The court’s decision shows that the suspect told police investigators that, before the incident, she had received threats from the now deceased through the social network Snapchat. According to her statement, he had written to her, among other things, “wait for me because now I will come and kill you and your family,” and when he arrived at the apartment, he assaulted her.

According to the decision obtained by “Oath for Justice,” Roshaj’s defense lawyer, court-appointed attorney Genc Kadriu, presented details from his client’s statement during the hearing and explained the course of the case.

In the testimony given before investigators, Roshaj also said that shortly before the message containing the threat, the victim had sent her another message with the word “qele.”

The decision describes that, at that moment, the defendant looked through the peephole and saw F.H. standing in front of her apartment. It states that this put her in a severe state of shock, because she had not thought he would actually come to her apartment, since, according to her, he had threatened her in the same way on 3-4 other occasions but had never shown up.

The decision further states that after F.H. entered the apartment, he grabbed the injured party by the hair and began striking her on the head. It also emphasizes that the defendant had been continuously under attack and, at one point, had taken a glass bottle with the aim of scaring the victim into stopping the assault. During this physical struggle, the defendant herself sustained bodily injuries.

According to the decision, the now deceased had the weapon in his hand the entire time. At one point during the struggle, the defendant managed to take the weapon from him, also because her parents were in another room of the apartment, so that no harm would come to them. At the moment the weapon passed into her hand, it is said that the victim had turned his back from the table, and it was precisely then that the gun went off, resulting in the killing of F.H.

On these grounds, attorney Kadriu opposed the Prosecution’s request for detention, stating that, in his view, the defendant had acted in necessary self-defense and had not intended to intentionally take the life of the now deceased.

At the hearing, Kadriu also added that, in the defense’s assessment, there are no conditions for influencing witnesses or fleeing. He justified this by the fact that the defendant had cooperated with the investigative authorities and, taking into account her emotional state after the incident, proposed that the Court impose an alternative measure.

Roshaj herself supported attorney Kadriu’s position, stating that she stands by what she said to the Police, while before the court she emphasized that, due to her emotional condition, she is not able to make a statement.

The decision also states that state prosecutor Veton Shabani requested detention, assessing that the conditions for this measure had been met. He mentioned the risk of flight, arguing that the suspect lives and works in France, while she had come to Kosovo for a temporary stay, as well as the fact that the case is in the initial stage of the investigation.

In the end, preliminary procedure judge Ilir Bytyqi assessed that there are grounds for ordering detention, finding that more lenient measures are not sufficient to ensure the proper conduct of the criminal proceedings.

Nga vendimi i Gjykatës rezulton se e dyshuara u ka thënë hetuesve policorë se, para ngjarjes, kishte marrë kërcënime nga tashmë i ndjeri përmes rrjetit social Snapchat. Sipas deklarimit të saj, ai i kishte shkruar, mes të tjerash, “më prit se tani do të vij të vras ty edhe familjen tënde”, ndërsa kur kishte mbërritur në banesë, e kishte rrahur.

Sipas vendimit të siguruar nga “Betimi për Drejtësi”, mbrojtësi i Roshajt, avokati i caktuar sipas detyrës zyrtare Genc Kadriu, gjatë seancës dëgjimore ka paraqitur hollësi nga deklarata e klientes së tij dhe ka shpjeguar rrjedhën e rastit.

Në dëshminë e dhënë para hetuesve, Roshaj ka thënë gjithashtu se pak para mesazhit me përmbajtjen e kërcënimit, viktima i kishte dërguar edhe një tjetër mesazh me fjalën “qele”.

Në vendim përshkruhet se, në ato çaste, e pandehura kishte parë nga vrima vëzhguese e derës se përballë banesës së saj po qëndronte F.H. Aty theksohet se kjo e kishte futur në gjendje të rëndë shoku, pasi nuk e kishte menduar se ai do të shkonte vërtet te banesa e saj, duke qenë se, sipas saj, edhe në 3-4 raste të tjera e kishte kërcënuar njësoj, por nuk ishte paraqitur asnjëherë.

Vendimi më tej thotë se, pasi F.H. kishte hyrë në banesë, ai e kishte kapur të dëmtuarën për flokësh dhe kishte nisur ta godiste në kokë. Po ashtu, theksohet se e pandehura kishte qenë vazhdimisht nën sulm dhe, në një moment, kishte marrë një shishe qelqi me synim që ta trembte viktimën që të ndalte sulmin. Gjatë kësaj përleshjeje fizike, vetë e pandehura kishte pësuar lëndime trupore.

Sipas vendimit, gjatë gjithë kohës tani i ndjeri e kishte pasur armën në dorë. Në një moment të përleshjes, e pandehura kishte arritur t’ia merrte armën, edhe për shkak se në një dhomë tjetër të banesës ndodheshin prindërit e saj, në mënyrë që të mos ndodhte ndonjë e keqe. Në çastin kur arma kishte kaluar në dorën e saj, thuhet se viktima ishte kthyer me shpinë nga tavolina dhe pikërisht atëherë arma ishte shkrepur, me pasojë vrasjen e F.H.

Mbi këto rrethana, avokati Kadriu e ka kundërshtuar kërkesën e Prokurorisë për paraburgim, duke deklaruar se, sipas bindjes së tij, e pandehura kishte vepruar në mbrojtje të nevojshme dhe se nuk kishte pasur qëllim ta privonte me dashje nga jeta tani të ndjerin.

Në seancën dëgjimore, Kadriu ka shtuar gjithashtu se, sipas vlerësimit të mbrojtjes, nuk ekzistojnë kushte për ndikim te dëshmitarët apo për arratisje. Ai e ka arsyetuar këtë me faktin se e pandehura ka bashkëpunuar me organet e hetuesisë dhe, duke pasur parasysh edhe gjendjen e saj emocionale pas ngjarjes, ka propozuar që Gjykata të caktojë ndonjë masë alternative.

Vetë Roshaj e ka mbështetur qëndrimin e avokatit Kadriu, duke deklaruar se i qëndron pranë asaj që ka thënë në Polici, ndërsa para gjykatës ka theksuar se, për shkak të gjendjes emocionale, nuk është në gjendje të deklarohet.

Në vendim thuhet edhe se prokurori i shtetit, Veton Shabani, ka kërkuar caktimin e paraburgimit, duke vlerësuar se kushtet për këtë masë janë përmbushur. Ai ka përmendur rrezikun e ikjes, me arsyetimin se e dyshuara jeton dhe vepron në Francë, ndërsa në Kosovë kishte ardhur për qëndrim të përkohshëm, si dhe faktin që rasti ndodhet në fazën fillestare të hetimeve.

Në fund, gjyqtari i procedurës paraprake Ilir Bytyqi ka vlerësuar se ekzistojnë bazat për caktimin e paraburgimit, duke konstatuar se masat më të buta nuk janë të mjaftueshme për zhvillimin e rregullt të procedurës penale.
