The arrests and convictions recorded so far in Kosovo for espionage share a common element: suspected links to Serbia’s intelligence service, the BIA, which is believed to have invested for years in recruiting collaborators in the country.

The latest case involves Feim Sali, who was stopped from leaving Kosovo at the Merdare border crossing. He was arrested on August 13 on suspicion of spying for Serbia’s BIA.

Earlier, Hysri Selimi had also been charged with the same criminal offence. At the conclusion of the trial, the former ISIS member himself admitted that he had been part of Serbia’s BIA.

Another espionage case ended with a guilty verdict in April 2026. Former OSCE official Jelena Gjukanoviq was found guilty and sentenced to six years in prison.

Feim Sali, Hysri Selimi and Jelena Gjukanoviq are the three most recent cases in which Kosovo’s justice and security institutions have been engaged over suspicions of espionage.

Lawyer Arbër Jashari believes these developments demonstrate a greater institutional focus on this criminal offence in recent years.

“It is encouraging that the state of Kosovo, especially over the past three years, has made extraordinarily significant progress in combating this type of crime. This type of crime was previously not widely known. It existed only as a criminal offence in the Criminal Code of the Republic of Kosovo, but before 2023, very few people were arrested, tried and even fewer convicted for such criminal offences. This shows that perhaps in the past, we as a state were not very vigilant towards this type of crime,” lawyer Arbër Jashari told Tëvë1.

According to Jashari, the Criminal Code of the Republic of Kosovo provides for harsh measures against people who commit this offence, while the length of the sentence depends on how it was committed.

“Depending on the manner in which this offence is committed, the minimum sentence may be five years, but the maximum can reach 10 or 12 years, and in certain cases, during wartime or states of emergency, it may vary with much higher sentences,” he said.

The information provided to people engaged in espionage activities is considered particularly important to the state. Professor Fatmir Çollaku says that through it, enemy states can obtain non-public data and use it against the national interest.

“This confidential information is of national interest, and if it is supplied or given to someone else for the purpose of gaining any benefit, whatever the nature of that benefit, it is considered to have harmed our state. For this reason, those persons are suspected of committing these criminal offences of espionage and are undoubtedly harmful to Kosovo’s security, because the enemy state, another state, receives information that is not public and on the basis of which it can create a plan or scenario detrimental to the national interest, namely to national security,” he said.

Kosovo’s Special Prosecutor’s Office has announced that, in addition to the cases already made public, it is also investigating other individuals suspected of links to espionage and cooperation with the BIA, Serbia’s intelligence service.

Arrestimet dhe dënimet e regjistruara deri tani në Kosovë për spiunazh kanë një element të përbashkët: dyshimet për lidhje me shërbimin sekret serb, BIA-n, për të cilën besohet se ka investuar prej vitesh në rekrutimin e bashkëpunëtorëve në vend.

Rasti më i fundit lidhet me Feim Salin, të cilit iu ndërpre dalja nga Kosova në pikën kufitare të Merdarës. Ai u arrestua më 13 gusht, nën dyshimin se kishte spiunuar për BIA-n serbe.

Më herët, për të njëjtën vepër penale ishte akuzuar edhe Hysri Selimi. Ish-pjesëtari i ISIS-it, në përfundim të procesit gjyqësor, kishte pranuar vetë se ishte pjesë e BIA-s serbe.

Një tjetër çështje për spiunazh mori fund me aktgjykim dënues në prill të vitit 2026. Ish-zyrtarja e OSBE-së, Jelena Gjukanoviq, u shpall fajtore dhe u dënua me gjashtë vjet burgim.

Feim Sali, Hysri Selimi dhe Jelena Gjukanoviq përbëjnë tri rastet e fundit në të cilat institucionet e drejtësisë dhe të sigurisë në Kosovë janë angazhuar për dyshime të spiunazhit.

Avokati Arbër Jashari vlerëson se këto zhvillime dëshmojnë një përqendrim më të madh të institucioneve te kjo vepër penale gjatë viteve të fundit.

“Është për t’u inkurajuar që shteti i Kosovës, sidomos në tri vitet e fundit, ka pasë një përparim jashtëzakonisht të madh në luftimin e këtij lloji të kriminalitetit. Këtij lloji të kriminalitetit i cili më parë nuk ka qenë shumë i njohur. Ka qenë vetëm si vepër penale në Kodin Penal të Republikës së Kosovës, por para vitit 2023 pothuajse shumë pak njerëz janë arrestuar, janë gjykuar e aq më pak dënuar për vepra të tilla penale dhe kjo tregon që ne si shtet ndoshta në të kaluarën nuk kemi qenë shumë vigjilentë ndaj këtij lloji të kriminalitetit”, thotë për Tëvë1 avokati Arber Jashari.

Sipas Jasharit, Kodi Penal i Republikës së Kosovës parashikon masa të ashpra për personat që kryejnë këtë vepër, ndërsa kohëzgjatja e dënimit varet nga mënyra e kryerjes.

“Varësisht prej formës së kryerjes së kësaj vepre, dënimi minimal mund të jetë 5 vjet, por maksimali mund të arrijë në 10, 12, e në raste të caktuara, në kohë luftash ose në gjendje jo të zakonshme, mund të variojë edhe me dënime shumë më të larta”, shprehet ai.

Informacionet që u dorëzohen personave të angazhuar në veprimtari spiunazhi konsiderohen të një rëndësie të veçantë për shtetin. Profesori Fatmir Çollaku thotë se përmes tyre shtetet armike mund të përfitojnë të dhëna që nuk janë publike dhe t’i përdorin kundër interesit kombëtar.

“Ato informacione te besueshme janë të interesit kombëtarë dhe ato informacione nëse servohen, jepen dikujt tjetër me qëllime te përfitimit çfarëdo qoftë natyre ai përfitim konsiderohet qe i ka bo dëm shtetit tonë dhe për këtë arsye ata persona dyshohen që janë kryer të këtyre veprave penale të spiunazhit dhe pa dyshim që janë të dëmshëm për sigurinë e Kosovës sepse shteti armik, shteti tjetër merr informacione qe s’janë publike dhe ku në bazë të cilave mund të krijojë një plan, skenarë me dëm të interesit nacional gjegjësisht në dëm të sigurisë nacionale”, thotë ai.

Fehim Sali, who was arrested last week at the Merdare border crossing on suspicion of committing the criminal offense of “espionage,” will remain in pretrial detention for one month.

The decision was made on Friday by the Basic Court in Pristina, which determined that the measure against him would remain in force until September 13, 2026.

According to the allegations, Sali continuously provided information and assistance to Serbia’s Intelligence Agency (BIA) in exchange for material gain.

The court justified the detention on the grounds that the suspect might flee, exert influence over witnesses or evidence, or repeat or continue the activity being investigated.

“The pretrial judge has ordered detention for defendant F.S. for a period of one (1) month, calculated from the date of his arrest, August 13, 2026, and lasting until September 13, 2026,” the court said in a statement.

The judicial institution assessed that, at this stage, there is a grounded suspicion of the criminal offense under investigation and that the legal requirements for imposing the detention measure have been met.

Security experts believe the case should be handled with heightened care and that the investigation should not focus solely on the arrested person. According to them, his contacts, communications and possible connections should also be examined.

According to the experts, the responsible institutions should analyze every piece of information that could indicate the existence of other structures or accomplices. The entire process should be conducted professionally, in accordance with the law and on the basis of evidence.

Prof. Dr. Muhamet Racaj, a retired major general, told “Bota sot” that the case of Fehim Sali should be treated seriously, while at the same time respecting the presumption of innocence.

“The case of Fehim Sali, whom the Basic Court in Pristina has remanded in custody for one month on suspicion of espionage, must be treated with particular seriousness by the security and justice institutions. At this stage, the principle of the presumption of innocence must be fully respected, since these are suspicions that still need to be proven through investigations and judicial proceedings, whether he acted as an individual or within a cell,” Racaj said.

He stressed that the nature of the suspicion makes the matter particularly sensitive to national security. According to Racaj, espionage may involve not only the gathering of information, but also infiltration of institutions, obtaining classified data, exposing institutional weaknesses and building channels of influence in the interests of a foreign state or structure.

The expert called for the investigation to extend to all of the suspect’s possible contacts, communications and connections.

“The court’s reasoning regarding the risk of influencing witnesses and evidence, as well as the possibility of repeating or continuing the criminal offense, is particularly significant from a counterintelligence perspective. These elements show that the investigation must be careful, comprehensive and focused not only on individual actions, but also on contacts, communications, sources of information and any possible organizational links,” Racaj said.

According to him, if the suspicions are confirmed, the consequences for Kosovo could be serious. Such activity could affect classified information, defense capabilities, state institutions and strategic decision-making processes.

Racaj added that, amid hybrid warfare, espionage may be accompanied by disinformation, political influence, economic pressure and cyber operations.

He stressed that the investigation should not stop with the suspected individual if information about other people or possible connections emerges during the process.

“For this reason, it would not be sufficient for the investigation to be limited only to the suspected individual. If indications of other contacts or accomplices emerge during the investigation, the competent institutions should investigate whether this is an isolated activity or part of a broader network. Modern counterintelligence aims precisely to uncover not only the ‘person,’ but also the structure, purpose, communication channels and possible beneficiary of the information,” he said.

Racaj said Kosovo should adopt zero tolerance toward any form of espionage, without abandoning a professional, legal and evidence-based approach.

“If these suspicions are confirmed, the case should be viewed as a national security issue and not merely as an individual criminal case. The security institutions must analyze whether other links exist behind it and whether the suspected activity is part of a broader operation against the interests of the Republic of Kosovo,” Racaj concluded in comments to “Bota sot.”

Jurist Blerim Burjani has also raised concerns about the possibility that networks operating against Kosovo may exist. In a statement to “Bota sot,” he stressed that, 26 years after the end of the war, the country still does not have a Lustration Law.

Burjani said the institutions continue to face individuals suspected of hostile activities against the state.

“There may be a network, because Kosovo is facing security problems and threats in many situations. Kosovo still does not have a Lustration Law either,” he said.

The jurist also questioned the lack of sufficient measures over the years against people suspected of such activities.

“Twenty-six years after the war, Kosovo continues to confront many people suspected of hostile activities against it, but so far there has been no restraining measure against many figures who have managed to operate within its institutions,” Burjani said.

According to him, the problem is not related only to particular individuals, but also to the possibility that structures and networks engaged in actions against Kosovo may exist.

“Therefore, Kosovo is confronting individuals alone, but not the structures and networks that may exist and that undertake actions against Kosovo,” Burjani concluded in comments to “Bota sot.”

Fehim Sali, i arrestuar javën e kaluar në pikën kufitare të Merdarës për dyshimin e kryerjes së veprës penale “Spiunazh”, do të qëndrojë një muaj në paraburgim.

Vendimi u mor të premten nga Gjykata Themelore në Prishtinë, e cila përcaktoi që masa ndaj tij të jetë në fuqi deri më 13 shtator 2026.

Sipas dyshimeve të ngritura, Sali për një periudhë të vazhdueshme i ka siguruar informacione dhe ndihmë Shërbimit Inteligjent të Serbisë (BIA), në këmbim të përfitimit material.

Gjykata e ka arsyetuar paraburgimin me rrezikun që i dyshuari të arratiset, të ushtrojë ndikim mbi dëshmitarët ose provat, si dhe të përsërisë apo vazhdojë veprimtarinë për të cilën po hetohet.

“Gjyqtari i procedurës paraprake ndaj të pandehurit F.S. ka caktuar masën e paraburgimit në kohëzgjatje prej një (1) muaji, e cila llogaritet nga data e arrestimit të tij, 13 gusht 2026 dhe zgjat deri më 13 shtator 2026”, thuhet në njoftimin e Gjykatës.

Institucioni gjyqësor ka vlerësuar se në këtë fazë ekziston dyshim i bazuar për veprën penale që është objekt i hetimit dhe se janë plotësuar kërkesat ligjore për vendosjen e masës së paraburgimit.

Ekspertët e sigurisë vlerësojnë se rasti duhet të trajtohet me kujdes të shtuar dhe se hetimi nuk duhet të përqendrohet vetëm te personi i arrestuar. Sipas tyre, duhet të shqyrtohen edhe kontaktet, komunikimet dhe lidhjet e mundshme të tij.

Institucionet përgjegjëse, sipas ekspertëve, duhet të analizojnë çdo të dhënë që mund të tregojë për ekzistencën e strukturave ose bashkëpunëtorëve të tjerë. I gjithë procesi duhet të zhvillohet në mënyrë profesionale, në përputhje me ligjin dhe mbi bazën e provave.

Prof. Dr. Muhamet Racaj, Gjeneral Major në pension, në një prononcim për “Bota sot”, ka deklaruar se rasti i Fehim Salit duhet të trajtohet me seriozitet, duke respektuar njëkohësisht prezumimin e pafajësisë.

“Rasti i Fehim Salit, ndaj të cilit Gjykata Themelore në Prishtinë ka caktuar një muaj paraburgim nën dyshimin për spiunazh, duhet të trajtohet me seriozitet të veçantë nga institucionet e sigurisë dhe drejtësisë. Në këtë fazë duhet respektuar plotësisht parimi i prezumimit të pafajësisë, pasi bëhet fjalë për dyshime që ende duhet të provohen përmes hetimeve dhe procedurave gjyqësore a ka vepruar si individ ose ne kuader te ndonjë celule”, ka thënë Racaj.

Ai ka nënvizuar se natyra e dyshimit e bën këtë çështje veçanërisht të ndjeshme për sigurinë kombëtare. Sipas Racajt, spiunazhi mund të nënkuptojë jo vetëm grumbullimin e informacionit, por edhe depërtimin në institucione, sigurimin e të dhënave të klasifikuara, zbulimin e dobësive institucionale dhe ndërtimin e kanaleve të ndikimit në interes të një shteti ose strukture të huaj.

Eksperti ka kërkuar që hetimi të shtrihet te të gjitha kontaktet, komunikimet dhe lidhjet e mundshme të të dyshuarit.

“Arsyetimi i gjykatës për rrezikun e ndikimit në dëshmitarë e prova, si dhe mundësinë e përsëritjes apo vazhdimit të veprës penale, nga këndvështrimi i kundërzbulimit është veçanërisht domethënës. Këto elemente tregojnë se hetimi duhet të jetë i kujdesshëm, gjithëpërfshirës dhe i orientuar jo vetëm te veprimet individuale, por edhe te kontaktet, komunikimet, burimet e informacionit dhe çdo lidhje të mundshme organizative”, ka thënë Racaj.

Sipas tij, nëse dyshimet vërtetohen, pasojat për Kosovën mund të jenë serioze. Një veprimtari e tillë mund të prekë informacionin e klasifikuar, kapacitetet mbrojtëse, institucionet shtetërore dhe proceset strategjike të vendimmarrjes.

Racaj ka shtuar se, në kushtet e luftës hibride, spiunazhi mund të shoqërohet me dezinformim, ndikim politik, presion ekonomik dhe operacione kibernetike.

Ai ka theksuar se hetimi nuk duhet të ndalet te individi i dyshuar, nëse gjatë procesit shfaqen të dhëna për persona të tjerë ose lidhje të mundshme.

“Për këtë arsye, nuk do të ishte e mjaftueshme që hetimi të kufizohej vetëm te individi i dyshuar. Nëse gjatë hetimeve dalin indicie për kontakte apo bashkëpunëtorë të tjerë, institucionet kompetente duhet të hetojnë nëse kemi të bëjmë me një veprimtari të izoluar apo me një rrjet më të gjerë. Kundërzbulimi modern pikërisht këtë synon: të zbulojë jo vetëm “personin”, por edhe strukturën, qëllimin, kanalet e komunikimit dhe përfituesin e mundshëm të informacionit”, është shprehur ai.

Racaj ka thënë se Kosova duhet të zbatojë zero tolerancë ndaj çdo forme spiunazhi, por pa hequr dorë nga një qasje profesionale, ligjore dhe e mbështetur në prova.

“Nëse këto dyshime konfirmohen, rasti duhet të shihet si çështje e sigurisë kombëtare dhe jo vetëm si një rast individual kriminal. Institucionet e sigurisë duhet të analizojnë nëse pas tij ekzistojnë hallka të tjera dhe nëse aktiviteti i dyshuar është pjesë e ndonjë operacioni më të gjerë kundër interesave të Republikës së Kosovës”, ka përfunduar Racaj për “Bota sot”.

Edhe juristi Blerim Burjani ka ngritur shqetësimin për mundësinë e ekzistimit të rrjeteve që veprojnë kundër Kosovës. Në një deklaratë për “Bota sot”, ai ka theksuar se, 26 vjet pas përfundimit të luftës, vendi ende nuk ka një Ligj për Lustracionin.

Burjani ka thënë se institucionet vazhdojnë të përballen me persona që dyshohen për veprimtari armiqësore ndaj shtetit.

“Rrjet mund të ketë, sepse Kosova po ka probleme dhe kërcënime të sigurisë në shumë situata. Kosova ende nuk ka as Ligj për Lustracionin”, ka deklaruar ai.

Juristi ka vënë në pikëpyetje edhe mungesën e masave të mjaftueshme gjatë këtyre viteve ndaj personave të dyshuar për veprimtari të tilla.

“26 vjet pas luftës, Kosova vazhdon të ketë përballje me shumë njerëz, të cilët dyshohen për veprimtari armiqësore ndaj saj, por deri tash nuk ka pasur ndonjë akt ndalese për shumë fytyra që kanë arritur të operojnë në institucionet e saj”, është shprehur Burjani.

Sipas tij, problemi nuk lidhet vetëm me individë të veçantë, por edhe me mundësinë që të ekzistojnë struktura e rrjete të angazhuara në veprime kundër Kosovës.

“Andaj, Kosova po ballafaqohet vetëm me individë, por jo edhe me struktura dhe rrjete që mund të ketë dhe që ndërmarrin veprime kundër Kosovës”, ka përfunduar Burjani për “Bota sot”.

However, the former investigator stressed that ordering pretrial detention does not amount to a declaration of guilt and that criminal responsibility can be determined only through judicial proceedings. According to Rexhepi, the fact that the court found circumstances related to possible influence over witnesses and evidence, as well as the risk that the suspected activity could be repeated or continue, calls for the most professional and thorough investigation possible.

Turning to counterintelligence, he said investigators should not limit themselves to determining the actions the suspect may have carried out. According to him, they must establish with whom he communicated, who recruited and instructed him, what information he sought or passed on, how long the activity lasted and what the possible objectives were.

If the suspicions are confirmed, Rexhepi also called for an investigation into the possible existence of a network. He explained that intelligence services do not necessarily operate through just one individual, as a person may serve as a contact, intermediary, source of information or member of a broader organization.

For this reason, he said, the security institutions should not seek answers only about what Fehim Sali is suspected of having done. The investigation should also determine whether there were other individuals, intermediaries, financiers, communication channels or structures that may have enabled the activity. Rexhepi said this is precisely the approach that distinguishes ordinary criminal proceedings from an investigation with counterintelligence dimensions.

The former investigator further warned of the risk to Kosovo’s national security if it is proven that the country’s sensitive data were collected and transmitted to a foreign service. He emphasized that the potential damage is not limited to the specific material that may have been handed over.

According to Rexhepi, such activity could expose human sources, institutions’ working methods, security weaknesses, structural organization and operational capabilities. In the worst-case scenario, a network of this kind could be used to influence state decision-making, undermine security institutions, cause destabilization or weaken the trust that citizens and international partners place in Kosovo’s institutions.

If the investigation uncovers organized espionage activity, Rexhepi said the matter should not end with the arrest or possible conviction of one individual. According to him, the authorities must trace the source of the information, the financing, contacts, those who issued the orders and every other link that may be part of the network.

He considered the damage assessment equally important. The responsible institutions, the former investigator said, must clarify not only whether a criminal offense was committed, but also what data may have been compromised, which individuals or institutions may have been exposed and whether immediate measures are needed to protect them.

At this stage, according to Rexhepi, counterintelligence has a decisive role. A serious investigative process should examine links, communications, transactions, contacts and patterns of activity, while always operating within the law and under the relevant institutional oversight.

He clarified that the aim should not be to spread suspicion toward citizens, but to accurately uncover any activity that could harm the strategic interests of the Republic of Kosovo. Rexhepi recalled that Kosovo is situated in a sensitive security environment in which various regional and international actors have direct interests.

In such circumstances, he said, protecting state information is not merely an administrative duty, but is directly linked to safeguarding sovereignty and national security.

In conclusion, the former investigator called for the Fehim Sali case to be handled without any negligence, but also without any prejudice. He said the institutions must insist on uncovering the truth while fully guaranteeing the presumption of innocence and the standards of due process.

If the allegations are confirmed, Rexhepi said, the authorities must uncover the entire possible mechanism behind the activity, identify every person or structure involved and determine whether state data have been compromised.

The message, he said, should be that Kosovo cannot become a place where foreign services collect information, create networks of influence or endanger the security of its institutions. If there is a network, it must be uncovered; if there is someone issuing orders, that person must be identified; and if state information has been compromised, it must be clarified what was compromised and how.

Rexhepi stressed that the success of an investigation is not measured solely by the possible conviction of one individual. The true result, he said, would be the full exposure of the mechanism, the disruption of infiltration channels and the strengthening of the counterintelligence system, so that the matter does not remain merely a criminal case file but serves as a lesson for the long-term protection of the state.

Agim Rexhepi concluded his statement to “Bota sot” by saying that if the suspicions are proven, the event is no longer merely the story of one person. In that case, it constitutes an alarm about how the Republic of Kosovo protects the state, its information and its security.

Në rast se pretendimet e Prokurorisë konfirmohen, sipas tij, çështja prek drejtpërdrejt sigurinë kombëtare, ruajtjen e të dhënave të ndjeshme dhe aftësinë e institucioneve kosovare për të penguar depërtimin e shërbimeve të huaja të inteligjencës.

Megjithatë, ish-hetuesi nënvizoi se vendosja e masës së paraburgimit nuk është shpallje fajësie dhe se përgjegjësia penale mund të përcaktohet vetëm nëpërmjet procedurës gjyqësore. Fakti që gjykata ka konstatuar rrethana të lidhura me ndikimin e mundshëm mbi dëshmitarët dhe provat, si dhe me rrezikun e përsëritjes apo vazhdimit të aktivitetit të dyshuar, sipas Rexhepit kërkon një hetim sa më profesional dhe të thelluar.

Duke u ndalur te kundërzbulimi, ai tha se hetuesit nuk duhet të mjaftohen vetëm me përcaktimin e veprimeve që mund të ketë kryer i dyshuari. Sipas tij, duhet të zbardhet se me kë ka komunikuar, nga kush është rekrutuar dhe udhëzuar, çfarë informacioni ka kërkuar ose përcjellë, sa ka zgjatur veprimtaria dhe cilat kanë qenë objektivat e mundshme.

Nëse dyshimet marrin konfirmim, Rexhepi kërkoi të hetohet gjithashtu mundësia e ekzistencës së një rrjeti. Ai shpjegoi se shërbimet inteligjente nuk veprojnë medoemos përmes vetëm një individi, pasi një person mund të shërbejë si kontakt, ndërmjetës, burim informacioni ose pjesëtar i një organizimi më të gjerë.

Për këtë arsye, sipas tij, institucionet e sigurisë nuk duhet të kërkojnë përgjigje vetëm për atë që dyshohet se ka bërë Fehim Sali. Hetimi duhet të përcaktojë edhe nëse kanë ekzistuar persona të tjerë, ndërmjetës, financues, kanale komunikimi ose struktura që mund ta kenë mundësuar aktivitetin. Rexhepi tha se pikërisht kjo qasje e veçon një procedurë të zakonshme penale nga një hetim me përmasa kundërzbulimi.

Ish-hetuesi paralajmëroi më tej për rrezikun ndaj sigurisë kombëtare të Kosovës, në rast se provohet se të dhëna të ndjeshme të vendit janë grumbulluar dhe i janë transmetuar një shërbimi të huaj. Ai theksoi se dëmi i mundshëm nuk kufizohet te materiali konkret që mund të jetë dorëzuar.

Një veprimtari e tillë, sipas Rexhepit, mund të nxjerrë në pah burime njerëzore, mënyrat e punës së institucioneve, dobësitë në siguri, organizimin strukturor dhe kapacitetet operative. Në skenarin më të rëndë, një rrjet i këtij lloji mund të shfrytëzohet për të ndikuar te vendimmarrja shtetërore, për të cenuar institucionet e sigurisë, për të shkaktuar destabilizim ose për të dobësuar besimin që qytetarët dhe partnerët ndërkombëtarë kanë tek institucionet e Kosovës.

Nëse hetimi zbulon një aktivitet të organizuar spiunazhi, Rexhepi vlerësoi se çështja nuk duhet të përfundojë me arrestimin ose dënimin eventual të një individi. Sipas tij, autoritetet duhet të gjurmojnë burimin e informacionit, financimin, kontaktet, urdhërdhënësit dhe çdo hallkë tjetër që mund të jetë pjesë e rrjetit.

Ai e cilësoi po aq të rëndësishëm edhe vlerësimin e dëmit. Institucionet përgjegjëse, tha ish-hetuesi, duhet të sqarojnë jo vetëm nëse është konsumuar vepra penale, por edhe cilat të dhëna mund të jenë komprometuar, kush ose cilat institucione mund të jenë ekspozuar dhe nëse nevojiten masa të menjëhershme për mbrojtjen e tyre.

Në këtë fazë, sipas Rexhepit, kundërzbulimi ka rol vendimtar. Një proces serioz hetimor duhet të shqyrtojë lidhjet, komunikimet, transaksionet, kontaktet dhe modelet e aktivitetit, duke vepruar gjithmonë brenda ligjit dhe nën mbikëqyrjen përkatëse institucionale.

Ai sqaroi se synimi nuk duhet të jetë përhapja e dyshimit ndaj qytetarëve, por zbulimi i saktë i çdo veprimtarie që mund të dëmtojë interesat strategjike të Republikës së Kosovës. Rexhepi kujtoi se Kosova ndodhet në një mjedis të ndjeshëm sigurie, ku aktorë të ndryshëm rajonalë dhe ndërkombëtarë kanë interesa të drejtpërdrejta.

Në rrethana të tilla, sipas tij, mbrojtja e informacionit shtetëror nuk përbën thjesht një detyrë administrative, por lidhet drejtpërdrejt me ruajtjen e sovranitetit dhe të sigurisë kombëtare.

Në përfundim, ish-hetuesi kërkoi që rasti Fehim Sali të trajtohet pa asnjë neglizhencë, por edhe pa asnjë paragjykim. Ai tha se institucionet duhet të këmbëngulin për zbardhjen e së vërtetës, ndërsa njëkohësisht duhet të garantojnë plotësisht prezumimin e pafajësisë dhe standardet e procesit të drejtë.

Nëse pretendimet konfirmohen, sipas Rexhepit, autoritetet duhet të zbulojnë të gjithë mekanizmin e mundshëm të veprimtarisë, të identifikojnë secilin person ose strukturë të përfshirë dhe të përcaktojnë nëse janë komprometuar të dhëna shtetërore.

Mesazhi, siç tha ai, duhet të jetë se Kosova nuk mund të shndërrohet në hapësirë ku shërbimet e huaja grumbullojnë informacion, krijojnë rrjete ndikimi ose rrezikojnë sigurinë e institucioneve të saj. Nëse ka një rrjet, ai duhet zbuluar; nëse ka një urdhërdhënës, ai duhet identifikuar; ndërsa, nëse janë cenuar informacione shtetërore, duhet sqaruar se çfarë është komprometuar dhe në çfarë mënyre.

Rexhepi theksoi se suksesi i një hetimi nuk matet vetëm me dënimin e mundshëm të një individi. Rezultati i vërtetë, sipas tij, do të ishte zbardhja e plotë e mekanizmit, ndërprerja e kanaleve të depërtimit dhe fuqizimi i sistemit të kundërzbulimit, në mënyrë që çështja të mos mbetet vetëm një dosje penale, por të shërbejë si mësim për mbrojtjen afatgjatë të shtetit.

Agim Rexhepi e mbylli deklaratën për “Bota sot” duke thënë se, nëse dyshimet provohen, ngjarja nuk lidhet më vetëm me historinë e një personi. Në atë rast, ajo përbën alarm për mënyrën se si Republika e Kosovës mbron shtetin, informacionin dhe sigurinë e saj.

Kosovo Police arrested Fehim Sali, a teacher from Dragash, on Thursday on suspicion of committing the criminal offense of espionage. A day later, the Basic Court in Pristina ordered him to remain in pretrial detention for 30 days.

According to the Special Prosecution’s request for pretrial detention, the suspect provided a detailed account during questioning of his activities and contacts with an official from Serbia’s Security Intelligence Agency, the BIA.

Fehim Sali, a Kosovo citizen and resident of the municipality of Dragash, is suspected of acting in the interests of Serbia’s BIA intelligence service.

The investigation into him began in June last year, after the Kosovo Intelligence Agency forwarded information about Sali’s suspicious activities to the Special Prosecution.

The prosecution alleges that Sali acted on the orders and instructions of senior BIA official Zhelimir Matoviq. He is suspected of providing the agency with information about the political situation in Kosovo, identifying Kosovo Intelligence Agency officials by photographing them, and supplying information about people belonging to the Wahhabi sect, as well as others.

He is also suspected of proposing these individuals to BIA officials as potential targets for contact and recruitment.

Before his dismissal in May 2024, Sali had been a member of the Consultative Council for Communities under the Office of the President of Kosovo. His role on the council was also mentioned in the Special Prosecution’s request for pretrial detention.

The prosecutor in the case, Bekim Kodraliu, told the media on Friday that evidence gathered by Kosovo Police in cooperation with the Kosovo Intelligence Agency established reasonable suspicion that Sali had been recruited by the BIA.

Kodraliu said Sali was suspected of having been recruited by BIA official Zhelimir Matoviq, and that the information he provided was detrimental to the interests of the state of Kosovo. According to the prosecutor, the defendant himself stated that he had been recruited and had maintained ongoing contact with BIA officials.

“Today, the Special Prosecution filed a request for pretrial detention to be imposed on the defendant, Fehmi Sali. Based on the evidence obtained by Kosovo Police, in close cooperation with the Kosovo Intelligence Agency, we have established reasonable suspicion that he was recruited by the Serbian Security Intelligence Agency—the BIA—more specifically by its official, Zhelimir Matoviq, and that he provided information to this agency to the detriment of our state’s interests. We believe that the evidence we have obtained has established well-founded reasonable suspicion,” he stated.

The prosecutor added that, during the hearing on the pretrial detention request, Sali again admitted that he had been recruited and had maintained ongoing communication with BIA members.

Meanwhile, during a raid conducted a day earlier in cooperation with Kosovo Police, the authorities seized phones and a sum of money. The prosecution suspects that the money represents financial proceeds obtained through the commission of the criminal offense.

Bekim Kodraliu said that once the investigation is completed, Sali is expected to be indicted for the criminal offense for which, according to him, reasonable suspicion has already been established.

Kosovo Police announced that F. S. was detained today at the Merdare border crossing on suspicion of the criminal offense of “Espionage.” By order of the Special Prosecution, he was placed in detention for 48 hours.

The search warrant for the suspect’s home in Dragash was executed by investigators from the Directorate for the Investigation of Organized Crime and Serious Crimes.

During the search of the residence, €39,500 in cash, 500 dinars, four mobile phones and various documents considered relevant to the case were found and seized.

The Basic Court in Pristina, specifically its Special Department, subsequently ordered Fehim Sali to be held in pretrial detention for one month on suspicion of the criminal offense of “Espionage,” as provided for under Article 124, paragraph 3 of the Criminal Code of the Republic of Kosovo.

The decision was issued on August 14 by pretrial judge Kushtrim Shyti, following a request filed by the Special Prosecution of the Republic of Kosovo.

The court reasoned that there was a risk Sali might flee. He was detained on August 13 at around 4:00 a.m. at the Merdare border crossing while leaving Kosovo.

In its assessment, the court also took into account the fact that Sali holds both Kosovo and Serbian citizenship and has family ties in Serbia.

In addition to the risk of flight, the court found that he could influence witnesses and evidence, and also determined that there was a possibility he could repeat the criminal offense.

The defense opposed the request for pretrial detention, emphasizing that Sali has a permanent residence in Kosovo, as well as his family and a teaching job in the country. According to the defense, his trips to Serbia were related to family and personal matters.

However, the Basic Court in Pristina found that alternative measures, such as house arrest, bail or mandatory reporting to the police, would neither guarantee his presence nor prevent interference with the investigation.

Policia e Kosovës arrestoi të enjten Fehim Salin, arsimtar nga Dragashi, nën dyshimin se ka kryer veprën penale të spiunazhit. Një ditë më pas, Gjykata Themelore në Prishtinë vendosi që ai të qëndrojë 30 ditë në paraburgim.

Sipas kërkesës së Prokurorisë Speciale për caktimin e masës së paraburgimit, i dyshuari ka dhënë gjatë intervistimit një përshkrim të hollësishëm të veprimtarisë së tij dhe të kontakteve me një zyrtar të BIA-s serbe.

Fehim Sali, shtetas i Kosovës dhe banor i komunës së Dragashit, dyshohet se ka vepruar në interes të Shërbimit Inteligjent Serb, BIA.

Hetimi ndaj tij kishte nisur që në qershor të vitit të kaluar, pasi Agjencia Kosovare për Inteligjencë ia kishte përcjellë Prokurorisë Speciale informacionin për aktivitetin e dyshimtë të Salit.

Prokuroria pretendon se Sali ka vepruar mbi urdhrat dhe udhëzimet e zyrtarit të lartë të BIA-s, Zhelimir Matoviq. Sipas dyshimeve, ai i ka përcjellë këtij shërbimi informacione lidhur me situatën politike në Kosovë, ka identifikuar zyrtarë të Agjencisë së Kosovës për Inteligjencë duke i fotografuar dhe ka ofruar të dhëna për persona që i përkasin sektit vehabi, si dhe për persona të tjerë.

Po ashtu, dyshohet se këta persona ua ka propozuar zyrtarëve të BIA-s si objektiva të mundshëm për kontaktim dhe rekrutim.

Para shkarkimit të tij në maj të vitit 2024, Sali kishte qenë pjesë e Këshillit Konsultativ për Komunitete pranë zyrës së Presidentes së Kosovës. Edhe mbajtja e këtij funksioni është përmendur në kërkesën e Prokurorisë Speciale për paraburgim.

Prokurori i rastit, Bekim Kodraliu, deklaroi të premten për media se provat e mbledhura nga Policia e Kosovës, në bashkëpunim me Agjencinë Kosovare për Inteligjencë, krijojnë dyshim të bazuar se Sali është rekrutuar nga BIA.

Kodraliu tha se rekrutimi dyshohet të jetë bërë nga zyrtari i BIA-s, Zhelimir Matoviq, ndërsa informacionet e dhëna prej Salit kanë qenë në dëm të interesave të shtetit të Kosovës. Sipas prokurorit, vetë i pandehuri ka deklaruar se ishte rekrutuar dhe se kishte mbajtur kontakte të vazhdueshme me zyrtarë të BIA-s.

“Sot, Prokuroria Speciale ka paraqitur kërkesë për caktimin e masës së paraburgimit ndaj të pandehurit Fehmi Sali. Nga provat që kemi siguruar nga Policia e Kosovës, në bashkëpunim të ngushtë edhe me Agjencinë Kosovare për Inteligjencë, kemi vërtetuar dyshimin e bazuar se i njëjti ka qenë i rekrutuar në Shërbimin Inteligjent Serb – BIA, më konkretisht nga zyrtari i saj, Zhelimir Matoviq, dhe se i njëjti ka ofruar informacione këtij shërbimi në dëm të interesave të shtetit tonë. Konsiderojmë se nga provat që kemi siguruar kemi vërtetuar dyshimin e bazuar mirë”, deklaroi ai.

Prokurori shtoi se, gjatë paraqitjes së kërkesës për paraburgim, Sali e kishte pranuar sërish se ishte rekrutuar dhe se kishte pasur komunikim të vazhdueshëm me pjesëtarë të BIA-s.

Ndërkohë, gjatë një bastisjeje të zhvilluar një ditë më herët në bashkëpunim me Policinë e Kosovës, autoritetet sekuestruan telefona dhe një shumë parash. Prokuroria dyshon se paratë përbëjnë dobi pasurore të përfituar nga kryerja e veprës penale.

Bekim Kodraliu bëri të ditur se pas përfundimit të hetimeve, ndaj Salit pritet të ngrihet aktakuzë për veprën penale për të cilën, sipas tij, tashmë është vërtetuar dyshimi i bazuar.

Policia e Kosovës njoftoi se F. S. u ndalua sot në pikën kufitare në Merdare, nën dyshimin për veprën penale “Spiunazh”. Me aktvendim të Prokurorisë Speciale, atij iu caktua ndalimi prej 48 orësh.

Urdhërkontrolli në banesën e të dyshuarit në Dragash u zbatua nga hetuesit e Drejtorisë për Hetimin e Krimit të Organizuar dhe Krimeve të Rënda.

Gjatë kontrollit në vendbanim u gjetën dhe u sekuestruan 39 mijë e 500 euro para të gatshme, 500 dinarë, katër telefona celularë dhe dokumente të ndryshme që konsiderohen relevante për rastin.

Gjykata Themelore në Prishtinë, përkatësisht Departamenti Special, vendosi më pas një muaj paraburgim ndaj Fehim Salit, i cili dyshohet për veprën penale “Spiunazhi”, të paraparë në nenin 124, paragrafi 3 të Kodit Penal të Republikës së Kosovës.

Vendimi u mor më 14 gusht nga gjyqtari i procedurës paraprake, Kushtrim Shyti, pas kërkesës së paraqitur nga Prokuroria Speciale e Republikës së Kosovës.

Gjykata arsyetoi se ekziston rreziku që Sali të arratiset. Ai ishte ndaluar më 13 gusht, rreth orës 04:00, në pikën kufitare në Merdare, teksa po largohej nga Kosova.

Në vlerësimin e gjykatës është marrë parasysh edhe fakti se Sali ka shtetësi të Kosovës dhe të Serbisë, si dhe lidhje familjare në Serbi.

Përveç mundësisë së arratisjes, gjykata ka konstatuar rrezik që ai të ndikojë te dëshmitarët dhe provat, ndërsa ka vlerësuar gjithashtu se ekziston mundësia e përsëritjes së veprës penale.

Mbrojtja e ka kundërshtuar kërkesën për paraburgim, duke theksuar se Sali ka vendbanim të përhershëm në Kosovë, familjen dhe vendin e punës si mësimdhënës në këtë vend. Sipas mbrojtjes, udhëtimet e tij në Serbi kanë qenë të lidhura me çështje familjare dhe personale.

Megjithatë, Gjykata Themelore në Prishtinë ka çmuar se masat alternative, si arresti shtëpiak, dorëzania apo detyrimi për t’u paraqitur në polici, nuk do të garantonin praninë e tij dhe as nuk do të parandalonin pengimin e hetimeve.

The Special Prosecution Office of the Republic of Kosovo has asked the Basic Court in Pristina to order Fehim Sali into pretrial detention. He was arrested yesterday on suspicion of espionage.

The request states that Sali is a citizen of Kosovo of Serbian ethnicity and also holds Serbian citizenship.

The Special Prosecution Office alleges that there is a well-founded suspicion that Sali, acting intentionally and for material gain, was recruited by the Intelligence Service of the Republic of Serbia, known as the BIA. According to the Prosecution, he continuously assisted this foreign service by carrying out the orders and instructions of senior BIA official Zhelimir Matović, known by the nickname “Zheljko.”

The request alleges that Sali passed on information about political developments in Kosovo and identified officials of the Kosovo Intelligence Agency (KIA), photographing them. He is also suspected of providing information about members of the Wahhabi sect and other individuals, whom he later proposed to the BIA official as potential targets for contact and recruitment.

Sali is also suspected of other actions contrary to the state interests of the Republic of Kosovo that undermine and harm the country’s constitutional order and national security.

In its request submitted to the Basic Court, the Special Prosecution Office maintains that through these actions, the defendant committed the criminal offense of “Espionage,” as defined in Article 124, paragraph 3 of the Criminal Code of the Republic of Kosovo.

Prokuroria Speciale e Republikës së Kosovës i është drejtuar Gjykatës Themelore në Prishtinë me kërkesë që Fehim Salit t’i caktohet masa e paraburgimit. Ai u arrestua dje nën dyshimin për spiunazh.

Në dokumentin e paraqitur për caktimin e kësaj mase thuhet se Sali është shtetas i Kosovës, me kombësi serbe, ndërsa posedon gjithashtu shtetësi të Serbisë.

PSRK-ja pretendon se ekziston dyshimi i bazuar që Sali, me dashje dhe për përfitim material, ishte rekrutuar nga Shërbimi Inteligjent i Republikës së Serbisë, i njohur si BIA. Sipas Prokurorisë, ai e kishte ndihmuar vazhdimisht këtë shërbim të huaj, duke zbatuar urdhrat dhe udhëzimet e zyrtarit të lartë të BIA-s, Zhelimir Matoviç, i njohur me nofkën “Zheljko”.

Në kërkesë pretendohet se Sali kishte përcjellë të dhëna për zhvillimet politike në Kosovë dhe kishte identifikuar zyrtarë të Agjencisë së Kosovës për Inteligjencë (AKI), duke i fotografuar ata. Ai dyshohet se kishte dhënë edhe informacione për persona që i përkasin sektit vehabi dhe për individë të tjerë, të cilët më pas ia kishte propozuar zyrtarit të BIA-s si objektiva të mundshëm për kontaktim dhe rekrutim.

Sali dyshohet gjithashtu për veprime të tjera që bien ndesh me interesat shtetërore të Republikës së Kosovës dhe që cenojnë e dëmtojnë rendin kushtetues dhe sigurinë kombëtare të vendit.

Prokuroria Speciale, në kërkesën dërguar Gjykatës Themelore, vlerëson se me këto veprime i pandehuri ka kryer veprën penale “Spiunazhi”, të përcaktuar në nenin 124, paragrafi 3 të KPRK-së.
