Avdullah Hoti, an MP from the Democratic League of Kosovo, has announced that he has signed on to the Kosovo Law Institute’s (KLI) legislative initiative to amend and supplement the Criminal Code.

According to Hoti, the initiative seeks to ensure that failure to comply with Constitutional Court decisions carries criminal liability.

“As an MP in the Assembly of Kosovo and a member of the Democratic League of Kosovo, I have signed the legislative initiative to amend and supplement the Criminal Code, launched by the Kosovo Law Institute (KLI), with the aim of ensuring that failure to implement Constitutional Court decisions does not go without criminal liability,” Hoti stated.

He said that the functioning of the rule of law cannot depend on whether institutions are willing to implement Constitutional Court decisions.

“There can be no rule of law under the following standard: the Court rules, and the Government chooses whether or not to implement the decision,” Hoti said.

The initiative also provides for criminalizing the misuse of public funds for electoral gain, to prevent the state budget from being used to influence citizens’ votes.

The LDK MP described the move as a clear warning to any government seeking to circumvent the Constitution.

“This initiative sends a clear message to any government that thinks it can bypass the Constitution. Constitutional Court decisions are not political recommendations. They are a constitutional obligation,” Hoti said.

Avdullah Hoti, deputet i Lidhjes Demokratike të Kosovës, ka njoftuar se i është bashkuar me nënshkrim nismës legjislative të Institutit të Kosovës për Drejtësi (IKD) për ndryshimin dhe plotësimin e Kodit Penal.

Sipas Hotit, përmes kësaj nisme kërkohet që mosrespektimi i vendimeve të Gjykatës Kushtetuese të shoqërohet me përgjegjësi penale.

“Si deputet i Kuvendit të Kosovës dhe Lidhjes Demokratike të Kosovës, kam nënshkruar nismën legjislative për ndryshimin dhe plotësimin e Kodit Penal të iniciuar nga Instituti i Kosovës për Drejtësi (IKD), me qëllim që moszbatimi i vendimeve të Gjykatës Kushtetuese të mos mbetet pa përgjegjësi penale”, ka deklaruar Hoti.

Ai ka vlerësuar se funksionimi i shtetit ligjor nuk mund të varet nga vullneti i institucioneve për të zbatuar ose jo vendimet e Gjykatës Kushtetuese.

“Nuk mund të ketë shtet ligjor me standardin: Gjykata vendos, Qeveria zgjedh nëse zbaton apo jo”, është shprehur Hoti.

Nisma parashikon po ashtu kriminalizimin e keqpërdorimit të parave publike për përfitime zgjedhore, në mënyrë që buxheti shtetëror të mos shfrytëzohet për ndikim në votën e qytetarëve.

Deputeti i LDK-së e ka përshkruar këtë hap si një paralajmërim të qartë për çdo pushtet që synon të shmangë Kushtetutën.

“Kjo nismë është një mesazh i qartë për çdo pushtet që mendon se mund ta anashkalojë Kushtetutën. Vendimet e Gjykatës Kushtetuese nuk janë rekomandime politike. Janë detyrim kushtetues”, ka thënë Hoti.

According to Hoti, this process can move forward only if the parties show a willingness to compromise.

Commenting on the political positions expressed by LVV officials yesterday and today, Hoti said that the LDK is ready to help form the institutions.

However, he emphasized that this requires a willingness to reach agreements and make compromises.

Hoti added that exerting pressure through threats of snap elections does not lead to a solution but, on the contrary, makes the situation more difficult.

The Democratic League of Kosovo (LDK) MP Avdullah Hoti has given his comments on the eve of the party’s extraordinary Assembly, which is expected to convene on Thursday at the initiative of delegates. He emphasized that this statutory instrument serves to enable democratic oversight by the membership over the party leadership.

Hoti points out that deep dissatisfaction with LDK’s recent electoral performance has led to the convening of this Assembly, citing as main reasons the failure in three parliamentary election cycles and the loss of two municipalities during local elections.

According to him, it is unacceptable to ignore these negative results and continue as if nothing has happened, a stance that, according to Hoti, is being taken by the current leadership by not supporting the convening of the Assembly. “An LDK that accepts such defeats without reaction cannot be in the service of the country,” he stated.

In his full statement, Hoti clarifies that the drafters of LDK’s ideological platform, drawing on models from sister parties within the European Union, conceived the extraordinary Assembly as a vital tool for democratic oversight by delegates.

He insisted that the calling of the Assembly came as a result of the leadership’s refusal to follow the example of 2021, when former chairman Mustafa took responsibility for the result and paved the way for the election of chairman Abdixhiku. This Assembly, according to Hoti, is not convened against any individual, but to strengthen the party in light of the political challenges awaiting Kosovo.

Furthermore, Hoti articulated a series of sharp criticisms of the six-year governance of the Vetëvendosje Movement, describing it as harmful to the country. He accused the majority of damaging strategic alliances, failing to fulfill the Washington Agreement, abandoning dialogue for mutual recognition, and ending up in Ohrid with obligations from an unsigned annex agreement. He also mentioned affairs in the energy sector, dubious tenders, nepotism, pressure on the judiciary, blocking the appointment of the Chief Prosecutor, illegal dismissals, and the instrumentalization of independent institutions such as RTK and KIA, emphasizing that these actions have undermined the rule of law and the separation of powers.

He added that economic failures, the lack of capital investments, rising inflation, and the deterioration of healthcare services have severely hit citizens’ welfare. To face all these problems, Hoti stresses that LDK must be stronger than ever.

At the end of his statement, the MP clarified that this Assembly does not intend to impose a predetermined leadership. He guaranteed that the next party leadership will emerge from a full internal electoral process, which will be fully transparent, inclusive, and rigorously overseen by the competent bodies of the LDK, from basic units to the central structure, in full compliance with the party’s Statute and regulations.

Deputeti i Lidhjes Demokratike të Kosovës, Avdullah Hoti, ka dhënë komentet e tij në prag të Kuvendit të jashtëzakonshëm të partisë, që pritet të mblidhet të enjten me nismën e delegatëve. Ai ka nënvizuar se ky instrument statutar shërben për të mundësuar mbikëqyrjen demokratike të anëtarësisë mbi udhëheqjen e partisë.

Hoti thekson se pakënaqësitë e thella me performancën e fundit zgjedhore të LDK-së kanë çuar në thirrjen e këtij Kuvendi, duke renditur si shkaqe kryesore dështimin në tre cikle zgjedhjesh parlamentare dhe humbjen e dy bashkive gjatë zgjedhjeve vendore.

Sipas tij, është e papranueshme të injorohen këto rezultate negative dhe të vijohet sikur asgjë nuk ka ndodhur, qëndrim ky që, sipas Hotit, po mbahet nga lidershipi aktual duke mos e përkrahur mbledhjen e Kuvendit. “Një LDK që pranon disfata të tilla pa reagim, nuk mund të jetë në shërbim të vendit,” ka deklaruar ai.

Në reagimin e tij të plotë, Hoti sqaron se hartuesit e platformës ideologjike të LDK-së, duke u mbështetur në modelet e partive simotra brenda Bashkimit Evropian, e kanë konceptuar Kuvendin e jashtëzakonshëm si një mjet thelbësor për kontrollin demokratik nga ana e delegatëve.

Ai këmbënguli se thirrja e Kuvendit erdhi si pasojë e refuzimit të lidershipit për të ndjekur shembullin e vitit 2021, kur ish-kryetari Mustafa mori përgjegjësinë për rezultatin dhe i hapi udhën zgjedhjes së kryetarit Abdixhiku. Ky Kuvend, sipas Hotit, nuk mblidhet kundër ndonjë individi, por për të forcuar partinë në funksion të sfidave politike që pret Kosova.

Më tej, Hoti ka artikuluar një sërë kritikash të ashpra ndaj qeverisjes gjashtëvjeçare të Lëvizjes Vetëvendosje, duke e cilësuar si të dëmshme për vendin. Ai ka akuzuar mazhorancën për dëmtim të aleancave strategjike, mospërmbushje të Marrëveshjes së Uashingtonit, braktisje të dialogut për njohje reciproke dhe përfundimin në Ohër me detyrime nga një aneks-marrëveshje e pashkruar. Gjithashtu, ka përmendur aferat në sektorin e energjisë, tenderat e dyshimtë, nepotizmin, presionin mbi gjyqësorin, bllokimin e emërimit të Kryeprokurorit, shkarkimet e paligjshme dhe instrumentalizimin e institucioneve të pavarura si RTK-ja dhe AKI-ja, duke theksuar se këto veprime kanë minuar sundimin e ligjit dhe ndarjen e pushteteve.

Ai shtoi se dështimet ekonomike, mungesa e investimeve kapitale, rritja e inflacionit dhe përkeqësimi i shërbimeve shëndetësore kanë goditur rëndë mirëqenien qytetare. Për t’u përballur me gjithë këto probleme, Hoti thekson se LDK-ja duhet të jetë më e fortë se kurrë.

Në fund të reagimit të tij, deputeti sqaroi se ky Kuvend nuk ka për qëllim të imponojë një lidership të paracaktuar. Ai garantoi se udhëheqja e ardhshme e partisë do të dalë nga një proces i plotë zgjedhor i brendshëm, i cili do të jetë tërësisht transparent, gjithëpërfshirës dhe i mbikëqyrur me rigorozitet nga organet kompetente të LDK-së, duke filluar nga njësitë bazë e deri te struktura qendrore, në përputhje të plotë me Statutin dhe rregulloret e partisë.

In a brief reaction on social media, Hoti emphasized that the core of LDK’s strength lies in its membership base, not in individual figures. “No one is above the LDK and its membership,” he wrote, adding that the party is led by collective will and not by personal ambitions.

In a post on the social network Facebook, Hoti noted the ongoing suspension of the Kosovo-US strategic dialogue, despite, according to him, Kosovars being the most pro-American people in the region and beyond.

He added that on the other hand, Serbia is expected to start on Friday the first cycle of its strategic dialogue with Washington.

“The most pro-American people in the region and beyond, the people of Kosovo, has its strategic dialogue with the US blocked. At the same time, our northern neighbor is opening this Friday the first chapter of this dialogue,” Hoti said.

The former minister also criticized Kosovo’s refusal to join the regional gas network, an initiative aimed at distributing American gas and reducing the Balkans’ dependence on Russian energy sources.

In his assessment, while Kosovo has turned its back on this initiative, Serbia has already signed major energy contracts, including the purchase of American liquefied natural gas.

The LDK MP warned that the perpetuation of this stance risks isolating Kosovo economically and politically, losing valuable opportunities to strengthen the strategic alliance with the US and to ensure energy independence.

Ish-ministri kritikoi gjithashtu refuzimin e Kosovës për t’iu bashkuar rrjetit rajonal të gazit, një iniciativë që synon të shpërndajë gazin amerikan dhe të reduktojë varësinë e Ballkanit nga burimet energjetike ruse.

Sipas vlerësimit të tij, ndërsa Kosova i ka kthyer shpinën kësaj nisme, Serbia tashmë ka nënshkruar kontrata madhore energjetike, duke përfshirë edhe blerjen e gazit të lëngshëm amerikan.

Deputeti i LDK-së paralajmëroi se përjetësimi i këtij qëndrimi rrezikon ta izolojë Kosovën në planin ekonomik dhe politik, duke humbur shanse të vyera për të forcuar aleancën strategjike me SHBA-në dhe për të garantuar pavarësinë energjetike.
