The Basic Court in Pristina recently ordered one month of pretrial detention for Fehim Salit, who is suspected of espionage.

The court’s decision was also based on the assessment that there is a risk of influencing witnesses and tampering with evidence, as well as the possibility that the criminal offense could be repeated or continue.

Security expert Fidair Berisha said that every suspected case of espionage requires special treatment, as such activity could directly threaten national security.

“Suspicions of espionage must be treated with the utmost seriousness, particularly when they are supported by concrete evidence and are linked to national security interests. However, at this stage, a clear distinction must be made between reasonable suspicion and proven guilt. Justice institutions and investigative bodies must be given the opportunity to analyze and clarify the case in its entirety, as they are the authorities that can make the greatest contribution to shedding light on the specific matter,” Berisha said.

He added that, from a security perspective, it must be determined what information is suspected of having been obtained or relayed, to whom it was sent, what the purpose was and whether it had consequences for the strategic interests of the Republic of Kosovo.

Berisha emphasized that the investigation must be broad and include tracing contacts, communication channels and any other data that could help fully clarify the case.

“In an investigation into suspected espionage, attention should not be focused solely on the alleged act. Evidence must be collected, contacts and communication channels identified, and it must be assessed whether this concerns an isolated activity or part of a broader operation.

Institutions must always take into account the possibility of influencing witnesses or interfering with evidence. This risk becomes particularly important if the person has had access to information, contacts or structures relevant to the investigation. The risk of the suspected activity continuing must also be carefully assessed, but only in accordance with legal standards and on the basis of concrete evidence,” he stressed.

According to the security expert, confirmation of the suspicions during the investigation would turn the matter into a case with direct consequences for national security.

“If the investigations confirm the suspicions of espionage, then we are potentially dealing with a serious national security matter. The risk lies not only in the information that may have been compromised, but also in the possibility that an external actor may have secured access, contacts or channels of influence within our institutions or society.

For this reason, the investigation should not be limited to the question of whether only one individual is involved. It must be professionally examined whether other people are involved, whether there are organizational or financial links, and whether the suspected activity was part of a broader structure.

This case must be treated seriously, but also with great institutional care. In the field of intelligence and counterintelligence, professionalism, preservation of evidence and coordination among institutions are equally important. What must not happen is either the minimization of the risk or the drawing of conclusions before the investigation has been fully completed!” Berisha concluded in an interview with “Bota Sot”.

Gjykata Themelore në Prishtinë ka vendosur, ditë më parë, masën e paraburgimit prej një muaji ndaj Fehim Salit, i cili dyshohet për spiunazh.

Vendimi i gjykatës është mbështetur edhe në vlerësimin se ekziston rreziku i ndikimit te dëshmitarët dhe provat, si dhe mundësia që vepra penale të përsëritet ose të vazhdojë.

Eksperti i sigurisë, Fidair Berisha, deklaroi se çdo rast i dyshuar spiunazhi kërkon trajtim të posaçëm, pasi një veprimtari e tillë mund të cenojë drejtpërdrejt sigurinë kombëtare.

“Dyshimet për spiunazh duhet të trajtohen me seriozitet të plotë, veçanërisht kur mbështeten në prova konkrete dhe lidhen me interesat e sigurisë kombëtare. Por, në këtë fazë, duhet të bëhet qartë dallimi mes dyshimit të arsyeshëm dhe fajësisë së vërtetuar. Institucioneve të drejtësisë dhe organeve hetimore duhet t’u lihet mundësia ta analizojnë e sqarojnë rastin në tërësi, pasi ato janë autoritetet që mund të japin kontributin kryesor për zbardhjen e çështjes konkrete”, tha Berisha.

Ai shtoi se, nga perspektiva e sigurisë, duhet të përcaktohet se çfarë informacioni dyshohet se është marrë ose përcjellë, kujt i është dërguar, cili ka qenë qëllimi dhe nëse ka pasur pasoja për interesat strategjike të Republikës së Kosovës.

Berisha nënvizoi se hetimi duhet të jetë i gjerë dhe të përfshijë gjurmimin e kontakteve, kanaleve të komunikimit dhe çdo të dhëne tjetër që mund të ndihmojë në sqarimin e plotë të rastit.

“Në një hetim për spiunazh të dyshuar, vëmendja nuk duhet të përqendrohet vetëm te veprimi i pretenduar. Duhet të mblidhen provat, të identifikohen kontaktet e kanalet e komunikimit dhe të vlerësohet nëse bëhet fjalë për një aktivitet të veçuar apo për pjesë të një veprimtarie më të gjerë.

Institucionet duhet të marrin parasysh gjithmonë mundësinë e ndikimit te dëshmitarët ose të ndërhyrjes në prova. Ky rrezik bëhet veçanërisht i rëndësishëm nëse personi ka pasur qasje në informacione, kontakte apo struktura me rëndësi për hetimin. Po ashtu, duhet të vlerësohet me kujdes edhe rreziku i vazhdimit të veprimtarisë së dyshuar, por vetëm në përputhje me standardet ligjore dhe mbi bazën e provave konkrete”, theksoi ai.

Sipas ekspertit të sigurisë, vërtetimi i dyshimeve gjatë hetimit do ta shndërronte çështjen në një rast me pasoja të drejtpërdrejta për sigurinë kombëtare.

“Nëse hetimet konfirmojnë dyshimet për spiunazh, atëherë kemi potencialisht të bëjmë me një çështje serioze të sigurisë kombëtare. Rreziku nuk qëndron vetëm te informacioni që mund të jetë komprometuar, por edhe te mundësia që një aktor i jashtëm të ketë siguruar qasje, kontakte ose kanale ndikimi brenda institucioneve apo shoqërisë sonë.

Për këtë arsye, hetimi nuk duhet të kufizohet te pyetja nëse përfshihet vetëm një individ. Duhet të shqyrtohet në mënyrë profesionale nëse ka persona të tjerë të përfshirë, nëse ka lidhje organizative apo financiare dhe nëse aktiviteti i dyshuar ka qenë pjesë e një strukture më të gjerë.

Ky rast duhet të trajtohet me seriozitet, por njëkohësisht edhe me kujdes të madh institucional. Në fushën e zbulimit-kundërzbulimit, profesionalizmi, ruajtja e provave dhe bashkërendimi mes institucioneve kanë rëndësi të barabartë. Ajo që nuk duhet të ndodhë është as minimizimi i rrezikut, as nxjerrja e përfundimeve përpara përfundimit të plotë të hetimit!”, përfundoi Berisha për “Bota sot”.

Security expert Fidair Berisha, in a statement to “Bota sot”, opposed the statements of Serbian President Aleksandar Vučić, assessing that they are aimed at downplaying Milan Radoičić’s responsibility for the attack in Banjska.

Berisha said: “Of course, I see this statement by President Vučić as a continuation of an approach aimed at relativizing Milan Radoičić’s responsibility for the terrorist attack in Banjska. The claim that he is not being prosecuted for crime, but only ‘because of Kosovo’, runs counter to the fact that Radoičić has publicly taken responsibility for organizing the attack and that there is an Interpol Red Notice against him based on criminal proceedings carried out by the Kosovo authorities.”

According to him, such an approach by Serbia sends a worrying signal, as it gives the impression that political protection is being offered to a person accused of the attack in Banjska.

He stressed that this issue is not only about relations between Kosovo and Serbia, but also about respect for the rule of law and international cooperation in the fight against crime and terrorism.

“I think this approach sends a worrying message, because it creates the impression of political protection for a person accused of a serious armed attack. This is not only a matter of Kosovo–Serbia relations, but also of respect for the principle of the rule of law and international cooperation in the fight against crime and terrorism.

I believe international partners should take this rhetoric seriously and demand full cooperation from Serbia with justice mechanisms. If a person wanted for such an attack remains politically protected and does not face justice, this risks damaging the credibility of Serbia’s commitments to the rule of law and regional stability,” he underlined to “Bota sot”.

Security expert Bedri Elezi also assessed that Aleksandar Vučić’s statements about Milan Radoičić constitute a challenge to international justice and seek to shift a criminal case linked to the Banjska attack into a political framework.

According to Elezi, this reflects a lack of willingness on Serbia’s part to cooperate in pursuing criminal accountability.

He said: “The statements of the President of Serbia, Aleksandar Vučić, regarding Milan Radoičić no longer constitute merely a political position, but an open challenge to the fundamental principles of international justice and legal cooperation between states.

The claim that Radoičić ‘is not wanted for crime, but because of Kosovo’ is a clear attempt to shift a serious criminal matter into a political narrative. This narrative runs counter to the fact that the case is linked to the armed attack in Banjska in 2023, an incident that directly undermined the security of the institutions of the Republic of Kosovo and regional stability.

Instead of institutional distancing from an individual who has publicly taken responsibility for such an act, the political discourse from Belgrade has moved toward relativization and indirect protection. This approach creates a serious perception in international opinion that there is a lack of political will to cooperate in pursuing criminal accountability, especially when it affects structures linked to state interests.”

Elezi added that the Banjska case should not be seen as an isolated event, but as a case that requires investigation into the supporting structures and political responsibility as well. According to him, the lack of a comprehensive indictment opens the way for political denial and distortion of the facts.

“The Banjska case cannot be treated as an isolated criminal episode. It represents a pattern of the organization of structured violence, where the key questions are not only related to the perpetrators, but to the possible chain of command, logistical support and political backing. This is precisely where the most sensitive dimension arises: state and political responsibility, which cannot be hidden behind declarative narratives.

In this context, the absence of a comprehensive indictment that addresses not only the direct perpetrators, but also the supporting structures and the possible interstate dimension, constitutes a serious gap in the legal handling of the case. This institutional vacuum gives space to political denial and distortion of the facts.

Therefore, Vučić’s statements are not merely political comment, but part of a discourse that risks normalizing impunity for acts of organized violence. If such figures are politically protected instead of being legally distanced, then not only the rule of law in Serbia is called into question, but also the seriousness of its international commitments.”

In the end, Elezi stressed that the Banjska issue is now a test for international justice and that criminal accountability must not be replaced with political narratives.

“This case now goes beyond the Kosovo–Serbia framework. It is a test for the European Union and international partners: whether the principle of criminal accountability is applied without double standards, or whether political narratives are allowed to replace legal responsibility.

In the end, Banjska remains a dividing line between two worlds: that of an international order based on law, and that of the politics of force, where responsibility is relativized and violence is treated as a justifiable political instrument,” he concluded for “Bota sot”.

Presidenti i Serbisë, Aleksandar Vuçiq, tha të hënën se Milan Radoiçiq, i cili ka pranuar përgjegjësinë për sulmin e armatosur kundër Policisë së Kosovës në Banjskë të Zveçanit në vitin 2023 dhe për të cilin është lëshuar një “Red Notice” nga Interpol, nuk po përballet me ndjekje penale për ndonjë vepër kriminale.

Siç u shpreh Vuçiq, procedurat që lidhen me të nuk burojnë nga akuza të caktuara penale, por nga rrethanat politike dhe tensionet ndërmjet Serbisë dhe Kosovës.

Ai deklaroi në një konferencë për media: “S’keni thënë pse Milan Radoiçiq është në njoftim të kuq. Nuk është për shkak të krimit, por për shkak të Kosovës”.

Berisha tha: “Sigurisht që këtë deklaratë të presidentit Vuçiq e shoh si vazhdimësi të një qasjeje që synon ta relativizojë përgjegjësinë e Milan Radoiçiqit për sulmin terrorist në Banjskë. Pretendimi se ai nuk po ndiqet për krim, por vetëm “për shkak të Kosovës”, bie ndesh me faktin se Radoiçiq ka marrë publikisht përgjegjësinë për organizimin e sulmit dhe ndaj tij ekziston një njoftim i kuq i Interpolit në bazë të procedurave penale të zhvilluara nga autoritetet e Kosovës”.

Sipas tij, një qasje e tillë nga Serbia përcjell një sinjal shqetësues, pasi lë përshtypjen se po ofrohet mbrojtje politike për një person të akuzuar për sulmin në Banjskë.

Ai theksoi se kjo çështje nuk ka të bëjë vetëm me raportet mes Kosovës dhe Serbisë, por edhe me respektimin e sundimit të ligjit dhe me bashkëpunimin ndërkombëtar në luftën kundër krimit dhe terrorizmit.

“Mendoj se kjo qasje dërgon një mesazh shqetësues, sepse krijon përshtypjen e mbrojtjes politike për një person të akuzuar për një sulm të rëndë të armatosur. Kjo nuk është vetëm çështje e marrëdhënieve Kosovë–Serbi, por edhe e respektimit të parimit të sundimit të ligjit dhe bashkëpunimit ndërkombëtar në luftën kundër krimit dhe terrorizmit.

Konsideroj se partnerët ndërkombëtarë duhet ta marrin seriozisht këtë retorikë dhe të kërkojnë bashkëpunim të plotë nga Serbia me mekanizmat e drejtësisë. Nëse një person i kërkuar për një sulm të tillë mbetet i mbrojtur politikisht dhe nuk përballet me drejtësinë, kjo rrezikon të dëmtojë besueshmërinë e angazhimeve të Serbisë ndaj sundimit të ligjit dhe stabilitetit rajonal”, nënvizoi ai për “Bota sot”.

Edhe eksperti i sigurisë, Bedri Elezi, vlerësoi se deklaratat e Aleksandar Vuçiqit për Milan Radoiçiqin përbëjnë sfidë ndaj drejtësisë ndërkombëtare dhe tentojnë ta zhvendosin një rast penal të lidhur me sulmin në Banjskë në një kornizë politike.

Sipas Elezit, kjo reflekton mungesë vullneti nga Serbia për të bashkëpunuar në ndjekjen e përgjegjësisë penale.

Ai u shpreh: “Deklaratat e presidentit të Serbisë, Aleksandar Vuçiq, lidhur me Milan Radoiçiqin nuk përbëjnë më thjesht një qëndrim politik, por një sfidë të hapur ndaj parimeve themelore të drejtësisë ndërkombëtare dhe bashkëpunimit juridik mes shteteve.

Pretendimi se Radoiçiq “nuk kërkohet për krim, por për shkak të Kosovës” është një përpjekje e qartë për të zhvendosur një çështje penale të rëndë në një narrativë politike. Kjo narrativë bie ndesh me faktin se rasti lidhet me sulmin e armatosur në Banjskë të vitit 2023, një incident që ka cenuar drejtpërdrejt sigurinë e institucioneve të Republikës së Kosovës dhe stabilitetin rajonal.

Në vend të distancimit institucional nga një individ që ka marrë publikisht përgjegjësinë për një akt të tillë, diskursi politik nga Beogradi ka shkuar në drejtim të relativizimit dhe mbrojtjes indirekte. Kjo qasje krijon një perceptim serioz në opinionin ndërkombëtar se ekziston një mungesë e vullnetit politik për bashkëpunim në ndjekjen e përgjegjësisë penale, sidomos kur ajo prek struktura të ndërlidhura me interesat shtetërore”.

Elezi shtoi se rasti i Banjskës nuk duhet parë si një ngjarje e shkëputur, por si një rast që kërkon hetim edhe për strukturat mbështetëse dhe për përgjegjësinë politike. Sipas tij, mungesa e një aktakuze gjithëpërfshirëse hap rrugë për mohim politik dhe shtrembërim të fakteve.

“Rasti Banjska nuk mund të trajtohet si episod i izoluar kriminal. Ai përfaqëson një model të organizimit të dhunës së strukturuar, ku pyetjet kryesore nuk lidhen vetëm me ekzekutorët, por me zinxhirin e mundshëm të komandës, mbështetjes logjistike dhe politike. Pikërisht këtu lind edhe dimensioni më i ndjeshëm: përgjegjësia shtetërore dhe politike, e cila nuk mund të fshihet pas narrativave deklarative.

Në këtë kontekst, mungesa e një aktakuze gjithëpërfshirëse që të adresojë jo vetëm autorët e drejtpërdrejtë, por edhe strukturat mbështetëse dhe dimensionin ndër-shtetëror të mundshëm, përbën një boshllëk serioz në trajtimin juridik të rastit. Ky vakum institucional i jep hapësirë mohimit politik dhe deformimit të fakteve.

Prandaj, deklaratat e Vuçiqit nuk janë thjesht koment politik, por pjesë e një diskursi që rrezikon të normalizojë mos-ndëshkueshmërinë për aktet e dhunës së organizuar. Nëse figura të tilla mbrohen politikisht në vend që të distancohen juridikisht, atëherë vihet në pikëpyetje jo vetëm sundimi i ligjit në Serbi, por edhe serioziteti i angazhimeve të saj ndërkombëtare”.

Në fund, Elezi theksoi se çështja e Banjskës tashmë është një provë për drejtësinë ndërkombëtare dhe se përgjegjësia penale nuk duhet të zëvendësohet me narrativa politike.

“Ky rast tashmë e tejkalon kornizën Kosovë–Serbi. Ai është test për Bashkimin Evropian dhe partnerët ndërkombëtarë: nëse parimi i përgjegjësisë penale zbatohet pa standarde të dyfishta, apo nëse lejohet që narrativat politike të zëvendësojnë përgjegjësinë juridike.

Në fund, Banjska mbetet një pikë ndarëse mes dy botëve: asaj të rendit ndërkombëtar të bazuar në ligj, dhe asaj të politikës së forcës, ku përgjegjësia relativizohet dhe dhuna trajtohet si instrument i justifikueshëm politik” – përfundon ai për “Bota sot”.
