Prime Minister Albin Kurti underlined that documenting war crimes and creating an accurate database are essential. According to him, this carries weight both for justice and for preserving the country’s historical memory.

However, at the center of the discussion remains the fact that such a list is only now being compiled. Debate also continues over whether this delay came as a result of negligence or political calculations over the years.

“Negligence and uncertainty have hindered a credible list”

On this issue, legal and political affairs expert Blerim Burjani told “Bota sot” that the absence of a credible list of victims, together with institutional negligence, has created major uncertainty in the handling of war crimes.

He assessed that the accurate recording of victims is especially important for creating the legal basis for possible lawsuits against the Serbian state in the future.

“Negligence, not the certainty that a credible list could provide, is of great importance in order to file a lawsuit against the Serbian state at any time,” Burjani said.

According to him, a more advanced legal step should now be taken, one that would include a comprehensive lawsuit over the mass killings of Albanians during the war.

Burjani also stressed that in the past there were major political calculations regarding the drafting of the lists of victims and the damages caused by Serbia.

“There were many political calculations over whether this list should be compiled, because it was believed that a Kosovo–Serbia agreement could be reached through dialogue, which failed long ago,” he said.

According to Burjani, for future legal processes, both the lists of victims and those of damages remain essential, including looting and the destruction of family economies and private property.

“Documenting the victims is a moral and institutional obligation”

On the other hand, Professor Dr. Muhamet Racaj said in a conversation with “Bota sot” that drafting a state list of war victims in Kosovo, 27 years after its end, constitutes a necessary step for the state of Kosovo.

He said that every state that has gone through war has a moral, institutional and legal obligation to accurately document the victims of aggression, both to honor their dignity and to preserve the historical truth.

“Compiling a state list of war victims is a necessary step for the Republic of Kosovo,” Racaj stressed.

According to him, although this process is being finalized now, institutional efforts over the years to document the victims, the missing and those affected by the war have not been lacking.

Racaj said that various databases have been built and verification processes have been carried out, but without achieving a single comprehensive register at the state level.

He stressed that it is not fair to say this issue was deliberately neglected by post-war governments, but neither should its finalization be attributed to just one executive.

According to the professor, the process has lacked full inter-institutional coordination, a unified methodology and sustained continuity.

Racaj underlined that a verified and reliable list is of strategic importance for Kosovo, as it strengthens its international position and helps in the prosecution of war crimes.

He added that it also serves to prevent the denial of crimes and to preserve the historical memory of the victims.

In the end, Racaj called for this process to be treated as a state project, beyond political and party divisions, and to be completed in a transparent and professional manner.

He also stressed that state institutions, experts, associations of victims’ family members and international partners should be involved in this process, so that Kosovo has a reliable and sustainable record.

Një çerek shekulli e më shumë pas mbarimit të luftës në Kosovë, është zhvilluar një takim konsultativ ku është paraqitur versioni fillestar i listës preliminare të viktimave të luftës. Qëllimi i këtij procesi është ngritja e një evidence shtetërore të verifikuar dhe të besueshme për viktimat e luftës së fundit.

Kryeministri Albin Kurti ka nënvizuar se dokumentimi i krimeve të luftës dhe krijimi i një baze të saktë të të dhënave janë të domosdoshme. Sipas tij, kjo ka peshë si për drejtësinë, ashtu edhe për ruajtjen e kujtesës historike të vendit.

Megjithatë, në qendër të diskutimit mbetet fakti pse një listë e tillë po përpilohet vetëm tani. Po ashtu, vazhdon debati nëse kjo vonesë erdhi si pasojë e neglizhencës apo e kalkulimeve politike përgjatë viteve.

“Neglizhenca dhe pasiguria kanë penguar një listë të besueshme”

Lidhur me këtë çështje, eksperti i çështjeve juridike dhe politike, Blerim Burjani, ka thënë për “Bota sot” se mungesa e një liste kredibile të viktimave, bashkë me neglizhencën institucionale, kanë prodhuar pasiguri të madhe në trajtimin e krimeve të luftës.

Ai ka vlerësuar se evidentimi i saktë i viktimave është veçanërisht i rëndësishëm për krijimin e bazës ligjore për padi të mundshme ndaj shtetit serb në të ardhmen.

“Neglizhenca, jo siguria, që mund të ketë një listë kredibile, ka rëndësi të madhe për të ngritur herëdokur padi ndaj shtetit serb”, ka deklaruar Burjani.

Sipas tij, tashmë duhet ndërmarrë një hap juridik më i avancuar, i cili do të përfshinte një padi gjithëpërfshirëse për vrasjet masive të shqiptarëve gjatë luftës.

Burjani ka theksuar gjithashtu se më herët ka pasur kalkulime të mëdha politike për sa i përket hartimit të listave të viktimave dhe të dëmeve të shkaktuara nga Serbia.

“Ka pasur shumë kalkulime politike nëse duhet bërë kjo listë, sepse është vlerësuar se mund të arrihet një marrëveshje Kosovë–Serbi përmes dialogut, i cili ka dështuar moti”, është shprehur ai.

Sipas Burjanit, për proceset e ardhshme ligjore mbeten thelbësore si listat e viktimave, ashtu edhe ato të dëmeve, duke përfshirë plaçkitjet dhe shkatërrimin e ekonomive familjare e të pronave private.

“Dokumentimi i viktimave është detyrim moral dhe institucional”

Nga ana tjetër, profesori dr. Muhamet Racaj ka vlerësuar në një bashkëbisedim me “Bota sot” se hartimi i një liste shtetërore të viktimave të luftës në Kosovë, 27 vjet pas përfundimit të saj, përbën një hap të domosdoshëm për shtetin e Kosovës.

Ai është shprehur se çdo shtet që ka kaluar përmes luftës e ka obligim moral, institucional dhe juridik të dokumentojë me saktësi viktimat e agresionit, si për të nderuar dinjitetin e tyre, ashtu edhe për të ruajtur të vërtetën historike.

“Përpilimi i një liste shtetërore të viktimave të luftës është një hap i domosdoshëm për Republikën e Kosovës”, ka theksuar Racaj.

Sipas tij, megjithëse ky proces po finalizohet tani, ndër vite nuk kanë munguar përpjekjet institucionale për dokumentimin e viktimave, të zhdukurve dhe të prekurve nga lufta.

Racaj ka bërë të ditur se janë ndërtuar baza të ndryshme të të dhënave dhe janë zhvilluar procese verifikimi, por pa u arritur një regjistër unik dhe gjithëpërfshirës në nivel shtetëror.

Ai ka theksuar se nuk është e drejtë të thuhet se kjo çështje është neglizhuar me qëllim nga qeveritë e pasluftës, por as që finalizimi i saj t’i atribuohet vetëm një ekzekutivi.

Sipas profesorit, procesit i ka munguar koordinimi i plotë ndërinstitucional, metodologjia e unifikuar dhe vazhdimësia e qëndrueshme.

Racaj ka nënvizuar se një listë e verifikuar dhe e besueshme ka rëndësi strategjike për Kosovën, pasi e forcon pozitën e saj ndërkombëtare dhe ndihmon në ndjekjen e krimeve të luftës.

Ai ka shtuar se ajo shërben edhe për të penguar mohimin e krimeve dhe për të ruajtur kujtesën historike të viktimave.

Në fund, Racaj ka bërë thirrje që ky proces të trajtohet si projekt shtetëror, përtej ndasive politike e partiake, dhe të përmbyllet në mënyrë transparente e profesionale.

Ai ka theksuar po ashtu se në këtë proces duhet të përfshihen institucionet shtetërore, ekspertët, shoqatat e familjarëve të viktimave dhe partnerët ndërkombëtarë, në mënyrë që Kosova të ketë një evidencë të besueshme dhe të qëndrueshme.

The official results show that the Vetëvendosje Movement (LVV), led by acting Prime Minister Albin Kurti, ranked as the leading political force with 47.13% of the vote, securing 53 seats in the Kosovo Assembly, which has a total of 120 deputies.

In a statement to “Bota sot,” legal affairs expert Blerim Burjani said that processes in Kosovo must move forward in full compliance with the constitutional order and the institutional chain provided for by the Constitution.

Burjani stressed that the procedure being followed is entirely constitutional, recalling that Kosovo functions as a parliamentary state and that the institutional order begins with the Assembly, continues with the Government, and then the President.

“The procedure is constitutional, Kosovo is a parliamentary state, it starts with the Assembly, the Government and the President, so the institutional chain must be respected, just as it is proclaimed in the Constitution in its principles. Any other interpretation is unconstitutional, and I believe this is clear to everyone,” he said.

He further criticized interpretations that, according to him, misread the constitutional norm.

“There are individuals who do not understand the parliamentary constitutional framework, therefore the Constitution should not be distorted for people who have no clue about this work,” Burjani concluded.

Burjani theksoi se procedura që po ndiqet është tërësisht kushtetuese, duke rikujtuar se Kosova funksionon si shtet parlamentar dhe se rendi institucional nis nga Kuvendi, vijon me Qeverinë dhe më pas me Presidentin.

“Procedura është kushtetuese, Kosova është shtet parlamentar, fillohet nga Kuvendi, Qeveria dhe Presidenti, pra duhet të përfillet zinxhiri institucional, ashtu si proklamohet në Kushtetutë në parimet e saj. Çdo interpretim tjetër është antikushtetues, kjo është, po besoj, e qartë për të gjithë”, ka thënë ai.

Më tej, ai ka shprehur kritika ndaj interpretimeve që, sipas tij, e lexojnë gabim normën kushtetuese.

“Po ka individ që nuk e kuptojnë normativin kushtetues parlamentar, andaj nuk duhet shtrëmbëruar Kushtetuta për njerëz që nuk kanë haber me këtë punë”, ka përfunduar Burjani.

Analyst Blerim Burjani spoke to “Bota sot” about this development, saying that there are individuals within the LDK who oppose Lumir Abdixhiku and the party’s current leadership.

According to him, dissatisfaction has also increased because of Vjosa Osmani’s return, as well as the fact that the election result did not bring any major change compared with last time.

“The LDK is facing some internal dissatisfaction. There are some individuals who are reacting outside the will of the leadership and are against Lumir Abdixhiku. They have objections regarding the issue of Vjosa Osmani’s return after everything that happened. The election result did not show any major success that could be described as significant progress, but nevertheless a certain degree of progress has occurred.”

Speaking about the possibility of internal party elections, Burjani said that the LDK currently does not have a name that could be considered an acceptable leader for the majority.

In his assessment, the main problem in this political entity is the lack of leading figures, and not necessarily a lack of ambition to unseat Abdixhiku.

“There may be demands for an extraordinary Assembly, but the LDK does not have any candidate who could be described as a new, fully empowered leader acceptable to the majority of the party. It is difficult for the LDK to currently have a candidate for chairman who would be considered hope or a turning point for the party in the next elections.

Naturally, individual voices that appear in public do not do the LDK any good. It should be considered clearly whether it is worth choosing a new leader and which of them could take on this responsibility. In my opinion, this political entity is in a crisis of leaders, but not of ambitions to bring down Lumir Abdixhiku.”

In the end, he also mentioned the name of Përparim Rama as a possibility for leading the LDK, though he added that Rama does not fully align with this party’s traditional structures.

“So, there are dissatisfied individuals, but it does not appear in public opinion that there is a large number of dissatisfied people within this political entity. Përparim Rama is mentioned as a potentially more serious candidate for future leader, but he appears more likely not to be interested in such a role. Moreover, he does not fully identify with the LDK’s traditional structures,” Blerim Burjani concluded for “Bota sot”.

“LDK po ballafaqohet me disa pakënaqësi të brendshme. Ka disa individë që reagojnë jashtë vullnetit të kryesisë dhe janë kundër Lumir Abdixhikut. Ata kanë vërejtje për çështjen e rikthimit të Vjosa Osmanit pas krejt asaj që ka ndodhur. Rezultati zgjedhor nuk tregoi ndonjë sukses të madh që mund të cilësohet si progres i rëndësishëm, por megjithatë një përparim i caktuar ka ndodhur.”

Duke folur për mundësinë e zgjedhjeve të brendshme në parti, Burjani u shpreh se LDK aktualisht nuk ka një emër që mund të konsiderohet lider i pranueshëm për shumicën.

Sipas vlerësimit të tij, problemi kryesor në këtë subjekt është mungesa e figurave udhëheqëse, e jo domosdoshmërisht mungesa e ambicieve për rrëzimin e Abdixhikut.

“Mund të ketë kërkesa për një Kuvend të jashtëzakonshëm, por LDK-ja nuk ka ndonjë kandidat që mund të cilësohet si lider i ri, i plotfuqishëm dhe i pranueshëm për shumicën e partisë. Vështirë se LDK-ja mund të ketë aktualisht një kandidat për kryetar që do të konsiderohej shpresë apo kthesë për partinë në zgjedhjet e ardhshme.

Natyrisht, zërat individualë që dalin në opinion nuk i bëjnë mirë LDK-së. Duhet të mendohet qartë nëse ia vlen të zgjidhet një lider i ri dhe cili prej tyre do të mund ta merrte këtë përgjegjësi. Sipas mendimit tim, ky subjekt është në krizë për liderë, por jo për ambicie për ta rrëzuar Lumir Abdixhikun.”

Në fund, ai përmendi edhe emrin e Përparim Ramës si një mundësi për drejtimin e LDK-së, megjithatë shtoi se ai nuk përputhet plotësisht me strukturat tradicionale të kësaj partie.

“Pra, ka individë të pakënaqur, por nuk duket në opinionin publik se ka një numër të madh njerëzish të pakënaqur brenda këtij subjekti. Përmendet Përparim Rama si një kandidat potencialisht më serioz për lider të ardhshëm, por ai më shumë duket se nuk është i interesuar për një rol të tillë. Për më tepër, ai nuk identifikohet plotësisht me strukturat tradicionale të LDK-së”, përmbylli Blerim Burjani për “Bota sot”.
