AAK MP Besnik Tahiri has announced that members of the party will not be present in the chamber during the voting process for Kosovo’s president.

The statement was challenged by Luan Gacaferi of Guxo, who described AAK’s stance as incompatible with its demands for the establishment of Kosovo’s institutions.

In a reaction on Facebook, Gacaferi mocked this position, stressing that the country’s president is elected in that same chamber and that, in his view, non-participation constitutes a betrayal of Radojqiç and the criminal Serb List.

He expressed surprise that AAK, on the one hand, calls every day for the formation of institutions, while on the other hand declares that it will not remain in the chamber where those institutions of the state of Kosovo are established.

Deputeti i AAK-së, Besnik Tahiri, ka bërë të ditur se anëtarët e kësaj partie nuk do të jenë të pranishëm në sallë gjatë procesit të votimit për presidentin e Kosovës.

Alliance MP Besnik Tahiri has accused the parliamentary majority of plunging Kosovo into a deep social, economic and political depression by failing to constitute Parliament and fulfill its constitutional duty.

According to Tahiri, the situation in the country is worsening and approaching a critical point that affects not only political functioning, but also security in society and the economy, including job creation and keeping the state functioning. He described this as an unprecedented political crisis in the history of Kosovo’s democracy.

Tahiri said this approach was not accidental, but deliberate, and aimed to lead Kosovo toward an identity crisis. He stated that this political constellation had been on the opposite side of history during the Rambouillet Agreement, NATO’s entry into Kosovo and the declaration of Kosovo’s independence.

The Alliance MP added that, in his view, there was an attempt to construct a false narrative contrary to the historic efforts of the Albanian nation in Kosovo to create a different identity. He stressed that such an attempt would not be allowed.

“We have no other place, no other state and no greater national achievement than Kosovo’s independence. This independence is the greatest achievement of the Albanian nation. Generation after generation has sacrificed for it, and we have an obligation to be here at our workplace and defend our greatest national achievement,” Tahiri said.

Deputeti i Aleancës, Besnik Tahiri, ka akuzuar shumicën parlamentare se, përmes moskonstituimit të Kuvendit dhe mospërmbushjes së detyrës së saj kushtetuese, e ka futur Kosovën në një depresion të thellë shoqëror, ekonomik dhe politik.

Sipas Tahirit, situata në vend po përkeqësohet dhe po afrohet me një pikë kritike, e cila prek jo vetëm funksionimin politik, por edhe sigurinë në shoqëri dhe ekonominë, përfshirë krijimin e vendeve të punës dhe mbajtjen gjallë të shtetit. Ai e cilësoi këtë si një krizë politike të paprecedentë në historinë e demokracisë së Kosovës.

Tahiri tha se kjo qasje nuk është e rastësishme, por e qëllimshme dhe synon ta çojë Kosovën drejt një krize identitare. Ai deklaroi se ky konstelacion politik ka qenë në anën e kundërt të historisë gjatë Marrëveshjes së Rambujesë, hyrjes së NATO-s në Kosovë dhe shpalljes së pavarësisë së Kosovës.

Deputeti i Aleancës shtoi se, sipas tij, po tentohet të ndërtohet një tregim i rremë dhe në kundërshtim me përpjekjet historike të kombit shqiptar në Kosovë për krijimin e një identiteti tjetër. Ai theksoi se një përpjekje e tillë nuk do të lejohet.

“Ne nuk kemi vend tjetër, as shtet tjetër dhe as arritje më të madhe kombëtare se pavarësinë e Kosovës. Kjo pavarësi është arritja më e madhe e kombit shqiptar. Për këtë tanimë ka sakrifikuar gjeneratë pas gjenerate, e kemi obligim me qenë këtu në vendin e punës tonë dhe me mbrojtur arritjen tonë më të madhe kombëtare”, tha Tahiri.

The Alliance has filed a criminal complaint with the Special Prosecution Office in Pristina over decisions made by the caretaker government, which it has described as unconstitutional.

Besnik Tahiri, the Alliance’s deputy leader, said that the 17 decisions concerning the appointment of commissions to recruit senior state officials violate the Law on Government.

According to Tahiri, the caretaker cabinet, led by caretaker Prime Minister Albin Kurti, has limited powers. He claimed that the decisions approved at the August 12 meeting undermine the legislation in force and the executive’s regulations, which define the scope of a caretaker government.

Tahiri explained that, according to the assessment of the Alliance and the lawyers representing it in this matter, the decisions taken on August 12 of this year contradict the law and the regulations governing the work of the government.

He stressed that a government is called a caretaker government precisely because it has not been approved by a vote and, for this reason, is not permitted to make decisions such as the 17 acts appointing commissions that will recruit senior state officials for government agencies.

According to him, the caretaker executive cannot violate a law it approved itself. Tahiri said that the limits on this government’s powers have been explicitly defined and claimed that, through these decisions, officials had breached their official duties and their positions as acting officeholders.

The Alliance’s deputy leader also raised the issue of the dual roles that, according to him, continue to be held by most members of the government cabinet, who are also elected members of parliament.

Tahiri argued that a lawmaker who has taken the oath in the Assembly cannot simultaneously hold a position in the executive branch, either as a minister or as an acting deputy minister.

He said that this issue was also included in the criminal complaint, since the law prohibits a sworn-in lawmaker from performing another executive duty. According to him, a person cannot take the oath as a lawmaker during a parliamentary session in the morning and then continue working in the government as an acting minister.

Tahiri described this as a serious legal violation, adding that such a situation has also been sanctioned through another decision by the Supreme Court. In conclusion, he called for an end to state capture and abuse of public office.

Civil society organizations have also expressed reservations about the decision-making of the caretaker government. In a press release published on August 13, the Group for Legal and Political Studies described the decisions as unlawful, arguing that most members of the caretaker government had taken the oath as members of the Assembly of Kosovo.

Kosovo’s snap parliamentary elections were held on June 7, while lawmakers took their oath on August 6. However, the Assembly has still not been constituted because its speaker and deputy speakers have not been elected.

Aleanca ka paraqitur kallëzim penal në Prokurorinë Speciale në Prishtinë për vendimet e Qeverisë në detyrë, të cilat i ka cilësuar si antikushtetuese.

Besnik Tahiri, nënkryetar i Aleancës, deklaroi se 17 vendimet që lidhen me caktimin e komisioneve për rekrutimin e zyrtarëve të lartë shtetërorë bien ndesh me Ligjin për Qeverinë.

Sipas Tahirit, kabineti qeveritar në detyrë, i drejtuar nga kryeministri në detyrë Albin Kurti, ka kompetenca të kufizuara. Ai pretendoi se vendimet e miratuara në mbledhjen e 12 gushtit cenojnë legjislacionin në fuqi dhe rregulloret e ekzekutivit, të cilat përcaktojnë fushëveprimin e një qeverie në detyrë.

Tahiri shpjegoi se, sipas vlerësimit të Aleancës dhe juristëve që e përfaqësojnë këtë çështje, vendimet e marra më 12 gusht të këtij viti janë në kundërshtim me ligjin dhe me rregulloret që rregullojnë punën e qeverisë.

Ai theksoi se një qeveri quhet në detyrë pikërisht sepse nuk është e votuar dhe, për këtë arsye, nuk lejohet të marrë vendime si 17 aktet për emërimin e komisioneve që do të rekrutojnë zyrtarë të lartë shtetërorë në agjencitë qeveritare.

Sipas tij, ekzekutivi në detyrë nuk mund ta shkelë ligjin që e ka miratuar vetë. Tahiri tha se kufizimi i kompetencave të kësaj qeverie është përcaktuar shprehimisht dhe pretendoi se, përmes këtyre vendimeve, zyrtarët kanë cenuar detyrën zyrtare dhe pozitën e tyre si ushtrues detyre.

Nënkryetari i Aleancës ngriti gjithashtu çështjen e roleve të dyfishta që, sipas tij, vazhdojnë t’i ushtrojnë shumica e anëtarëve të kabinetit qeveritar, të cilët njëkohësisht janë edhe deputetë të zgjedhur.

Tahiri argumentoi se një deputet që është betuar në Kuvend nuk mund të mbajë paralelisht një funksion në pushtetin ekzekutiv, qoftë si ministër apo si zëvendësministër në detyrë.

Ai tha se kjo çështje është përfshirë edhe në kallëzimin penal, pasi ligji ia ndalon një deputeti të betuar ushtrimin e një detyre tjetër ekzekutive. Sipas tij, një person nuk mund të betohet paradite në seancë si deputet dhe më pas të vazhdojë punën në qeveri si ministër në detyrë.

Tahiri e konsideroi këtë një shkelje të rëndë ligjore, duke shtuar se një situatë e tillë është sanksionuar edhe përmes një vendimi tjetër të Gjykatës Supreme. Në përfundim, ai kërkoi ndaljen e kapjes së shtetit dhe të abuzimit me funksionin publik.

Rezerva ndaj vendimmarrjes së Qeverisë në detyrë kanë shprehur edhe organizata të shoqërisë civile. Përmes një komunikate për media të publikuar më 13 gusht, Grupi për Studime Juridike dhe Politike i vlerësoi vendimet si të kundërligjshme, me arsyetimin se shumica e anëtarëve të Qeverisë në detyrë janë betuar si deputetë të Kuvendit të Kosovës.

Zgjedhjet e jashtëzakonshme parlamentare në Kosovë u mbajtën më 7 qershor, ndërsa deputetët e dhanë betimin më 6 gusht. Megjithatë, Kuvendi ende nuk është konstituuar, pasi nuk janë zgjedhur kryetari dhe nënkryetarët.

Once again this Sunday, MPs from the PDK and the Alliance found the doors to the Kosovo Assembly chamber closed.

They called for the constitutive session to be convened as soon as possible so that, as they stated, the institutions of the Republic could be constituted.

Arian Tahiri of the PDK said the session could resume and the Assembly could become operational within the 48-hour deadline stipulated in the Assembly’s rules of procedure.
