Nurse Enlirat Duraku has sent an open letter to the Disciplinary Commission of the University Clinical Center of Kosovo (UCCK), calling for an examination of the actions of the director of the Neurosurgery Clinic, Besnik Elshani, in connection with a report filed against a nurse at the clinic.

Duraku is asking for the case to be carefully analyzed and for it to be determined whether the report against the nurse was supported by facts and evidence. According to him, she was accused of stealing clips.

In his letter, the nurse criticizes the organizations responsible for protecting nurses’ rights, as well as the Nursing Division, claiming that they did not support their accused colleague.

“Since the organizations that protect nurses’ rights have failed to fulfill their duties, leaving the nurse from the Neurosurgery Clinic to face unsubstantiated accusations alone,” Duraku’s letter states.

He also claims that the Nursing Division, “whether intentionally or not,” failed to protect the nurse’s professional integrity.

Duraku emphasizes that, based on the circumstances of the case and the decision of the competent court, the nurse was found not guilty.

According to him, the review of the case showed that the report was not accompanied by concrete evidence and that there were insufficient facts to establish her responsibility.

He believes that such accusations can damage a healthcare worker’s professional reputation, dignity and working relationships.

For this reason, Duraku is asking the UCCK Disciplinary Commission to verify the factual basis of the report and determine whether director Besnik Elshani had concrete evidence for the claim that was submitted.

He is also asking it to examine whether institutional procedures were followed when the report was filed and whether the nurse suffered professional or reputational harm.

Duraku is asking that, if it is established that the report was knowingly made falsely, without facts, without evidence or in breach of professional rules and responsibilities, the disciplinary measures provided for be imposed on the director of the Neurosurgery Clinic.

“The aim is not to prejudge anyone’s responsibility, but to guarantee a fair procedure, protect workers from unsubstantiated accusations and preserve professional integrity within UCCK,” his letter states.

The nurse is asking the Commission to address the matter objectively and transparently, in accordance with the procedures and institutional acts currently in force.

The letter was addressed to the UCCK Disciplinary Commission. By the time this article was published, the director of the Neurosurgery Clinic, Besnik Elshani, had not issued a position regarding the claims raised in the open letter.

Infermieri Enlirat Duraku i ka dërguar një letër të hapur Komisionit Disiplinor të Qendrës Klinike Universitare të Kosovës (QKUK), përmes së cilës kërkon shqyrtimin e veprimeve të drejtorit të Klinikës së Neurokirurgjisë, Besnik Elshani, lidhur me një denoncim ndaj një infermiereje të kësaj klinike.

Duraku kërkon që rasti të analizohet me kujdes dhe të përcaktohet nëse denoncimi ndaj infermieres është mbështetur në fakte dhe prova. Sipas tij, ajo ishte akuzuar për vjedhjen e klipave.

Në letrën e tij, infermieri kritikon organizatat që kanë për detyrë mbrojtjen e të drejtave të infermierëve, si dhe Divizionin për Infermieri, duke pretenduar se nuk e kanë mbështetur kolegen e akuzuar.

“Duke qenë se organizatat që mbrojnë të drejtat e infermierëve kanë dështuar në përmbushjen e detyrave të tyre, kështu duke e lënë infermieren e Klinikës së Neurokirurgjisë që e vetme të përballet me akuza të pabaza”, thuhet në letrën e Durakut.

Ai pretendon gjithashtu se Divizioni për Infermieri, “me apo pa qëllim”, nuk ka arritur ta mbrojë integritetin profesional të infermieres.

Duraku thekson se, duke u bazuar në rrethanat e çështjes dhe në vendimin e gjykatës kompetente, infermierja është shpallur e pafajshme.

Sipas tij, shqyrtimi i rastit ka treguar se denoncimi nuk është shoqëruar me prova konkrete dhe se nuk kanë ekzistuar fakte të mjaftueshme për të vërtetuar përgjegjësinë e saj.

Ai vlerëson se akuza të tilla mund të dëmtojnë reputacionin profesional, dinjitetin dhe marrëdhëniet e punës së një punëtori shëndetësor.

Për këtë arsye, Duraku i kërkon Komisionit Disiplinor të QKUK-së të verifikojë bazën faktike të denoncimit dhe të përcaktojë nëse drejtori Besnik Elshani ka pasur prova konkrete për pretendimin e paraqitur.

Po ashtu, ai kërkon të shqyrtohet nëse janë respektuar procedurat institucionale gjatë dorëzimit të denoncimit dhe nëse infermieres i është shkaktuar dëm profesional ose reputacional.

Duraku kërkon që, në rast se vërtetohet se denoncimi është bërë me vetëdije në mënyrë të rreme, pa fakte, pa prova ose në kundërshtim me rregullat dhe përgjegjësitë profesionale, ndaj drejtorit të Klinikës së Neurokirurgjisë të zbatohen masat disiplinore të parapara.

“Qëllimi nuk është paragjykimi i përgjegjësisë së askujt, por garantimi i një procedure të drejtë, mbrojtja e punëtorëve nga akuzat e pabazuara dhe ruajtja e integritetit profesional brenda QKUK-së”, thuhet në letrën e tij.

Infermieri kërkon që Komisioni ta trajtojë çështjen në mënyrë objektive dhe transparente, në pajtim me procedurat dhe aktet institucionale në fuqi.

Letra i është drejtuar Komisionit Disiplinor të QKUK-së. Deri në publikimin e këtij shkrimi, drejtori i Klinikës së Neurokirurgjisë, Besnik Elshani, nuk ka dhënë qëndrim lidhur me pretendimet e ngritura në letrën e hapur.
