje që tashmë janë mbyllur me vendim gjyqësor. Ai i referohet faktit se Gjykata Speciale, pas një hetimi gjashtëvjeçar dhe një procesi gjyqësor që zgjati rreth tre vjet e gjysmë, ka nxjerrë aktgjykim lirues për akuzat për krime kundër njerëzimit. Për Gashin, është një paradoks të kërkosh hetimin e një çështjeje për të cilën ekziston tashmë një vendim i tillë, dhe këto ai i sheh thjesht si hipoteza politike që nuk do të sjellin asnjë efekt real.

Duke e lidhur iniciativën me klimën aktuale politike në Kosovë, Gashi vlerëson se ajo mund të arrijë të polarizojë edhe më tej një situatë tashmë të brishtë. Ai kujton se shumica e atyre që sot janë në PDK e kanë votuar pikërisht ligjin për Gjykatën Speciale në vitin 2015 dhe duhej të reflektonin që atëherë për pasojat e atij veprimi, jo të përpiqen ta ndryshojnë atë më shumë se 11 vjet më vonë, kur gjërat janë të pakthyeshme.

Për sa i përket mbylljes së mundshme të Dhomave të Specializuara, Gashi shpjegon se ndërprerja e punës së gjykatës nuk varet nga vullneti i Prishtinës, por nga një trup i posaçëm brenda Këshillit të Evropës ose Bashkimit Evropian, i cili do të vendosë nëse ajo e ka përmbushur qëllimin për të cilin u krijua. Më pas, fondet do të ndërpriten dhe do të jepej një afat kohor për përmbylljen e veprimtarisë.

Një element tjetër i rëndësishëm, sipas tij, është edhe marrëveshja ndërkombëtare me Holandën si shtet nikoqir. Gashi nënvizon se Gjykata Speciale ka karakterin e një gjykate ndërkombëtare dhe kontrata me Holandën nuk mund të prishet në mënyrë të njëanshme. Nëse Holanda do të synonte t’i jepte fund marrëveshjes, do të duhej të formohej një arbitrazh i posaçëm për të vlerësuar pasojat e këtij veprimi.

Në përfundim, Gashi e sheh gjithë këtë nismë si një episod të luftës politike të brendshme, e cila pavarësisht angazhimit, do të japë një rezultat gati zero. Ai e konsideron të vonuar dhe të pamundur çdo përpjekje për të ndryshuar ligjin, pavarësisht se sa e dhimbshme dhe e padrejtë mund të duket gjykata. Sipas tij, deputetët që e votuan atë ligj në vitin 2015 duhej të kishin qenë më të kujdesshëm dhe jo të reagojnë tani, të udhëhequr nga pakënaqësia publike ndaj aktgjykimit të fundit ndaj ish-krerëve të UÇK-së, të cilin ai e quan të bazuar në prova të Serbisë.

Avokati ngre edhe pyetjen se përse PDK-ja nuk ka reaguar ndaj vendimeve të mëparshme të Dhomave të Specializuara, si ato për Pjetër Shalën, Hysni Gucatin e Nasim Haradinajn. Sipas tij, reagimi i tanishëm është thjesht politik, ndërkohë që kërkesa i drejtohet një parlamenti që vetë partia e konteston si të pakonstituuar, duke e cilësuar këtë si një kontradiktë të pastër.

Partia Demokratike e Kosovës depozitoi sot në Kuvend Projektligjin për plotësimin dhe ndryshimin e aktit normativ që rregullon Dhomat e Specializuara dhe Zyrën e Prokurorit të Specializuar. Kryetari Bedri Hamza bëri të ditur se nisma nuk synon mbylljen e gjykatës, por që akuzat ndaj katër ish-udhëheqësve të UÇK-së – Hashim Thaçi, Kadri Veseli, Jakup Krasniqi dhe Rexhep Selimi – të lidhen ngushtë me arsyet për të cilat u themelua ajo gjykatë dhe jo me interpretime të zgjeruara. Kjo nismë vjen si pasojë e kundërshtimit publik të PDK-së ndaj dënimit që Dhomat e Specializuara u dhanë këtyre figurave, një vendim që partia e ka quajtur të padrejtë dhe të papranueshëm.

Afrim Gashi, Speaker of the Assembly of North Macedonia, said that no court ruling can undo the fact that Hashim Thaçi, Jakup Krasniqi, Kadri Veseli and Rexhep Selimi are part of one of the most glorious chapters in Kosovo’s history.

Reacting after the Specialist Chambers’ guilty verdict against the former KLA leaders, Gashi stressed that, for the Albanian people, they have been and continue to be liberators.

He added that the proceedings before the Specialist Chambers do not end with this ruling, as the legal battle will continue at the appeals stage.

In his full Facebook post, Gashi wrote:

At a time when Kosovo’s freedom, as well as peace and stability in the region, remained ideals that still had to be fought for, they showed the courage to commit themselves and assumed the historic responsibility of bringing freedom to their people.

In the eyes of the Albanian people, they are and will remain Kosovo’s liberators. It was precisely the KLA’s struggle, and the sacrifice and selflessness of its leaders and members, that paved the way for Kosovo’s liberation and the beginning of a new era of peace and stability for the region.

The ruling issued today is at first instance, so the pursuit of justice will continue.

For this reason, today we must remain united, calm and dignified, showing that our thoughts and hearts are with the liberators and their families.

The struggle for a free Kosovo was the most difficult battle, and they managed to win it. A free Kosovo remains the testament of the generation that had the courage to dream of freedom, but also the consolation that should give us the strength to face today’s ruling and other challenges.

Vullnet Gashi has been sentenced by the Basic Court in Prishtina to 1 year and 4 months in prison after being found guilty for the fatal accident that took the life of professor Ferhat Bejtullahu.

The decision was made public on Wednesday by judge Driton Berisha. In addition to imprisonment, the court also decided to revoke Gashi’s driver’s license, prohibiting him from obtaining a new driving permit for a period of four years.

The accident occurred on December 2, 2023, on “Bill Clinton” street in Prishtina. According to the indictment filed on February 27, 2024, by the Basic Prosecutor’s Office in Prishtina, Gashi was driving the vehicle without a driver’s license and was moving in the lane reserved for buses and taxis.

The prosecution had argued that the defendant did not adjust his speed to the traffic conditions. While driving, the front part of his vehicle hit Ferhat Bejtullahu, who was crossing the road. Due to the injuries sustained, Bejtullahu died.

In his closing statement, prosecutor Ardian Mehmeti sought an effective prison sentence for Gashi. He emphasized that, before the accident, the defendant had been convicted 117 times for traffic violations and that even on the day of the incident he was driving without a driver’s license.

During the initial hearing, Vullnet Gashi had pleaded not guilty.

The decision of the Basic Court in Prishtina is not final, as the parties have the right to appeal.

Aksidenti ndodhi më 2 dhjetor 2023, në rrugën “Bill Clinton” në Prishtinë. Sipas aktakuzës së ngritur më 27 shkurt 2024 nga Prokuroria Themelore në Prishtinë, Gashi drejtonte automjetin pa patentë-shofer dhe po lëvizte në shiritin e rezervuar për autobusë dhe taksi.

Prokuroria kishte argumentuar se i akuzuari nuk e kishte përshtatur shpejtësinë me kushtet e trafikut. Gjatë lëvizjes, pjesa e përparme e automjetit të tij e goditi Ferhat Bejtullahun, i cili po kalonte rrugën. Për shkak të plagëve të pësuara, Bejtullahu ndërroi jetë.

Në fjalën përfundimtare, prokurori Ardian Mehmeti kërkoi një dënim efektiv me burgim për Gashin. Ai nënvizoi se, para aksidentit, i akuzuari ishte dënuar 117 herë për kundërvajtje në trafik dhe se edhe në ditën e ngjarjes ishte në drejtim të automjetit pa patentë-shofer.

Gjatë shqyrtimit fillestar, Vullnet Gashi ishte deklaruar i pafajshëm.

Six deputies from the Democratic League of Kosovo, together with the Democratic Party of Kosovo and the Alliance for the Future of Kosovo, have declared that they will not support presidential candidate Bekim Sejdiu, who was nominated through the agreement between LVV and LDK.

Avdullah Hoti, Hykmete Bajrami, Kujtim Shala, Arben Gashi, Armend Zemaj and Janina Ymeri are the six LDK deputies who oppose the agreement on the election of the president. They have justified their position as opposition to cooperation with LVV and to the “extension of Albin Kurti’s rule.”

PDK and AAK, meanwhile, made their opposition clear from the outset, regardless of the name of the proposed candidate.

PDK, which has 22 deputies in the Assembly of Kosovo, has rejected cooperation with Kurti both on forming the government and on electing the president. The party has declared that it will remain in opposition during this term.

AAK, with seven deputies, has set six conditions for supporting the institutions and has refused to meet with Kurti until those demands are met.

Political analyst Lirim Gashi was asked in a statement to “Bota sot” whether PDK and AAK should reconsider their position and vote for Bekim Sejdiu. According to him, both parties should seriously consider this possibility.

Gashi stresses that a vote for Sejdiu should not automatically be viewed as support for the Kurti-Abdixhiku agreement, as it could primarily represent an effort to make the institutions functional.

“I think PDK and AAK should seriously reconsider their position. This would not be a favor to Albin Kurti, Lumir Abdixhiku or any other political entity, but a decision in the interest of Kosovo and its citizens.

If it has long been demanded that the country be freed from institutional deadlock, then a concrete opportunity to overcome it should be addressed with state responsibility and not solely through party calculations.

Support for Bekim Sejdiu should not necessarily be interpreted as a vote in favor of the Kurti-Abdixhiku agreement. Above all, it may be a vote for the functioning of the state. An opposition party should not fear making the institutions functional simply because a political agreement has created this opportunity,” Gashi declared.

According to the analyst, the opposition has the right not to support every agreement reached by the majority. However, it must distinguish between political opposition and the obligation to protect the institutional interest.

“It is PDK and AAK’s right not to support the candidacy. Democracy gives them the opportunity to oppose, disagree and propose alternatives.

But this right also comes with responsibility. If these parties have specific objections to Bekim Sejdiu, concerning his integrity, competence, experience or suitability for the office of president, they should make them clear to the public.

If, on the other hand, the main reason for the rejection is simply the fact that Sejdiu is the result of an agreement between LVV and LDK, then the party agreement is being placed above the needs of the institutions.

The president of Kosovo is not the president of LVV, LDK, PDK or AAK. He must be the President of the Republic of Kosovo,” Gashi told “Bota sot.”

He warned that the country could once again become caught in a cycle of political deadlock. According to Gashi, Kosovo cannot continually return to the same vicious circle, in which parties demand functioning institutions when they are in opposition but regard compromise as a political loss when it becomes possible.

Gashi called on PDK and AAK not to treat the situation as a competition to determine which entity is gaining points against the other, but as an opportunity to end the institutional deadlock.

“The risk is real and should not be underestimated. Kosovo cannot afford to remain stuck in the same cycle, in which the functioning of institutions is demanded only by the opposition, while a concrete compromise is viewed as a loss as soon as it emerges.

Such an approach does not serve democracy, much less the state. Politics also involves compromise. In a healthy democracy, the side that gets everything it demands does not always win. In some cases, the state wins precisely when the parties agree to give up part of their demands.

It would be more useful for PDK and AAK to view this moment as an opportunity to close a long chapter of deadlock, rather than as a confrontation to measure who is benefiting politically.

A political agreement should not be judged solely by the benefit to one party, but also by what society and the state gain,” he said.

Asked whether the rejection of Sejdiu stemmed from a political principle or from a clash with the new majority, Gashi said that PDK and AAK themselves should determine this.

However, he assessed that the debate should move away from who nominated Sejdiu and focus on the question of what kind of president he could be for the Republic of Kosovo.

“I would not attribute motives to PDK and AAK that they themselves have not stated. But a principled position must be supported by equally principled arguments.

If the reason is that Sejdiu is the candidate of the Kurti-Abdixhiku agreement, then we are dealing with political opposition. If the rejection is related to his personality, professionalism, experience or vision for the institution of the president, then we have an argument that should be seriously discussed.

Therefore, attention should shift from the question of who nominated Bekim Sejdiu to what role he could play and what kind of president he could be for the Republic of Kosovo. This would elevate the debate from party calculations to the level of institutional interest,” the analyst stressed.

Gashi considers Sejdiu a candidate emerging from an interparty agreement and views this as a positive development. He says that LVV and LDK have shown a willingness to compromise on an issue important to the functioning of the institutions.

“I would be cautious about using the term ‘consensus candidate.’ In the fullest sense, a consensus candidate would be one who enjoys significantly broader political support.

Nevertheless, it cannot be denied that Bekim Sejdiu is the result of an interparty agreement, and that in itself is positive. LVV and LDK have shown that they are willing to compromise on an issue of particular importance to the functioning of the institutions.

Now the opposition must also show whether it is willing to take a step toward compromise if it believes this serves the Republic. Consensus is not created simply by asking the other side to move. It is built when each side agrees to change its own position,” Gashi added.

The analyst called on PDK and AAK, if they consider Sejdiu unsuitable for the post, to explain the reasons to citizens using concrete arguments.

“My message would be simple: do not vote for Kurti and do not vote for Abdixhiku, but vote for the person you consider best for the Republic of Kosovo.

If you believe that Bekim Sejdiu is worthy and suitable for this duty, then support him. If you believe the opposite, citizens should be clearly informed, with arguments, why he should not be voted for.

What must be avoided is turning Kosovo into a hostage of an endless conflict between the parties. Citizens do not view the state through party trenches. They want to know whether the institutions are working, whether the country is progressing and whether politics is capable of finding solutions.

The main question should not be who won, LVV or PDK. The question should be whether the institutions are functional, whether the state is acting and whether Kosovo is moving forward. This should guide every political decision,” he underlined.

In conclusion, Gashi said that Kosovo does not need another party winner, but a result that strengthens the institutions.

“If Bekim Sejdiu is a worthy candidate, PDK and AAK should not be afraid to vote for him merely out of fear that such an action could strengthen Kurti.

A functioning state strengthens not only the government but also the opposition. To be strong, the opposition does not need blocked institutions. It should challenge the government within functioning institutions, through arguments, alternatives and better policies.

If PDK and AAK have continually demanded that the institutions be made functional, now is the time to prove that this position was not merely a tool for criticizing the majority, but a sincere belief in the interest of the Republic.

Parties and governments change, as do majorities. Institutions remain, and the state must always stand above any party,” Gashi concluded.

Gjashtë deputetë të Lidhjes Demokratike të Kosovës, së bashku me Partinë Demokratike të Kosovës dhe Aleancën për Ardhmërinë e Kosovës, kanë deklaruar se nuk do ta mbështesin kandidatin për president, Bekim Sejdiun, i cili u propozua përmes marrëveshjes së LVV-së me LDK-në.

Avdullah Hoti, Hykmete Bajrami, Kujtim Shala, Arben Gashi, Armend Zemaj dhe Janina Ymeri janë gjashtë deputetët e LDK-së që kundërshtojnë marrëveshjen për zgjedhjen e presidentit. Ata e kanë arsyetuar qëndrimin e tyre si kundërshtim ndaj bashkëpunimit me LVV-në dhe ndaj “zgjatjes së pushtetit” të Albin Kurtit.

PDK-ja dhe AAK-ja, ndërkaq, e kanë bërë të ditur kundërshtimin e tyre që në fillim, pa marrë parasysh emrin e kandidatit të propozuar.

PDK-ja, e cila në Kuvendin e Kosovës ka 22 deputetë, ka refuzuar bashkëpunimin me Kurtin si për formimin e Qeverisë, ashtu edhe për zgjedhjen e presidentit. Kjo parti ka deklaruar se gjatë këtij mandati do të mbetet në opozitë.

AAK-ja, me shtatë deputetë, ka vendosur gjashtë kushte për mbështetjen e institucioneve dhe ka refuzuar takimin me Kurtin pa u përmbushur më parë këto kërkesa.

Analisti politik Lirim Gashi, në një deklaratë për “Bota sot”, është pyetur nëse PDK-ja dhe AAK-ja duhet ta rishikojnë qëndrimin e tyre dhe ta votojnë Bekim Sejdiun. Sipas tij, të dyja partitë duhet ta shqyrtojnë seriozisht këtë mundësi.

Gashi thekson se vota për Sejdiun nuk duhet të shihet automatikisht si mbështetje për marrëveshjen Kurti-Abdixhiku, pasi ajo mund të nënkuptojë para së gjithash përpjekjen për funksionalizimin e institucioneve.

“Mendoj se PDK-ja dhe AAK-ja duhet ta rishqyrtojnë seriozisht qëndrimin e tyre. Kjo nuk do të ishte një favor për Albin Kurtin, Lumir Abdixhikun apo ndonjë subjekt tjetër politik, por një vendim në interes të Kosovës dhe qytetarëve të saj.

Nëse për një kohë të gjatë është kërkuar që vendi të çlirohet nga bllokada institucionale, atëherë një mundësi konkrete për tejkalimin e saj duhet të trajtohet me përgjegjësi shtetërore dhe jo vetëm përmes llogarive partiake.

Mbështetja për Bekim Sejdiun nuk duhet interpretuar medoemos si votë pro marrëveshjes Kurti-Abdixhiku. Ajo mund të jetë, mbi të gjitha, votë për funksionimin e shtetit. Një parti opozitare nuk duhet të frikësohet nga funksionalizimi i institucioneve vetëm pse një marrëveshje politike e ka krijuar këtë mundësi”, ka deklaruar Gashi.

Sipas analistit, opozita ka të drejtë të mos e përkrahë çdo marrëveshje të arritur nga shumica. Megjithatë, ajo duhet të dallojë mes kundërshtimit politik dhe detyrimit për të mbrojtur interesin institucional.

“Është e drejtë e PDK-së dhe AAK-së të mos e mbështesin kandidaturën. Demokracia u jep mundësinë të kundërshtojnë, të mos pajtohen dhe të propozojnë alternativa.

Por kjo e drejtë shoqërohet edhe me përgjegjësi. Nëse këto parti kanë vërejtje të caktuara për Bekim Sejdiun, për integritetin, kompetencat, përvojën ose përshtatshmërinë e tij për postin e presidentit, ato duhet t’ia bëjnë të qarta opinionit publik.

Nëse, në anën tjetër, arsyeja kryesore e refuzimit është vetëm fakti se Sejdiu është rezultat i marrëveshjes mes LVV-së dhe LDK-së, atëherë marrëveshja partiake po vendoset mbi nevojën e institucioneve.

Presidenti i Kosovës nuk është president i LVV-së, LDK-së, PDK-së apo AAK-së. Ai duhet të jetë President i Republikës së Kosovës”, ka thënë Gashi për “Bota sot”.

Ai paralajmëron se vendi mund të përfshihet sërish nga një cikël i bllokimit politik. Sipas Gashit, Kosova nuk mund të rikthehet vazhdimisht në të njëjtin rreth vicioz, ku partitë kërkojnë institucione funksionale kur janë në opozitë, por e konsiderojnë kompromisin si humbje politike kur ai bëhet i mundur.

Gashi u bën thirrje PDK-së dhe AAK-së që situatën të mos e trajtojnë si një garë për të përcaktuar se cili subjekt po fiton pikë ndaj tjetrit, por si një mundësi për t’i dhënë fund bllokadës institucionale.

“Rreziku është real dhe nuk duhet nënvlerësuar. Kosova nuk ka luksin të mbetet gjithmonë në të njëjtin cikël, ku funksionalizimi i institucioneve kërkohet vetëm nga opozita, ndërsa një kompromis konkret shihet si humbje sapo paraqitet.

Një qasje e tillë nuk i shërben demokracisë dhe aq më pak shtetit. Politika përfshin edhe kompromisin. Në një demokraci të shëndetshme nuk fiton gjithmonë pala që merr gjithçka që kërkon. Në disa raste, shteti fiton pikërisht kur palët pranojnë të heqin dorë nga një pjesë e kërkesave të tyre.

Do të ishte më e dobishme që PDK-ja dhe AAK-ja ta shihnin këtë moment si një mundësi për mbylljen e një kapitulli të gjatë të bllokadës, jo si përballje për të matur se kush po përfiton politikisht.

Një marrëveshje politike nuk duhet vlerësuar vetëm sipas përfitimit të një partie, por edhe sipas asaj që fitojnë shoqëria dhe shteti”, është shprehur ai.

I pyetur nëse refuzimi i Sejdiut buron nga një parim politik apo nga një përplasje me shumicën e re, Gashi ka thënë se këtë duhet ta përcaktojnë vetë PDK-ja dhe AAK-ja.

Megjithatë, ai vlerëson se debati duhet të largohet nga fakti se kush e ka propozuar Sejdiun dhe të përqendrohet te pyetja se çfarë presidenti do të mund të ishte ai për Republikën e Kosovës.

“Nuk do t’u atribuoja PDK-së dhe AAK-së motive që ato nuk i kanë deklaruar vetë. Por një qëndrim parimor duhet të mbështetet në argumente po të tilla.

Nëse arsyeja është se Sejdiu është kandidat i marrëveshjes Kurti-Abdixhiku, atëherë kemi të bëjmë me një kundërshtim politik. Nëse refuzimi lidhet me personalitetin e tij, profesionalizmin, përvojën ose vizionin për institucionin e presidentit, atëherë kemi një argument që duhet të diskutohet seriozisht.

Prandaj, vëmendja duhet të zhvendoset nga pyetja se kush e propozoi Bekim Sejdiun te ajo se çfarë roli dhe çfarë Presidenti mund të jetë ai për Republikën e Kosovës. Kështu debati do të ngrihej nga kalkulimi partiak në nivelin e interesit institucional”, ka theksuar analisti.

Gashi e konsideron Sejdiun një kandidat të dalë nga një marrëveshje ndërpartiake dhe e sheh këtë si zhvillim pozitiv. Ai thotë se LVV-ja dhe LDK-ja kanë shfaqur gatishmëri për kompromis lidhur me një çështje të rëndësishme për funksionimin e institucioneve.

“Do të isha i kujdesshëm në përdorimin e shprehjes ‘kandidat konsensual’. Në kuptimin e plotë, kandidat konsensual do të ishte ai që gëzon pajtim dukshëm më të gjerë politik.

Megjithatë, nuk mund të mohohet se Bekim Sejdiu është rezultat i një marrëveshjeje ndërpartiake, dhe kjo në vetvete është pozitive. LVV-ja dhe LDK-ja kanë treguar se janë të gatshme të bëjnë kompromis për një çështje me rëndësi të veçantë për funksionimin institucional.

Tashmë edhe opozita duhet të tregojë nëse është e gatshme të bëjë një hap drejt kompromisit, nëse vlerëson se kjo i shërben Republikës. Konsensusi nuk krijohet vetëm duke kërkuar që pala tjetër të lëvizë. Ai ndërtohet atëherë kur secila palë pranon të ndryshojë pozicionin e vet”, ka shtuar Gashi.

Analisti u ka kërkuar PDK-së dhe AAK-së që, nëse e vlerësojnë Sejdiun si të papërshtatshëm për postin, t’ua shpjegojnë qytetarëve arsyet me argumente konkrete.

“Mesazhi im do të ishte i thjeshtë: mos votoni Kurtin dhe mos votoni Abdixhikun, por votoni atë që e konsideroni më të mirë për Republikën e Kosovës.

Nëse mendoni se Bekim Sejdiu është i denjë dhe i përshtatshëm për këtë detyrë, atëherë mbështeteni. Nëse mendoni të kundërtën, qytetarët duhet të informohen qartë dhe me argumente se përse nuk duhet votuar.

Ajo që duhet shmangur është kthimi i Kosovës në peng të një konflikti të pafundëm mes partive. Qytetarët nuk e shohin shtetin përmes llogoreve partiake. Ata duan të dinë nëse institucionet punojnë, nëse vendi po përparon dhe nëse politika është në gjendje të gjejë zgjidhje.

Pyetja kryesore nuk duhet të jetë se kush fitoi, LVV-ja apo PDK-ja. Duhet të pyetet nëse institucionet janë funksionale, nëse shteti po vepron dhe nëse Kosova po ecën përpara. Kjo duhet të udhëheqë çdo vendim politik”, ka nënvizuar ai.

Në përfundim, Gashi ka thënë se Kosovës nuk i nevojitet një tjetër fitues partiak, por një rezultat që forcon institucionet.

“Nëse Bekim Sejdiu është kandidat i denjë, PDK-ja dhe AAK-ja nuk duhet të druhen ta votojnë vetëm nga frika se një veprim i tillë mund ta fuqizojë Kurtin.

Një shtet funksional nuk e forcon vetëm qeverinë, por edhe opozitën. Për të qenë e fortë, opozita nuk ka nevojë për institucione të bllokuara. Ajo duhet ta sfidojë qeverinë brenda institucioneve që funksionojnë, përmes argumenteve, alternativave dhe politikave më të mira.

Nëse PDK-ja dhe AAK-ja e kanë kërkuar vazhdimisht funksionalizimin e institucioneve, tani është koha të dëshmojnë se ky qëndrim nuk ka qenë thjesht mjet për kritikën ndaj shumicës, por një bindje e sinqertë në interes të Republikës.

Partitë dhe qeveritë ndryshojnë, ashtu siç ndryshojnë edhe shumicat. Institucionet mbeten dhe shteti duhet të jetë gjithmonë mbi çdo parti”, ka përfunduar Gashi.

Lumir Abdixhiku secured the majority of votes to continue as chairman of the LDK at the party’s General Assembly, held on 30 July.

LDK MP Arben Gashi stated that the unsuccessful attempt to remove Abdixhiku from the leadership has not caused resentment, describing it as part of the democratic functioning within the party.

According to Gashi, some of the structures sought a different political direction because they believed that, under current circumstances, Abdixhiku was no longer the suitable figure to lead the LDK.

He said that the decision resulting from the vote must be respected and that this process does not have to turn into a personal conflict between party members.

On the programme “Intervista e Javës”, Gashi described this as a normal democratic development, admitting that supporters of the change still do not constitute a majority. He added that if, in the future, an overwhelming majority of LDK members and delegates agrees that the party needs a different dynamic and new movements, then the chairman could also be changed. Gashi underlined that their goal is not to eliminate the chairman of this party or any other party, while repeating that there is no reason for resentment, as it would harm both sides.

Referring to the figures of the process, he said that 152 delegates to the Assembly, out of 355 in total or 327 who were present, assessed that Abdixhiku, at the current stage, does not inspire enough to win elections for the LDK. According to them, he cannot be the contact and dialogue person who would secure the maximum during the constitution of institutions and in a negotiation process.

Lumir Abdixhiku siguroi shumicën e votave për të vazhduar në postin e kryetarit të LDK-së në Kuvendin e Përgjithshëm të partisë, të zhvilluar më 30 korrik.

Deputeti i LDK-së, Arben Gashi, deklaroi se përpjekja e pasuksesshme për ta larguar Abdixhikun nga udhëheqja nuk ka shkaktuar hatërmbetje, duke e cilësuar atë si pjesë të funksionimit demokratik brenda partisë.

Sipas Gashit, disa prej strukturave kërkuan një orientim tjetër politik, sepse mendonin se, në rrethanat aktuale, Abdixhiku nuk ishte më figura e përshtatshme për ta drejtuar LDK-në.

Ai tha se vendimi i dalë nga votimi duhet respektuar dhe se ky proces nuk ka pse të shndërrohet në konflikt personal mes anëtarëve të partisë.

Në emisionin “Intervista e Javës”, Gashi e përshkroi këtë si një zhvillim normal demokratik, duke pranuar se përkrahësit e ndryshimit ende nuk përbëjnë shumicën. Ai shtoi se, nëse në të ardhmen shumica dërrmuese e anëtarëve dhe delegatëve të LDK-së pajtohet se partisë i duhet një dinamikë tjetër dhe lëvizje të reja, atëherë mund të ndryshohet edhe kryetari. Gashi nënvizoi se synimi i tyre nuk është eliminimi i kryetarit, i kësaj apo i ndonjë partie tjetër, ndërsa përsëriti se nuk ka arsye për hatërmbetje, pasi ajo do t’u kalojë të dyja palëve.

Duke iu referuar shifrave të procesit, ai tha se 152 delegatë të Kuvendit, nga 355 gjithsej ose nga 327 që ishin të pranishëm, vlerësuan se Abdixhiku, në fazën aktuale, nuk frymëzon mjaftueshëm për t’i fituar zgjedhjet për LDK-në. Sipas tyre, ai nuk mund të jetë as personi kontaktues dhe dialogues që do të siguronte maksimumin gjatë konstituimit të institucioneve dhe në një proces bisedimesh.
