<p>Professor and political activist from Prizren, Behajdin Allaqi, disappeared without a trace in June 1998. For many years, the circumstances of his disappearance remained unclear.</p>
<p>On September 16, 2026, the Kosovo Specialist Chambers in The Hague, during the announcement of the first-instance verdict against Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selimi, found that Allaqi had been killed after Thaçi and Veseli had taken him handcuffed from the headquarters of the Kosovo Liberation Army (KLA) in Drenoc of Rahovec.</p>
<p>The defense of former president Thaçi has objected to the way the court handled this case, emphasizing that while the conclusions about Allaqi&#8217;s murder were made public, the evidence remained confidential.</p>
<p>Who was Behajdin Allaqi?</p>
<p>Behajdin Allaqi was born on April 7, 1963 in Prizren.</p>
<p>For Allaqi&#8217;s life and work, his family had narrated to the Humanitarian Law Center in Kosovo (FDHK), an organization dealing with transitional justice.</p>
<p>According to the family&#8217;s account, he had completed the Faculty of Philosophy in Prishtina and lectured sociology and philosophy in Prizren, while he was continuously committed to the freedom and independence of Kosovo.</p>
<p>The account of Behajdin Allaqi&#8217;s disappearance is found in the FDHK book, Kosovo Memory Book 1998-2000.</p>

<p>Allaqi belonged to the People&#8217;s Movement for the Republic of Kosovo (LPRK) and is considered a martyr of the KLA.</p>
<p>In 2015, the then President of Kosovo, Atifete Jahjaga, decorated Allaqi as Hero of Kosovo.</p>
<p>According to the law in Kosovo, this decoration is given to persons who have performed acts of sacrifice and bravery for the freedom and independence of Kosovo.</p>
<p>Radio Free Europe tried to contact members of the Allaqi family for an interview, but received no response to any of the messages sent.</p>
<p>1993: The &#8216;dispute&#8217; with Thaçi and Syla</p>
<p>According to the summary of the Specialist Chambers&#8217; verdict, Allaqi had had a &#8216;serious dispute with Thaçi and Azem Syla&#8217; in 1993, who accused him of bringing into the LPRK a person they suspected of being a Serbian spy.</p>
<p>The trial panel also found that, before his disappearance in 1998, Allaqi was under surveillance by the KLA intelligence service and that Thaçi and Veseli had requested to be notified of his presence at the KLA headquarters in Drenoc.</p>
<p>June 11, 1998: Allaqi was seen for the last time</p>
<p>According to the account of his wife, Nazmije Allaqi, in the &#8216;Kosovo Memory Book 1998-2000&#8217;, a publication of the Humanitarian Law Center that documents persons killed and disappeared during the war, Allaqi was last seen on June 11, 1998 in Prizren.</p>
<p>She had said that Behajdin Allaqi had gone towards the KLA headquarters in the village of Drenoc in Rahovec and from there had set off for the KLA General Headquarters, which at that time was located in the Drenica area.</p>
<p>After this date, there are no public records that Allaqi was seen alive.</p>
<p>What did the Special Court find?</p>
<p>According to the summary of the verdict of September 16, 2026, Allaqi had gone to the headquarters in Drenoc around June 11, 1998. The trial panel found that Thaçi and Veseli had arrived later and had taken Allaqi handcuffed.</p>
<p>Allaqi was never seen again, and the trial panel concluded that he had been killed.</p>
<p>The summary of the verdict does not make public all the evidence on which this finding was based.</p>
<p>November 1, 1998: The KLA communiqué</p>
<p>On November 1, 1998, the KLA General Headquarters published Communiqué No. 61, which stated that Behajdin Allaqi had fallen as a martyr in battle. The Specialist Chambers trial panel described this communiqué as an attempt to cover up what had happened to Allaqi.</p>
<p>According to the court, after the war Thaçi, Veseli and Azem Syla also tried to convince Allaqi&#8217;s family, through bribes and promises, to give up seeking justice. The court said the family had refused these offers.</p>
<p>The verdict is of the first instance and can be appealed.</p>
<p>Documented data after the war</p>
<p>In the early 2000s, according to a document published in the media after the Specialist Chambers verdict, Nazmije Allaqi had reportedly reported to UNMIK bodies that her husband had been &#8216;taken by Serbian police&#8217;.</p>
<p>In a response to Radio Free Europe, UNMIK did not comment on the authenticity of the document, saying it is limited in what it can say, &#8216;given the transfer of competencies and files&#8217; to subsequent authorities, international and local.</p>

<p>Nazmije Allaqi had told researchers of the Humanitarian Law Center in Kosovo (FDHK) that &#8216;Selim Krasniqi and Bedri Zyberaj had knowledge of the abduction [of Allaqi]&#8217;.</p>
<p>Radio Free Europe contacted Krasniqi and Zyberaj, both former KLA members, regarding the case. Krasniqi briefly said he has no knowledge, while until the publication of this article, Radio Free Europe has not been able to get a comment from Zyberaj.</p>

<p>In the book, Allaqi&#8217;s disappearance is described as &#8216;liquidation without trial&#8217;, for which, according to the author, &#8216;the KLA General Headquarters bears political, moral and legal responsibility&#8217;.</p>
<p>Kadolli&#8217;s book was accepted as evidence at the request of the Specialist Prosecutor&#8217;s Office, according to a 2025 decision of the Specialist Chambers.</p>

<p>However, from public documents it is not clear whether the part of the book that deals with the Allaqi case was among the materials on which the trial panel specifically relied for its findings on the murder.</p>
<p>Asked whether he had been invited to testify about the Allaqi case, Kadolli told Radio Free Europe that he had refused to testify &#8216;due to health condition&#8217;.</p>

<p>What does the defense say?</p>
<p>Thaçi&#8217;s lawyer, Lluka Mishetiq, wrote on the social platform X that the trial panel had publicly linked his client with the murder of Allaqi, even though it had previously ordered all parties not to discuss the Allaqi matter in public court sessions.</p>
<p>&#8216;The trial panel publicly found Thaçi guilty of a murder, while at the same time keeping the evidence on which it based this conclusion away from public scrutiny. Thaçi would welcome such public scrutiny of the evidence,&#8217; Mishetiq said on September 17, a day after the verdict in The Hague.</p>
<p>Thaçi&#8217;s other lawyer, Pierre-Richard Prosper, in an interview on Klan Kosova television, objected to the publication of the conclusions without the information supporting them. He said the defense had information and questions about the case, but was not allowed to discuss them publicly.</p>
<p>Asked by Radio Free Europe about the Allaqi case, the Specialist Prosecutor&#8217;s Office in The Hague said it &#8216;will not comment on materials that have not been made public&#8217;.</p>
<p>Was Allaqi&#8217;s disappearance ever investigated in Kosovo?</p>
<p>After the war in Kosovo, in the early 2000s, UNMIK had full executive and judicial powers.</p>
<p>This mission has not commented on the Allaqi case, and whether it initiated investigations into it while it was competent, namely until 2008 when Kosovo declared independence.</p>
<p>&#8216;UNMIK&#8217;s previous files regarding investigations and prosecutions for criminal matters were transferred to EULEX [the European Union Rule of Law Mission in Kosovo] in 2008, and may have subsequently been transferred to Kosovo&#8217;s competent authorities. UNMIK does not comment on individual cases that are subject to judicial proceedings before independent courts,&#8217; says UNMIK&#8217;s response to Radio Free Europe.</p>
<p>On the other hand, neither EULEX, which took over powers after UNMIK, commented on whether it ever handled the Allaqi case.</p>
<p>&#8216;Due to the end of EULEX&#8217;s executive mandate in the justice system in 2018, the cases and files handled by EULEX were handed over to Kosovo&#8217;s authorities,&#8217; says this mission&#8217;s response to Radio Free Europe.</p>
<p>Nor has the Kosovo Special Prosecution responded as to whether there have ever been investigations within Kosovo&#8217;s legal system regarding the case of Behajdin Allaqi, before it was addressed in The Hague.</p>

<p>Profesori dhe aktivisti politik nga Prizreni, Behajdin Allaqi, humbi pa gjurmë në qershor të vitit 1998. Për shumë vite, rrethanat e zhdukjes së tij mbetën të paqarta.</p>
<p>Më 16 shtator 2026, Dhomat e Specializuara të Kosovës në Hagë, gjatë shpalljes së aktgjykimit të shkallës së parë ndaj Hashim Thaçit, Kadri Veselit, Jakup Krasniqit dhe Rexhep Selimit, konstatuan se Allaqi ishte vrarë pasi Thaçi dhe Veseli e kishin marrë me pranga nga shtabi i Ushtrisë Çlirimtare të Kosovës (UÇK) në Drenoc të Rahovecit.</p>
<p>Mbrojtja e ish-presidentit Thaçi e ka kundërshtuar mënyrën si e trajtoi gjykata këtë rast, duke theksuar se ndërsa përfundimet për vrasjen e Allaqit u bënë publike, provat mbetën konfidenciale.</p>
<p>Kush ishte Behajdin Allaqi?</p>
<p>Behajdin Allaqi lindi më 7 prill të vitit 1963 në Prizren.</p>
<p>Për jetën dhe veprën e Allaqit, familja e tij kishte rrëfyer te Fondi për të Drejtën Humanitare në Kosovë (FDHK), organizatë që merret me drejtësinë tranzicionale.</p>
<p>Sipas rrëfimit të familjes, ai e kishte përfunduar Fakultetin Filozofik në Prishtinë dhe ligjëronte sociologji e filozofi në Prizren, ndërsa ishte angazhuar vazhdimisht për lirinë dhe pavarësinë e Kosovës.</p>
<p>Rrëfimi i zhdukjes së Behajdin Allaqit gjendet në librin e FDHK-së, Libri i Kujtimit të Kosovës 1998-2000.</p>

<p>Allaqi bënte pjesë në Lëvizjen Popullore për Republikën e Kosovës (LPRK) dhe konsiderohet dëshmor i UÇK-së.</p>
<p>Në vitin 2015, presidentja e atëhershme e Kosovës, Atifete Jahjaga, e dekoroi Allaqin si Hero të Kosovës.</p>
<p>Sipas ligjit në Kosovë, kjo dekoratë u jepet personave që kanë kryer vepra sakrifice dhe trimërie për lirinë dhe pavarësinë e Kosovës.</p>
<p>Radio Evropa e Lirë u përpoq të kontaktonte me anëtarë të familjes Allaqi për intervistë, por nuk mori përgjigje në asnjë nga mesazhet e dërguara.</p>
<p>1993: “Mosmarrëveshja” me Thaçin dhe Sylën</p>
<p>Sipas përmbledhjes së aktgjykimit të Dhomave të Specializuara, Allaqi kishte pasur në vitin 1993 një “mosmarrëveshje serioze me Thaçin dhe Azem Sylën”, të cilët e akuzuan se kishte sjellë në LPRK një person që ata e dyshonin si spiun serb.</p>
<p>Trupi gjykues konstatoi gjithashtu se, para zhdukjes së tij në vitin 1998, Allaqi ishte nën vëzhgimin e shërbimit të zbulimit të UÇK-së dhe se Thaçi e Veseli kishin kërkuar të njoftoheshin për praninë e tij në shtabin e UÇK-së në Drenoc.</p>
<p>11 qershor 1998: Allaqi shihet për herë të fundit</p>
<p>Sipas rrëfimit të bashkëshortes së tij, Nazmije Allaqi, në “Librin e Kujtimit të Kosovës 1998-2000”, botim i Fondit për të Drejtën Humanitare që dokumenton personat e vrarë dhe të zhdukur gjatë luftës, Allaqi ishte parë për herë të fundit më 11 qershor 1998 në Prizren.</p>
<p>Ajo kishte thënë se Behajdin Allaqi kishte shkuar në drejtim të shtabit të UÇK-së në fshatin Drenoc të Rahovecit dhe prej andej ishte nisur drejt Shtabit të Përgjithshëm të UÇK-së, që në atë kohë ndodhej në zonën e Drenicës.</p>
<p>Pas kësaj date, nuk ka të dhëna publike se Allaqi është parë i gjallë.</p>
<p>Çfarë konstatoi Gjykata Speciale?</p>
<p>Sipas përmbledhjes së aktgjykimit të 16 shtatorit 2026, Allaqi kishte shkuar në shtabin në Drenoc rreth datës 11 qershor 1998. Trupi gjykues konstatoi se Thaçi dhe Veseli kishin mbërritur më vonë dhe e kishin marrë Allaqin të prangosur.</p>
<p>Allaqi nuk u pa më, ndërsa trupi gjykues arriti në përfundimin se ai ishte vrarë.</p>
<p>Në përmbledhjen e aktgjykimit nuk bëhen publike të gjitha provat mbi të cilat është mbështetur ky konstatim.</p>
<p>1 nëntor 1998: Komunikata e UÇK-së</p>
<p>Më 1 nëntor 1998, Shtabi i Përgjithshëm i UÇK-së publikoi Komunikatën Nr. 61, në të cilën thuhej se Behajdin Allaqi kishte rënë dëshmor në betejë. Trupi gjykues i Dhomave të Specializuara e cilësoi këtë komunikatë si përpjekje për të fshehur atë që kishte ndodhur me Allaqin.</p>
<p>Sipas gjykatës, pas luftës Thaçi, Veseli dhe Azem Syla u përpoqën gjithashtu ta bindnin familjen e Allaqit, përmes ryshfeteve dhe premtimeve, që të hiqte dorë nga kërkimi i drejtësisë. Gjykata tha se familja i kishte refuzuar këto oferta.</p>
<p>Aktgjykimi është i shkallës së parë dhe mund të apelohet.</p>
<p>Të dhënat e dokumentuara pas luftës</p>
<p>Në fillim të viteve 2000, sipas një dokumenti të publikuar në media pas aktgjykimit të Dhomave të Specializuara, Nazmije Allaqi thuhet se kishte raportuar tek organet e UNMIK-ut se bashkëshorti i saj ishte “marrë nga policia serbe”.</p>
<p>Në një përgjigje për Radion Evropa e Lirë, UNMIK-u nuk ka komentuar vërtetësinë e dokumentit, duke thënë se është i kufizuar në atë që mund të thotë, “duke pasur parasysh transferimin e kompetencave dhe të dosjeve” te autoritetet pasardhëse, ndërkombëtare e vendëse.</p>
<p>Nazmije Allaqi i kishte thënë hulumtuesve të Fondit për të Drejtën Humanitare në Kosovë (FDHK) se “Selim Krasniqi dhe Bedri Zyberaj kishin dijeni për rrëmbimin [e Allaqit]”.</p>
<p>Radio Evropa e Lirë kontaktoi Krasniqin dhe Zyberajn, që të dy ish-pjesëtarë të UÇK-së, në lidhje me rastin. Krasniqi tha shkurt se nuk ka njohuri, ndërkaq deri në publikimin e këtij artikulli, Radio Evropa e Lirë nuk ka arritur të marrë koment nga Zyberaj.</p>
<p>Rrëfimi në librin “Syri i Shqiponjës”</p>

<p>Në libër, zhdukja e Allaqit përshkruhet si “likuidim pa gjyq”, për të cilin, sipas autorit, “Shtabi i Përgjithshëm i UÇK-së mban përgjegjësi politike, morale dhe ligjore”.</p>
<p>Libri i Kadollit u pranua si provë me kërkesë të Zyrës së Prokurorit të Specializuar, sipas një vendimi të vitit 2025 të Dhomave të Specializuara.</p>

<p>Megjithatë, nga dokumentet publike nuk është e qartë nëse pjesa e librit që trajton rastin e Allaqit ishte ndër materialet mbi të cilat trupi gjykues u mbështet konkretisht për konstatimet e tij për vrasjen.</p>

<p>Çfarë thotë mbrojtja?</p>
<p>Avokati i Thaçit, Lluka Mishetiq, shkroi në platformën sociale X se trupi gjykues e kishte lidhur publikisht klientin e tij me vrasjen e Allaqit, edhe pse më parë kishte urdhëruar të gjitha palët të mos e diskutonin çështjen e Allaqit në seancë publike në gjykatë.</p>
<p>“Trupi gjykues e ka shpallur publikisht Thaçin fajtor për një vrasje, duke i mbajtur njëkohësisht provat mbi të cilat e bazoi këtë përfundim larg shqyrtimit publik. Thaçi do ta mirëpriste një shqyrtim të tillë publik të provave”, tha Mishetiq, më 17 shtator, një ditë pas aktgjykimit në Hagë.</p>
<p>Edhe avokati tjetër i Thaçit, Pierre-Richard Prosper, në një intervistë në televizionin Klan Kosova, kundërshtoi publikimin e përfundimeve pa informacionet që i mbështesin. Ai tha se mbrojtja kishte informacione dhe pyetje për rastin, por nuk ishte lejuar t’i diskutonte publikisht.</p>
<p>E pyetur nga Radio Evropa e Lirë në lidhje me rastin e Allaqit, Zyra e Prokurorit të Specializuar në Hagë tha se “nuk do të komentojë materiale që nuk janë bërë publike”.</p>
<p>A u hetua ndonjëherë në Kosovë zhdukja e Allaqit?</p>
<p>Pas luftës në Kosovë, në fillim të viteve 2000, UNMIK-u kishte kompetenca të plota ekzekutive dhe gjyqësore.</p>
<p>Ky mision nuk ka komentuar rastin e Allaqit, dhe nëse ka nisur hetime për të gjatë kohës sa ishte kompetent, përkatësisht deri në vitin 2008, kur Kosova shpalli pavarësinë.</p>
<p>“Dosjet e mëparshme të UNMIK-ut lidhur me hetimet dhe ndjekjet penale për çështje penale iu transferuan [Misionit të Bashkimit Evropian për Sundim të Ligjit në Kosovë] EULEX-it në vitin 2008, dhe mund të jenë transferuar më pas te autoritetet kompetente të Kosovës. UNMIK-u nuk komenton raste individuale që janë objekt i procedurave gjyqësore para gjykatave të pavarura”, thuhet në përgjigjen e UNMIK-ut për Radion Evropa e Lirë.</p>
<p>Në anën tjetër, as EULEX-i, që mori kompetencat pas UNMIK-ut, nuk komentoi nëse e ka trajtuar ndonjëherë rastin e Allaqit.</p>
<p>“Për shkak të përfundimit të mandatit ekzekutiv të EULEX-it në sistemin e drejtësisë në vitin 2018, rastet dhe dosjet e trajtuara nga EULEX-i iu dorëzuan autoriteteve të Kosovës”, thuhet në përgjigjen e këtij misioni për Radion Evropa e Lirë.</p>
<p>As Prokuroria Speciale e Kosovës nuk është përgjigjur në atë se a ka pasur ndonjëherë hetime brenda sistemit ligjor të Kosovës në lidhje me rastin e Behajdin Allaqit, para se ai të trajtohej në Hagë.</p>

<p>After more than 28 years without a definitive answer, the case of the disappearance and killing of activist Behajdin Allaqi received a judicial finding from the Kosovo Specialist Chambers in The Hague.</p>
<p>During the delivery of the first-instance judgment against Hashim Thaçi, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi, the Trial Panel declared that Thaçi had personally participated in crimes committed against Allaqi.</p>
<p>The summary of the judgment states that Hashim Thaçi was directly involved in the arrest, detention, transfer and killing of Behajdin Allaqi. The same document also mentions his participation in the arrest, detention and interrogation of 13 lawmakers.</p>
<p>This assessment by the Court concerns Thaçi’s individual responsibility in the Allaqi case and does not represent merely general responsibility for the actions of other individuals.</p>
<p>The decision, delivered on September 16, 2026, is a first-instance ruling and may be challenged by the defense through an appeal. Thaçi has been sentenced to 25 years in prison, while the judgment is not yet final.</p>
<p>Behajdin Allaqi was born on April 7, 1963, in Prizren. He was a political activist, intellectual and member of the Albanian national movement, and had begun his involvement in Albanian political organizations as early as the 1980s.</p>
<p>In 1981, Allaqi took part in demonstrations, and later continued his underground activities to advance Kosovo’s political status. In the 1990s, he was active in the structures of the national movement and later joined the Kosovo Liberation Army.</p>
<p>Allaqi disappeared on June 11, 1998. His body has not been found and, until Wednesday’s judgment, local institutions had not provided a definitive explanation of his fate.</p>
<p>Throughout this time, family members, fellow activists and public figures called for the circumstances surrounding his arrest, disappearance and killing to be clarified.</p>
<p>According to the summary of the judgment, Thaçi had been a member of the General Staff and head of the KLA’s Political Directorate. In this capacity, according to the Court, he had played a key role in designing and implementing a common purpose.</p>
<p>This purpose included identifying people perceived as opponents of the KLA, arresting and detaining them, as well as establishing and operating detention facilities.</p>
<p>The Court also included in this framework the mistreatment and, in certain cases, killing of detainees, as well as the use of public statements and communiqués against people described as “collaborators” or opponents.</p>
<p>The Trial Panel concluded that Thaçi had contributed to this common purpose and had personally participated in some of the crimes. Among the cases mentioned was that of Behajdin Allaqi.</p>
<p>In the Allaqi case, the Court listed four stages of Thaçi’s involvement: the arrest, detention, transfer and unlawful killing.</p>
<p>Kadri Veseli, Rexhep Selimi and Jakup Krasniqi were also found responsible by the Trial Panel for their contributions to the common criminal purpose against people perceived as opponents of the KLA.</p>
<p>However, the public summary of the judgment does not say that Veseli, Selimi and Krasniqi personally participated in the arrest or killing of Behajdin Allaqi.</p>
<p>Consequently, the judgment should not be interpreted as finding that all four accused were identified as executors or direct co-perpetrators of the killing. In the Allaqi case, the individual finding made public expressly concerns Hashim Thaçi.</p>
<p>Behajdin Allaqi’s name had been mentioned over the years in public statements, testimonies and political disputes. In the past, allegations had also been raised of strained relations between him and some of the then-political leaders of the KLA.</p>
<p>However, these allegations had not constituted a judicial decision, and the case had remained unresolved.</p>
<p>The September 16, 2026, judgment marks the first time that a trial panel has found Thaçi individually responsible for the arrest, detention, transfer and unlawful killing of Behajdin Allaqi.</p>
<p>The summary of the decision was also reported by The Guardian, while live coverage from the hearing was also published. The full judgment and the official transcript are expected to be made public in the Kosovo Specialist Chambers’ document database.</p>

<p>Pas më shumë se 28 vjetësh pa një përgjigje përfundimtare, rasti i zhdukjes dhe vrasjes së veprimtarit Behajdin Allaqi mori një konstatim gjyqësor në Dhomat e Specializuara të Kosovës në Hagë.</p>
<p>Gjatë shpalljes së aktgjykimit të shkallës së parë ndaj Hashim Thaçit, Kadri Veselit, Rexhep Selimit dhe Jakup Krasniqit, Trupi Gjykues deklaroi se Thaçi kishte marrë pjesë personalisht në krimet e kryera ndaj Allaqit.</p>
<p>Në përmbledhjen e aktgjykimit thuhet se Hashim Thaçi ishte i përfshirë drejtpërdrejt në arrestimin, ndalimin, transferimin dhe vrasjen e Behajdin Allaqit. Në të njëjtin dokument përmendet edhe pjesëmarrja e tij në arrestimin, ndalimin dhe marrjen në pyetje të 13 parlamentarëve.</p>
<p>Ky vlerësim i Gjykatës lidhet me përgjegjësinë individuale të Thaçit në rastin Allaqi dhe nuk paraqet vetëm një përgjegjësi të përgjithshme për veprimet e personave të tjerë.</p>
<p>Vendimi, i shpallur më 16 shtator 2026, është i shkallës së parë dhe mund të kundërshtohet nga mbrojtja përmes apelit. Thaçi është dënuar me 25 vjet burgim, ndërsa aktgjykimi nuk konsiderohet ende i formës së prerë.</p>
<p>Behajdin Allaqi lindi më 7 prill 1963 në Prizren. Ai ishte veprimtar politik, intelektual dhe pjesëtar i lëvizjes kombëtare shqiptare, ndërsa angazhimin në organizimet politike shqiptare e kishte nisur që në vitet ’80.</p>
<p>Gjatë vitit 1981, Allaqi mori pjesë në demonstrata, ndërsa më pas vazhdoi veprimtarinë ilegale për avancimin e statusit politik të Kosovës. Në vitet ’90 ai ishte aktiv në strukturat e lëvizjes kombëtare dhe më vonë iu bashkua Ushtrisë Çlirimtare të Kosovës.</p>
<p>Allaqi u zhduk më 11 qershor 1998. Trupi i tij nuk është gjetur dhe, deri në aktgjykimin e së mërkurës, institucionet vendore nuk kishin dhënë një shpjegim përfundimtar për fatin e tij.</p>
<p>Gjatë gjithë kësaj kohe, familjarët, bashkëveprimtarët dhe figura publike kërkuan zbardhjen e rrethanave që lidhen me arrestimin, zhdukjen dhe vrasjen e tij.</p>
<p>Sipas përmbledhjes së aktgjykimit, Thaçi kishte qenë anëtar i Shtabit të Përgjithshëm dhe drejtues i Drejtorisë Politike të UÇK-së. Në këtë cilësi, sipas Gjykatës, ai kishte pasur rol kyç në hartimin dhe zbatimin e një qëllimi të përbashkët.</p>
<p>Ky qëllim përfshinte identifikimin e personave që perceptoheshin si kundërshtarë të UÇK-së, arrestimin dhe ndalimin e tyre, si dhe krijimin dhe funksionimin e objekteve të ndalimit.</p>
<p>Gjykata përfshiu në këtë kuadër edhe keqtrajtimin dhe, në raste të caktuara, vrasjen e të ndaluarve, si dhe përdorimin e deklaratave e komunikatave publike kundër personave të cilësuar si “bashkëpunëtorë” ose kundërshtarë.</p>
<p>Trupi Gjykues arriti në përfundimin se Thaçi kishte kontribuar në këtë qëllim të përbashkët dhe se kishte marrë pjesë vetë në disa prej krimeve. Në mesin e rasteve të përmendura ishte edhe ai i Behajdin Allaqit.</p>
<p>Për rastin Allaqi, Gjykata renditi katër etapa të pjesëmarrjes së Thaçit: arrestimin, ndalimin, transferimin dhe vrasjen e paligjshme.</p>
<p>Edhe Kadri Veseli, Rexhep Selimi dhe Jakup Krasniqi u shpallën përgjegjës nga Trupi Gjykues për kontributin e tyre në qëllimin e përbashkët kriminal ndaj personave të perceptuar si kundërshtarë të UÇK-së.</p>
<p>Megjithatë, përmbledhja publike e aktgjykimit nuk thotë se Veseli, Selimi dhe Krasniqi morën pjesë personalisht në arrestimin apo vrasjen e Behajdin Allaqit.</p>
<p>Për rrjedhojë, aktgjykimi nuk duhet interpretuar si konstatim se të katër të akuzuarit u identifikuan si ekzekutorë ose bashkautorë të drejtpërdrejtë të vrasjes. Në rastin Allaqi, konstatimi individual i bërë publik lidhet shprehimisht me Hashim Thaçin.</p>
<p>Emri i Behajdin Allaqit ishte përmendur ndër vite në deklarata publike, dëshmi dhe përplasje politike. Në të kaluarën ishin ngritur edhe pretendime për marrëdhënie të tensionuara mes tij dhe disa prej drejtuesve politikë të atëhershëm të UÇK-së.</p>
<p>Megjithatë, këto pretendime nuk kishin përbërë një vendim gjyqësor dhe çështja kishte mbetur e pazbardhur.</p>
<p>Aktgjykimi i 16 shtatorit 2026 shënon herën e parë kur një trup gjykues ka konstatuar përgjegjësi individuale të Thaçit për arrestimin, ndalimin, transferimin dhe vrasjen e paligjshme të Behajdin Allaqit.</p>
