AVONET, together with 13 other civil society organizations, has submitted a request to the Constitutional Court of Kosovo for a review of the manner in which Judgment KO124/25 is being implemented, concerning the deadline for the constitution of the Assembly.

According to AVONET’s statement to the media, the initiative was undertaken following recent developments in the procedure for constituting the Assembly elected in the June 7, 2026 elections.

The organizations assess that the 30-day deadline for constituting the Assembly expired on August 7. Meanwhile, the constitutive session held on August 6 did not conclude with the election of the Speaker and Deputy Speakers of the Assembly.

Referring to Judgment KO124/25, they emphasize that holding a session that does not conclude with the election of the Speaker and Deputy Speakers cannot be considered the constitution of the Assembly.

AVONET said that the continuation of the session had been scheduled for August 8, after the 30-day deadline had expired.

Through their request, the organizations have asked the Constitutional Court to determine whether Judgment KO124/25 was implemented in accordance with its content and within the stipulated deadline.

The request is based on Rule 60 of the Rules of Procedure of the Constitutional Court, which sets out the procedure for claims concerning the non-implementation of a decision of the Court.

If the Court determines that the decision was not implemented, AVONET and the signatory organizations are requesting that the measures provided for by the rules be taken, including the issuance of a ruling on non-implementation or non-enforcement, as well as any other actions the Court may deem necessary.

AVONET considers this issue particularly important for the functioning of elected institutions and for ensuring respect for the constitutional order.

The organizations clarify that the purpose of the request is to create legal and institutional clarity regarding the process of constituting the Assembly and the implementation of decisions by the Constitutional Court.

AVONET, së bashku me 13 organizata të tjera të shoqërisë civile, i kanë parashtruar Gjykatës Kushtetuese të Kosovës një kërkesë për shqyrtimin e mënyrës së zbatimit të Aktgjykimit KO124/25, që lidhet me afatin për konstituimin e Kuvendit.

Sipas deklaratës së AVONET-it për media, nisma është ndërmarrë pas zhvillimeve të fundit në procedurën e konstituimit të Kuvendit të dalë nga zgjedhjet e 7 qershorit 2026.

Organizatat vlerësojnë se afati 30-ditor për konstituimin e Kuvendit ka skaduar më 7 gusht. Ndërkohë, seanca konstituive e mbajtur më 6 gusht nuk përfundoi me zgjedhjen e Kryetarit dhe Nënkryetarëve të Kuvendit.

Duke iu referuar Aktgjykimit KO124/25, ato theksojnë se zhvillimi i një seance, e cila nuk mbyllet me zgjedhjen e Kryetarit dhe Nënkryetarëve, nuk mund të konsiderohet si konstituim i Kuvendit.

AVONET bën të ditur se vazhdimi i seancës ishte planifikuar për 8 gusht, pra pasi kishte përfunduar afati 30-ditor.

Përmes kërkesës së tyre, organizatat i kanë kërkuar Gjykatës Kushtetuese të përcaktojë nëse Aktgjykimi KO124/25 është zbatuar sipas përmbajtjes së tij dhe brenda afatit të përcaktuar.

Kërkesa mbështetet në Rregullin 60 të Rregullores së Punës së Gjykatës Kushtetuese, ku përcaktohet procedura për pretendimet lidhur me moszbatimin e një vendimi të Gjykatës.

Nëse Gjykata konstaton se vendimi nuk është zbatuar, AVONET dhe organizatat nënshkruese kërkojnë marrjen e masave të parashikuara nga rregullorja, përfshirë nxjerrjen e aktvendimit për moszbatim apo mospërmbarim, si dhe veprime të tjera që Gjykata mund t’i vlerësojë të nevojshme.

AVONET e konsideron këtë çështje veçanërisht të rëndësishme për funksionimin e institucioneve të zgjedhura dhe garantimin e respektimit të rendit kushtetues.

Organizatat sqarojnë se synimi i kërkesës është krijimi i qartësisë juridike dhe institucionale për procesin e konstituimit të Kuvendit dhe zbatimin e vendimeve të Gjykatës Kushtetuese.
