The Basic Court in Pristina has ordered one month of detention for each of the suspects, M.J. and M.B., who are suspected of war crimes against the civilian population.

The decision was issued by the pretrial judge following a hearing, approving the detention request submitted by the Special Prosecution Office of the Republic of Kosovo.

According to the court’s assessment, detention is the appropriate measure in this criminal case because there is a real risk that the defendants, if released, could flee to avoid criminal liability. Since they are also Serbian citizens, the court found that they could easily leave and become unreachable by the judicial authorities, which would make it impossible to secure their presence and would hinder the normal conduct of the criminal proceedings.

The court also found that releasing them could create opportunities to influence evidence and witnesses. For this reason, it determined that, for now, detention is the only measure that guarantees the unhindered conduct of proceedings in this criminal case.

The notice states that dissatisfied parties may appeal the ruling to the Court of Appeals through the Basic Court in Pristina.

Halit Gashi, a survivor and witness, has raised concerns about the closing statement delivered by Milorad Gjoković’s defense lawyer after the Basic Court in Pristina decided to reopen the retrial of the defendant on war crimes charges.

Gashi claims that the verdict is being delayed because of a witness who, according to him, gave accurate testimony and was an eyewitness to the killing and massacre of the Krasniqi family.

He said the court proceedings have lasted 1,489 days and that the court is once again postponing the case to question another witness, even though, according to him, she was very precise and directly witnessed the killing and massacre of the Krasniqi family.

Gashi described the move as unnecessary, stressing that Nurije Krasniqi has been questioned three times about the massacre of the Krasniqi, Morina and Shala families. According to him, during her first testimony, the defendant’s lawyers had not been prepared to question and cross-examine her, while during her second and third appearances, they had tried to identify minor details.

He also raised specific objections to the closing statement delivered on the 21st, last Tuesday. According to Gashi, every point, comma, word and sentence, whether narrow or broad in scope, presented by the defendant’s lawyer was untrue.

Gashi also said he had never received any transcripts from the court hearings held under Judge Valon Kurti. He said he began receiving these documents only after Donika Shala-Avdyli took over as presiding judge of the trial panel.

According to him, he has not been provided with any transcripts from the hearings held from the 8th of 2022 to the present day. For this reason, Gashi said he strongly suspects that the documents may contain something entirely different from the questions asked during the hearings.

He explained that after Valon Kurti stepped down as presiding judge of the trial panel and Donika Shala-Avdyli took over the role, transcripts began to be provided for every hearing held.

Gashi said he was ready to face justice and the truth at any time and at any moment. As for Gjoković, he expects the court to impose the punishment he deserves, namely the maximum sentence, and expressed disappointment that the ruling expected that day was not issued.

The Basic Court in Pristina decided to reopen the trial of Milorad Gjoković, who is accused of war crimes. The decision was prompted by the failure to locate a statement that witness Nurije Krasniqi had given to the Institute for War Crimes in Kosovo.

In the indictment, the prosecution alleges that during 1998-1999, in the village of Ozdrim in Peja and other villages in the region, Gjoković acted as a member of Serbian police and military forces. He is suspected of implementing measures that included the killing, raiding, beating, mistreatment, arrest, torture, cruel and inhumane treatment, enslavement, expulsion and deportation of dozens of Albanian civilians.

The indictment, drawn up on June 23, 2023, states that regular military forces entered from the northern part of Ozdrim via the Peja–Mitrovica regional road. Meanwhile, paramilitary groups mixed with members of special military units advanced from the western side of the village, toward Vitomirica.

According to the same document, these forces opened fire on the civilian population, killing six Albanian civilians: I.K., Sh.K., E.M., R.Sh., Z.Sh. and M.H.

The indictment states that three other civilians, A.G., H.G. and M.G., were wounded by gunfire and initially taken to Peja Hospital. They were then allegedly executed and buried in the village of Lutogllavë.

Five other Albanian civilians, R.K., Z.K., A.K., A.K. and A.Sh., were also allegedly killed during the offensive. Their bodies have not been found, and all five remain listed as missing persons.

Defendant D.B. was sentenced to 13 years in prison after the Basic Court in Mitrovica, specifically the Department for Serious Crimes, found him guilty of attempted aggravated murder and unauthorized possession of weapons.

The verdict was made public on July 23, 2026, by the presiding judge of the trial panel, Xhemajl Jusufi.

The Basic Prosecution in Mitrovica had accused D.B. of attempting to eliminate his son in the village of Stanoc, in the Municipality of Vushtrri.

Police data shows that the incident occurred on July 28, 2025. The suspect remained at large for several months until he was arrested on November 14 of the same year, following a law enforcement operation.

In a public statement, the prosecution had announced that “following operational work, a person with the initials D.B., who had been wanted for months on suspicion of committing the criminal offenses of ‘Attempted aggravated murder’ and ‘Unauthorized ownership, control, or possession of weapons’, was arrested.”

According to a written response the court sent to kp, the decision was issued on July 10, 2026. The Basic Prosecution Office in Mitrovica had not submitted a request to extend the measure or replace it with another measure.

“The Basic Court in Mitrovica, acting ex officio and pursuant to Article 181, paragraphs 1 and 7, in conjunction with Article 188, paragraph 1, of Criminal Procedure Code No. 08/L-032, issued a ruling on July 10, 2026, terminating the house arrest measure for defendants V.R. and E.S.,” the Court said in its response.

The Court stressed that reasonable suspicion remains against the two suspects that they committed the criminal offence of “Accepting Bribes” under the Criminal Code of the Republic of Kosovo.

Meanwhile, the Basic Prosecution Office in Mitrovica said it had not sought an extension of house arrest because the legal conditions for submitting such a request no longer existed.

According to the Prosecution, all necessary witnesses and defendants have been interviewed at this stage of the proceedings, including the individuals against whom proceedings were conducted in connection with the criminal offence of giving bribes.

However, an indictment has not yet been filed, as several other necessary procedural actions are still expected to be carried out.

The Prosecution said that V.R. is being investigated over six suspected cases of accepting bribes, while E.S. is being investigated over three such cases.

In its explanation, the Prosecution also said that E.S. had previously been under house arrest from January 10 to February 9, 2023, in connection with another criminal case. In that case, on July 30, 2024, the Prosecution filed an indictment against him for the criminal offence of “Accepting Bribes”, which is pending before the Basic Court in Mitrovica.

The two doctors from Vushtrri General Hospital were arrested by Kosovo Police on May 13, 2026, on suspicion of the criminal offence of “Accepting Bribes”. The case continues to be investigated by the Basic Prosecution Office in Mitrovica.

According to the suspicions, they are accused of the criminal offenses of money laundering, smuggling of goods in co-perpetration, participation in or organization of an organized criminal group, unauthorized ownership, control or possession of weapons, as well as counterfeiting money.

The court’s announcement states that the Special Department of the Basic Court in Pristina reviewed the request of the Special Prosecution of the Republic of Kosovo to impose detention on the defendants in this criminal case.

Pristina, 03 July 2026 – after the hearing was held, the pre-trial procedure judge, through a ruling, approved the request of the Special Prosecution of the Republic of Kosovo, deciding that each of the defendants be placed in detention for a period of 1 (one) month.

The court assessed that this measure is appropriate in the circumstances of this case, as there is a real risk that, if the accused remain at liberty, they may flee in order to avoid criminal responsibility and obstruct the normal course of the criminal proceedings.

Also, according to the court’s assessment, leaving them at liberty could create the opportunity for them to continue communicating and cooperating with one another in order to continue committing criminal offenses or new criminal offenses.
