He told EO that the vote-counting process was conducted properly and that no irregularities were encountered that could have harmed the integrity of the election result.

According to Cakolli, Democracy in Action deployed approximately 100 observers across all 38 municipal counting centers, who closely monitored the entire process.

“Democracy in Action engaged around 100 observers distributed across each of the 38 municipal centers, who monitored the progress of the process and the regularity of the counting of candidates’ votes in particular. Data from the field show that, beyond the minor human errors identified also in CEC reports, there were no serious irregularities that could have undermined the integrity and validity of the process, as we saw after the December 28 elections last year. As such, I believe it is now clear that the counting process has produced, first and foremost, accurate and credible results and, secondly, another very important element is that these results appear to reflect almost fully the will of the citizens regarding the elections held on June 7,” he said.

Speaking about complaints related to the elections, he stressed that candidates have the legal right to use all legal remedies available, but added that the practice so far of the Electoral Complaints and Appeals Panel (ECAP) as well as the Supreme Court has set clear standards for handling such cases.

“Naturally, candidates who were part of the race had the right and still have the legal right to file complaints, even if this concerns a limited number of votes. But what matters is that a kind of precedent has now been established by the ECAP, including in previous election cycles, regarding the level of proof that must be provided concerning possible irregularities. In this regard, I believe that the decisions of the ECAP and the Supreme Court on earlier complaints — not the ones we have had most recently — will serve as the basis for decision-making even in cases that may potentially be submitted to the Supreme Court,” he said.

Cakolli believes that the responsible institutions can reach a final decision quickly, thus paving the way for the certification of the results.

“Therefore, I believe that, if not during this weekend, then at the latest in the first days of next week, there may be a decision by the ECAP and the Supreme Court, which is the final concluding step toward the certification of the election results. And that, as such, then constitutes the crucial step, I believe, in the process of forming the institutions. Because, after the certification of the election results, the deadlines for the formation of institutions will begin to run, in particular for the election of the country’s new President and for the election of the Government, and naturally also for the constitution of the Assembly. With the latter, which is the main condition, the 60-day deadline for electing the President and the other respective deadlines for forming the Government then begin to run,” he said.

According to him, mid-July remains the most likely period for holding the constitutive session.

“Since the Constitutional Court has determined that the 30-day deadline for constituting the Assembly is a definitive and absolute deadline, in terms of the obligation deputies have to complete it as a procedure, with the time usually needed — one to two weeks — to prepare the session and other elements, I believe that the third week of July, or mid-July, could be an optimal timeframe during which we may have the convening of the constitutive session. And at this point, the numbers, as such, dictate a relatively calm pace regarding the constitution of the Assembly. Because Lëvizja Vetëvendosje as the party that came first in the elections and its partners from the community ranks, I do not believe will have any problem when it comes to constituting the Assembly. Although the need for a political agreement regarding the election of the President could also dictate the very dynamics of political developments, both with regard to the constitution of the Assembly and the election of the Government,” he said.

He added that the main difficulty is not expected to be related to forming the Government, but to electing the country’s new President.

“If the Assembly is constituted in the second half of July, then this means that mid- or late September will be the final constitutional deadline within which the new President of the country must be elected. In this regard, this is the most categorical deadline, whereas in the case of the election of the Government there are two parallel deadlines. So, on the one hand there is the 60-day deadline from the day of the mandate, and on the other hand there is the total 40-day deadline, which includes 15 days for the first candidate (who is nominated by the acting President, or depending on which procedure is followed first), and in the event of a possible failure, there is the 10-day deadline for the election of the second candidate. And again 15 days for the other candidate, which in total makes 40 days. This means that, on the issue of the Government, a decision may be made at the latest sometime at the beginning of September, if not even earlier than that. But, given that I do not expect the issue of the Government to be a problem because of the configuration of the numbers, I believe that the more sensitive and potentially more problematic issue will be that of the election of the President, with the deadline that I believe will expire by mid- or possibly late September, depending on the procedures that will be followed for the constitution of the Assembly,” Cakolli added.

In the latest decision of the Constitutional Court, it is clearly determined that the President of Kosovo is elected with two-thirds of the votes and a quorum of two-thirds in the first two rounds of voting, while 61 votes are needed in the third round.

Likewise, the 35-day deadline set by the Constitutional Court expired at midnight on April 28, which means that, according to that decision, the Assembly is automatically dissolved without the need for a presidential decree.

Pas përfundimit të procedurave ankimore dhe certifikimit të rezultateve të zgjedhjeve, java e tretë e korrikut paraqitet si koha më optimale për thirrjen e seancës konstituive të Kuvendit të Kosovës, vlerëson Eugen Cakolli nga Demokracia në Veprim.

Ai tha për eo se procesi i numërimit të votave është zhvilluar në mënyrë të rregullt dhe se nuk janë hasur parregullsi që do të mund të dëmtonin integritetin e rezultatit zgjedhor.

Sipas Cakollit, Demokracia në Veprim ka angazhuar afërsisht 100 vëzhgues në të 38 qendrat komunale të numërimit, të cilët e kanë përcjellë nga afër gjithë procesin.

“Demokracia në Veprim ka pasur të angazhuar rreth 100 vëzhgues të shpërndarë në secilën prej 38 qendrave komunale, të cilët kanë monitoruar mbarëvajtjen e procesit dhe rregullsinë e numërimit të votave të kandidatëve në veçanti. Të dhënat nga terreni tregojnë që, përtej gabimeve minore njerëzore të evidentuara edhe në raportet e KQZ-së, nuk ka pasur asnjë parregullsi serioze e cila do të mund ta cenonte integritetin dhe vlefshmërinë e procesit, siç e kemi pasur rastin pas zgjedhjeve të 28 dhjetorit të vitit të kaluar. Kësisoj, unë besoj që tashmë është e qartë që procesi i numërimit ka prodhuar, në radhë të parë, rezultate të sakta e kredibile dhe, së dyti, një element tjetër me shumë rëndësi është që këto rezultate duket që reflektojnë pothuajse në plotni vullnetin e qytetarëve sa i përket zgjedhjeve të mbajtura më 7 qershor”, ka deklaruar ai.

Duke folur për ankesat që lidhen me zgjedhjet, ai nënvizoi se kandidatët gëzojnë të drejtën ligjore për të shfrytëzuar të gjitha mjetet juridike në dispozicion, por shtoi se praktika e deritanishme e Panelit Zgjedhor për Ankesa dhe Parashtresa (PZAP) si dhe e Gjykatës Supreme ka vendosur standarde të qarta për trajtimin e këtyre rasteve.

“Normalisht, kandidatët që kanë qenë pjesë e garës kanë pasur të drejtë dhe kanë të drejtën ligjore për të parashtruar ankesë, qoftë kjo edhe për një numër të kufizuar të votave. Por, ajo çfarë ka rëndësi është që tashmë është krijuar një lloj precedenti nga ana e PZAP-së, edhe në ciklet e mëparshme zgjedhore, sa i përket nivelit të provimit që duhet bërë lidhur me parregullsitë eventuale. Dhe në këtë drejtim, besoj që vendimet e PZAP-së dhe të Gjykatës Supreme për ankesat paraprake (pra jo këto që i patëm tashmë së fundi) do të shërbejnë si bazë për vendimmarrje edhe në rastet që potencialisht mund të parashtrohen pranë Gjykatës Supreme”, u shpreh ai.

Cakolli vlerëson se institucionet përgjegjëse mund të arrijnë shpejt në vendimin përfundimtar, duke hapur kështu rrugën për certifikimin e rezultateve.

“Kësisoj, unë besoj që, nëse jo gjatë kësaj fundjave, më së voni në ditët e para të javës së ardhshme mund të ketë vendimmarrje nga ana e PZAP-së dhe Gjykatës Supreme, që është hapi i fundit përmbyllës drejt certifikimit të rezultateve zgjedhore. E që, si i tillë, përbën pastaj hapin krucial, besoj unë, në procesin e formimit të institucioneve. Sepse, pas certifikimit të rezultateve zgjedhore, do të fillojnë të rrjedhin afatet për formimin e institucioneve, në veçanti për zgjedhjen e Presidentit të ri të vendit dhe për zgjedhjen e Qeverisë, e normalisht edhe për konstituimin e Kuvendit. Me këtë të fundit, që është kushti kryesor, brenda të cilit pastaj fillon të rrjedhë afati 60-ditor për zgjedhjen e Presidentit dhe afatet e tjera përkatëse për formimin e Qeverisë”, tha ai.

Sipas tij, mesi i korrikut mbetet periudha më e mundshme për mbajtjen e seancës konstituive.

“Meqenëse Gjykata Kushtetuese ka përcaktuar se afati 30-ditor për konstituimin e Kuvendit është afat definitiv dhe absolut, në kuptim të obligimit që kanë deputetët për ta përmbyllur atë si procedurë, me afatet që zakonisht marrin një deri në dy javë për përgatitjen e seancës e elemente të tjera, besoj që java e tretë e muajit korrik, ose mesi i muajit korrik, mund të jetë një afat optimal gjatë të cilit mund të kemi thirrjen e seancës konstituive. Dhe që tashmë numrat, si të tillë, diktojnë një tempo relativisht të qetë sa i përket konstituimit të Kuvendit. Sepse Lëvizja Vetëvendosje si parti e dalë e para nga zgjedhjet dhe partnerët e saj nga radhët e komuniteteve, nuk besoj që do të kenë ndonjë problem sa i përket konstituimit të Kuvendit. Sado që nevoja për një marrëveshje politike në raport me zgjedhjen e Presidentit do të mund ta diktojë edhe vetë dinamikën e zhvillimeve politike, qoftë sa i përket konstituimit të Kuvendit, ashtu edhe të zgjedhjes së Qeverisë”, deklaroi ai.

Ai shtoi se vështirësia kryesore nuk pritet të lidhet me formimin e Qeverisë, por me zgjedhjen e Presidentit të ri të vendit.

“Në rast se Kuvendi do të konstituohet në pjesën e dytë të muajit korrik, atëherë i bie që mesi apo fundi i muajit shtator do të jetë afati i fundit kushtetues brenda të cilit duhet të zgjidhet Presidenti apo Presidentja e re e vendit. Në këtë drejtim, ky është afati më kategorik, derisa në rastin e zgjedhjes së Qeverisë ekzistojnë dy afate paralele. Pra, në njërën anë është afati 60-ditor nga dita e mandatimit, dhe në anën tjetër është afati i tërësishëm prej 40 ditësh, që përfshin 15 ditë për kandidatin e parë (i cili nominohet nga ana e Presidentit ushtrues të detyrës, apo në varësi se cila procedurë do të ndiqet e para), dhe në rast të dështimit eventual, është afati 10-ditor për zgjedhjen e kandidatit të dytë. Dhe sërish 15 ditë për kandidatin tjetër, që në tërësi bëjnë 40 ditë. Që i bie se, për çështjen e Qeverisë, vendimmarrja mund të jetë më së voni diku nga fillimi i muajit shtator, nëse jo edhe më herët se aq. Por, duke qenë se çështja e Qeverisë nuk pres të jetë problem për shkak të konfiguracionit të numrave, besoj se çështja më e ndjeshme dhe potencialisht më problematike do të jetë ajo për zgjedhjen e Presidentit, me afatin që besoj do të përfundojë nga mesi apo eventualisht fundi i muajit shtator, në varësi të procedurave që do të ndiqen për konstituimin e Kuvendit”, shtoi Cakolli.

Në vendimin e fundit të Gjykatës Kushtetuese përcaktohet qartë se Presidenti i Kosovës zgjidhet me dy të tretat e votave dhe me kuorumin prej dy të tretave në dy rundet e para të votimit, ndërsa në rundin e tretë nevojiten 61 vota.

Po ashtu, afati 35-ditor i caktuar nga Gjykata Kushtetuese përfundoi në mesnatën e 28 prillit, çka nënkupton se, sipas atij vendimi, Kuvendi shpërbëhet automatikisht pa pasur nevojë për dekret presidencial.
