Judges have filed a criminal complaint over the failure to pay judges’ and prosecutors’ salaries for August 2026. The complaint calls on the prosecution service to investigate the circumstances and identify the person or persons who made, communicated or implemented the decision that resulted in the salaries not being paid.

Finance Minister Petrit Malaj is among those named in the complaint.

The complaint emphasizes that the situation affects not just one magistrate, but a considerable number of judges and prosecutors across the country.

According to the complaint, the aim is for the prosecution service to establish individual responsibility for the specific actions or omissions that led to the failure to pay the salaries. The judges also clarify that the criminal complaint does not seek to replace the administrative, judicial or institutional remedies available for resolving disputes over how salaries are calculated.

They emphasize that the initiative is not intended to put pressure on any state institution to achieve a specific financial outcome, but solely to have the legality of the actions that led to the blocking of the salaries verified through criminal proceedings.

“Through this complaint, we ask you to consider the factual circumstances and the reasoning concerning your jurisdiction, as well as the criminal liability of those named in the complaint for the criminal offenses set out in its subject matter.

The administration of the Civil Chamber of the Tirana Court has launched a general boycott, blocking services and court proceedings in protest against the government’s decision to block magistrates’ salaries.

The administration notified the court president of the boycott, while employees were informed that a position would be taken following a meeting of the presidents of all the courts, scheduled for 15:00 at the Supreme Court.

The deadlock arose after Parliament failed to approve the new salary formula for magistrates by the July 31 deadline, in accordance with the Constitutional Court’s request.

After the deadline expired, the High Judicial Council and the High Prosecutorial Council determined that they were obliged to directly implement the court’s decision and set a new reference salary of 222,425 lekë, up from the previous 156,800 lekë, along with a 14,000-lekë supplement for the qualification level.

However, the Ministry of Finance did not execute the payrolls prepared on the basis of the new increase. The ministry argued that determining the salary formula falls under Parliament’s authority and requested that the payrolls be resubmitted using the previous methodology.

As a result, August salaries have not been paid to a considerable part of the justice system, including not only judges and prosecutors, but also employees of the court and prosecution administrations.

LVV MP Adnan Rrustemi has said that Kosovo has been experiencing a political deadlock since the February 9, 2025 elections.

Rrustemi claims that the opposition initially obstructed the establishment of new institutions and later blocked the election of the president as well. According to him, even the agreement reached between LVV and LDK on the candidacy of Prof. Bekim Sejdiu was not supported by six LDK MPs.

He warned that the continuation of this situation could send Kosovo back to the polls. Rrustemi accuses the opposition of seeking to prevent Albin Kurti from governing.

In his post, Rrustemi listed the political developments that, according to him, have led to this situation:

After the completion of a full four-year term, regular elections were held on February 9, 2025.

According to him, from February 2025 until November 2025, the opposition blocked efforts to allow LVV to govern. He noted that the election of Albulena Haxhiu as speaker of the Assembly was obstructed for several months, while later neither Albin Kurti for prime minister nor Glauk Konjufca received support.

As a result, Kosovo went to new elections.

On December 28, 2025, LVV won the elections with an even more convincing result.

After the constitution of the Assembly and the formation of the government, the opposition, according to Rrustemi, shifted the blockade to the election of the president, which required 80 votes in the ballot box.

LVV asked opposition parties to propose names that could receive its support, but they did not put forward a single name. LVV then proposed a nonpartisan figure, Feride Rushiti, but that candidacy was also rejected.

After this, Kosovo went to the polls again.

On June 7, 2026, LVV once again won convincingly.

“If this does not happen, meaning if there is no political agreement and political parties want to go to elections, then we as civil society and as citizens will only see the consequences that will arise as a result of the lack of institutions in the Republic of Kosovo,” Jakaj said.

Albulena Haxhiu expressed regret after the Democratic Party of Kosovo and the Alliance declined an invitation to a consultative meeting with the leaders of parliamentary political entities.

According to Kosovo’s acting president, the meeting was intended to achieve the political consensus needed to overcome the institutional deadlock. She described the refusal as a wrong and ill-considered step, as well as evidence of a lack of willingness to move away from what she called “barricade-like positions.” Haxhiu stressed that such stances serve no one, and least of all the Republic.

Haxhiu believes that three electoral processes, which produced broadly similar results, show that the institutional crisis cannot be resolved without political dialogue. Although, formally, the election of the president constitutes the third step, she said that under the current circumstances, this issue should be placed first on the discussion table.

She recalled that during the winter and spring of this year, there had been requests and appeals for the parties to hold talks in advance, before any institutions were constituted and regardless of the outcome. According to Haxhiu, the moment, opportunity and necessity to implement this now exist. She called for the discussions not to begin with what could be achieved easily, but with the issue that, in her view, is continually taking the country to elections: the question of the president.

During the morning, the Parliamentary Group of the Democratic Party of Kosovo appeared at Parliament after earlier asking Avni Dehari, the chair of the constitutive session, to call for its continuation. Alliance lawmakers were also seen on the premises of Parliament.

Arian Tahiri, head of the PDK Parliamentary Group, said that the blockade in the Assembly of Kosovo could no longer be treated merely as a “political crisis.” According to him, it is now a matter of protecting the constitutional order, the institutions and the Republic itself.

Besnik Tahiri, who leads the AAK Parliamentary Group, meanwhile said that the door to the chamber where plenary sessions are held was being deliberately kept closed.

In a notice, the Parliament Administration clarified that it had received no official communication regarding the organization and holding of a session on 16 August.

The clarification emphasized that the absence of a notice did not constitute a political decision or a position on initiatives by lawmakers or parliamentary groups.

The Administration said that as soon as official communication regarding the holding of a session was received, the appropriate steps would be taken and administrative, technical and logistical support would be provided within the scope of its authority.

PDK and Alliance lawmakers are requesting for the third time that the constitutive session continue. However, Avni Dehari has reiterated that he will not call for its continuation until there is a political agreement on the head of state.

He believes the call to continue the session can be interpreted as an attempt to get the process back on an institutional track and end a deadlock that has lasted beyond any reasonable limit.

However, Avdimetaj cautions that the resumption of the session must not end in another political confrontation without any result.

“If there is no willingness to vote and assume the responsibility entrusted to them by the citizens, then even the continuation of the session could turn into another form of obstruction,” he said.

According to Avdimetaj, responsibility for breaking the deadlock lies with all political forces, including the PDK, LDK, AAK and Vetëvendosje, which must sit down together and find an institutional solution.

He emphasizes that compromise is an element of democracy, but it cannot be used by one party to impose its will on another. At the same time, he says, the election result must be respected.

“We cannot demand democracy only when we like the result,” Avdimetaj said. He added that the opposition has the right to oppose, criticize and challenge the majority within the Assembly, but it cannot override the will of the citizens through political obstruction.

On the other hand, he stresses that the majority must also understand that a democratically secured mandate does not give it the right to ignore everyone else.

“Kosovo does not need temporary winners of a political battle. It needs functioning institutions,” Avdimetaj said.

He warns that the continuation of the political impasse risks undermining citizens’ trust both in politics and in the institutions of the Republic of Kosovo.

In his assessment, the main concern is not which party may win the political confrontation, but the possibility that “the citizens and the state will be the losers.”

Commentator and activist Gazmend Dashi, analyzing the latest developments on the political scene, says the PDK’s approach deserves to be welcomed if its aim is to break the deadlock and make the institutions operational. However, he warns that such actions would be harmful to Kosovo if they are driven by narrow personal or party interests.

“Kosovo cannot be treated as the property of any political party or as a means of advancing individual interests,” Dashi told “Bota sot.” He added that such an approach would further damage Kosovo’s image in the international arena.

Dashi describes the current institutional situation as worrying, arguing that the failure to establish and operationalize stable institutions is pushing the country toward a cycle of political uncertainty. According to him, institutions must serve the citizens and the state, rather than be used as instruments for controlling power.

Referring to the LDK, he says the party has placed state and national interests above narrow party interests. Dashi says that, even under the current circumstances, the LDK is trying to contribute to finding a solution and overcoming the institutional collapse.

He calls on the political parties to abandon grudges, confrontations and narrow calculations, because, according to him, Kosovo stands above every party and is more important than any individual.

Economic expert Jakup Bellaqa told “Bota sot” that the failure of Kosovo’s full institutions to function is having serious consequences for the economy.

Bellaqa explains that the lack of fully established institutions produces not only political but also economic consequences. According to him, political instability is transferred directly to the economy, damaging the conditions for doing business and macroeconomic and macro-fiscal indicators, while also driving foreign investors away from strategic sectors.

He stresses that this situation harms economic growth, social welfare and citizens’ standard of living.

Bellaqa emphasizes that Kosovo’s economic integration remains difficult as long as the country lacks full and stable institutions.

According to him, without institutional stability, the economy cannot be properly integrated into the regional and European markets. International investors avoid medium- and long-term agreements because they perceive Kosovo as a country characterized by legal uncertainty and economic instability.

According to Bellaqa, the consequences of the crisis are also visible in the labor market.

He believes that the situation directly affects the growth of Gross Domestic Product and makes the labor market more unstable. Younger generations are particularly affected, as they still lack the preparation necessary to meet the demands of this market.

A different perspective is offered by Korab Rashiti, an Albanian deputy in Bern, Switzerland, who says the consequences of the absence of fully established institutions should be analyzed separately for the private sector and for the functioning of the state.

In a statement to “Bota sot,” Rashiti says he is not necessarily convinced that the private economy is harmed by the lack of fully established institutions. According to him, when Parliament does not continuously pass new laws and regulations, greater legal stability is created. Businesses primarily need predictability, and when the rules do not change every month, entrepreneurs find it easier to invest and make plans.

He adds that economic progress is not determined by the number of laws passed.

Rashiti notes that politics sometimes acts as though economic development depended on the number of legal acts voted on, although, in his view, wealth is created by citizens and businesses, not in the halls of Parliament.

However, he stresses that the picture changes completely when the functioning of the state itself is analyzed.

Rashiti says that the implementation of public projects, infrastructure investments and strategic reforms is impossible without functional institutions. After more than two years of political deadlock, many projects have been postponed, and it is reasonable to expect some of them to face delays lasting several years. According to him, the time lost by politicians is later paid for by the administration and citizens.

Summing up the distinction, he explains that the private sector may benefit from greater legal stability during periods when politicians do not constantly change the rules. Meanwhile, state projects bear the main cost of the institutional deadlock.

Rashiti warns that the risk is not limited to the economy, as it also affects security and the democratic functioning of institutions.

According to him, institutions that operate for a long time at only half capacity create an institutional vacuum. History shows that such spaces do not remain empty, because various actors, whether domestic or external, may increase their influence over society and institutions. For this reason, the normal functioning of the state is essential not to pass as many laws as possible, but to ensure order, security and the rule of law.

In his assessment, the private sector is not necessarily the party suffering the greatest harm from the institutional crisis. The highest price is paid by state projects, security and democratic functioning.

Rashiti also criticizes the political class for allowing the crisis to continue for so long.

He says the economy does not stop even when politicians become stuck. Every morning, businesses resume work, workers report to their jobs, entrepreneurs take on risks and citizens create value, while political representatives continue discussing who will occupy each seat.

According to Rashiti, Kosovo does not lack politics, but governance.

He believes that the country may not have had too little politics in recent years, but rather too much politics and very little governance. States, he says, do not advance through the number of statements or manufactured crises, but thanks to functional institutions and citizens who are allowed to work and build their future.

Referring to current political developments, Rashiti also asks whether this situation may suit the acting Prime Minister.

He notes that, from a political perspective, running the country without a fully functional Parliament and without the continuous oversight of parliamentary committees may be more comfortable than being held accountable every day. Nevertheless, he says, this is precisely where the danger lies: in a serious democracy, those in power should never feel comfortable when institutional oversight is absent. When a government becomes accustomed to ruling without supervision, it is not the opposition that loses, but democracy.

In his assessment, Kosovo does not lack politics, but governance. Rashiti raises the possibility that the problem over these years has not been too little politics, but too much of it and a lack of governance.

He emphasizes that states do not progress through the number of statements issued or crises manufactured, but through functional institutions and citizens who are enabled to work and build the future.

Commenting on current political developments, Rashiti also raises the question of whether this situation may suit the acting Prime Minister.

According to him, from a political standpoint, it is more comfortable to govern without a fully functional Parliament and without constant scrutiny from parliamentary committees than to be held accountable every day. This, Rashiti says, is precisely where the problem lies, because in a serious democracy, those in power should never feel comfortable when institutional oversight is absent.

Rashiti concludes that when a government becomes accustomed to exercising power without oversight, it is no longer the opposition that loses, but democracy itself.
