The Democratic Party of Kosovo has announced that it will hold a press conference today.

According to the party’s announcement, the meeting with journalists will take place at 11:00 in the lobby of the Kosovo Assembly.

In recent days, the PDK has held protests and carried out actions in front of the government and at the Assembly, demanding that the constitutive session be convened. Through these actions, the party has accused acting Prime Minister Albin Kurti of violating the constitutional order and usurping institutions.

A day earlier, the chair of the constitutive session, Avni Dehari, announced that its continuation had been scheduled for September 9. Meanwhile, the constitutional deadline for constituting the Assembly expired on August 7.

Sipas njoftimit të partisë, takimi me gazetarët do të zhvillohet në orën 11:00, në hollin e Kuvendit të Kosovës.

Gjatë ditëve të fundit, PDK ka zhvilluar protesta dhe aksione para Qeverisë dhe në Kuvend, duke kërkuar që të thirret seanca konstituive. Përmes këtyre veprimeve, partia ka akuzuar kryeministrin në detyrë, Albin Kurti, për shkelje të rendit kushtetues dhe uzurpim të institucioneve.

Një ditë më parë, kryesuesi i seancës konstituive, Avni Dehari, njoftoi se vazhdimi i saj është caktuar për 9 shtator. Ndërkohë, afati kushtetues për konstituimin e Kuvendit përfundoi më 7 gusht.

The Parliamentary Group of the Democratic Party of Kosovo, through its Secretary General Vlora Çitaku, has asked the chairman of the constitutive session, Avni Dehari, to act in accordance with the Constitution and the Rules of Procedure of the Assembly and schedule the continuation of the session for September 1, 2026, at 11:00.

The PDK stresses that, according to the jurisprudence of the Constitutional Court, exceeding the constitutional deadline does not eliminate the obligation for the Assembly to be constituted.

The letter addressed to Dehari states:

Dear Mr. Dehari,

In your role as the chairman of the constitutive session by age, in accordance with Article 9 of the Rules of Procedure of the Assembly of the Republic of Kosovo, we ask you, on behalf of the deputies of the Democratic Party of Kosovo, to fulfill your constitutional and procedural responsibility. For this reason, on September 1, 2026, at 11:00, you must call the continuation of the constitutive session, in accordance with the requirements of the Rules of Procedure of the Assembly of the Republic of Kosovo.

The failure to constitute the Assembly within the specified deadline has already led to a serious situation, which is linked to the violation of the Constitution and the non-implementation of the judgments of the Constitutional Court. Failure to respect the deadlines and procedures set out in the Assembly’s Rules of Procedure further aggravates this situation.

You must take into account that the jurisprudence of the Constitutional Court determines that, even in the event of exceeding the constitutional deadline, the Assembly must be constituted. The passing of this deadline does not remove the obligation to complete the constitution process.

Calling the continuation of the constitutive session gives you the opportunity, but at the same time also imposes the obligation, to avoid another violation and ensure the continuation of the Assembly’s constitution process.

We remind you that your powers as the chairman of the constitutive session by age are defined and limited by the Constitution, the judgments of the Constitutional Court, and the Rules of Procedure of the Assembly. Your duty is to enable the development and continuation of the session until the constitution of the Assembly. You cannot decide, on the basis of political assessments or considerations, whether and when the constitution process of the Assembly will continue, as this does not fall within your powers.

Political assessments and negotiations are the responsibility of the political forces and can only take place within the constitutional framework of the Republic of Kosovo, which we are all obliged to respect.

Therefore, we ask you, without any further delay, to call the continuation of the constitutive session on September 1, 2026, at 11:00, thus enabling the exercise of the constitutional mandate by the elected deputies of the Republic of Kosovo.

Në funksionin tuaj si kryesues i seancës konstituive sipas moshës, në pajtim me Nenin 9 të Rregullores së Punës së Kuvendit të Republikës së Kosovës, ju kërkojmë, në emër të deputetëve të Partisë Demokratike të Kosovës, të përmbushni përgjegjësinë tuaj kushtetuese dhe procedurale. Për këtë arsye, më 01 shtator 2026, në ora 11.00, duhet të thërrisni vazhdimin e seancës konstituive, në përputhje me kërkesat e Rregullores së Kuvendit të Republikës së Kosovës.

Moskonstituimi i Kuvendit brenda afatit të përcaktuar ka sjellë tashmë një situatë serioze, e cila lidhet me shkeljen e Kushtetutës dhe moszbatimin e aktgjykimeve të Gjykatës Kushtetuese. Mosrespektimi i afateve dhe procedurave të parashikuara në Rregulloren e Kuvendit e rëndon edhe më shumë këtë gjendje.

Duhet të merrni parasysh se jurisprudenca e Gjykatës Kushtetuese përcakton që, edhe në rast të tejkalimit të afatit kushtetues, Kuvendi duhet të konstituohet. Kalimi i këtij afati nuk e heq detyrimin për përfundimin e procesit të konstituimit.

Thirrja e vazhdimit të seancës konstituive ju jep mundësinë, por njëkohësisht ju ngarkon edhe me detyrimin, që të shmangni një shkelje tjetër dhe të siguroni vijimin e procesit të konstituimit të Kuvendit.

Ju rikujtojmë se kompetencat tuaja si kryesues i seancës konstituive sipas moshës janë të përcaktuara dhe të kufizuara nga Kushtetuta, aktgjykimet e Gjykatës Kushtetuese dhe Rregullorja e Kuvendit. Detyra juaj është të mundësoni zhvillimin dhe vazhdimin e seancës deri në konstituimin e Kuvendit. Nuk mund të vendosni, mbi bazën e vlerësimeve ose konsideratave politike, nëse dhe kur do të vazhdojë procesi i konstituimit të Kuvendit, pasi kjo nuk hyn në kompetencat tuaja.

Vlerësimet dhe negociatat politike janë përgjegjësi e forcave politike dhe mund të zhvillohen vetëm brenda kornizës kushtetuese të Republikës së Kosovës, të cilën të gjithë jemi të detyruar ta respektojmë.

Andaj, ju kërkojmë që, pa asnjë vonesë të mëtejshme, ta thërrisni vazhdimin e seancës konstituive më 01 shtator 2026, në ora 11.00, duke mundësuar kështu ushtrimin e mandatit kushtetues nga deputetët e zgjedhur të Republikës së Kosovës.

According to the PDK, the failure to constitute the Assembly within the prescribed deadline has created a serious situation, characterized by violations of the Constitution and disregard for the decisions of the Constitutional Court.

The letter emphasizes that the situation is further aggravated by the failure to implement the procedures and deadlines set out in the Rules of Procedure of the Assembly.

The PDK recalls that the case law of the Constitutional Court requires the constitution of the Assembly even after the constitutional deadline has elapsed, since violating this deadline does not invalidate the obligation to complete the process. The Democratic Party of Kosovo has called on the chair of the constitutive session, Avni Dehari, to resume the work of the Kosovo Assembly today at 11:00 a.m., with the aim of unblocking the process of constituting the legislature.

The request was conveyed by PDK Secretary Vlora Çitaku in a letter addressed to Dehari.

In the document, the party requests that the session continue pursuant to Article 9 of the Rules of Procedure of the Assembly of the Republic of Kosovo.

According to the PDK, the delay in constituting the Assembly has created a serious situation regarding compliance with the Constitution and the judgments of the Constitutional Court.

“The failure to constitute the Assembly within the prescribed deadline has already created a serious situation with regard to compliance with the Constitution and the judgments of the Constitutional Court,” the PDK’s request states.

The opposition PDK emphasizes that exceeding the procedural deadlines set out in the Assembly’s Rules of Procedure further worsens the situation.

“Failure to comply with the procedural deadlines established by the Assembly’s Rules of Procedure only deepens this situation further,” the letter states.

Referring to the jurisprudence of the Constitutional Court, the PDK underscores that the expiry of the constitutional deadline does not remove the obligation to constitute the Assembly.

“The violation of the deadline does not extinguish the obligation to constitute it,” the party’s request emphasizes.

Opozitarja PDK thekson se tejkalimi i afateve procedurale të parashikuara në Rregulloren e Kuvendit e përkeqëson më tej gjendjen.

“Mosrespektimi i afateve procedurale të përcaktuara me Rregulloren e Kuvendit vetëm sa e thellon më tej këtë situatë”, thuhet në shkresë.

Duke iu referuar jurisprudencës së Gjykatës Kushtetuese, PDK-ja nënvizon se kalimi i afatit kushtetues nuk e heq detyrimin për konstituimin e Kuvendit.

“Shkelja e afatit nuk e shuan detyrimin për konstituimin e tij”, theksohet në kërkesën e partisë.
